ORDER :

Rc.No.MC3/11124/1/2011,- Certain APSRTC workers belonging to

SC/ST communities of Ananthapuramu district have submitted a representation

to the Collector & District Magistrate, Ananthapuramu and stating that

Sri K.Balanjineyulu S/o K.Hanumanthappa of Guntakal mandal got job in

APSRTC, Ananthapuramu region by producing false Madari Kuruba (SC) caste

certificate even though he does not belonging to Madari Kuruba (SC) caste.

The matter has been referred to the Regional Manager, APSRTC., Ananthapuramu

to furnish the caste certificate and present residential address of Sri K.Balanjineyulu

S/o K.Hanumanthappa for conducting discreet enquiry.

In this connection, the Regional Manager, APSRTC., Ananthapuramu has

furnished the xerox copy of caste certificate and residential address of

Sri K.Balanjineyulu S/o K.Hanumanthappa for taking further action in the

matter. The above matter was referred to the Tahsildar, Guntakal for enquiry

into the caste status of Sri K.Balanjineyulu S/o K.Hanumanthappa.

Accordingly, Tahsildar, Guntakal has submitted a report and stating

that Sri K.Balanjineyulu S/o K.Hanumanthappa is resident of D.No. 18/795-D5,

Old Guntakal. He is working as Supervisor in APSRTC, Gooty depot. He married

to one Smt Jayalakshmi D/o Kothuru Manikyappa who is resident of Burujula

village of Maddikera mandal, Kurnool district. His wife also belongs to Kuruba

(BC-B) caste. They worship the goddesses made with Wood, Preach Ujjinamma

(Beerappa Swamy). They also preach Billi devathas.

Further, Tahsildar, Guntakal has stated that Sri K.Balanjineyulu

S/o K.Hanumanthappa belongs to Kuruba (BC-B) caste.

The District Collector, Ananthapuramu has been referred the case to the

District Level Scrutiny Committee, Ananthapuramu for its scrutiny and Findings.

In this connection, The Joint Collector & Chairman, District Level Scrutiny

Committee, Ananthapuramu has been issued a Notice in Form VI to

Sri K.Balanjineyulu S/o K.Hanumanthappa to attend before the Joint Collector’s

Chamber, Collector’s office, Ananthapuramu on 10.02.2015 regarding the caste

status claimed as “Madari Kuruba” (SC). The said notice has been served to

applicant’s wife ie., Smt K.Jayalakshmi W/o K.Balanjineyulu as he is not

available to serve the copy. The DLSC has convened the meeting on 10.02.2015

at 5.00 P.M. at Joint Collector’s Chamber, Collector office, Ananthapuramu

with DLSC Committee Members regarding caste status of Sri K.Balanjineyulu

S/o K.Hanumanthappa, resident or u.No. 18/795-D5, Guntakal. During the DLSC

meeting, in which a decision has been taken to obtain discreet reports from the

Revenue Divisional Officer, Ananthapuramu and Deputy Director of Social

Welfare, Ananthapuramu.

The matter was referred to the Revenue Divisional Officer, Ananthapuramu

and Deputy Director of Social Welfare, Ananthapuramu for conducting discreet

enquiry in the above matter.

In the reference 18^lh read., the Revenue Divisional Officer, Ananthapuramu

has submitted enquiry report through the Tahsildar, Guntakal and stating that

Sri K.Balanjineyulu S/o K.Hanumanthappa is resident of D.N0.18/795-D5, Guntakal

Town. At present, he is working as a Supervisor in APSRTC, Gooty depot. The

respectable persons of Guntakal Town have also confirmed that he belongs

to Kuruba (BC-B) caste. Finally, the Revenue Divisional Officer, Ananthapuramu has

stated that Sri K.Balanjineyulu S/o K.Hanumanthappa, resident of D.No.

l8/795-D5, Guntakal Town belongs to Kuruba (BC-B) caste and does not belongs

to Madari Kurava (SC).

