ANNEXURE - I

STATEMENT OF ARTICLE OF CHARGES FRAMED AGAINST SMT. Y.S.BHARATHI,

TAHSILDAR, ANANTHAPURAMU DISTRICT

***

CHARGE-I: That Smt. Y.S.Bharathi, while working as Tahsildar, HMDA,

Hyderabad was repatriated to Revenue Department and allotted and posted as

Tahsildar, Ananthapuramu District vide CCLA Prcdgs.No. XX1/375/2011, Dt.8.5.2014.

But she has neither reported to duty before the Collector, Ananthapuramu nor applied

for any kind of leave and thereby unathorizedly absented to duty form 12.5.2014 to

19.3.2017. Thus being responsible Government servant, she has shown gross

negligence toward her legitimate duties and thereby violated Rule 3 of Andhra Pradesh

Civil Services (Conduct) Rules, 1964.

Basis of the Charge :

Smt. Y.S.Bharathi, formerly Tahsildar, working on deputation in HMDA,

Hyderabad (during combined State of Andhra Pradesh) went on E.O.L in different

spells from 24.4.2011 onwards. She reported to duty before the CCLA & Spl.CS, A.P,

Hyderabad on Dt.21.4.2014. The CCLA vide Prcdgs XX1/375/2011, Dt.8.5.2014

allotted her to Ananthapuramu District in the existing vacancy of Tahsildar

pending finalization of E.O.L availed by her in different spells from 24.4.2011 onwards.

She was directed to report to duty before the Collector, Ananthapuramu

District immediately. The individual has received the above orders on 14.5.2014.

But she has not reported to duty in Ananthapuramu District as per the orders of the

CCLA Dt.8.5.2014. She has not applied for any leave either before the

Collector, Ananthapuramu or before the CCLA.

2

ANDHRA PRADESH GAZETTE, March 14, 2018

Subsequently, she has submitted joining report on 20.3.2017 before the

CCLA & Spl.CS, A.P, Vijayawada, stating that she was posted as Tahsildar,

Ananthapuramu District in CCLA Prcdgs.Dt.8.5.2014 and could not join in

Ananthapuramu District as she had to attend to her mother-in-law, who is paralytic &

cancer patient and needed Chemotherapy at Hyderabad. Therefore, inevitably

she has applied for permission and went on E.O.L from 15.4.2014. She has further

stated that, since her mother-in-law has recovered after treatment she wish to

join duty. She has requested to issue posting orders preferably in Kurnool or

Chittoor District.

Vide CCLAs Ref.No. Ser II (1)/XX1/375/2011-2, Dt.3.4.2017 the individual

was informed that, no leave application was received either in CCLA Office

or in Collectorate, Ananthapuramu for grant of E.O.L as stated by her and

therefore directed to produce proof /evidence for applying E.O.L said to be filed

by her on 15.5.2014 otherwise action will be initiated as per CCA Rules, 1991.

The individual in her reply Dt.10.4.2017 stated that, due to inevitable

circumstances she was forced to go on leave from 12.5.2014. She has further

stated that the proof/evidence of Leave application filed by her on 15.5.2014 could

not be traced out as the same was misplaced in the course of shifting of her house

from Panjaguta to Banjara Hills Road No.3. She has requested to treated the

period of absence from 12.5.2014 to 19.3.2017 as E.O.L.

Further the Collector, Ananthapuramu in Rc.No.A1/2201/2017, Dt.20.4.2017 as

reported that Smt.Y.S.Bharathi, Tahsildar, who is allotted and posted as Tahsildar,

Ananthapuramu has neither approached the District Collector/Joint Collector/D.R.O/

Administrative Officer, Collectorate, Ananthapuramu nor submitted any joining report as

Tahsildar, Ananthapuramu. Further submitted that, no leave application has been received

from the Individual for grant of E.O.L and no action was initiated against her, since she

has not joined duty at Ananthapuramu.

Thus it is evident that Smt.Y.S.Bharathi, Tahsildar is habituated in absenting to

duty. On repatriation from HMDA, Hyderabad, she has not joined duty as Tahsildar in

Ananthapuramu District as per the orders issued by the CCLA & Spl.CS, Dt.8.5.2014.

She has not submitted any leave application either before the Collector, Ananthapuramu

or before the CCLA, A.P. and failed to produce any proof of applying leave. Therefore,

she has shown gross negligence towards her legitimate duties and thereby violated

Rule 3 of APCS (Conduct) Rules, 1964.

Hence the above charge.
