ORDER:

Rc.No.MC3/11124/2/2011,- Certain APSRTC workers belonging to

SC/ST communities of Ananthapuramu district have submitted a representation

to the Collector & District Magistrate, Ananthapuramu and stating that

Sri B.Ramappa S/o B.Kondanna got job in APSRTC, Ananthapuramu region by

producing false SC - Madiga caste certificate even though he does not belonging

to SC - Madiga caste. The matter has been referred to the Regional Manager,

APSRTC., Ananthapuramu to furnish the caste certificate and present residential

address of Sri B.Ramappa S/o B.Kondanna for conducting discreet enquiry.

In this connection, the Regional Manager, APSRTC., Ananthapuramu has

furnished the xerox copy of caste certificate and residential address of

Sri B.Ramappa S/o B.Kondanna of Beluguppa mandal for taking further action

in the matter. The above matter was referred to the Tahsildar, Beluguppa

for enquiry into the caste status of Sri B.Ramappa S/o B.Kondanna, Beluguppa.

Accordingly, Tahsildar, Beluguppa has submitted a report and stating

that Sri B.Ramappa S/o B.Kondanna is resident of Nuthimadugu village of

Kambadur mandal who belongs to Bestha (BC-A) community. He obtained

SC - Madiga caste certificate bearing No. 1/17-12-1987 from the then Tahsildar,

Beluguppa.

The District Collector, Ananthapuramu has been referred the case to the

District Level Scrutiny Committee, Ananthapuramu for its scrutiny and Findings.

In this connection, The Joint Collector & Chairman, District Level

Scrutiny Committee, Ananthapuramu has been issued a Notice in Form VI

to Sri B.Ramappa S/o B.Kondanna, Nuthimadugu village of Kambadur mandal

to attend before the Joint Collector’s Chamber, Collector’s office, Ananthapuramu

on 10.02.2015 with regard to verification of his caste status claimed as

“SC - Madiga”. The DLSC has convened the meeting on 10.02.2015 at 5.00 P.M.

at Joint Collector’s Chamber, Collector’s office, Ananthapuramu with DLSC

Committee Members regarding the caste status of Sri B.Ramappa

S/o B.Kondanna, Nuthimadugu village of Kambadur mandal. During the DLSC

meeting, in which a decision has been taken to obtain discreet reports from the

Revenue Divisional Officer, Kalyandurg and Deputy Director of Social

Welfare, Ananthapuramu.

The matter was referred to the Revenue Divisional Officer, Kalyandurg

and Deputy Director of Social Welfare, Ananthapuramu for conducting discreet a

discreet enquiry in the above matter.

In the reference 18^lh read., the Revenue Divisional Officer, Kalyandurg has

submitted enquiry report through Tahsildar, Kambadur and stating that

Sri B.Ramappa S/o B.Kondanna is resident of Nuthimadugu village of Kambadur

mandal who is working as conductor in APSRTC. Raydura depot. He appeared

before the Tahsildar, Kambadur and deposed that his father was enrolled

“SC Madiga” caste instead of Bestha (BC-A) by mistake while admitting him

into school for primary education and the caste of the individual is continued

as SC community. Further, Sri B.Ramappa S/o B.Kondanna has deposed that

while he was working as Water Man on temporary basis in APSRTC and

subsequently vacancies arose he was taken on permanent basis. He and

his family members have also stated that they originally belongs to Bestha

(BC-A) community and does not availed any benefits under SC category.

Moreover, he wants to retain his caste as Bestha (BC-A) community. He

obtained SC - Madiga caste certificate from the Tahsildar, Beluguppa in the

year 1987.

Finally, Revenue Divisional Officer, Kalyandurg has stated that

Sri B.Ramappa S/o B.Kondanna is resident of Nuthimadugu village of Kambadur

mandal belongs to Bestha (BC-A) caste and does not belongs to SC - Madiga

caste.

The Tahsildar, Kambadur has submitted a report and stating that

Sri B.Ramappa S/o B.Kondanna, Nuthimadugu village of Kambadur mandal

belongs to Bestha (BC-A) by caste and does not belongs to SC - Madiga.

In the reference 19^th read., the Deputy Director of Social Welfare,

Ananthapuramu has submitted a report through the Assistant Social Welfare

Officer, Kalyandurg and stating that Sri B.Ramappa S/o B.Kondanna is resident

of D.No.2/101, B.C.Colony, Nuthimadugu village of Kambadur mandal. At present,

he is working as Conductor in APSRTC, Raydurg depot. He is having three

daughters and one son. They celebrate all Hindu festivals and their surname is

Bestha and Gothram is Tallavari. During the course of enquiry, applicant and

his father deposed a statement that they belongs to Bestha (BC-A) caste which

comes under BC category and also stated that he did not utilized the reservation

to get any benefit during his education and not even for getting job.

Finally, Deputy Director of Social Welfare, Ananthapuramu has stated

that Sri B.Ramappa S/o B.Kondanna, resident of Nuthimadugu village of Kambadur

mandal belongs to Bestha (BC-A) caste.

