DECLARATION

The 23rd June, 2026

(Under Section(19) of the Right to Fair Compensation and Transparency in Land Acquisition,

Rehabilitation and Resettlement Act, 2013)

No. LMD-13011(11)/23/2025/637.--- WHEREAS, it appears to the Governor of Arunachal Pradesh

that a total 14.225 Hectares (i.e 142250.00 Sqmtrs) of land is required at Potin village under Yazali circle

Keyi Panyor District for public purposes namely upgradation of Kimin-Potin road from NHSL specification to

NHDL specification from Ch. 35.500 Km to 45.00 Km by 119 RCC (GREF).

AND WHEREAS, a preliminary notification as required under Section 11 of LARR Act, 2013 was

issued by the Department of Land Management vide memo No.LMD-13011(11)/23/2025/22 Dated Itanagar

2/12/2025, notifying the intention of the State Government for acquiring of 14.225 Hectares (142250.00 Sqmtrs)

of the said land and inviting public claims and objections to the proposed acquisition of land if any.

AND WHEREAS, the Deputy Commissioner Keyi Panyor District vide her Memo No. KPD/NCL/LM-

01/NHSL-NHDL/KP-RD/2025/3113-21 dated 31st March, 2026 certified that land is a private land and free

from Publics and Government projects and that there are no project affected families and therefore no

compensation towards rehabilitation and resettlement/displaced are required to be paid under Section 31 of

LARR Act and has requested the State Government to issue the draft declaration under Section 19 of the

LARR Act, 2013.

AND WHEREAS, the appropriate Government is pleased to note that it is satisfied that chapters-II and

III and Section -15 and 16 shall not apply to acquisition process in respect of the said land Kimin- Potin road.

And now, therefore the Governor of Arunachal Pradesh is pleased to issue the declaration under

Section 19 of the Act specifying that the piece of land measuring 14.225 Hectares (142250.00 Sqmtrs)

located at Potin under Yazali circle Keyi Panyor District is being acquired, the detailed description whereof

is as follows:-

The Governor of Arunachal Pradesh is further pleased to order as under :-

(i)

The except such parts of the mines and minerals which may be required to be dug or removed or

used during construction phase of the project for the purpose of which land is being acquired, no

mines, minerals, iron, stone, slate and other minerals lying under the said land shall be extracted or

removed.

(ii)

A plan of the land may be inspected in the office of the Collector and DLRSO, Keyi Panyor District

on any working day during the working hours. The provisions of the chapter-II and III and Section 15

to 18 of the Act shall not apply to the acquisition in respect of the above land since the land is

acquired by the ministry of Defence in exercise of the powers conferred by sub- section (1) and (4)

of Section 40 of the LARR Act, 2013.

(iii)

The Collector (Deputy Commissioner) through no award has been made, may, on expiration of thirty

days from the date of publication of the notice mentioned in Section 21, take possession of any land

needed for a public purpose and such land shall thereupon vest absolutely in the Government free

from all encumbrances.

(iv)

No additional compensation will be paid as per Section 40 (5) of the LARR Act, 2013 since the

acquisition affects the sovereignty and integrity of India and the security and strategic interest of the

State.
