Development Officer (ADO), was appointed to the post of Agricultural Development Officer
(ADO) vide Notification No. AGA.66/2016/114 dated 26th February, 2016.A criminal case
was subsequently registered in the year 2017, pursuant to which the Police, under the direction
of the Hon'ble Court of the Special Judge, Assam, investigated and examined 1075 candidates
in connection with the matter, whereby out of a total of 40 Agricultural Development Officers
under scrutiny, 11 have boon acquitted and 29 have been convicted.
AND WHEREAS, the Court of Special Judge, Assam, Guwahati vide Order dated 22nd
July, 2024 in the Special Case No.05/2021 arising out of Bhangagarh Police Station Case No.
159 of 2017 U/ss 120-B/420/468/IPC read with sections 7/13 (1)(a)(d)(III)/13(2) of the
Prevention of Corruption Act, 1988 convicted Shri Phanindra Saikia and he was taken into
judicial custody and remanded to jail,
AND WHEREAS, after careful examination of the Order dated 22nd July, 2024 of the
Court of Special Judge, Assam, Guwahati in the Special Case No.05/2021, the Disciplinary
Authority has decided to inflict the penalty of "Dismissal from Service which shall ordinarily
be a disqualification for future employment" upon Shri Phanindra Saikia. with immediate
effect.
AND WHEREAS Agriculture Department sought the views of Assam Public Service
Commission regarding the proposed penalty against the Charged Officer and the Commission
vide letter No. 45PSC/DP-1/3/2024-25 dated 06th May, 2025, agreed with the decision of the
Disciplinary Authority to inflict penalty of "Dismissal from Service which shall ordinarily be
a disqualification for future employment"
"NOW THEREFORE, the Governor of Assam, after careful consideration of all the
facts and materials on records submitted by the Disciplinary Authority and after due application
of mind, is hereby pleased to impose the penalty of "Dismissal from Service which shall
ordinarily be a disqualification for future employment" as prescribed under Rule 7 (vii), of the
Assam Services (Discipline and Appeal) Rules, 1964 in respect of Shri Phanindra Saikia'

under scrutiny, 11 have been acquitted and 29 have been convicted.
AND WHEREAS, the Court of Special Judge, Assam, Cuwahati vide Order dated 22nd
July, 2024 in the Special Case No.05/2021 arising out of Bhangagarh Police Station Case No.
159 of 2017 U/ss 120-B/420/4681IPC read with sections 7/13 (l)(a)(d)(IIl)/13(2) of the
Prevention of Corruption Act, 1988 convicted Shri Pranab Bharali and he was taken into
judicial custody and remanded to jail,
AND WHEREAS, after careful examination of the Order dated 22nd July, 2024 of the
Court of Special Judge, Assam, Guwahati in the Special Case No.05/2021, the Disciplinary
Authority has decided to inflict the penalty of "Dismissal from Service which shall ordinarily
be a disqualification for future employment" upon Shri Pranab Bharali with immediate effect.
