ORDER :

Rc.No.MC3/11124/7/2011,- Certain APSRTC workers belonging to

SC/ST communities have submitted a representation to the Collector & District

Magistrate, Ananthapuramu and stating that Sri K.Ramalingaiah S/o K.Subba Rayudu

got job in APSRTC, Ananthapuramu region by producing false Kammara (BC-B)

caste certificate even though he does not belonging to Kammara caste. The

matter has been referred to the Regional Manager, APSRTC., Ananthapuramu

to furnish the caste certificate and present residential address of

Sri K. Ramalingaiah S/o K.Subba Rayudu for conducting discreet enquiry.

In this connection, the Regional Manager, APSRTC., Ananthapuramu has

furnished the xerox copy of caste certificate and residential address of

Sri K.Ramalingaiah S/o K.Subba Rayudu for taking further action in the matter.

The above matter was referred to the Tahsildar, Ananthapuramu for enquiry into

the caste status of Sri K.Ramalingaiah S/o K.Subba Rayudu, Ananthapuramu Town.

The Tahsildar, Ananthapuramu has submitted a report and stating

that Sri K.Ramalingaiah S/o K.Subba Rayudu, resident of D.No. 19/110/226,

Rani Nagar, Ananthapuramu Town who belongs to Kammara BC-B community

and the caste certificate issued from their office is genuine one.

Accordingly, the District Collector, Ananthapuramu has been referred the

case to the District Level Scrutiny Committee, Ananthapuramu for its scrutiny

and Findings.

The Joint Collector and Chairman, District Level Scrutiny Committee

has been issued a Notice to Sri K.Ramalingaiah S/o K.Subba Rayudu of

Ananthapuramu Town to attend before the Scrutiny committee on 10.02.2015

along with documentary evidences in support of his caste claim. On 10.02.2015,

the individual i.e., Sri K.Ramalingaiah S/o K.Subba Rayudu had attended

before the committee and stated that he belongs to Kammara (BC-B) and

produced the caste certificate as Kammara (BC-B) issued to him previously by

the Tahsildar, Ananthapuramu. During the DLSC meeting, in which a decision

has been taken to obtain discreet reports from the Revenue Divisional

Officer, Ananthapuramu and Deputy Director of B.C. Welfare, Ananthapuramu.

The matter was referred to the Revenue Divisional Officer, Ananthapuramu

and Deputy Director of B.C.Welfare, Ananthapuramu for conducting a discreet

enquiry in the matter.

In the reference 18^th read., the Revenue Divisional Officer, Ananthapuramu

has submitted enquiry report through the Tahsildar, Ananthapuramu and stating

that Sri K.Ramalingaiah S/o K.Subba Rayudu is resident of D No.19-2-230

Ram Naqar of Ananthapuramu Town. He belongs to “Kammara” (BC-B) caste.

He was working as a Driver in APSRTC, Dharmavaram depot. During the

enquiry, the respectable persons of locality and the neighbours of

Sri K.Ramalingaiah have also stated that he belongs to “Kammara” BC-B caste.

During the enquiry, applicant produced his Transfer certificate bearing

No.458/1981 in which, his caste is mentioned as “Kammara” and also furnished

Kammara BC-B caste certificate issued to him previously in application bearing

No. 8103/1988 by the then Mandal Revenue Officer, Ananthapuramu.

Finally, the Revenue Divisional Officer, Ananthapuramu has reported

that Sri K.Ramalingaiah S/o K.Subba Rayudu, D.No.19/110/226, Rani Nagar,

Behind T.B. Hospital, Ananthapuramu is belongs to Kammara (BC-B) community.

In the reference 19^th read., the Deputy Director of B.C.Welfare,

Ananthapuramu submitted a report through the Assistant B.C.Welfare

Officer, Ananthapuramu and stating that Sri K.Ramalingaiah S/o K.Subba Rayudu

is resident of D.No.19-2-230, Rani Nagar, Near T.B.Hospital, Ananthapuramu

since 40 years. Sri K.Ramalingaiah is having four children l.Sri Kammara

Sivaiah 2. Kammara Bhargavachari 3. Kammari Vijayalakshmi 4. Kammari

Nagamani. Among them, two daughters were married with Kammara community

people. As verified the Transfer certificates of male children, in which their caste is

mentioned as “Kammara”. The respectable persons have also stated

that Sri K.Ramalingaiah S/o K.Subba Rayudu belongs to Kammara Caste.

Finally, the Deputy Director of B.C.Welfare, Ananthapuramu has reported

that Sri K.Ramalingaiah S/o K.Subba Rayudu, resident of D.No.19/110/226,

Rani Nagar, Behind T.B.Hospital, Ananthapuramu Town belongs to Kammara

community.

