C.
PRODUCT UNDER CONSIDERATION AND LIKE ARTICLE
C.1 Views of the Domestic industry
5. Domestic industry has submitted that the present review investigation is a sunset review investigation and the product
involved in the original investigation and the first sunset review investigation as well as in the present sunset review
investigation is Hexamine. The product under consideration in the present sunset review should remain the same as the
¹Hkkx Iµ[k.M 1º
Hkkjr dk jkti=k % vlk/kj.k
35
previous investigations as the present investigation is only review of the anti-dumping duty. It is further argued that
Hexamine produced by the domestic industry and imported from the subject countries are like product. The domestic
industry has submitted that the scope of the product under consideration and like article is not required to be examined
in a sunset review. Hexamine is an organic chemical classified under Chapter 29 of the Customs Tariff Act under
subheading 2921.2910.
C.2 Views of the Importers, Consumers, Exporters and Other Interested Parties
6. None of the producers/exporters, importers, consumers and any other interested party has filed any comments or
submissions with regard to the product under consideration and like articles.
C.3 Examination by the Authority
7. The product under consideration in the present investigation is Hexa Methylene Tetramine, generally known as
Hexamine in market parlance. It is classified under custom subheadings 2921 of Chapter 29 of Schedule I of the
Customs Tariff Act, 1975. The classification is indicative only and is in no way binding on the scope of the present
investigation.
8. Hexa Methylene Tetramine is a white crystalline powder with a sweet metallic taste. In the pure form, it is colourless
and odourless. It crystallizes in rhombic dodecahedrons. Hexa Methylene Tetramine compound is also known as
Ammoform, Methenamine, Cystamine, Cystogen, Urotropine.
9. The goods manufactured by domestic industry and exported from the subject countries are identical and technically and
commercially substitutable and, therefore, the Authority holds that the subject goods produced by the domestic industry
and imported from the subject countries are like articles, as per Rule 2(d) of rules Supra, to the product under
consideration.
D.
SCOPE OF THE DOMESTIC INDUSTRY
D.1 Views of the Domestic industry
10. The application has been jointly filed by M/s. Simalin Chemical Industries Pvt. Ltd., Vadodara and M/s. Kanoria
Chemicals & Industries Ltd., Ankleshwar. There are two more producers of Hexamine in India apart from the
petitioners. The other two producers are M/s. Rockhard and M/s. Newton Engineering. However, to the best of the
petitioners' information, M/s. Rockhard is closed and M/s. Newton is closed most of the time due to financial problems.
Therefore, the production of the petitioners constitutes majority proportion in Indian production. The petition, therefore,
satisfies the requirement of standing under the Rules and petitioner companies constitute domestic industry within the
meaning of the Anti-Dumping Rules.
D.2 Views of the exporter from Saudi Arabia
11. None of the producers/exporters, importers, consumers and any other interested party has filed any comments or
submissions with regard to the scope of the Domestic Industry.
D.3 Examination by the Authority
12. Rule 2(b) under the AD Rules provides as follows:-
"domestic industry" means the domestic producers as a whole engaged in the manufacture of the like article and
any activity connected therewith or those whose collective output of the said article constitutes a major proportion
of the total domestic production of that article except when such producers are related to the exporters or importers
of the alleged dumped article or are themselves importers thereof in such case the term ‘Domestic Industry' may be
construed as referring to the rest of the producers."
13. The application has been jointly filed by M/s. Simalin Chemical Industries Pvt. Ltd., Vadodara and M/s. Kanoria
Chemicals & Industries Ltd., Ankleshwar on behalf of the domestic industry. As per the information available with the
Authority, the applicants account for a major proportion of Indian production of the subject goods and, therefore,
constitute the domestic industry within the meaning of the Rules.
E.
CONFIDENTIALITY
Views of exporters/importers/other opposing interested parties
14. Excessive confidentiality has been claimed with respect to the following:
a.
Raw material prices adopted as per ICIS-LOR has been kept confidential though there is nothing
confidential about such source.
36
THE GAZETTE OF INDIA : EXTRAORDINARY
[PART I—SEC. 1]
b. Domestic industry has computed ex-factory export price by taking arbitrary adjustments towards ocean
freight, insurance, commission, inland freight, port expenses and bank charges, without providing any
evidence for such adjustments.
c.
While domestic industry is justified in claiming confidentiality with respect to its own conversion costs,
however, domestic industry is totally wrong in claiming confidentiality with respect to raw material price
adopted for Methanol and computation of price for Formaldehyde.
d. Financial statements has not been provided.