The Tahsildar, Guntakal has submitted a report and stating that

Sri K.Balanjineyulu S/o K.Hanumanthappa is resident of D.No. 18/795-D5, Guntakal

Town. At present, he is working as a Supervisor in APSRTC, Gooty depot. His

father and mother are un-educated and they are said to be Madari Kurava caste.

They have not produced any material evidence to prove that their caste “Madari

Kurava”. They worship the goddesses made with Wood, preach Ujjinamma

(Beerappa Swamy) and also preach Billi Devathas.

Further, Tahsildar, Guntakal has stated that Sri K.Balanjineyulu is having two

brothers and two sisters. His elder brother by name Sri K.Ramanjineyulu has

studied upto Ph.D., who is working as Lecturer in Private college who belongs to

Kuruba (BC-B) caste. His younger brother studied up to xth class is working in

Wine shop who also belongs to Kuruba (BC-B) caste. His sister names are

Aruna Jyothi and Anasuyamma who are un-educated, married and residing

with their families. Their caste also belongs to Kuruba (BC-B) caste. They

perform Gramadevatha Varosthsavalu and speaks Grameena Telugu language.

Their Surname is Burujula and Gotram is Killari. Finally, Tahsildar, Guntakal

has stated that Sri K.Balanjineyulu S/o K.Hanumanthappa belongs to Kuruba

(BC-B) caste.

In the reference 19^th read., the Deputy Director of Social Welfare,

Ananthapuramu has submitted a report through Assistant Social Welfare

Officer, Uravakonda and stating that Sri Kilai Balanjineyulu S/o K.Hanumanthappa

is resident of D.No. 18/795-D5, Old Guntakal of Guntakal Town. At present, he is

working as Assistant Mechanical Foremen in APSRTC, Gooty depot.

Sri K.Balanjineyulu is having two brothers and two sisters. His elder brother by

name Sri K.Ramanjineyulu has completed Ph.D., and working as Lecturer in

private college who belongs to Kuruba (BC-B) caste. His younger brother by

name Sri K.Babu studied up to xth class and working in Wine shop who also

belongs to Kuruba (BC-B) caste. His sister names are Aruna Jyothi and

Anasuyamma are uneducated, married and residing with their families who also

belongs to Kuruba (BC-B) caste.

Further, Deputy Director of Social Welfare, Ananthapuramu has stated

that Sri K. Balanjineyulu S/o K.Hanumanthappa married to one Smt Jayalakshmi

D/o K.Manikyappa who is resident of Burujula village of Maddikera mandal, Kurnool

district who also belongs to Kuruba (BC-B). Finally, Deputy Director of Social

Welfare,

has

stated

that

Sri

K.Balanjineyulu

S/o K.Hanumanthappa, resident of Guntakal mandal belongs to Kuruba (BC-B).

The Joint Collector & Chairman, District Level Scrutiny Committee,

Ananthapuramu has been issued another Notice in Form VI to Sri K. Balanjineyulu

S/o K.Hanumanthappa to attend before the Scrutiny committee on 03.04.2018 with

material and documentary evidences etc. In obedience to the said Notice,

individual appeared before the D.L.S.C., committee and stated that he is

working as Supervisor in APSRTC Gooty depot who belongs to Madari Kurava (SC)

caste. Further, he has stated that he has no documentary evidences except

that caste certificate issued by the then Tahsildar, Gooty .

The District Level Scrutiny Committee, Ananthapuramu has examined the

case in detail and asked customs and traditions being followed by family, to

whom he married. Accordingly, the individual has stated that he belongs to Madari

Kurava (SC) caste and married to Kuruba (BC-B) person who got two children and

admitted the fact that their children got caste certificates as Kuruba (BC-B).

The Committee opined that they wear normal and as usual dresses as villagers

wear and has noticed the caste certificate as Madari Kuruba (SC) issued by

the then Tahsildar, Gooty who was not competent authority (without proper

channel and Hierarchy).

