Barbhuiya, retired Assistant Executive Engineer with his junior Sri Rudra Choudhury, retired

Finance (Estt-A) Department returned the file with , request to re-submit the proposal with all

relevant information/documents as per Checklist for proper examination; and

Whereas an appeal petition was filed by Maksud Ahmed Barbhuiya, retired Assistant

Executive Engineer of PWD Jalukbari. Guwahati Centrel and New Guwahati Territorial

Building Division before Assam Administrative & Pension Tribunal on 30th January, 2023,

No. 1 ATA / 2023, against not providing salary to the appellant Maksud Ahmed Barbhuiya,

retired Assistant Executive Engineer in comparison to his junior Sri Rudra Choudhury, retired

Assistant Engineer.; and

Whereas, the matter of the proposal for pay equalization of Maksud Ahmed Barbhuiya,

retired Assistant Executive Engineer of PWD Jalukbari, Guwahari Central and New Guwahati

Territorial Building Division, with that of his junior Sri Rudra Choudhury, retired Assistant

Engineer, Was re-submitted to Finance (Establishment-A) Department vide Ecf. No. 289234

dated 16th November, 2024 ; and

Whereas, after careful consideration of the matter Finance (Estahlishrnent-A) Department

offers their views vide Finance (Establishment -A) Department's B/S eCF No.289865 dated

19th March, 2025 as follows:

" The proposal for pay equalization in respect of Sri Maksud Ahmed Barbhuya, retired

Assistant Executive Engineer of PWD Jalukbari, Guwahati Central and New Guwahati

Territoral Building Division with that of his junior Sri Rudra Choudhury, retired Assistant

Engincer was examined. It has been observed that the anomaly of pay occurred on 1st April,

2016 when Sri Maksud Ahmed Barbhuiya was AEE and his junior, Sri Rudra Choudhury was

JE. As such both the posts were not identical. As per provision in point Rule 8(B)(v)(g)(i)

(copy attached below) in the Notification NO.FPC.1/2017/Pt/2 dated 17th March, 2017on

AS(ROP), Rules, 2017, stepping up of pay is applicable only when both the junior and senior

incumbents belong to the same cadre and the posts in which they have been promoted should

be identical in the same cadre.

by Section 4 of the Northern India Ferries Act, 1878 (Act. XVII - 1887), the Governor of

Assam is pleased to declare the Boraichala Ferry Service on the River Manash in the District

of Bongaigaon for the purpose of Section 4 (a) of the said Act.

As such stepping up of pay is not applicable in the instant case as it is observed that no

stage of pay is found whereby both the incumbents held the same post. By virtue of seniority

the sonior incumbent got subsequent promotions and MACPS benefit and the junior followed

so. As such when tho disparity of pay cropped up on 1st April, 2016, the senior was holding

the post of AEE and the junior held the post of JE. lnview of the above, Finance (Establishment-

A) regrets the proposal, since the proposal does not appear to have merit to be admissible as

per this Depdrtment's O.M. No.FEG.25/87/l32, dated 10th September,1997 (copy attached

below) and Rule 8(B)(v)(g) (i) in the Notification No.FPC.1/2017/Pt/2 dated 17th March,

2017."

Now, therefore, in consideration of the above, the appeal petition of Maksud Ahmed

Barbhuiya, retired Assistant Executive Engineer of PWD Jalukbari, Guwahati Central and

New Guwahati Territorial Building Division for equalization of his pay, with that of his junior

Sri Rudra Choudhury, retired Assistant Engineer, is hereby regretted and the matter is

accordingly disposed of.