Sri B.Ramappa S/o B.Kondanna to attend before the Scrutiny committee on

03.04.2018 with material and documentary evidences etc. In obedience to the

Notice, Sri B.Ramappa S/o B.Kondanna has appeared before the D.L.S.C.,

committee and stated that he is working as Conductor in APSRTC Raydurg

depot who belongs to Bestha (BC-A) caste. While he was working as Water

Man on temporary basis in APSRTC and subsequently vacancies arose he was

taken on permanent basis. He was not selected in APSRTC under the

strength of SC Madiga caste and admitted facts that he originally belongs to

Bestha (BC- A) caste.

The District Level Scrutiny Committee, Ananthapuramu has examined the

case in detail and asked customs and traditions being followed by family.

Accordingly, the individual has stated that while his father was working as

Office Sub ordinate in a school, Kambadur mandal obtained SC - Madiga caste

certificate bearing No. 1/17-12-1987 infavour of Sri B.Ramappa S/o B.Kondanna

from the Tahsildar, Beluguppa. Further, he admitted facts that he originally

belongs to Bestha (BC-A) caste.

On observation of the above, documentary evidences submitted by the

applicant and enquiries under undertaken in this regard, the DLSC committee

members have been established the fact that the above individual i.e.,

Sri B.Ramappa S/o B.Kondanna of Kambadur mandal belongs to Bestha

(BC-A) caste. In analysis of the above phenomenon and enquiry records

available with this office, the District Level Scrutiny Commiittee, Ananthapuramu

have concluded that Sri B.Ramappa S/o B.Kondanna, Nuthimadugu village of of

Kambadur mandal belongs to Bestha (BC-A) and does not belongs to the

caste and community of Madiga (SC) through the Case Sheet.

The Joint Collector & Chairman, District Level Scrutiny Committee,

Ananthapuramu has agreed the facts with the opinion of members of District

Level Scrutiny Committee, Ananthapuramu and has given approval upon the

“Findings of the District Level Scrutiny Committee” that Sri B.Ramappa

S/o B.Kondanna, Nuthimadugu village of Kambadur mandal belongs to Bestha

(BC-A) and does not belongs to the caste and community of Madiga (SC).

The caste certificate obtained by Sri B.Ramappa S/o B.Kondanna as SC - Madiga

is false one and liable for cancellation.

I have verified the records as well as the report of Revenue Divisional

Officer, Kalyandurg and Deputy Director of Social Welfare, Ananthapuramu and

the report of District Level Scrutiny Committee and perused the documents

produced by the applicant. After perusing the above factors with a critical

view, I am convinced that the District Level Scrutiny Committee rightly

recommended

and

declaring

that

the

caste

Sri

B.Ramappa

S/o B.Kondanna, Nuthimadugu village of Kambadur mandal do belongs to

the caste & community of “Bestha” (BC-A) and does not belongs to the caste

and community of Madiga (SC).

Under section 5 (1) of AP (SC,ST and BC) Regulation of issue of

Community, Nativity and Date of Birth Certificate Act 16 of 1993 r/w Sub-Rule 7

of Rule 9 of AP (SC,ST & BC) Issue of Community, Nativity and Date of Birth

Certificate Rules, 1997, communicated in G.O.Ms.No.58 of Social Welfare

Department, dt. 12.05.1997, the District Collector is competent to cancel the caste

certificate.

In view of the above circumstances and in exercise of powers conferred

under Sub Rule 7 of Rule 9 of A.P.by the Government under Rule (9) of A.P.

(SC/ST & BC)Issue of Community, Nativity and Date of Birth Certificate Rules,

1997 (G.O.Ms.No.58 S.W. (J) Dept., dated.12.05.1997) read with secretion 5 (i)

of A.P. (SCs,STs and BCs) Regulation of Issue of Community, Certificates Act

16/93, I, Sri G.Veerapandian, I.A.S., Collector and District Magistrate,

Ananthapuramu do hereby cancel the Madiga (SC) caste certificate obtained

by Sri B.Ramappa S/o B.Kondanna, Nuthimadugu village of Kambadur

mandal, Ananthapuramu district, Andhra Pradesh state from the then Mandal

Revenue Officer, Beluguppa and other caste certificates if any obtained later

on, with immediate effect duly declaring that the individual does not belongs to

Madiga (SC) community.

A notification to this effect shall be published in the District Gazette

extraordinary.

An appeal against this order lies before the Government within thirty

(30) days from the publication of order in the Andhra Pradesh Gazette as per

Section 7 (2) of Act 16 of 1993.

and Date of Birth Certificate Rules, 1997 communicated vide G.O.Ms.No.58,

Social Welfare (J) Department, Dt: 12-5-1997, I, Sri G.Veerapandian, I.A.S.,

Collector and District Magistrate, Ananthapuramu do hereby cancel the Madiga

(SC) caste certificate obtained by Sri B.Ramappa S/o B.Kondanna, Nuthimadugu

village of Kambadur mandal, Ananthapuramu district, Andhra Pradesh state from

the then Mandal Revenue Officer, Beluguppa and other caste certificates if any

obtained later on, with immediate effect duly declaring that the individual does

not belongs to Madiga (SC) community.