Views of the Domestic industry
15. The domestic industry has not given any submissions with respect to confidentiality claims of the cooperating exporter.
Examination by the Authority
16. The Authority examined the confidentiality claims of the interested parties and on being satisfied with regard to claim
on confidentiality, the same has been allowed in accordance with the practice of the Authority.
F.
MISCELLANEOUS ISSUES
Views of the exporter from Saudi Arabia
17. DGAD can review the need for continuance of antidumping duty only when there is anti-dumping duty in force. With
Customs Notification No 89/2007-Customs expiring on 24th July 2012 and Customs Notification No. 38/2012-Customs
(ADD) being illegal for reviving an expired notification retrospectively, no anti-dumping exists on the product
concerned for DGAD to review the need for continuance of anti-dumping duty.
18. Imports from subject countries held a market share of only 3% in 2009-10 and 2010-11 and a meagre 5% during POI,
while on the other hand; domestic industry has held 94% market share during 2009-10 and 2010-11 and 87% market
share during POR.
19. During the POI, market share of imports from subject countries increased by a mere 2%, while share of domestic
industry fell by 7%. At the same time, share of imports from other countries increased from 2.9% in 2010-11 to 7.8%
during the POI, which is responsible for decline in share of domestic industry.
Views of the Domestic industry
20. The domestic industry has not made any miscellaneous submissions.
Examination by the Authority
21. As regards the submission that extension of duty Notification after the lapse of duty is illegal and against the legal
provisions, the Authority notes that there is no bar on the Central Government to extend the anti-dumping duty during
the ongoing sunset review investigation. Other issues have been dealt with under the appropriate headings in this
Disclosure Statement.
G.
ASSESSMENT OF DUMPING - METHODOLOGY AND PARAMETERS
Dumping determination
G.1. Views of the Domestic industry
22. The Domestic industry, in brief, has claimed as follows:
a.
No sufficient, reasonable and reliable evidence of published price of Hexamine in the domestic market of the
exporting subject countries could be traced. Under the circumstances, it is considered appropriate to construct cost
of production of Hexamine in the domestic market in the subject countries.
b. From original investigations, it would be seen that the producer in Saudi Arabia did not have sufficient domestic
sales of the product under consideration and the Authority had to resort to the cost of production method to
determine dumping. The petitioners believe that the consumption of Hexamine in the domestic market of Saudi
Arabia continues to be negligible. For this additional reason, it would be appropriate to determine normal value in
Saudi Arabia on the basis of cost of production. In the absence of actual information with regard to actual cost
incurred by the producer in Saudi Arabia, the petitioners have constructed the cost of production on the basis of best
estimates of the cost of production.
c.
One of the raw materials for production of hexamine is formaldehyde. Formaldehyde is produced from methanol.
International prices of methanol are available as per ICIS-LOR. Petitioners have adopted prices of Methanol
prevailing in Asia Pacific (S.W. Asia) as per ICIS-LOR for Saudi Arabia and prices of methanol prevailing in
Europe for Russia. The price of formaldehyde has been constructed on this basis considering all other expenses as
per most efficient petitioner's cost of manufacturing formaldehyde. This constructed price of formaldehyde has been
¹Hkkx Iµ[k.M 1º
Hkkjr dk jkti=k % vlk/kj.k
37
considered for determining the normal value of Hexamine in Saudi Arabia and Russia. All other raw materials,
utility, manufacturing, SGA and interest costs of the most efficient petitioner have been adopted with a reasonable
profit of 5% for calculating the normal value of Hexamine in the subject countries.
G.1. Views of the exporter Chemanol from Saudi Arabia
23. Chemanol has filed its questionnaire response providing all the information and the data submitted would show de-
minimus/negative dumping margin for Chemanol.
24. Chemanol manufactures Hexamine from formaldehyde, which is produced in-house using methanol, which is again
produced captively using natural gas. All captively produced goods are valued at actual cost. The other major raw
material, Ammonia, is purchased from unrelated party in KSA. No input is imported by the company or purchased from
related company.
