NOTIFICATION

New Delhi, the 6th March, 2002

Subject: Garment and Knitwears Export Entitlement (Quota) Policy (2000—2004), in respect of countries where such

exports are covered by restraints under the provision of the Agreement on Textiles and Clothing.

No. i/15/2001-Exports-L— l. Attention is invited to Notification No. 1/128/99

Exports-I dated 12^th November, 1999, which was amended subsequently by

Notifications of even number dated 10^th December, 1999, 7^th February, 2000,

Notification No. 1/68/2000 dated 13^th June, 2000, Notification No. 1/21/2000-

Exports-I dated 21^st July, 2000, Notification No.l/133/2000-Exports-I dated 20*

November, 2000, Notification No.l3/33/2000-Exports-I dated 8^th January, 2001,

Notification No.l/149/99-Exports-I dated 24^th January, 2001, Notification

No.1/121/2001 and Notification No.l/161/2000-Exports-I dated 30^th April, 2001

on the above mentioned subject.

In exercise of the powers conferred by Para 20 of the Policy, the

Government of India hereby grants relaxation from the operation of Para 12(vii)

to (ix) of the Policy for exports against entitlements of the year 2001, in the

following manner:-

"(vii) The EMD/BG/LUT/Post

Dated Cheque of an

exporter who

exports 75% or more of the entitlement would be released in full.

However, in the case of slow moving items, this percentage will be 50%

or more.

(viii) The 'Quota Administering Authority' shall forfeit the EMD/BG, in

case utilisation is 50% or more but less than 75% in case of fast moving

items and 40% or more but less than 50% in case of slow moving items,

proportionate to the shortfall in utilisation.

(ix) If utilisation is less than the above, i.e. 50% in case of fast moving

items and 40% in case of slow moving items, the EMD/BG/LUT/Post

Dated Cheque shall be forfeited in full."

All other terms and conditions of the Notification mentioned in Para 1

above will remain unchanged.
