MEMORANDUM OF CHARGE

ARTICLE OF CHARGES FRAMED AGAINST TO Sri M. GOVINDA RAO,

CT-2784 (U/s) OF APSPF, VIJAYAWADA GUARDS - PROCEEDINGS UNDER

RULE-20 OF ANDHRA PRADESH CIVIL SERVICES (CLASSIFICATION,

CONTROL AND APPEAL RULES, 1991.

It is proposed to

hold an inquiry against Sri M.Govinda Rao, CT-2784 (U/s) of APSPF, Vijayawada

Guards in accordance with the procedure laid down in Rule 20 of the Andhra

Pradesh Civil Services (Classification, Control and Appeal) Rules, 1991.

The substances of the imputations of misconduct or misbehaviour in

respect of which the inquiry is proposed to be held is set out in the enclosed

statement of articles of charge (Annexure - I). A list of documents by which, and a

list of witnesses by whom, the articles of charges are proposed to be sustained

are also enclosed (Annexure-II and III).

Sri M.Govinda Rao, CT-2784 (U/s) of APSPF, Vijayawada Guards is directed

to submit within (10) days of the receipt of this order, a written statement of his

defense.

Sri M.Govinda Rao, CT-2784 (U/s) of APSPF, Vijayawada Guards is

informed that an inquiry will be held only in respect of those articles of charges

as are not admitted. He should, therefore, specifically admit or deny each article

of charge.

further informed that, if he does not submit his written statement of defence on

or before the date specified in para-3 above further action will be processed

based on the material available.

Attention of Sri M.Govinda Rao, CT-2784 (U/s) of APSPF, Vijayawada

Guards is invited to Rule-24 of the Andhra Pradesh Civil Services (Conduct)

Rules, 1964, under which no Government servant shall bring or attempt to bring

any political or outside influence to bear upon any superior authority to further his

interests in respect of matters pertaining to his service under the Government.

If any representations received on his behalf from another person in respect of

any matter dealt with in these proceedings, it will be presumed that Sri

M. Govinda Rao, CT-2784 (U/s) of APSPF, Vijayawada Guards is aware of

such a representation and that it has been made at his instance and action

will be taken against him for violation of Rule-24 of the Andhra Pradesh

Civil Services (Conduct) Rules, 1964.

The receipt of the Memorandum may be acknowledged.

ANNEXURE - I

Statement of Article of Charge framed against Sri M.Govinda Rao,

CT- 2784 (U/s) of APSPF, Vijayawada Guards.

ARTICLE - I

That the said Sri M.Govinda Rao, CT-2784 of APSPF, Vijayawada Guards

was placed under suspension from 04.08.2003 for involvement in theft of a

sealed cash box (briefcase) containing an amount of Rs.2,63,000/- (Rupees

Two Lakhs Sixty Three thousand only) from Armed Guard room, AIR, Vijayawada

02.08.2003 at about 22:00 Hrs. After issuing the Show Cause Notice, his

probation was terminated from service on 10.10.2003 on the grounds of

unsatisfactory conduct. As per the orders of Hon’ble APAT vide O.A.No.2972

of 2004, Dated: 29.10.2009, he was reinstated in to the service and deemed to

have been under suspension from the date of termination of his probation i.e.,

w.e.f. 10.10.2003 on the same conditions. During the period of the orders remain

in the force, the Head Quarters of Sri M.Govinda Rao, CT-2784 is SPF, Vijayawada

and shall not leave Vijayawada without obtaining the prior permission of the

Commandant.

This office has paid subsistence allowance up to September 2015 on

submission of unemployment certificate by him. But, from October 2015

onwards, without any prior intimation or permission from Commandant, he

left Vijayawada HQrs and his whereabouts are not known to this Office till date.

In spite of correspondence made from this Office, neither he responded nor

submitted any explanation regarding his disappearance.

By the above acts, he has exhibited gross misconduct, which is unbecoming

of a Government servant thereby violation of Rule-3 of APCS (Conduct)

Rules-1964.

Statement of imputations of gross misconduct in support of Articles of Charges

framed against Sri M.Govinda Rao, CT-2784 (U/s) of APSPF,

Vijayawada Guards

Sri M. Govinda Rao, CT-2784 (U/s) of APSPF, Vijayawada Guards is

native of Sanapalavanipeta (V), Fareedpeta (Po), Etcherala (M), Srikakulam

District, Pin-532410. His date of Birth is 01.07.1975. He was appointed as

Constable in APSPF on 11.02.2003 in such capacity he has been discharging his

duties in APSPF, Vijayawada Zone.

That the said Sri M.Govinda Rao, CT-2784 of APSPF, Vijayawada Guards

was placed under suspension from 04.08.2003 for involvement in theft of a
