NOTIFICATIONS BY HEADS OF DEPARTMENTS Etc.,

As per the reference 1^stread above, Smt. K. Kavitha, SA(PS) joined duty at ZPHS,

Palukur(V), Banaganapalli(M) on 05-06-2011 and attended to her duties up to 20.07.2011.

Later, she applied for Casual Leave on 21.07.2011 and continued her leave without

prior permission of the Competent Authority.

In the reference 2^nd read above, the Commissioner of School Education, A.P,

Amaravathi has communicated a copy of the Govt. Endorsement No. 3186770/

Ser.11/2020, dated:29.01.2020 and representation Dated: 30.12.2019 of Smt. K. Kavitha,

SA(PS) ZPHS. Palukur(V), Banaganapalli (M), (unauthorized absentee) and requested

to take necessary action strictly in accordance with the Acts and Rules in force and

inform to the applicant.

In the reference 3^rd read above, instructions have been issued to the Mandal

Educational Officer, Banaganapalli(M) to enquire into the matter and submit a detailed

report on the request dated:30.12.2019 of Smt. K. Kavitha, SA(PS) ZPHS, Palukur (V),

Banaganapalli(M), (unauthorized absentee) and accordingly the Mandal Educational Officer,

Banaganapalli(M) has submitted her report vide reference 4^thread above.

In the reference 5^th read above, a Show Cause Notice has been issued to

Smt. K. Kavitha, SA(PS) ZPHS, Palukur (V), Banaganapalli (M), (unauthorized absentee)

on her negligency towards her legitimate duties and also having her “Service Register”

in her custody which is against to the rules. She is unauthorized absent to her duties

from 21.07.2011, till to date without applying for any kind of leave and without obtaining

any leave sanction orders from the competent authority and she was directed to explain

as to why she should not be treated to have deemed to have been removed from service

under clause (a) & (b) under rule-1 of G.O.Ms.No.127 General Admn (Service C) Dept,

dated: 15-09-2017 and also under F.R. 18.A, for the afore said lapses and her unauthorized

absente to duties.

Accordingly, in the reference 6^th read above, Smt. K. Kavitha, SA(PS), ZPHS,

Palukur (V), Banaganapalli (M) (unauthorized absentee) submitted her statement of

defense and denied the Show Cause Notice. Hence, the Headmaster, ZPHS, Palukur(V),

Banaganapalli(M) was instructed to submit his report on the statement of defense

submitted by Smt. K. Kavitha, SA(PS), ZPHS, Palukur (V), Banaganapalli (M) (unauthorized

absentee) vide this office Rc. No. 8197/A3/2020, Dated: 20.08.2020.

In the reference 7^th read above, the Headmaster, ZPHS, Palukur (V). Banaganapalli (M)

has submitted his detailed report in respect of Smt.K.Kavitha. SA(PS), ZPHS, Palukur (V).

Banaganapalli (M) (unauthorized absentee)

As seen from the documentary evidences, it is evident that Smt. K. Kavitha, SA(PS),

has been on continuous absent to her duties w.e.f. 21.07.2011 to date which includes

certain period covered under leave and certain period not covered under leave. In the case of

leave applications it is also evident that, all are prepared with different dates in a single or two

occasions by mentioning her designation as SGT on some of the leave letters, they also do

not possess dated initials in certain cases (by the Headmasters), Her last Leave Application

is of dated: 21.03,2019 for the period to 17.10.2019. Thereafter, there are no leave applications

till to date

It is a clear case that falls under Clause 1(b) of G.O.Ms.No. 127 Dt: 15.09.2017

communicated in Procgs. Rc.No.13026/27/2018 - Estt.III - CSE, Dt: 16.06.2020 of CSE. A.P..,

Amaravathi which reads as follows:

“Remains absent from duty for a continuous period exceeding 5 years with or without

leave”.

Further, as per reports of Headmaster, ZPHS, Palukur (V) & also Mandal Educational

Officer, Banaganapalli, leave letters available period is 7 years 1 month 12 days, whereas, leave

letters not available / No leave applied period is 1 Year 3 months 29 days which comes to

8 years 5 months 11 days as on 01.01.2020. Altogether it comes to 9 years 3 months 10 days

as on 31.10.2020 in which, No leave applied period 2 years 1 month 29 days which also

satisfies Clause 1(a) of the G.O.Ms.No.127, General Administration (Ser.C) Department,

Govt. AP Dt: 15.09.2017.

For the above reasons and grounds it is evident that. Smt. K. Kavitha, SA(PS), ZPHS,

Palukur (V), Batiaganapalli(M)} Kurnool (dt) is wilful unauthorized absent from duties and

continuous long absentee to duties for altogether 9 years as on 31.10.2020. Hence, as per the

norms contained in G.O.Ms.No.127 General Administration (Ser.C) Department. Govt A.P.

Dt: 15.09.2017 communicated in Proc.Rc.No.13026/27/2018-EST-3-CSE, Dated:16.06.2020 of

the Commissioner of School Education. A.P. Amaravati. Smt. K. Kavitha, SA(PS), ZPHS,

Palukur (V), Banaganapalli (M), Kurnool (Dt) (unauthorized absentee) is deemed to have been

removed from service under Rule 9 (ix) as amendment in the said Government order and

accordingly, hereby impose the penalty of removal on the said Smt. K. Kavitha. SA(PS), ZPHS,

Palukur (V), Banaganapalli (M) (on willful continues unauthorized absent from duties) from

service for her unauthorized absence for more than 1 year besides leave period for more than

7 years which includes certain period covered under leave application and certain period

not covered. This penalty is imposed under Rule 9 (ix) of APCS (CC&A) Rule 1991 as

amendment in G.O.Ms.No.127, General Admn. (services.C) Department. Dt: 15.-09-2017 read

with Rule.18. Note (4)of FR duly treating the unauthorized period from 21.07.2011 onwards as

“DIES-NON”.

Receipt of these proceedings should be acknowledged.
