ORDER:

Whereas, 1.t was brought to the notice of the Government that I.n the reference

lst read above disciplinary proceedings were insti.tuted against Sri A. Narasimhulu,

former Dy. Tahsildar, Gangavaram Mandal, Chi.ttoor District and others on the

allegation that he being a responsi.ble Government Servant, while working as Deputy

Tahsi.ldar, Gangavaram has processed the file for conversion of agriculture land in

Sy.No.245/2 extent Ac 3.10 cents of Keelapalle Village of Gangavaram Mandal stating

that no LA proceedings have been ini.tiated or goi.ng to be initiate 1.n and around the

proposed lands in the village in File No DT/106/2016 dt.02.03.2016 without verifying

the offi.ce records. Whereas the Government of lndi.a vide Gazette No.707

dt.06.04.2015 publi.shed the not].ficati.on S.O.931(E) dt.06.04.2015 of Mi.ni.stry of Road

Transport a Highways under Section 3A(1 ) of National Hi.ghways Act,1956 (48 of 1956)

noti.fying the lands in Sy.No, 240 to 242, 244, 247 etc of Keelapalle village of

Gangavaram Mandal are required for buildi.ng, mal.ntenance, management and

operation of Nati.onal Highway No.4 on the stretch of land from Kin 133.360 to Kin

216.975 in Chi.ttoor Distri.ct along wl.th some other vi.llages in Chi.ttoor Di.strict. After

following the due procedure under A.P.C.S (CC&A) Rules, 1991, the Chief

Commissioner of Land Administration, A.P. issued orders imposing a major penalty of

Reduction in Rank as Senior Assi.stant against Sri A. Narasimhulu, former Dy. Tahsildar,

Gangavaram Mandal, Chittoor District, vide reference 2nd read above.

2. Aggr].eved by the above orders, Sri. A. Narasimhulu, former Dy. Tahsildar,

Gangavaram has fl.led an appeal petition before the Government, stati.ng that the

Chi.ef Commi.ssi.oner of Land Admini.stration ought to have consi.der the Enqui.ry

officer's report and findings in which it was reported that the charge I.s not proved

against the appellant. Hence, the orders are li.able to be interdicted attenti.vely.

Therefore, he has fi.nally he has stated that the order issued by the CCLA is devoid of

any merits and hence requested the order for punishment of Reduction of Rank to the

appellant as senior Assistant 1.ssued by the CCLA is li.able to be interdicted and set

aside.

3. While sending a copy of the appeal peti.tion, the Chi.ef Commi.ssi.oner of Land

Admi.nistration, A.P was requested to exami.ne the contents of the appeal petition

filed by Sri A. Narasimhulu, former Dy. Tahsi.ldar and furnish a report along with

specific remarks and connected records to take further acti.on in the matter.

Accordingly, in the reference 4th read above, the Chi.ef Commissi.oner of Land

Admini.stration has submitted the connected records and stated that the appellant has

processed the conversion file basing on the reports of the field staff and I.nspect].on

notes of the then Tahsildar, Gangavaram without Yen.fying t.he records and

notifications issued by the Govt. of India, he recommended for conversion of

agricultural land situated in Sy.No. 245/2 for an extent of Ac3.10 cts of Keelapalle

village. It shows his gross negligence on duty. After careful examinati.on of the

matter, a punishment of Reducti.on i.n Rank as Senior Assi.stant has been i.mposed

agai.nst Sri A. Narasimhulu, former Dy. Tahsildar, Gangavaram Mandal vide CCIA

proceedings VS.II(1)/34/2021, dt:17.10.2022. Further, I.nformed that the orders issued

by Spl.CS a CCLA in VS-lI(1)/34/2021, dt.14.5.2022 is self explanatory.

4. Government, after careful examination of the matter, has allowed the appeal

and observed that the enquT.ry officer categorically mentioned that the charge framed

against the appellant is not proved. As a Deputy Tahsildhar he has t.o sati.sfy himself

regarding the correctness of informat].on subm].tted to hi.in by the lower staff instead

of completely relying on them. In the present case I.n hand I.t was not: done. Hence, it

is a lapse on the part of the appellant.

5. Accordingly, Government after careful examination of the matter have deci.ded

and hereby revoke the puni.shment of Reduction in Rank as Senior Assistant I.mposed

"withholding of one annual grade increment without cumulative effect" against

him, under Rule 37 r/w Rule 9 of A.P.C.S (CcaA), Rules,1991.

6. The Chief Commissioner of Land Admim.stration, A.P., Mangalag].ri shaH take

necessary further action accordingly.
