thereof and on recommendation of the Assam Public Service Commission (APSC)

Communicated vide their letter No.71PSCICON/Exam-22/2023-2024 dated 5th November,

2024, the following candidates are hereby appointed as Lecturer in the District Institute of

Education and Training (DIET) under the Directorate of the State council of Educational Research

and Training (SCERT), Assam in the. Pay-Band 4, Rs. 30,000/- - 1,10,000/- with Grade Pay: Rs.

The following are the Terms and conditions of service for the appointee:

The services of any selected candidate found to have furnished false/falsified

information regarding educational qualification/ caste/ gender EWS status etc. in his/her

application and detected subsequently, will be terminated and legal action will also be taken as

per law.

If a Candidate or any of his/her family members is availing benefits under the

Arunodoi Scheme at the time of the appointment, he/she or the concerned family member shall

voluntarily opt out of the Scheme, as per Arunodoi Guidelines for getting appointment to the

that I do not have more than two living children on or after 01-01-2021 from a single or multiple

partners. In case of any detection to the contrary in due course, I shall be summarily discharged

provisions of the Personnel (B) Department O.M. No, ABP.78/2021/0I, dated' 18/11/2021.

Format of the affidavit as per Annexure-I,

Their services shall be governed by the "New Defined Contributory Pension

Scheme" issued vide Finance Department's O.M. No. B.W.7/2008/Pt/40 dated 06/10/2009. In

this regard, the incumbents will have to submit an undertaking at the time of joining in the

service which read as follows:-

"I understand and accept that Government Servants joining the service of the State

Government on or after 01-02-2005 shall not be governed by the existing Assam Service

(Pension) Rules, 1969 and orders issued there under from time to time and that their pension

and other retirement benefits will be governed by a set of New Pension Rules, which are being

introduced in the line with the Contributory Pension Scheme of Government of India"

The candidate has to report at their respective place of posting on appointment,

within 15 (Fifteen) days from the date of issue of this Notification, failing which the appointment

will automatically stand cancelled.

The inter-se seniority ot the appointees will be fixed later on.

ECF No. 238062/980749 .- Whereas, the Governor of Assam disposed of the Disciplinary Proceedings

by imposing the penalty of Removal from service upon the delinquent officer Sri Dipanka Hzarikia, the then

Assistant Research Officer due to long unauthorized absent from service under Rule 7(vi) of Assam Services

(Discipline and Appeal) Rules, 1964 vide this Department's Order No ECF No. 238062 Dated 26th April,

2024;

Whereas, Sri Dipanka Hazarika, the then Assistant Research Officer, PC Division, T&D Department

preferred an appeal against this Department's Order dated 26th April, 2024 with following grounds:

1) He has stated that he is the only caretaker of his ailing younger brother and his mother is also a

patient of various ailments for which the family are dependent on him.

He could not join in Nalbari due to joining of another incumbent.

Moreover, he has indicated physical, financial, mental hardship faced by him including affecting

the livelihood of entire family.

Whereas, on re-examination of the Proceeding in the light of the appeal, the following observations

have been made:

1. The reasons for modification of the Penalty Order issued vide ECF No. 238062 dated 26th April,

2024 stated by the appellant in his appeal petition is merely family problem which cannot be a cause for

considering the appeal.

2. The appellant had got 3 (three) numbers of opportunities to join in service after transfer orders, but

he did not join and was unauthorizedly absent for more than 5 (five) years from service which hampers the

delivery of public services.

3. The penalty of Removal from service was issued in respect of Sri Dipanka Hazarika on 26th April,

2024. However, he has submitted the appeal petition on 20th October, 2024 i.e. after expiry of more than

5 (five) months, which is beyond the specified period of 3 months limitation for appeal as per Rule 17 of the

Assam Services ( Discipline and Appeal) Rule 1964 as given below.

"No appeal under this part shall be entertained unless it is submitted within a period of three months

AND WHEREAS, Shri Manish Agarwal did not report to the Director of Training, Assam

Administrative Staff College, Khanapara, Guwahati on 1st March, 2024 for the 2 (two) week

Induction Training Programme:

AND WHEREAS, it is found that from the date of prayer petition dated 13th March, 2024

seeking extension up to 30th April, 2024 and another petition dated 26th April, 2024 submitted

by Shri Manish Agarwal, more than 7 (seven) months have passed;

AND WHEREAS, the Rule 14 (2) of the Assam Police Service Rules, 1966 prescribes

that a person shall join within 15 days of the date of receipt of the order of appointment, failing

which and unless the Governor extends the periods, which shall not exceed three months, his

appointment shall liable to cancellation.

NOW THEREFORE, after careful examination of the petitions and the facts and

circumstances of the case, the Governor of Assam is pleased to order that the appointment of

Shri Manish Agarwal in the Assam Police Service (Junior Grade) is hereby cancelled as per

provision of Rule 14 (2) of the Assam Police Service Rules, 1966.
