of the “Industrial Relations Code, 2020 (No. 35 of 2020)”, the Governor of Assam is pleased

to appoint the Senior Most Secretary to the Govt. of Assam, Labour Welfare Department as

the Appellate Authority. The Appellate Authority shall perform the functions provided under

section 32 of the “Industrial Relations Code, 2020 (No. 35 of 2020)” within the whole State of

Assam with immediate effect.

No. E-749100/5.- In exercise of the powers conferred under sub-section (1) of section 5

of the “Industrial Relations Code, 2020” (No. 35 of 2020), the Governor of Assam is pleased

to appoint the Registrar, Additional Registrar, Joint Register and Deputy Registrar to perform

the functions provided under the “Industrial Relations Code, 2020” within the State of Assam

with immediate effect:

Roles and Responsibilities of Registrar of Trade Unions:

(i) The Registrar shall, on being satisfied that the Trade Union has complied with all the

requirements of the provisions under the “Industrial Relations Code, 2020” in regard to

registration, shall register the Trade Union.

(ii) Registrar may show cause and hear the Trade Union before cancellation of

registration under clause (ii) of sub-section (5) of section 9 of the “Industrial Relations Code,

2020”,

(iii) Registrar of Trade Unions may withdraw or cancel the certificate of registration of

a Trade Union if the Registrar is satisfied that the certificate has been obtained by fraud or

mistake.

2. Roles and Responsibilities of Additional Registrar of Trade Union:

(i) The Additional Registrar of Trade Unions shall exercise such powers and perform

such duties of the Registrar of Trade Unions as may be assigned or delegated by the Registrar

of Trade Unions from time to time under the provisions of the Industrial Relations Code,

2020.

(ii) The Additional Registrar shall scrutinize applications for registration of Trade Unions

and, upon being satisfied, may forward to the Register the Trade Union for granting of regis-

tration.

(iii) The Additional Registrar may issue notice, call for explanation, and afford a reason-

able opportunity of being heard to a Trade Union before initiating action under sub-section (5)

of section 9 of the Industrial Relations Code, 2020.

3.Roles and Responsibilities of Joint Registrar of Trade Unions:

(i)The Joint Registrar shall exercise such powers and perform such duties of as may be

assigned or delegated by the Government of Assam or by the Registrar of Trade Unions from

time to time under the provisions of the Industrial Relations Code, 2020.

(ii)The Joint Registrar shall maintain record register relating to the registration of Trade

Unions in accordance with the provisions of the Code of Industrial Relations, 2020.

(iii)The Joint Registrar shall verify the annual return submitted by the Trade Unions

under the code and may call for further information, documents, clarifications in respect of

the returns submitted as may be necessary for verification of compliance or for the purposes

of any proceeding under the Code of Industrial Relations, 2020.

4. Roles and Responsibilities of Deputy Registrar of Trade Unions:

(i) The Deputy Registrar shall submit enquiry report regarding application for registra-

tion, name change and in any other matter as sought by the Registrar of Trade Unions, or

Additional Registrar of Trade Unions or Joint Registrar of Trade Unions.

(ii) The Deputy Registrar shall exercise such powers and perform such duties as may be

assigned or delegated by the Government of Assam or by the Registrar of Trade Unions from

time to time under the provisions of the Industrial Relations Code, 2020.

No. LA&A/568221/57.- Whereas Smti. Arpana Sarmah, ALRS (DR-2017), the then AERO

Tihu LAC & Circle Officer, Paschim Nalbari Revenue Circle, Dist.- Nalbari was placed under

suspension with effect from 15th May, 2024 vide Notification ECF No. RLR.491816/230

dated 17th May, 2024 for her reported abandonment of Election Duties, insubordination,

disruptive behavior and utter negligence in works related to Lok Sabha Elections 2024, as

recommended by the Election Commission of India vide letter No. 464/AS/NES- II/2024

dated 15th May, 2024 and informed by the Chief Electoral Officer, Assam vide letter No.

CEO/MIS/2023/1/Vol.1/21 dated 16th May, 2024;

Whereas, the Suspension Review Committee has observed that departmental

proceedings has already been initiated against the officer by issue of show cause vide eCF No.

RLR.491816/273 dated 17th August, 2024 and the officer has submitted reply to the show

cause vide her letter dated 4th June, 2025;

Whereas, the Suspension Review Committee has observed that Inquiry Officer has

already been appointed for conduct of enquiry of departmental proceedings against Smti.

Arpana Sarmah, ALRS (U/S) and the enquiry is now ongoing;

Whereas, the Suspension Review Committee has also observed that the circumstances

that led to suspension of the Delinquent Officer and subsequent extensions thereof still

prevails and the departmental proceeding is pending against the suspended officer;

Whereas, the Suspension Review Committee has recommended for extension of

suspension of Smti. Arpana Sarmah, ALRS (DR-2017), by another 3 (three) months with

effect from 15th August, 2026.

