NOTIFICATION

New Delhi, the 8th October, 2002

G.S.R. 687(E).—In exercise of powers conferred by

section 3 read with section 7 of the Coal Mines Provident

Fund and Miscellaneous Provisions Act, 1948 (46 of 1948),

the Central Government hereby makes the following

Scheme further to amend the Coal Mines Provident Fund

Scheme, 1948, published with the notification of the

Government of India in the Ministry of Labour number PF

15(5) 48, dated the 1 lth December, 1948, namely :—

1. (1) This Scheme may be called the Coal Mines

Provident Fund (Amendment) Scheme, 2002.

It shall come into force on the date of its

publication in the Official Gazette.

2 In the Coal Mines Provident Fund Scheme, 1948

(hereinafter referred to as ihc said Scheme), in paragraph 1,

after sub-paragraph (ii), ihc following shall be inserted,

namely:—

"(iii) It shall apply to all the members of the Central

Coalfields Limited Staff Provident Fund, Darbhanga

House, Ranchi, a non-statutory organization and the

Coal Mines Authority Limited Staff Provident Fund

constituted under the Coal Mines Nationalization

Provident Fund Rules, 1976."

3. In the said Scheme, in paragraph 2, sub-paragraph

(g)(ii) shall be omitted.

4 In the said Scheme, after paragraph 25C, the

following shall be inserted, namely .—

"25D. Membership of the Scheme to employees of

Central Coalfields Limited Staff Provident Fund and Coal

Mines Authority Limited Staff Provident Fund.

(1) Every person who is in the employment of a coal

mine and is a member of the Central Coalfields

Limited Staff Provident Fund and the Coal Mines

Authority Limited Staff Provident Fund shall

become a member of the Fund.

(2) An employee shall pay his contribution at the

rate specified in Table V of paragraph 27 of the

Scheme".

5 In the said Scheme, in paragraph 27A, to sub-

paragraph (1), the following proviso shall be inserted,

namely :—

"Provided that the provisions of this sub-paragraph

shall not apply to the members of the Central

Coalfields Limited Staff Provident Fund who arc

contributing in excess of the above limit on the date

they become members of the Coal Mines Provident

Fund"

6. Transfer of Fund.—In the said Scheme, after

paragraphs 31C, the following shall be inserted,

namely:—

"31D. (1) All moneys and assets standing to the credit

of the Central Coalfields Limited Staff Provident Fund and

the Coal Mines Authority Limited Staff Provident Fund

shall be transferred to the Fund and shall be dealt with by

the Commissioner in accordance with the provisions of the

Scheme.

(2) Any outstanding amount payable or due to be

paid at any time by any employer to the Central Coalfields

Limited StafTProvidcnt Fund and the Coal Mines Authority

Limited Staff Provident Fund shall be paid and be payable,

as the case may be, to the Fund within thirty days from the

date on which the amount become due.

(3) Any default made by an employer under sub-

paragraph (2) shall carry in interest at the rate of two per

cent. Over and above the rate of interest as applicable to

the member of the Scheme on the accumulation of their

Fund."