The Joint Collector & Chairman, District Level Scrutiny Committee,

Ananthapuramu has been issued another Notice to Sri K.Ramalingaiah

S/o K.Subba Rayudu of Ananthapuramu Town to attend before the Scrutiny

committee on 03.04.2018 with material and documentary evidences etc.

In obedience to the said Notice, individual has appeared before the DLSC

committee and stated that he is residing in D.No. 19/110/226, Rani Nagar,

Behind T.B.Hospital, Ananthapuramu and admitted that he belongs to Kammari

(BC-B) caste. He is working as Driver in Dharmavaram APSRTC depot and

produced xerox copy of caste certificate issued to him.

The District Level Scrutiny Committee, Ananthapuramu has examined

the issue in detail “According to List of Socially and Educationally Backward

Classes in A.P (As per G.O.Ms.No.1793, Education Dept dated: 23-09-1970

as modified from time to time)” Kammara caste is not existed in the list of

BCs under Group B Category. Hence, it is construed that Sri K.Ramalingaiah

S/o K.Subba Rayudu belongs to Kammari (BC-B) caste.

Further, DLSC Committee has gone through the records available and

confirmed that the caste certificate issued infavour of Sri K.Ramalingaiah

S/o K.Subba Rayudu has to be modified as Kammari “BC-B” instead of

Kammara “BC-B” through the Case Sheet.

On observation of the above explanations, documentary evidences

submitted by the applicant and enquiries under undertaken in this regard,

the

DLSC

committee

members

have

opined

and

concluded

that

Sri K.Ramalingaiah S/o K.Subba Rayudu, D.No. 19/110/226, Rani Nagar,

Behind T.B.Hospital, Ananthapuramu Town belongs to the caste and

community of Kammari (BC-B) and does not belongs to Kammara (BC-B).

In analysis of the above phenomenon and enquiry records available

with this office, the District Level Scrutiny Committee, Ananthapuramu have

concluded through the Case Sheet that Sri K.Ramalingaiah S/o K.Subba Rayudu,

D.No. 19/110/226, Rani Nagar, Behind T.B.Hospital, Ananthapuramu Town

belongs to the caste and community of Kammari (BC-B).

The Joint Collector & Chairman, District Level Scrutiny Committee,

Ananthapuramu has agreed with the opinions of members of District Level

Scrutiny Committee, Ananthapuramu and has given consent upon the “Findings

of the District Level Scrutiny Committee” that Sri K.Ramalingaiah

S/o K.Subba Rayudu, D.No. 19/110/226, Rani Nagar, Behind T.B.Hospital,

Ananthapuramu Town belongs to the caste and community of Kammari (BC-B).

Finally, after perusing the Findings and Recommendation of the District

Level Scrutiny Committee, there is valid substantial reasons to accept

that Sri K.Ramalingaiah S/o K.Subba Rayudu, D.No. 19/110/226, Rani Nagar,

Behind T.B.Hospital, Ananthapuramu Town belongs to Kammari (BC-B) community.

I have verified the records as well as the report of Revenue Divisional

Officer, Ananthapuramu and Deputy Director of B.C.Welfare, Ananthapuramu

and the report of District Level Scrutiny Committee and perused the documents

produced by the applicant. After perusing the above factors with a critical

view, I am convinced that the District Level Scrutiny Committee rightly

recommended and declaring that the caste of Sri K.Ramalingaiah S/o K.Subba

Rayudu of Ananthapuramu Town belongs to Kammari (BC- B) community

In view of the above circumstances and in exercise of powers conferred

under Sub Rule 7 of Rule 9 of A.P. by the Government under Rule (9) of A.P.

(SC/ST & BC) Issue of Community, Nativity and Date of Birth Certificate Rules. 1997

(G.O.Ms.No.58 S.W. (J) Dept., dated: 12.05.1997) read with section 5 (i) of A.P.

(SCs,STs and BCs) Regulation of Issue of Community, Certificates Act 16/93,

I, Sri G.Veerapandian, I.A.S., Collector and District Magistrate, Ananthapuramu

do hereby declare and confirm that Sri K.Ramalingaiah S/o K.Subba Rayudu,

D.No.19/110/226, Rani Nagar, Behind T.B.Hospital, Ananthapuramu Town,

Ananthapuramu district of Andhra Pradesh State belongs to Kammari (BC-B)

community.

A notification to this effect shall be published in the District Gazette

extraordinary.

An appeal against this order lies before the Government within thirty

(30) days from the publication of order in the Andhra Pradesh Gazette as per

Section 7 (2) of Act 16 of 1993.
