ORDER

In the reference read above, the collector & District Magistrate, Kurnool, has

submitted a representation of Sri Syed Akbar Pasha S/o S.Khaja Mohiuddin Krishna

Reddy Nagar, Kurnool City for appointing him as Government Kazi for Kurnool City in

addition to existing Kazis in terms of Section 2 of the Qazis Act, 1880. Further, the

Collector, Kurnool has obtained reports from the Superintendent of Police, Kurnool, the

Revenue Divisional Officer, Kurnool & the Tahsildar, Kallur mandal and stated that The

Principal Mohammandan residents of Kallur area of Kurnool City have recommended

the appointment of Sri. Syed Akbar Pasha S/o S Khaja Mohiuddin as Government Kazi

for Ahle Sunatul Jamat Sect (Hanfi Sect). The applicant is passed Hafiz

Aalim-Qari

course in 2005 conducted by Darul-Uloom Sabeelur Rashad, Arabic College, Bengaluru

and good at Islamic Law, Islamic Culture and Muslim Community Domestic Issues. He

has further stated that there are no criminal cases are pending against the applicant as

per report of the Superintendent of Police, Kurnool dated:09.02.2021.

Further, the Collector, Kurnool, has stated that, there

a strong need for

appointment ^ofone more Kazi for speedy delivery of various services to the needy.

Currently, ^the^KCCanal which passes through the heart of the city is reported to be

fixed as boundary line for the two Kazis pertaining to Ahle Sunnatul Jamat Sect (Hanfi

Sect). Hence, the area lying south of the KC Canal may be divided proportionately. The

area of operation for the proposed new kazi for Ahli Sunnatul Jamat Sect (Hanfi Sect)

may be fixed to the right

starting ^fromKC Canal (Central Plaza) thereby the area lying to the left of the said main

road shall be retained to the existing kazi i.e., Sri Janab Mufthi Md Abdul Salam Kousar

S/o Md Allabakash, so as to clearly avoid interference in to the jurisdiction of each

of the main road connecting Kurnool with Ananthapur

other.

Finally, ^theCollector, Kurnool, has recommended Sri. Syed Akbar Pasha Slo S

Khaja Mohiuddin as Government Kazi for Ahle Sunatul Jamat Sect (Hanfi Sect) with a

Jurisdiction of the area lying the right side of the main road connecting Kurnool with

Anantapur starting from KC Canal (Central Plaza) of Kurnool City.

After careful examination of the report of the Collector & District Magistrate,

Kurnool District, the Government hereby appoint Sri Syed Akbar Pasha S/o S. Khaja

Mohiuddin, Krishna Reddy Nagar, Kurnool City as Government Kazi for Kurnool City for

Ahli Sunnatul Jamat Sect (Hanfi Sect) with a Jurisdiction of the area lying right side of

the main road connecting Kurnool with Anantapur starting from KC Canal (Central

Plaza) ^ofKurnool City in addition

to the existing Kazis,

Kurnool City and retain

remaining ^arealying left of the said main road with the existing Kazi i.e., Sri Janab

Mufthi Md Abdul Salam Kousar S/o Md Allabakash, Kurnool City, initially for a period of

three (3) years for performing Marriages of Muslim Community only as per Section-2 of

the Kazis Act, 1880 (Central Act Xll of 1880) subject to the following conditions:

1. ^The^Kazi^is^answerable^to^the^Government^for^his^actions.

2. he appointment of the Kazi can ^be^revoked^by^the^Government^on^receipt

of complaints/verification of records ^orⁱⁿ^extreme^cases^without^notice,^if

malafide is established as per record.

3. Ihe Kazi shall not indulge any illegal activity in the conduct of marriages

nor infringe any law established by the Government

4. The Kazi shall not carry out marriage of any minor.

5. The Kazi shall not act in any way which is prohibited in Islam or is not

permissible in Islam.

6. The Kazi shall not conduct contract marriages.

7. The Kazi or his Naib Kazi shall not perform any marriage, in any area,

beyond his specified Jurisdiction.

8 The Kazi shall charge the specified fee and nothing more than that.

9. The Kazi shall appoint not

than three (3) Naib Kazis and the names of

Such Naib Kazis shall be informed to the Government.

10. Government shall have the right to take disciplinary action against the

Kazi, in case of any contravention of Law or of any conditions specified

above.

11. The Kazi shall hand-over the Marriage Record to the Wakf Board, at

the end of the tenure.

4.f any question arises whether any person has been rightly appointed as Kazi

under the above said Section, the decision thereof by the State Government shall be

conclusive. The State Government may, if it thinks fit, suspend or remove any Kazi

appointed under this Section, who is guilty of any misconduct in the execution of his

Office, or who is for a continuous period of six months absent from the local area for

which he is appointed, or leaves such local area for the purpose of residing elsewhere,

or is declared an insolvent or desires to be discharged from the office, or who refuses or

becomes in the opinion of the State Government unfit, or personally incapable to

discharge the duties of office.

The following Notification shall be published in the next issue of Andhra Pradesh

State Gazette: -

"In exercise of the powers conferred by Section-2 of the Kazis Act, 1880 (Central

ActXIl of 1880), the Government of Andhra Pradesh, after consulting the Principal

Muhammadans residents of local area, hereby appoint Sri Syed Akbar Pasha S/o s.

Khaja Mohiuddin, Krishna Reddy Nagar, Kurnool City as Government Kazi for Kurnool

City for Ahli Sunnatul Jamat Sect (Hanfi Sect) with a Jurisdiction of the area lying right

side of the main road connecting Kurnool with Anantapur starting from KC Canal

(Central Plaza) of Kurnool City, in addition to the existing Kazis, Kurnool City and retain

remaining area lying left of the said main road with the existing Kazi i.e., Sri Janab

Mufthi Md Abdul Salam Kousar S/o Md Allabakash, Kurnool City, initially for a period of

three (3) years for performing Marriages of Muslim Community only".

The Chief Executive Officer, Andhra Pradesh State Waqf Board, Vijayawada/the

District Collector, Kurnool is directed to take necessary action, accordingly.