According to List of Socially and Educationally Backward Classes in

A.P (As per G.O.Ms.No.58, Social Welfare (J) Department., dated: 12.05.1997)

All Revenue Divisional Officers / Sub Collector / Asst. Collector in the State

are competent to issue Madasi Kuruba and Madari Kurava (SC) caste

certificates.

In this instant caste, Sri K.Balanjineyulu S/o K.Hanumanthappa obtained

the said Madari Kuruba (SC) caste certificate from the then Tahsildar, Gooty.

As such, Madasi Kuruba caste are not existed in the list of Scheduled Caste

where as Madasi Kuruva and Madari Kurava is existed. Hence, it is construed

that he obtained Madari Kuruba (SC) caste from the then Tahsildar, Gooty is a

false one. There are no evidences tallied as per the Madasi / Madari Kurava traditions /

customs in claimant family. He failed to produce evidence either primary of

corrobotate to prove that he belongs to Madari Kuruba community.

On observation of the above, documentary evidences submitted by the

applicant and enquiries under undertaken in this regard, the DLSC committee

members have been established that the above individual i.e., Sri K.Balanjineyulu

S/o K.Hanumanthappa of Guntakal Town belongs to Kuruba (BC-B) and does not

belongs to the caste and community of Madari Kuruba (SC) through the Case

Sheet.

The Joint Collector & Chairman, District Level Scrutiny Committee,

Ananthapuramu has agreed the facts with the opinion of members of District

Level Scrutiny Committee, Ananthapuramu and has given approval upon the

“Findings of the District Level Scrutiny Committee” that Sri K.Balanjineyulu

S/o K.Hanumanthappa of Guntakal Town belongs to Kuruba (BC-B) and does not

belongs to the caste and community of Madari Kuruba (SC). The caste certificate

obtained by Sri K.Balanjineyulu S/o K.Hanumanthappa, resident of D.No. 18/795-D5,

Old Guntakal of Guntakal Town as Madari Kuruba (SC) is false one and liable for

cancellation.

I have verified the records as well as the report of Revenue Divisional

Officer, Ananthapuramu and Deputy Director of Social Welfare, Ananthapuramu

and the report of District Level Scrutiny Committee and perused the documents

produced by the applicant. After perusing the above factors with a critical view,

I am convinced that the District Level Scrutiny Committee rightly recommended

and declaring that the caste of Sri K.Balanjineyulu S/o K.Hanumanthappa,

resident of D.No.l8/795-D5, Old Guntakal of Guntakal Town do belongs to the

caste & community of “Kuruba” (BC-B) and does not belongs to the caste and

community of “Madari Kuruba” (SC).

Under section 5 (1) of AP (SC,ST and BC) Regulation of issue of

Community, Nativity and Date of Birth Certificate Act 16 of 1993 r/w Sub-Rule 7 of

Rule 9 of AP (SC,ST & BC) Issue of Community, Nativity and Date of Birth Certificate

Rules, 1997, communicated in G.O.Ms.No.58 of Social Welfare Department, dt.

12.05.1997, the District Collector is competent to cancel the caste certificate.

In view of the above circumstances and in exercise of powers conferred

under Sub Rule 7 of Rule 9 of A.P.by the Government under Rule (9) of A.P.

(SC/ST & BC) Issue of Community, Nativity and Date of Birth Certificate

Rules,1997 (G.O.Ms.No.58 S.W. (J) Dept., dated.12.05.1997) read with secretion 5 (i)

of A.P. (SCs,STs and BCs) Regulation of Issue of Community, Certificates Act 16/93,

I, Sri G.Veerapandian, I.A.S., Collector and District Magistrate, Ananthapuramu

do hereby cancel the “Madari Kuruba” (SC) caste certificate obtained by

Sri K.Balanjineyulu S/o K.Hanumanthappa, D.No.l8/795-D5, Old Guntakal of

Guntakal Town, Ananthapuramu district, Andhra Pradesh state from the then

Tahsildar, Gooty and other caste certificates if any obtained later on, with immediate

effect duly declaring that the individual does not belongs to “Madari Kuruba” (SC)

community.
