ORDER:

The Director General, State Disaster Response & Fire Services, Andhra Pradesh

in his letter first read above has reported that Sri T.V.Subba Rao, Junior Assistant

(Retd.)O/o. Divisional Fire Officer Kakinada, has represented that while he was working

as Junior Assistant, Divisional Fire Officer, Kakinada he was suspended from the service

vide Proceedings Rc.No. 784/A3/1996, dt. 18.03.1996 of the Divisional Fire Officer,

Kakinada and later dismissed from the service in the Proceedings Rc.No. PR/1/A2/99,

dated. 31.08.1999 of the Divisional Fire Officer, Kakinada. Subsequently , on the Hon’ble

A.P. Administrative Tribunal, Hyderabad Orders dated 10.10.2001 in O.A.No.7107/2001

he was reinstated into service. While enclosing a copy of the Judgement dated

25.11.2021 of the Hon’ble High Court, Amaravathi, in Criminal Appeal No. 1537/2009,

which while dismissing the Appeal filed by State of Andhra Pradesh, upheld the verdict of

the IIIrd Additional District and Sessions Judge, Kakinada in acquitting the Petitioner and

another, noting that the findings arrived at warrants no interference, the applicant has

requested to regularise his suspension period from 18-03-1996 to 05-12-2001 and fix his

pay in Revised Pay Scales 1996. Sri. T.V. Subba Rao, Junior Assistant of O/o. the then

Divisional Fire Officer, Kakinada was retired from service on the A.N. of 31.10.2002 on

superannuation after attainting the age of 58 Years. The Director General, State Disaster

Response and Fire Services AP has requested to issue necessary orders on

regularisation of suspension period of the individual and fix his pay in Revised Pay Scales

1996.

2. The Director General, State Disaster Response and Fire Services, AP in his letter

third read above has reported that Sri T.V.Subba Rao Junior Assistant (Retired) was

expired on 08.12.2022 . Hence, duly furnishing the death certificate of Sri T.V.Subba Rao,

the Director General, Fire Services requested the Government to issue necessary orders

in the matter.

3. Government after careful consideration of the matter with reference to the records

made available hereby order that further action against late Sri T.V.Subba Rao Junior

Assistant (Retd.)O/o. Divisional Fire Officer Kakinada be abated under Rule 9(7) (a) of

A.P.Revised Pension Rules, 1980 as the individual had expired on 08.12.2022 and

regularise the suspension Period from 18.03.1996 to 05.12.2001 as On Duty under FR.

54-B(2) subject to recovery of loss caused or misappropriated Government amount if any,

by the deceased Government servant from his retirement benefits.

4. The Director General, State Disaster Response and Fire Services, Andhra Pradesh

is requested to take further follow up action to release the pensionary benefits to the legal

heirs of the deceased officer.
