The special Tribunal Prakasam District, Ongole has taken cognizance of the

case filed by the applicant. It is alleged that the land belonging to the above applicants

as specified in the schedule below is grabbled by the above respondents 28.

Notice is hereby given to whatsoever if any concern including the custodian of

Eva case property as required under the first proviso to sub-section (4) of Section 7-A

of the Andhra Pradesh Land Grabbing Prohibition Act, 1982 (A.P. Act 12 of 1982)

if any person intends to object, they may submit their objections if any to the Special

Tribunal, Prakasam District on 30.12.2019 for its consideration.

If no objections are received by the said Special Tribunal within the specified

period, it will be presumed that there were no objections for proceedings further and

the case will be proceeded accordingly.

15. A consise statement of ail relevant

facts as to the claim & Provision

under which is preferred

The petition schedule properties are situated in Survey No.93/1C (clearly described

in the schedule) of Annavarappadu area of Ongole Mandal, Prakasam District.

The petitioners 1 to 11 are the owners of the respective schedule properties shown

in the schedule. The 1^st petitioner Inala Malathi Devi got the property by way of

Patta issued by the Special Deputy Tahsildar. The patta is filed as Document

No.1. It is for an extent of A.c.0.08 cents in Sy.No.93/1C-20. As per the Patta

Dated: 27.07.1982 it is clear that joint Patta was divided and an extent of

A.c.0.08 cents is given in the name of the 1^st petitioner Inala Malathi Devi. The

name of the 1^st petitioner was entered in the village records and the Revenue

Authorities collected ‘Cist’ from the 1^st petitioner Cist receipt is filed as Document

No.2 and the passbook as document No.3. The 1^st petitioner has obtained

ecumbrance certificate from the sub-registrar’s office on 28.03.2012. From the

certificate the property is in the name of the 1^st petitioner and there are no

encumbrances.

The 2^nd petitioner Emmaneni Lakshmipathi Rao is also got plot under the above

referred division of joint Patta by the Special Deputy Tahsildar, Ongole. As per the

order, in form-III, issued by the Special Deputy Tahsildar. Dated: 27.07.1982 an

extent of A.c.0.21 cents is in the name of Emmaneni Lakshmi Pathi Rao. The Patta is

filed as Document No.4. There is tax receipt for the plot in the name of the

2^nd petitioner. He has also obtained Encumbrance Certificate which shows that

there are no transactions and the property is in the name of Emmaneni Laksmipathi Rao

pass book and cit receipt are filed as document No.5.

The 3^rd Item of the petition schedule is an extent of Ac.0.17 cents belongs to

Mdduluri Rajeswaramma. Rytwari Pass book is in the name of Madduluri

Rajeswaramma for an extent of Ac.0.17Cents in Survey number 93/1C-22. The

Pass Book was issued by the Tahsildar, Ongole is filed as Document No.6. The

3^rd petitioner is the son of Madduluri Rajeswaramma, and he is the legal heir of

Rajeswaramma who died on 02.03.2009. There are proceedings in form-III issued

by the Special Deputy Tahsildar, after dividing the original Patta, it is in the name of

Madduluri, Rajeswaramma it is filed as Document No.7. There is ‘Cist’ receipt for the plot

and it is filed as Document No.8.

Plot No.23 is an extent of Ac.0.73 cents in Sy.No.93/ 1C is in the name of

Gummaneni Lalithakumari and Audhi Lakshmi Nagamba Devi, the petitioners 4 and 5.

These petitioners purchased the property for a valuable consideration from Thai

Ramanjaneya Rao, S/o. Kotaiah Naidu under a registered sale deed Dated: 12.05.1988.

registered as Document No. 1432/88. The original sale deed is filed as Document

No.9. The vendor Ramanjaneyulu was having Rytwari passbook for the plot and

there is ‘Cist.’ receipt dated 09.03.1994 in the name of the petitioners 4 and 5.

Ryotwari pass book and Cist receipts are filed as Document numbers 10,11,12.

Plot no.26 belonging to the 6^th petitioner Inabattina Yanadhi Rao is an extent of

Ac.0.05 cents. Originally the property is in the name of Inabattina Venkamma.