Therefore, considering the seriousness of the matter, the Governor of Assam is pleased

to extend the period of suspension in respect of Smti. Arpana Sarmah, ALRS (DR-2017), for

another period of 3 (three) months with effect from 15th August, 2026 or till further order.

hours, Dr. Jyotirmoy Deka was placed under suspension w.e.f. 10th December, 2023 under

Rule 6(2) of Assam Services (Discipline & Appeal) Rules, 1964 vide ECF No. 437009/3,

dated 12th February, 2024;

And whereas, during the pendency of the criminal proceedings, departmental

proceedings had also been initiated against Dr. Jyotirmoy Deka, Sr. M&HO, Hajo BPHC,

Kamrup (U/S), under the provisions of Rule 9 of the Assam Services (Discipline & Appeal)

Rules, 1964 vide this Department's Show Cause Notice bearing ECF No. 437009/4, dated

23rd February, 2024; and thereafter, Dr. Pranati Gogoi, ACS, the then Joint Secretary

(presently Additional Secretary) to the Government of Assam, Health & Family Welfare

Department, was appointed as the Inquiry Officer to inquire into the charges framed against

Dr. Jyotirmoy Deka vide Order No. HLA./E-437009/8, dated 25th July, 2025;

And whereas, the Inquiry Officer conducted the inquiry in accordance with the

provisions of the Assam Services (Discipline & Appeal) Rules, 1964 and during the course of

hearing, Dr. Jyotirmoy Deka was heard on 18th August, 2025 and after completion of the

process of enquiry, the Inquiry Officer submitted the Inquiry Report on 04th July, 2026;

And whereas, a judgment and sentencing order was passed by the Hon'ble Special Judge,

POCSO, Kamrup (M), Guwahati, dated 16th September, 2025 and dated 22nd September,

2025 respectively in Sessions (Special) Case No. 17/2024, wherein the relevant portion of the

sentencing order reads as "...Situated thus, accused on being convicted under section 376(2)

of IPC is sentenced to undergo rigorous imprisonment for 20 (twenty) years and a fine of Rs.

5,00,000 (five lakhs) and in default of payment of fine he shall undergo a rigorous

imprisonment for another period of 5 five years...".

And whereas, Rule 10(i) (Special Procedure in certain cases) of the Assam Services

(Discipline and Appeal) Rules, 1964 reads as,

"Notwithstanding any thing containing in Rule 9-

(i) Where a penalty is imposed on a Government servant on the ground of conduct which

has led to his conviction on a criminal charge; or ...

the Disciplinary Authority may consider the circumstances of the case and pass such

orders thereon as it deems fit:

Provided that the Commission shall be consulted before passing such orders in any case

in which such consultation is necessary.";

And whereas, after careful consideration of the judgment and order of conviction passed

by the Hon'ble Special Judge, POCSO, Kamrup (M), Guwahati, the conduct which has led to

such conviction, the Disciplinary Authority in Health and Family Welfare Department has

come to the conclusion that the said conduct is of such grave nature as to render Dr. Jyotirmoy

Deka unfit and unbecoming to continue in Government service and has, therefore, decided to

impose the penalty of "DISMISSAL from service, which shall ordinarily be a disqualification

for future employment" under provisions of Sub Rule (vii) in Rule 7 of the Assam Services

(Discipline and Appeal) Rules, 1964 exercising the powers conferred under Rule 10(i)

(Special Procedure in certain cases) of the said rules by invoking the special procedure

prescribed under Rule 10(i) of the said Rules;

And whereas, the records of the Departmental Proceeding along with all relevant records

were forwarded to the Assam Public Service Commission (APSC) for their views and the

Commission conveyed its views vide letter ecF.No.821246/356, dated 31st July, 2026 wherein

the Commission gave its agreement to the decision of the Government to impose penalty of

"dismissal from service, which shall ordinarily be disqualification for future employment.

Now, therefore, after due consultation with the Assam Public Service Commission, the

Governor of Assam is pleased to order the penalty of “dismissal from service, which shall

ordinarily be disqualification for future employment" as per provision of Rule 7 (vii) of the

Assam Service (Discipline & Appeal) Rules, 1964 read with special procedure prescribed

under Rule 10(i) of the said Rules.

Therefore, the Government in Health & Family Welfare Department is hereby pleased to

impose the penalty of dismissal from service, which shall ordinarily be disqualification for

future employment, upon Dr. Jyotirmoy Deka, Sr. M&HO, Hajo BPHC, Kamrup (U/S) with

effect from the date of issue of this order and the Departmental Proceeding drawn up against

him is thus finally disposed of.

placed under Suspension with effect from 2nd October, 2021 vide Notification ECF No.

RLR.98/2020/7 dated 11th October, 2021 due to his arrest on 2nd October, 2021 by

Directorate of Vigilance & AC, Assam in connection with arrest of Gulzar Hussain, Lot

Mandal of Thelamara Revenue Circle, Dist.- Sonitpur;

Whereas, departmental proceedings had been initiated against the officer by issue of

show cause vide ecf 213539/184 dated 19th July, 2023 and the officer had submitted reply to

the show cause vide his letter dated 6th October, 2023;

Whereas, Shri Barenya Ranjan Borthakur, ALRS (U/S) was reinstated vide Notification

ECF No. RLR.247831/180 dated 3rd May, 2024 and posted as Circle Officer (A), Katlichera

Revenue Circle, Dist.- Hailakandi as per Hon'ble Gauhati High Court order dated 17th March,

2023 in WP (C) No. 3730/2022 (Barenya Ranjan Borthakur –Vs- The State of Assam & Oth-

ers) whereby it was directed to reinstate him;

Whereas, Shri Barenya Ranjan Borthakur was again placed under Suspension vide No-

tification ECF No. RLR.247831/187 dated 2nd July, 2025 under Rule 6 (1) (a) of the Assam

Services (Discipline and Appeal) Rules, 1964 and pending drawal of departmental

proceedings with Headquarter at Hailakandi which was later extended for another 3 (three)