G.2. Examination by the Authority
25. Under section 9A (1) (c), normal value in relation to an article means:
i. The comparable price, in the ordinary course of trade, for the like article, when meant for consumption in the exporting
country or territory as determined in accordance with the rules made under subsection (6), or
ii. When there are no sales of the like article in the ordinary course of trade in the domestic market of the exporting country
or territory, or when because of the particular market situation or low volume of the sales in the domestic market of the
exporting country or territory, such sales do not permit a proper comparison, the normal value shall be either:
a. comparable representative price of the like article when exported from the exporting country or territory or an
appropriate third country as determined in accordance with the rules made under sub-section (6); or
b. the cost of production of the said article in the country of origin along with reasonable addition for
administrative, selling and general costs, and for profits, as determined in accordance with the rules made under
sub-section (6);
Normal value for Saudi Arabia
Methanol Chemicals Company (Chemanol), Saudi Arabia
26. The Authority sent questionnaires to the known exporters/producers from Saudi Arabia, advising them to provide
information in the form and manner prescribed. The Authority has received only one response to the questionnaire from
Methanol Chemicals Company (Chemanol). The Authority has received no other response to the questionnaire nor has
there been any submission by any other producer/exporter.
27. Chemanol has submitted the information about the domestic sales price, information on exports to India & third
countries along with cost of production in Saudi Arabia and other information as per the questionnaire format prescribed
by the authority. The Authority has noted that domestic sales quantity of Chemanol is less than ***% of the total exports
to India during POI.
28. The exporter has also requested that Normal Value may be determined in accordance with the cost of production of the
product as quantity sold in domestic market does not represent the representative quantity. Therefore, the Authority has
determined the Normal Value in relation to the subject goods in accordance with Section 9A (1) (c) (ii) (b).
29. The Authority has verified the data of the cooperating exporter Chemanol and constructed the normal value based on its
actual cost of production of the subject goods and by adding actual profit margin. The normal value, thus, arrived at is
mentioned in the Dumping Margin Table below.
Normal value for Russia
30. The Authority sent questionnaires to the known exporters/producers from Russia, advising them to provide information
in the form and manner prescribed. The Authority has received no response to the questionnaire.
31. As information about the actual domestic sales price, information on individual country wise exports to third countries
or cost of production in Russia and other information as per the questionnaire have not been furnished by any of the
producers/exporters from Russia and thus could not be verified, the Authority has determined normal value as per the
best available information.
32. The Authority notes that one of the raw materials for production of hexamine is formaldehyde. Formaldehyde is
produced from methanol. The Authority has first constructed the price of formaldehyde on the basis of methanol price
which has been taken from World Trade Atlas (WTA) data of imports in to India from Russia for the POI. While
calculating the same, the adjustments for ocean freight, inland freight, marine insurance, port handling charges, etc. have
38
THE GAZETTE OF INDIA : EXTRAORDINARY
[PART I—SEC. 1]
been taken into account. All other expenses have been taken as per most efficient petitioner's cost of manufacturing
formaldehyde. Similarly, prices of Ammonia have also been taken from WTA data and due adjustments have been
applied. All other expenses like utility, manufacturing overheads, SGA and interest cost etc. of the most efficient
petitioner have been adopted with a reasonable profit of 5% for calculating the normal value of Hexamine in Russia. By
adopting this method, the normal value is determined as US$ ***per MT for Russia.
Export Price for Saudi Arabia
Methanol Chemicals Company (Chemanol), Saudi Arabia
33. Chemanol has exported 419 MT of the subject goods to India during the POI. As per Appendix-2, the company has
claimed the adjustments of commission (US$ ***/MT), inland freight (US$ ***/ MT), overseas freight (US$ ***/ MT),
overseas insurance (US$ ***/MT), bank charges (US$ ***/MT) and credit cost (US$ ***/MT), the total costs before
and after FOB comes to US$ ***/MT. The adjustments from the export price have been allowed, as per actual and as
verified by the Authority. Accordingly, the export price at ex-factory level is determined as US$ ***/MT.
Non Cooperative exporters from Saudi Arabia
34. The Authority notes that no other exporter from Saudi Arabia has submitted exporter’s questionnaire response.
Therefore, the Authority has adopted the lowest representative net export price to India of the cooperating exporters
from Saudi Arabia.
Export Price for Russia
35. The Authority has relied upon the import data of DGCI&S for ascertaining the export price. To determine the ex-factory
export price, adjustment on account of marine insurance @0.5%, ocean freight @70 US$ per MT, commission @ 1%,
inland freight @ 0.5%, port expenses @ 0.5% and bank charges @ 0.2% have been made. After making the
adjustments, the ex-factory export price is determined as US$ ***per MT for Russia.
Dumping Margin
36. On the basis of the normal value and export price so determined at ex-factory level, the dumping margin during the POI
for all exporters/producers from both the subject countries has been determined as shown in the table below.

