Sri M. Krishna, Assistant Prohibition & Excise Superintendent (AP&ES) (DR)

(trainee) has submitted representations for extension of EOL on medical grounds from

10.10.2019 to 24-10-2019 from 25-10-2019 to 07.11.2019 and from 08.11.2019 to

21.11.2019. He was sanctioned EOL on medical grounds from 24.09.2019 to 09.10 2019

vide this office Cr.No.5998/2019/CPE/B1 dated 21.10.2019 and the individuai applied

for further extension of EOL on medical grounds as stated above.

As per A.P. Leave Rules, 1933, the medical certificate has to be issued by Civil

Surgeon to the Gazetted employees, but the individual submitted the Medical Certificate

issued by the Assistant Civil Surgeon. The individual has not submitted any joining report or

leave extension from 22.11.2019 onwards.

Sri M.Krishna. AP&ES was allocated to the SEB vide G.O.Ms.No.154 Revenue

(Excise-I) dated 16-05-2020 and he has not reported in SEB after allocation.

Under the above circumstances, his explanation was called for vide reference

1^st cited. In the reference 2^nd cited the individual submitted his explanation stating that he is

still advised to take rest and requested to give time up to 30.09.2020 to report before the

Commissioner of Prohibition & Excise with all relevant medical certificates. He further

represented that he enrolled for online training by APHRDI from 12.08.2020 onward

and the classes may go up to the end of September 2020 and requested to permit him to

attend the online classes from his home and there is no certification whether he attended

training in APHRDI or not and as such it is deemed that he has also not attended the

training. However, he did not turn up to report before the undersigned till today.

Sri M.Krishna, AP&ES who has been selected by APPSC and joined duty on

24.10.2018 in the Prohibition & Excise Department and he is under probation. He is

absent from duty from 10.10.2019 onwards without authorization from the Competent

Authority and thus, he is absent from duty for a period exceeding one year which attracts

Rule 9 (ix) (a) of APCC & A Rules.

As per proviso, under sub-class (a) of clause (ix) of Rule 9 of AP Civil Services

(Classification, Control, Appeal) Rules, 1991, a Government Servant shall be deemed to

have been removed from service, if he/she is absent from duty without authorization for a

period exceeding one year. In the instant case, Sri M Krishna, AP&ES is on unauthorized

absence from duty for more than one year.

In view of the above circumstances, a Show Cause Notice has been issued to

Sri M. Krishna, AP&.ES vide reference 3^rd cited and the same was published In A.P. Gazette

Extraordinary No.211, Dated.01.07.2021, but even after lapse of more than (3) months,

Sri M. Krishna, AP&ES (Trainee} has not submitted his explanation in writing in response to

SCN or reported before the Commissioner of Prohibition & Excise.

Therefore, Sri M. Krishna, AP&ES (Trainee) is hereby impose the penalty of

removal from the Government services for continuous absence to duty beyond one year

and so i.e., from 10.10.2019 to till date under Rule 5-B of the A.P. Lesve Rules, 1933

R/w FR-18 with immediate effect.
