1st cited, the Proh. & Excise Superintendent, Amalapuram was requested to inform
the whereabouts of Sri T.V.Prasada Rao, Proh. & Excise Constable, Border Mobile
patrolling party l&ll (Yedurlanka), as his name was found missing in the nominal
Rolls of the Department. In the reference 2 nd cited, the Proh. & Excise
Superintendent, Amalapuram informed that the was absent for duty from 01sl July,
2006 to till date.

Accordingly, in the reference 3rd cited, disciplinary action was initiated
against the individual under Rule 20 of APCS (CCA) Rules, 1991 and the Proh. &
Excise Superintendent, Amalapuram was requested to serve the articles onto the
delinquent Officer.
In the reference 4th cited, the Proh. & Excise Superintendent, Amalapuram
informed that the articles of charges could not be served on to Sri T.V. Prasada Rao,
as his address particulars are not known. In the reference 5th cited, the Asst.
Proh. & Excise Superintendent, Amalapuram was appointed as Enquiry Officer to
enquire the last known address particulars of the delinquent Officer. In the reference
6th cited, the Asst. Proh. & Excise Superintendent, Amalapuram reported
along with connected statements, stating that despite detailed enquiry, the
whereabouts of the delinquent Officer were not traced. His famiiy members have also
confessed that the present whereabouts are not known to them.
Accordingly, a ‘Press Note’ was got published in ‘Eenadu’ daily News paper, East
Godavari District edition, dt. 24.02.2018, in the reference 7th and 8th cited, directing the
individual to appear before the undersigned and to submit his defence statement, within
(10) days, failing which it will be construed that the delinquent Officer is not willing to continue
as Government servant in Proh. & Excise Department and deemed to have removed from
service from 01st July, 2006.
The matter has been thoroughly verified. Though the delinquent Officer was given
reasonable opportunity to submit his statement, he neither appeared before the disciplinary
authority nor submitted his written statement of defence as on the date. Therefore, it is
concluded that Sri T.V. Prasada Rao, Proh. & Excise Constable is not willing to continue as
Govt. Servant in Proh. & Excise Department.
Therefore in view of Rule 20 of APCS (CCA) Rules, 1991 and in view of the Govt.
Orders issued vide reference 9th cited, Sri T.V. Prasada Rao, Proh. & Excise Constable,
worked at Border Mobile patrolling party l&ll (Yedurlanka) is hereby awarded punishment
of “Deemed to have been removed from post of Prohibition & Excise Constable w.e.f.
01st July, 2006”.
Sri T.V.Prasada Rao is further informed that appeal on the above orders lay before
the Deputy Commissioner of Proh. & Excise, Kakinada within (90) days from the date of
issue of this Order.