ASSESSMENT OF INJURY AND EXAMINATION OF CAUSAL LINK
Views of Domestic industry
37. The domestic industry has submitted as follows:
i)
There is continued dumping of the product concerned from the subject countries;
ii)
Dumping of the product under consideration is likely to intensify from the subject countries should the current anti
dumping duty be withdrawn;
iii)
Volume of dumped imports has declined as a result of current anti dumping duties being in force;
iv)
Imports from the subject countries continue to enter the Indian market at dumped prices;
v)
Price undercutting from both the subject countries is significantly positive;
vi)
Performance of the domestic industry in terms of profits, return on investments, cash flow, inventories etc. has
deteriorated in the current period of investigation, whereas the same should have improved after imposition of anti
dumping duties;
vii)
Despite anti dumping duty in force, the profits of the domestic industry have declined. Should the current anti
dumping duties cease, the domestic industry would be forced to sell its product at a price comparable to import
prices. This would mean significant financial losses, further negative return on investment and significant cash
losses;
¹Hkkx Iµ[k.M 1º
Hkkjr dk jkti=k % vlk/kj.k
39
viii)
Domestic industry has been prevented from utilizing its capacities to the fullest extent.
ix)
Thus, it is submitted that there is continued dumping from the subject countries and the consequent injury to the
domestic industry. Further, dumping and consequent injury is likely to continue and intensify further should the
current anti dumping duty cease.
Views of the exporter Chemanol
38. The exporter Chemanol has submitted as follows:
i)
Mere existence of antidumping duty for last 10 years does not mean prevalence of dumping. Since previous
investigation, imports from subject countries have declined by more than half.
ii)
Domestic industry has held 94% market share during 2009-10 and 2010-11 and 87% market share during POI.
iii)
During POI, market share of imports from subject countries increased by a mere 2%, while share of domestic
industry fell by 7%. This shows that it is the imports from other countries, whose share increased from 2.9% in
2010-11 to 7.8% during POI, which is responsible for decline in share of domestic industry.
iv)
Imports from subject countries constituted 8% of domestic production as well as sales during 2008-09, which
came down to mere 3% during 2009-10 and 2010-11 before increasing slightly to around 6% during POR.
However, during POR also, subject imports in relation to domestic production and sales are less than that of the
base year.
v)
As regards the price effect of alleged dumped imports on domestic industry, it is submitted that the basic
premise, that is, the import prices, on which domestic industry is claiming injury itself is wrong.
vi)
There is a difference of 41% between the import quantity for Saudi Arabia reported by domestic industry and
respondent. Import price of Saudi Arabia has been deflated by domestic industry to the tune of 9% than the actual
export price reported by respondent.
vii) Given the wrong import prices adopted by the domestic industry in their petition, the resultant price
underselling/injury margin will also turn out to be faulty.
viii) There does not seem to be any logic in domestic industry’s contention that it will be forced to sell at import
prices of those importing countries, which are commanding only 5% of total domestic demand.
Examination by the Authority
39. Article 3.1 of the ADA and Annexure II of the AD Rules provide for an objective examination of both, (a) the volume
of dumped imports and the effect of the dumped imports on prices in the domestic market for the like products; and (b)
the consequent impact of these imports on domestic producers of such products, with regard to the volume effect of the
dumped imports. The Authority is required to examine whether there has been a significant increase in imports, either in
absolute term or relative to production or consumption. With regard to the price effect of the dumped imports, the
Authority is required to examine whether there has been significant price undercutting by the dumped imports as
compared to the price of the like product in the importing country, or whether the effect of such imports is otherwise to
depress prices to a significant degree, or prevent price increase, which would have otherwise occurred to a significant
degree. Regarding submission by Chemanol on declining market share, difference in import quantity and export price
etc., the Authority notes that the analysis is being done on the basis of their actual data.
40. As regards the impact of the dumped imports on the domestic industry, para (iv) of Annexure-II of the AD Rules states
as follows:
"The examination of the impact of the dumped imports on the domestic industry concerned, shall include an
evaluation of all relevant economic factors and indices having a bearing on the state of the Industry, including
natural and potential decline in sales, profits, output, market share, productivity, return on investments or
utilization of capacity; factors affecting domestic prices, the magnitude of margin of dumping actual and potential
negative effects on cash flow, inventories, employment, wages, growth, ability to raise capital investments."
41. For the purpose of injury analysis the Authority has examined the volume and price effects of dumped imports of the
subject goods on the domestic industry and its effect on the prices and profitability to examine the existence of injury
and causal link between the dumping and injury, if any.
