In this connection, The Joint Collector & Chairman, District Level Scrutiny

Committee, Ananthapuramu has been issued another Notice in Form VI to

M.Subramanyam S/o M.Ramachari to attend before the Joint Collector’s

Chamber, Collector’s office, Ananthapuramu on 09.03.2018 with regard to

verification of his caste status claimed as “Kammara” under S.T. category. The

Notice has been served to the above applicant on 07.03.2018 through the Mandal

Revenue Inspector, Tadimarri. The Joint Collector & Chairman, DLSC,

Ananthapuramu has convened the meeting on 09.03.2018 at Joint Collector’s

Chamber, Collector’s office, Ananthapuramu with DLSC Committee Members

regarding the verification of caste status of Sri M.Subramanyam S/o late

M.Ramachari, Dadithota village of Tadimarri mandal.

In obedience to the said Notice, individual has appeared before the DLSC

committee and stated that he is working as Conductor in APSRTC Uravakonda

depot who belongs to Kammara caste. Further, he has stated that he has no

documentary evidences except caste certificate as Kammara (ST) issued by

the then Mandal Revenue Officer, Tadimarri in the year 1987.He has failed to

submit the required documents to the scrutiny committee in support of his claim as

belonging to the caste “Kammara” (ST).

According to List of Socially and Educationally Backward Classes in

A.P (As per G.O.Ms.No.58, Social Welfare (J) Department., Dated: 12.05.1997)

All Revenue officials i.e. Revenue Divisional Officers / Sub Collector / Asst.

Collector in the State are competent to issue Kammara (ST) caste certificate.

In this instant caste, Sri M.Subramanyam S/o late M.Ramachari obtained

the said Kammara (ST) caste certificate from the then Mandal Revenue Officer,

Tadimarri who was not competent authority (without proper channel and Hierarchy).

Hence, it is construed that Kammara (ST) caste certificate obtained by him from

the then Mandal Revenue Officer, Tadimarri is a false one.

According to section (6) of A.P. (SC,ST & BC) Regulation of Issue of

Community Certificates Act, 1993, (Act No. 16 of 1993), burden of proof lies on the claimant

i.e., Appellant only. But, the Appellant failed to prove his caste claimed as Kammara (ST).

The fact that Sri M.Subramanyam S/o late M.Ramachari had admitted

fact that from his fore fathers time they were in the profession of manufacturing

farm implements which is the profession of Kammari community. Hence, it has

been established that the certificate as “ST - Kammara” obtained by

Sri M. Subramanyam S/o late M. Ramachari has to be cancelled.

On observation of the above explanations, documentary evidences

submitted by the applicant and enquiries under undertaken in this regard,

the DLSC committee members, Ananthapuramu have concluded that

Sri M.Subramanyam S/o late M.Ramachari, Dadithota village of Tadimarri mandal

belongs to the caste and community of Kammari (BC-B) and does not belongs to

Kammara (ST) community through the Case Sheet.

The Joint Collector & Chairman, District Level Scrutiny Committee,

Ananthapuramu has agreed the facts with the opinion of members of District

Level Scrutiny Committee, Ananthapuramu and has given approval upon the

“Findings of the District Level Scrutiny Committee” that., Sri M.Subramanyam

S/o late M.Ramachari, Dadithota village of Tadimarri mandal do belongs to the

caste & community of Kammari (BC-B) caste and does not belongs to

Kammara (ST) community. The caste certificate obtained by him as Kammara (ST)

is a fraudulent one and deserves for cancellation.

I have verified the records as well as the report of Revenue Divisional

Officer, Dharmavaram and District Tribal Welfare Officer, Ananthapuramu and

the report of District Level Scrutiny Committee and perused the documents

produced by the applicant. After perusing the above factors with a critical

view, I am convinced that the District Level Scrutiny Committee rightly

recommended and declaring that the caste of Sri M.Subramanyam

S/o late M.Ramachari, Dadithota village of Tadimarri mandal do belongs to

the caste & community of Kammari (BC-B) caste and does not belongs to

Kammara (ST) community.