After the death of Venkamma her son succeeded to the property and he also died on

December, 2018 and his son Yanadhi Rao succeeded to the property. Ryotwari pass

book in the name of Inabattina Venkamma is filed as Document No. 13 and Tax

receipt Dated: 03.08.1982 is filed as Document No. 1.4 and there are also orders

in form-III issued by the Spl. Deputy Tahsildar, Ongole after division of joint Patta,

it is filed as Document No. 15.

Plot No.28 belonging to the 7^th petitioner Jagarlapudi Venkateswarlu. Originally this

property belongs to Kolachana Lakshmi Narasimham. He got it by way of registered sale

deed dated 15.12.1955. The Original sale deed is filed as Document No. 16. After his

death his wife Satyavathamma succeeded to the property. There is form-ill order in the

name of Satyavathamma it is filed as Document No. 17. Ryotwari Pass Book in the name

of Satyawathamma is filed as Document No.18. She died on 21.11.1998 and her only

daughter Jayalakshmi succeeded to the property of Satyavathamma and she also

died one year after, that is on 25.10.1999. After her death her only daughter Jagarlapudi

Indira Succeeded and unfortunately she also died on 12.10.2011 and her husband

Venkateswarlu succeeded to the property.

Plot No. 11 in Sy No.93/1C originally belonged to Ayesha Khatoon, W/o. late Mahaboob

Khan. She got the property under a registered sale deed dated 15.12.1955 purchased

from Konuru Venkata Sundar Rao. Further there are orders in form-III issued by the

Special Deputy Tahsildar, the sale deed and orders in form-Ill is filed as Document Numbers

19, 20. There is Ryotwari Pass book in the name of Ayesha Katoon and it is filed as

Document No.21. The 8^th petitioner Amanulla Khan is the son of Ayesha Katoon. as

Ayesha Khatoon died her son is filing the petition.

Plot No. 10 in Sy. No.93/1C originally belonged to late Siva Raju Lakshmi Narayana Rao

as per the registered sale deed under document No.2687/55. He purchased the

property from Konuru Venkata Sundhara Ramaiah. 9^th petitioner is the son of late

Sivaraju Lakshmi Narayana Rao. The sale deed in the name of Siva Raju Lakshmi

Narayana Rao is filed as Document No.22.

Plot No.6 in Sy. No.93/ 1C of Annavarappadu, originally belonged to Vellampalli

Kesavulu. There are orders in form-III issued by the Special Deputy Tahsildar after

division of Pattas and there is Ryotwari Pass Book in his name. 10^th petitioner

Vellampalli Srinivasa Rao is the grand son. After the death of Kesavulu, his son

Vellampalli Srinivasa Rao Succeeded to the property. Form-III order and Ryotwari

Pass Book in the name of Vellampalli Kesavulu, is filed as Document numbers 23, 24.

10. Plot No.3 in Sy.No. 93/1C, is an extent of A.c.0.20 cents purchase by the grand

father of the 11^th petitioner Uppuluri Satyanarayana under document No.2691/55.

The sale deed is filed as document No.25 and the Ryotwari Pass Book is filed as

document No.26.

11. The respondents have no title or any sort of owner ship over the properties shown

in the schedule belonging to the petitioners. The petitioners for their livelihood are

residing in different places. Taking advantage of it, the respondents and their

followers high handedly entered the schedule properties and raised structures with

taties and started residing in the hurts without any legal right. Their illegal

occupation of petitioner site started in 2005. Since then the petitioners have been

trying to resist the respondents illegal entry by complaining the matter to the local

authorities, Revenue Authorities and the Police. When ever there was resistance

the respondents with drew their entry and again they started their act of encroachment by

raising structures in site. Inspite of best efforts to stop them the petitioners could

not and know the respondents are in illegal occupation of the schedule properties of

the petitioners. Hence the petitioners are constrained to file this petition.

IV. Court Fee :

Court Fees of Rs. only is paid by way of Bank Challan in State Bank of India,

District Court Complex, Ongole.

V. Relief’s :

The petitioner prays that the honourable court may be pleased pass Orders in favour

of the petitioners and against the respondents:-

directing the respondents to deliver the vacant possession of the petition schedule

property to the petitioner within the time stipulated by this Hon’ble court, if they fail

to do so such delivery may be effected under the due process of the Honourable

Tribunal;

b. directing the Respondents to pay damages of Rs. 1,00,000/- to the petitioner;

for costs of the petition;

for such other reliefs as the Honourable court deems fit and proper in the

circumstances of the case.
