PART II - MISCELLANEOUS NOTIFICATIOSN OF INTEREST TO THE PUBLIC
--x--
NOTIFICATIONS BY HEADS OF DEPARTMENTS Etc.,
Rc.No.28/A3/Comdt.Hqrs/APSPF/TPT/2017-18, O.O.No.481/2018,- In the
references first to third cited, the Asst. Commandant, APSPF, UCIL, Thummalapalle
submitted absence reports against Sri M. Anand Suresh, HC-1187 of APSPF,
UCIL Thummalapalle, Sub-Unit: Airport Kadapa stating that, the said Head Constable
was passported to avail (30) days Medical leave w.e.f. 03.03.2017 FN to
01.04.2017 AN. Instead of reporting back for duties from said leave, he became
absent to his duties w.e.f. 01.04.2017 AN unauthorizedly without obtaining any
leave or intimation to his superiors.
Vide reference fourth cited, an Article of Charge was framed against
Sri M. Anand Suresh, HC-1187 for absenting the duties un-authorizedly w.e.f.
01.04.2017 AN and explanation called for.
Vide reference fifth cited, the Charged Officer Sri M. Anand Suresh,
HC-1187 acknowledged the Memorandum of Charge which was sent to his native
address by Registered Post. However, the Charged Officer has failed to submit
written explanation to the Memorandum of Charge within stipulated period. Therefore,
the disciplinary authority decided to conduct Oral Enquiry in accordance with
the rules.
Vide reference sixth cited, an Oral Enquiry was ordered duly appointing
Sri D. Hussenaiah, Inspector, APSPF, RTPP Kalamalla as Inquiring Authority to
inquire into the charge framed against the Charged Officer Sri M. Anand Suresh,
HC-1187.
Vide reference seventh cited, the Inquiring Authority has conducted an
Ex-parte enquiry under Rule 20 (6) of APCS (CC&A) Rules, 1991 as the Charged
Officer’s whereabouts were not known and submitted the enquiry report duly
“Proving” the Article of Charge framed against the Charged Officer Sri M. Anand
Suresh, HC-1187.
Vide reference eighth cited, a Show Cause Notice was issued to the Charged
Officer inviting further explanation if any, on the enquiry report. Accordingly,
a copy of the Show Cause Notice along with enquiry report was sent to the native
address of the Charged Officer by Registered post which was returned vide

Stores Purchase, Vijayawada was requested to publish the Show Cause Notice in
the A.P. Gazette. Accordingly, the Show Cause Notice was published in the
A.P. Gazette vide reference eleventh cited.
Having gone through the entire PR file, I agree with the findings and opinion
of the Enquiry Officer, who proved the Article of Charge. I am of the considered
opinion that the Charged Officer is a willful absentee for a prolonged period of
exceeding one year. Further non acceptance of Show Cause Notice amounts
to willful rejection. Therefore, the Show Cause Notice has been published in
the A.P. Gazette.

Absenting for the duties by the charged officer without any intimation for
prolonged period will have adverse impact on operational duties and the
personnel are required to be put on extra duties in place of habitual absentees
and thus it amounts to gross misconduct.
The Government vide G.O. Ms. No 260, Genl. Admn. (Ser. C) Dept., dated:
04.09.2003 directed that “in all cases of unauthorised absence to duty for a
continuous period exceeding ‘one year’, the penalty of removal from service
shall be imposed on the Government employee, after duly following the procedure
laid in the Andhra Pradesh Civil Services (CC&A) Rules, 1991".
Therefore, I am constrained to award the Charged Officer with a penalty of
“Removal from Service” with immediate effect under Rule-9(ix) of APCS
(CC&A) Rules, 1991.
The entire unauthorized absence period of (391) days w.e.f.
01.04.2017 AN to 27.04.2018 (date of issue of this order) is treated as
“Not on duty’.
Acknowledge the receipt of the proceedings.

A.P. Special Protection Force,
Tirupati.
To
Sri M. Anand Suresh,
HC-1187 of APSPF,
