MA&UD Department – Removal of Sri Talari Raj Kumar from the Office of the Chairperson,

Kalyanadurgam Municipality, for his willful disobedience and abuse of the powers vested in

the post of Chairperson as per AP Municipalities Act, 1965 - Notification - Issued.

Whereas,

AP.,

Vaddeswaram, in his Letter Roc. No.13023/24/2025/H1, dt.03.09.2025 has informed that the

RDMA, Anantapuram, has reported that the Chairperson, Kalyanadurgam, has failed to

convene two meetings of the council consecutively within a period of 2 months from the

date of the last meeting held, i.e., 30.10.2024, as per provisions of the APM Act, 1965, and

rules thereunder. The Commissioner & Director of Municipal Administration, AP has also

reported that the Chairperson, Kalyanadurgam Municipality has not conducted any council

meeting in November & December 2024, and February, March & April 2025, and also not

called a requisition meeting which was requested by one third of the members of the

council.

The above action of the Chairperson, Kalayanadurgam Municipality shows his willful

disobedience of the provisions of the AP Municipalities Act, 1965 and rules there under in

particular the 2^nd proviso to Rule 1 of the Rules regarding proceedings of the Council

specified in Schedule–I as per Section 32 of APM Act, 1965 (which was incorporated through

Act No 24 of 2020 w.e.f. 02.03.2020), as per which, if the Chairperson fails to convene two

meetings of the council consecutively within a period of two months from the date of last

meeting held, the Government may, by notification in Andhra Pradesh Gazette remove the

Chairperson who in his/her opinion wilfully omits to convene the Council meeting after giving

reasonable opportunity for his/her explanation.

Therefore, Government, following due procedure, have issued show cause notice in

Govt.Memo.No..2962810/G/2025, Dt.22.09.2025 to Sri Talari Raj Kumar, Chairperson,

Kalyanadurgam Municipality to show cause in terms of Section 60(2) of AP Municipalities Act,

1965 as to why action shall not be taken for removing him from the Office of Chairperson,

Kalyanadurgam Municipality as per Section 60(1) of AP Municipalities Act, 1965 and as per

2^nd proviso to Rule 1 of the Rules regarding proceedings of the Council specified in

Schedule-1 as per Section 32 of AP Municipalities Act, 1965 (which was incorporated

through Act No 24 of 2020 w.e.f. 02.03.2020). Sri Talari Raj Kumar, Chairperson,

Kalyanadurgam Municipality was further requested to submit his explanation in writing to the

Government within a period of 15 days from receipt of this Show Cause Notice, failing which,

he was informed that further necessary action will be contemplated based on the available

material as per provisions of the AP Municipalities Act, 1965, and rules in force. The Show

Cause notice dated 22.09.2025 was served by the O/o Commissioner, Kalayanadurgam

Municipality on 25.09.2025.

Whereas, no written explanation to the Show cause notice was received from Sri

Talari Raj Kumar, Chairperson, Kalyanadurgam Municipality, to the Government even after

the expiry of 15 days. In Govt. Memo No.2962810/G/2025, dt. 17.10.2025, the

Commissioner, Kalayanadurgam, and the Commissioner & Director of Municipal

Administration, AP were requested to inform whether any written explanation to show cause

notice was received from Sri Talari Raj Kumar, Chairperson, Kalyanadurgam Municipality at

their office, and if so, they were requested to furnish the same to Government. In reply, the

Municipal Commissioner, Kalyanadurgam Municipality in his letter Roc. No.364/2024-C1,

dated 18-10-2025, and the Commissioner & Director of Municipal Administration, AP, in his

letter Lr.Roc.No.13022/5/2025/H1, dated 22-10-2025, have informed that, after completion

of 15 days, no written explanation has been received from Sri Talari Raj Kumar, Chairperson,

Kalyanadurgam Municipality, as on date to their offices. Therefore, it is construed that Sri

Talari Raj Kumar, Chairperson, Kalyanadurgam Municipality, has no explanation to offer to

the show cause notice dt.22.09.2025 even after a sufficient opportunity is given to him for

explanation.

Now, therefore, in exercise of the powers conferred by section 60(1) of A P

Municipalities Act, 1965 read with 2^nd proviso to Rule 1 of the Rules regarding proceedings

of the Council specified in Schedule-1 as per Section 32 of AP Municipalities Act, 1965

(which was incorporated through Act No 24 of 2020 w.e.f. 02.03.2020), Government hereby

remove Sri Talari Raj Kumar from the Office of Chairperson, Kalyanadurgam Municipality for

his wilful disobedience and abusing the powers vested on the post of Chairperson as per AP

Municipalities Act, 1965.
