ORDER :

Rc.No.MC3/11124/17/2011-,. Certain APSRTC workers belonging to

SC/ST communities of Ananthapuramu district have submitted a representation to the

Collector & District Magistrate, Ananthapuramu and stating that Sri J.Adinarayana

S/o J.Pedda Ganganna got job in APSRTC, Ananthapuramu region by producing false

SC - Mala caste certificate even though he does not belonging to SC - Mala caste.

The matter has been referred to the Regional Manager, APSRTC., Ananthapuramu to

furnish the caste certificate and present residential address of Sri J.Adinarayana

S/o J.Pedda Ganganna, Mudigubba mandal for conducting discreet enquiry.

In this connection, the Regional Manager, APSRTC., Ananthapuramu has

furnished the xerox copy of caste certificate and residential address of

Sri J.Adinarayana S/o J.Pedda Ganganna of Mudigubba mandal for taking further

action in the matter. The above matter was referred to the Tahsildar, Mudigubba for

enquiry into the caste status of Sri J.Adinarayana S/o J.Pedda Ganganna, Mudigubba

mandal.

Accordingly, Tahsildar, Mudigubba has submitted a report and stating that

Sri J.Adinarayana S/o J.Ganganna is resident of Yenumulavaripalli H/o Malakavemula

village of Mudigubba mandal belongs to Sc- Mala by caste. He is working as Driver in

APSRTC., Puttaparthi depot.

The District Collector, Ananthapuramu has been referred the case to the

District Level Scrutiny Committee, Ananthapuramu for its scrutiny and Findings.

The Joint Collector & Chairman, District Level Scrutiny Committee,

Ananthapuramu has been issued a Notice to Sri J.Adinarayana S/o J.Ganganna of

Mudigubba mandal to attend before the Joint Collector’s chamber, Collector’s office,

Ananthapuramu on 10.02.2015 with regard to verification of his caste status claimed

as SC - Mala.

The DLSC has convened the meeting on 10.02.2015 at 5.00 P.M. with DLSC

Committee Members regarding the caste status of Sri J.Adinarayana S/o J.Ganganna

of Mudigubba mandal. He appeared before the D.L.S.C committee, Ananthapuramu

and stated that he belongs to Mala (SC) caste and studied 7^th class in Z.P.H.S. School

in Yenumulavaripalli village of Mudigubba mandal.

Further, Sri J.Adinarayana S/o J.Ganganna has deposed a statement that

he is residing in S.C.Colony in Yeumulavaripalli village of Mudigubba mandal since

30 years. He has been sanctioned RDT house under weaker section SC category.

He deposed a statement that he got scholarship under SC category in schooling and

got married with Gangadevi F/o D.Chenappa, native of Krishnapuram village of

Bukkapatnam mandal who also belongs to SC - Mala caste. During the DLSC meeting,

in which a decision has been taken to obtain discreet reports from the Revenue

Divisional Officer, Dharmavaram and Deputy Director of Social Welfare,

Ananthapuramu.

The matter was referred to the Revenue Divisional Officer, Dharmavaram and

Deputy Director of Social Welfare, Ananthapuramu to conduct discreet enquiry into

the caste status of Sri J.Adinarayana S/o J.Ganganna, Yenumulavaripalli

H/o Malakavemula village of Mudigubba mandal and submit a detailed report.

Accordingly, the Revenue Divisional Officer, Dharmavaram has submitted

enquiry report through the Tahsildar, Mudigubba and stating that Sri J.Adinarayana

S/o J.Pedda Ganganna is resident of Yenumulavaripalli H/o Malakavemula village of

Mudigubba mandal is belongs to Mala (SC) and the caste certificate issued to him

earlier from the then Tahsildar, Mudigubba is genuine one. The elder persons of the

village and blood relatives have stated that Sri J.Adinarayana S/o J.Ganganna, resident

of Mudigubba mandal belongs to SC- Mala caste. As verified the Transfer Certificate

issued to the above applicant by Z.P. High School, Yenumulavaripalli village vide

T.C.No.36/90 91, in which his caste is also registered as SC- Mala.

Finally, Revenue Divisional Officer, Dharmavaram has verified the Family

Members certificate, Genealogical report and permanent caste certificate issued by

the Tahsildar, Mudigubba and reported that Sri J.Adinarayana S/o J.Ganganna resident

of Mudigubba mandal belongs to SC- Mala caste.

The Tahsildar, Mudigubba has submitted a report and stating that

Sri J.Adinarayana S/o late J.Ganganna, is resident of Yenumulavaripalli H/o

Malakavemula village of Mudigubba mandal who belongs to SC - Mala. The SC - Mala

caste certificate issued previously to the applicant by the then Tahsildar, Mudigubba is

genuine one.

The Deputy Director of Social Welfare, Ananthapuramu has submitted a report

through Assistant Social Welfare Officer, Penukonda and stating that Sri J.Adinarayana

S/o late J.Ganganna is resident of D.No.20-206, Yenumulavaripalli H/o Malakavemula

village of Mudigubba mandal. At present, he is working as Driver in APSRTC Puttaparthi

depot. He married to one Smt J.Arunamma D/o D.Chinnappa, resident of D.No. 1-62,

Krishnapuram village of Bukkapatnam mandal who belongs to SC - Mala caste.

