ORDER:

Rc.No.MC3/11124/15/2011,- Certain APSRTC workers belonging to

SC/ST communities of Ananthapuramu district have submitted a representation

to the Collector & District Magistrate, Ananthapuramu and stating that Sri M.Venugopal

S/o M.Subbarayudu got job in APSRTC, Ananthapuramu region by producing false

Nese (BC-B) caste certificate even though he does not belonging to Nese community.

The matter has been referred to the Regional Manager, APSRTC., Ananthapuramu

to furnish the caste certificate and present residential address of Sri M.Venugopal

S/o M.Subbarayudu for conducting discreet enquiry.

In this connection, the Regional Manager, APSRTC., Ananthapuramu has

furnished the xerox copy of caste certificate and residential address of Sri M.Venugopal

S/o M.Subbarayudu of Pamidi mandal for taking further action in the matter. The

above matter was referred to the Tahsildar, Pamidi for enquiry into the caste status

of Sri M.Venugopal S/o M.Subbarayudu.

Accordingly, Tahsildar, Pamidi has submitted a report and stating that

Sri M.Venugopal S/o M.Subbarayudu is native of Katrimala village of Pamidi mandal

who belongs to Nese (BC-B) community and the caste certificate issued from their

office is genuine one.

The District Collector, Ananthapuramu has been referred the case to the

District Level Scrutiny Committee, Ananthapuramu for its scrutiny and Findings.

Further, Regional Manager, APSRTC., Ananthapuramu has furnished

the new residential address of Sri M.Venugopal S/o M.Subbarayudu, D.No.3-154-1,

Pattabhi Weavers colony, Near SKU, Ananthapuramu mandal for taking further

action in the matter.

In this connection, the Joint Collector & Chairman, District Level Scrutiny

Committee, Ananthapuramu has been a Notice to Sri M.Venugopal

S/o M.Subbarayudu, resident of D.No.3-154-1, Pattabhi Weavers colony, Near

SKU, Ananthapuramu mandal to attend before the Joint Collector’s chamber,

Collector’s office, Ananthapuramu on 10.02.2015 with regard to verification of

his caste status claimed as “BC-B Nese”. The DLSC has convened the meeting

on 10.02.2015 at 5.00 P.M. at Joint Collector’s Chamber, Collector’s Office,

Ananthapuramu with DLSC Committee Members with regard to verification of caste

status of Sri M Venugopal S/o M.Subbarayudu, D.No.3-154-1, Pattabhi Weavers

colony, Near SKU, Ananthapuramu mandal.

Finally, the Deputy Director of B.C.Welfare, Ananthapuramu has stated

that Sri M.Venugopal S/o M.Subbarayudu belongs to Thogata (BC-B) caste.

The Joint Collector & Chairman, District Level Scrutiny Committee,

Ananthapuramu has been issued another Notice to Sri M.Venugopal

S/o M.Subbarayudu to attend before the Joint Collector’s chamber, Collector’s

office, Ananthapuramu on 09.03.2018 with material and documentary

evidences etc.

In obedience to the said Notice, Accordingly, individual has appeared

before the DLSC committee and stated that he belongs to Thogata (BC-B) caste.

He is working as Conductor in Uravakonda APSRTC depot and produced

xerox copies of caste certificate as Thogata (BC-B) issued to him.

Further, the District Level Scrutiny Committee, Ananthapuramu has examined

the issue in detail “According to List of Socially and Educationally Backward

Classes in A.P (As per G.O.Ms.No.l793r Education Dept., dated: 23-09-1970 as

modified from time to time)” Nese caste is not existed in the list of BCs and

Nese is profession of the caste. Hence, it is construed that Sri M.Venugopal

S/o M.Subbarayudu, resident of D.No. 17-982-1, Venugopal Nagar, Ananthapuramu

Town belongs to the caste and community of Thogata (BC-B).

On observation of the above, documentary evidences submitted by the

applicant and enquiries under undertaken in this regard, the DLSC committee

members have concluded that Sri M.Venugopal S/o M.Subbarayudu, resident of

D.No.17-982-1, Venugopal Nagar, Ananthapuramu Town belongs to the

caste and Community of Thogata (BC-B) through the Case Sheet.

The Joint Collector & Chairman, District Level Scrutiny Committee,

Ananthapuramu has agreed the facts with the opinion of members of District Level

Scrutiny Committee, Ananthapuramu and has given approval upon the “Findings

of the District Level Scrutiny Committee” that Sri M.Venugopal S/o M.Subbarayudu

D.No. 17-982-1, Venugopal Nagar, Ananthapuramu Town belongs to Thogata (BC-B).

