Rc.No.16121/2004 SR-II,- In the reference 2nd read above, the following

charges have been framed under Rule 20 of the A.P.C.S. (CC&A) Rules, 1991

against Sri. M.Srinivasa Sastry, Assistant Registrar for his unauthorized

absence and for taking advances from Societies while working as Auditor, Kalakurru,

West Godavari District.

ARTICLE OF CHARGE -I :-

“That the said Sri M.Srinivasa Sastry, Coop.Sub-Registrar (now

re­designated as Assistant Registrar), West Godavari District while he

worked as Auditor under F.R.127 terms to a group of societies had drawn good

working remuneration bonus and encashment of earned leave from the societies

irregularly to an extent of Rs.36,424/- , Rs.44,030/- and Rs.6,500/- respectively*.

ARTICLE OF CHARGE-II :-

“That the said Sri M.Srinivasa Sastry, Coop.Sub-Registrar (now re-designated

as Assistant Registrar), is unauthorizedly absent from his official duties with effect

from 01.11.2001

EXPLANATION OF THE CHARGED OFFICER: -

The District Coop. Officer, West Godavari District, Eluru vide reference

third read above had submitted that Charge Memo could not be served on

the Sri M.Srinivasa Sastry, Assistant Registrar as the individual is not residing at

the given leave address and hence the Charge memo had been served on his

father Sri M.Satyanarayana on 17.07.2005. That his father had also given a letter

stating that the address particulars of his son are not known to him.

In the reference 4th read above the Commissioner of Printing & Stationary,

Hyderabad had been addressed to publish the Charge Memo 2nd read above

in the A.P.Gazette and accordingly the same had been published A.P. Gazette

No. 17, Dated: 27.04.2006 at page nos. 385 to 387.

FINDINGS OF THE INQUIRY AUTHORITY:-

In the reference 7th read above, the Divisional Cooperative Officer, Eluru had

been appointed as Inquiry Authority to inquire into the charge framed

Sri M.Srinivasa Sastry, Assistant Registrar / Charged Officer vide reference 2nd read

above and the District Cooperative Audit Officer, Eluru had been appointed as

Presenting Officer to present the case before the Inquiry Authority.

In the reference 8th read above, the Divisional Cooperative Officer, Eluru /

Inquiry Authority had submitted his Inquiry report wherein for the reasons submitted

therein he has held that the two charges framed against Sri M.Srinivasa Sastry,

Assistant Registrar / Charged Officer are “PROVED”.

In the reference 9th read above, the Inquiry report had been forwarded to the

District Cooperative Officer, West Godavari District, Eluru with a direction to

communicate the same to the Charged Officer and furnish his dated

acknowledgement.

The District Coop. Officer, West Godavari District, Eluru vide reference

10th read above had informed that the Inquiry report sent to the Charged Officer

through the Registered post to his last known address was returned by the

Postal Department with remarks that, “ ADDRESSEE LEFT AND WHEREABOUTS

NOT KNOWN”.

CONCLUSION OF THE DISCIPLINARY AUTHORITY:

The Disciplinary Authority i.e., Additional Registrar (Services), O/o the

Commissioner for Cooperation & Registrar of Cooperative Societies, Andhra

Pradesh, Hyderabad has reviewed the disciplinary case pending against

Sri M.Srinivasa Sastry, Assistant Registrar / Charged Officer with reference to

the charge framed and the findings of the Inquiry Authority and observed that,

as per G.O. 12th read above, Government have clear cut instructions that in all

cases of unauthorized absence to duty for a continuous period exceeding

“one year”, the penalty of removal from service shall be imposed on the

Government employee after duly following the procedure laid down in the A.P.C.S.

(CCA) Rules, 1991. The Charged Officer is absconding from the official duties

with effect from 01.11.2001 which is also proved in the Departmental Inquiry.

In the circumstances, the Disciplinary Authority i.e., Additional Registrar

(Services), O/o the Commissioner for Cooperation & Registrar of Cooperative

Societies, Andhra Pradesh, Hyderabad hereby impose a major peanlty of

“REMOVAL FROM SERVICE” against Sri M.Srinivasa Sastry, Assistant ‘ Registrar /

Charged Officer and accordingly the disciplinary case pending against the charged

Officer is hereby disposed off.

An appeal on the present orders shall lie before the Commissioner for

Cooperation & Registrar of Cooperative Societies, Andhra Pradesh, Hyderabad

within three months from the date of receipt of the order by the Charged Officer

as per Rule 33 of Andhra Pradesh Civil Services (Classification Control & Appeal)

Rules, 1991.