Further, Assistant Social Welfare Officer, Penukonda has verified the Family

Members Certificate, Transfer certificate issued to the applicant by Z.P.High school,

Yenumulavaripalli village, Genealogical report and statement of elders of the

Yenumulavaripalli village and permanent caste certificate issued by the Tahsildar,

Mudigubba.

Finally, Deputy Director of Social Welfare, Ananthapuramu has stated that Sri

J.Adinarayana S/o late J.Ganganna, resident of Mudigubba mandal belongs to

SC - Mala caste.

The Joint Collector & Chairman, District Level Scrutiny Committee,

Ananthapuramu has been issued another Notice to Sri J.Adinarayana S/o late

J.Ganganna to attend before the Scrutiny committee on 03.04.2018 with material and

documentary evidences etc. In obedience to the said Notice, individual has appeared

before the DLSC committee and stated that he belongs to SC - Mala caste and married

in SC community family. His children have also obtained SC - Mala caste certificates.

The District Level Scrutiny Committee has gone through the record available

and asked questions to him regarding customs and traditions being followed by their

family, which type of food preferred during death ceremony. In response to that

questions, individual has explained the traditions followed by his community during

death ceremonies.

On observation of the above, documentary evidences submitted by the

applicant and enquiries under undertaken in this regard, the DLSC committee members

have been established that the above individual i.e., Sri J.Adinarayana S/o

late J.Ganganna, resident of Mudigubba mandal belongs to the caste and

community of SC - Mala.

In analysis of the above phenomenon and enquiry records available with this

office, the District Level Scrutiny Committee, Ananthapuramu have concluded that Sri

J.Adinarayana S/o late J.Ganganna, resident of Mudigubba mandal belongs to the

caste and Community of SC - Mala through the Case Sheet.

The Joint Collector & Chairman, District Level Scrutiny Committee,

Ananthapuramu has agreed the facts with the opinion of members of District Level

Scrutiny Committee, Ananthapuramu and has given approval upon the “Findings of

the District Level Scrutiny Committee that Sri J.Adinarayana S/o late J.Ganganna,

resident of Mudigubba mandal belongs to the caste and Community of SC - Mala and

the caste certificate issued by the then Tahsildar, Mudigubba as SC - Mala is genuine

one and deserves for confirmation.

I have verified the records as well as the report of Revenue Divisional Officer,

Dharmavaram and Deputy Director of Social Welfare, Ananthapuramu and the report

of District Level Scrutiny Committee and persued the documents produced by the

applicant. After perusing the above factors with a critical view, I am convinced that the

District Level Scrutiny Committee rightly recommended and declaring that the caste

of Sri J.Adinarayana S/o late J.Ganganna, resident of Mudigubba mandal belongs to

the caste and community of SC - Mala.

In view of the above circumstances and in exercise of powers conferred under

Sub Rule 7 of Rule 9 of A.P.by the Government under Rule (9) of A.P. (SC/ST & BC)

Issue of Community, Nativity and Date of Birth Certificate Rules, 1997 (G.O.Ms.No.58

S.W. (J) Dept., dated.12.05.1997) read with secretion 5 (i) of A.P. (SCs,STs and BCs)

Regulation of Issue of Community, Certificates Act 16/93, I, Sri G.Veerapandian, I.A.S.,

Collector and District Magistrate, Ananthapuramu do hereby confirm that Sri

J.Adinarayana S/o late J.Ganganna, resident of Mudigubba mandal, Ananthapuramu

district of Andhra Pradesh State belongs to SC - Mala caste and he obtained

SC - Mala caste certificate in favour of him from the then Tahsildar, Mudigubba is

genuine one and deserves for confirmation.

A notification to this effect shall be published in the District Gazette

extraordinary.

An appeal against this order lies before the Government within thirty (30)

days from the publication of order in the Andhra Pradesh Gazette as per Section 7

(2) of Act 16 of 1993.

Level Scrutiny Committee and in exercise of powers conferred under section 5 (i) of

the A.P. (SC/ST/BC) Issue of community certificate Act 16/1993 r/w Sub-Rule (7) of

Rule 9 of A.P. (SC/ST/BC) issue of Community, Nativity and Date of Birth Certificate

Rules, 1997 communicated vide G.O.Ms.No.58, Social Welfare (J) Department, Dt:

12-5-1997, I, Sri G.Veerapandian, I.A.S., Collector and District Magistrate,

Ananthapuramu do hereby confirm that Sri J.Adinarayana S/o late J.Ganganna, resident

of Mudigubba mandal, Ananthapuramu district of Andhra Pradesh State belongs to

SC - Mala caste and obtained SC - Mala caste certificate in favour of him from the

then Tahsildar, Mudigubba is genuine one and deserves for confirmation.