I have verified the records as well as the report of Revenue Divisional

Officer, Ananthapuramu and Deputy Director of B.C.Welfare, Ananthapuramu

and the report of District Level Scrutiny Committee and perused the documents

produced by the applicant. After perusing the above factors with a critical view,

I am convinced that the District Level Scrutiny Committee rightly recommended

and declaring that theDuring the DLSC meeting, in which a decision has been

taken to obtain discreet reports from the Revenue Divisional Officer, Ananthapuramu

and Deputy Director of B.C.Welfare, Ananthapuramu.

Accordingly, the matter was referred to the Revenue Divisional

Officer, Ananthapuramu and Deputy Director of B.C.Welfare, Ananthapuramu for

conducting discreet enquiry in the above matter and submit report.

In the reference 18^th read., the Revenue Divisional Officer, Ananthapuramu

has submitted enquiry report through the Tahsildar, Pamidi and stating that

Sri M.Venugopal S/o M.Subbarayudu is resident of D.No.17-982-1, Venugopal

Nagar, Ananthapuramu Town. In the year 1990, he got a job in APSRTC

department as Conductor at Dharmavaram Town. Later, he was shifted his

family to Ananthapuramu Town. At present, he is said to be working in

APSRTC at Uravakonda mandal. He was obtained BC-B Thogata caste certificate

from the Tahsildar, Pamidi in the year 2008. Further, he was obtained BC-B

Thogata caste certificate by the Tahsildar, Ananthapuramu in Application No.

CGC 011504344730, dt.04.03.2015. Sri M.Subbarayudu F/o M.Venugopal was

obtained BC-B Thogata caste certificate by the Tahsildar, Pamidi on 23.02.2015.

During the course of enquiry in Katrimala village, the village elders & neighbors

have stated that Sri M.Venugopal S/o M.Subbarayudu belongs to BC-B Nese caste.

Finally, the Revenue Divisional Officer, Ananthapuramu stated that

Sri M.Venugopal S/o M.Subbaryudu, D.No.3-154, Pattabhi Weavers colony,

SKU, Ananthapuramu Mandal previously resident of Katrimala Village, Pamidi

mandal is belongs to Nese (BC-B) community.

In the reference 19^th read., the Deputy Director of B.C. Welfare,

Ananthapuramu has submitted a report and stating that Sri M.Venugopal

S/o M.Subbarayudu is residing in D.No.17-982-1, Venugopal Nagar, Ananthapuramu

Town since 12 years. He is native of Katrimala village of Pamidi mandal. In the

year 1990, he got a job in APSRTC department as Conductor at present who is

working as Conductor in Uravakonda APSRTC depot. His family members

are being performed marriages according to Thogata caste. Earlier, Sri M.Venugopal

S/o M.Subbarayudu has obtained BC-B Nese caste from the Tahsildar, Pamidi

whose profession is Nese and their caste is Thogata, Accordingly, their children

have also obtained BC-B Thogata caste.

Caste of Sri M.Venugopal S/o M.Subbarayudu of Ananthapuramu Town

belongs to Thogata (BC-B) caste and he obtained Thogata (BC-B) caste certificate

from the then Tahsildar, Ananthapuramu is genuine one.

In view of the above circumstances and in exercise of powers conferred

under Sub Rule 7 of Rule 9 of A.P. by the Government under Rule (9) of A.P. (SC/

ST & BC) Issue of Community, Nativity and Date of Birth Certificate Rules, 1997

(G.O.Ms.No.58 S.W. (J) Dept., Dated: 12.05.1997) read with secretion 5 (i) of A.P.

(SCs,STs and BCs) Regulation of Issue of Community, Certificates Act 16/93,

I, Sri G.Veerapandian, I.A.S., Collector and District Magistrate, Ananthapuramu

do hereby confirm that Sri M.Venugopal S/o M.Subbarayudu, resident of D.No.

17-982-1, Venugopal Nagar, Ananthapuramu Town, Ananthapuramu district of

Andhra Pradesh State belongs to Thogata (BC-B) caste and the caste certificate

obtained in favour of him from the then Tahsildar, Ananthapuramu is genuine

one and deserves for confirmation.

A notification to this effect shall be published in the District Gazette

extraordinary.

An appeal against this order lies before the Government within thirty

(30) days from the publication of order in the Andhra Pradesh Gazette as per

Section 7 (2) of Act 16 of 1993.

Date of Birth Certificate Rules, 1997 communicated vide G.O.Ms.No.58, Social

Welfare (J) Department, Dt: 12-5-1997, I, Sri G.Veerapandian, I.A.S., Collector and

District Magistrate, Ananthapuramu do hereby confirm that Sri M.Venugopal

S/o M.Subbarayudu, resident of D.No.17-982-1, Venugopal Nagar, Ananthapuramu

Town, Ananthapuramu district of Andhra Pradesh State belongs to Thogata (BC-B)

caste and the caste certificate obtained in favour of him from the then
