NOTIFICATION

New Delhi, the 27th December, 2001

S.O.1265(E).—Whereas elections were held in pursuance of notification number S.O.

480(E), dated the 30th May, 1998 issued under section 12 of the Representation of the

People Act, 1951 (43 of 1951) for the purpose of filling the seats of members of the

Council of States, elected by the elected members of the Legislative Assembly of the

State of Bihar, who retired on 7th July, 1998, on the expiration of their term of office;

And whereas, in pursuance of section 71 of the Representation of the People Act,

1951 (43 of 1951), the name of Shri Shibu Soren elected by the elected members of the

Legislative Assembly of the State of Bihar was notified vide notification number S.O.

575(E), dated the 8th July, 1998;

And whereas, the Supreme Court of India, in Civil Appeal No.3538 of 2000

(Shibu Soren Vs. Dayanand Sahay and Others) decided on July 19, 2001, has set aside

the election of Shri Shibu Soren and held Shri Dayanand Sahay to be duly elected to

Rajya Sabha;

Now, therefore, in pursuance of section 71 of the Representation of the People

Act, 1951, the Central Government hereby makes the following amendment in the

notification of the Government of India, in the Ministry of Law, Justice and Company

Affairs (Legislative Department) number S.O.575(E), dated the 8th July, 1998, namery:-

In the said notification number S.O.575(E), dated the 8th July, 1998, under

the heading "BIHAR" for S.No.5 and the entries relating thereto, the

following S.No. and entries shall be substituted, namely:-

"5. Shri Dayanand Sahay".