Volume Effect: Volume effect of dumped imports and impact on domestic industry:
42. With regard to the volume of the dumped imports, it has to be examined whether there has been a significant increase in
dumped imports either in absolute terms or relative to production or consumption in India. Annexure II (ii) of the Anti
Dumping Rules provides as under:
"While examining the volume of dumped imports, the said authority shall consider whether there has been
significant increase in the dumped imports either in absolute terms or relative in production or consumption in
India"

The domestic industry submitted the import data of International Business Information Services (IBIS) at the time
of initiation of the investigation but the Authority subsequently obtained the transaction-wise details of imports
from the DGCIS and, thus, the same has been relied upon and analysed. The DGCIS data shows that imports from
the subject countries were 795 MT in 2008-09 and the same declined sharply in 2009-10 but regained to 727 MT in
2010-11. The imports from the subject countries have, however, once again decreased significantly in the period of
investigation and further declined significantly in the post POI. The imports from the subject countries have
decreased not only in absolute terms but also in relation to production and consumption in India between 2010-11
and the POI.
Assessment of demand and market share
45.
For the calculation of the domestic consumption/demand of the product under consideration, the Authority has
added sales volume of the domestic industry and other Indian producers to the total imports into India. It is noted
that domestic industry has determined imports volume and value based on data collected from secondary source,
i.e., International Business Information Services. The domestic industry has earlier submitted transaction wise
import information in their submission. During the investigation, the Authority requested DGCI&S to provide the
said information on transaction to transaction basis, which was received by the Authority. The Authority has relied
upon the data of the DGCIS for the purpose of imports statistics with regard the quantity and price of the subject
goods for the purpose of present Sunset Review.
46.
Demand of the product in the country has been assessed as the sum of the domestic sales of the domestic producers
and imports from all sources.

The Authority notes that the demand for the product has shown the increasing trend during the years 2009-10,
2010-11 and the POI in comparison to the base year. In general, the demand shows an increase of 20% over the
injury period.
Price Effect : Price Effect of the dumped imports on the Domestic Industry
48.
With regard to the effect of the dumped imports on prices, Annexure II (ii) of the Rules states as under:
"With regard to the effect of the dumped imports on prices as referred to in sub-rule (2) of rule 18 the Designated
Authority shall consider whether there has been a significant price undercutting by the dumped imports as
compared with the price of like product in India, or whether the effect of such imports is otherwise to depress prices
to a significant degree or prevent price increase which otherwise would have occurred to a significant degree."
Price Undercutting and Price Underselling
49.
During the investigation, it was examined as to whether there has been a significant price undercutting effect by the
dumped imports as compared with the price of the like product in India, or whether there is likelihood of recurrence
of price effect after revocation of duty. Since, the present investigation is a sunset review investigation, the
Authority is required to consider what would be the extent of price undercutting, if the current duties are allowed to
cease. In this context, the Authority has undertaken an analysis of the net sales realization, non-injurious selling
price of the domestic industry and the landed price of the imports from the subject countries during the period of
investigation.
50.
The impact of dumped imports on the prices of the domestic industry has been examined with reference to the price
undercutting and price underselling. For this purpose, net sales realization (NSR) and the non-injurious price (NIP)
of the domestic industry have been compared with the landed value of imports from the subject countries. The net
sales realization was arrived at by excluding excise duty, rebate, discount and taxes. Landed value of imports has
been calculated by adding 1% landing charge, applicable basic customs duty and cess to the CIF value of the
subject imports. The landed value of imports was compared with net sales realization of the domestic industry so
determined. The trend of undercutting and underselling is given below:

51. The Authority notes that price undercutting and price underselling without ADD are positive in the POI from both the
subject countries. However, the price undercutting and price underselling with ADD are negative in the POI from both
the subject countries. The Authority further notes that the landed price of imports (without ADD) from both the subject
countries during the POI is below the non injurious price of the domestic industry. However, the landed price of imports
with ADD from both the subject countries during the POI is above the non injurious price of the domestic industry.
Price suppression/depression
52. The Authority notes that in a sunset review investigation, the Authority is required to examine whether there was a
significant adverse price effect by the dumped imports as compared with the price of the like product in India, or
whether there is likelihood of significant adverse price effect in case of revocation of anti dumping duty.
53. To examine price suppression and depression effect, the Authority has examined cost of sales and selling price per unit
of the domestic industry during the POI and the injury period. The trends in this regard are given in the table below:

54. From the above, the Authority notes that cost of sales of the domestic industry declined in 2009-10 in comparison to the
base year and increased thereafter. However, in the POI, the cost of sales increased by 29 % as compared to base year.
The Authority further notes that the selling price also shows the same trend. Thus, there is no major indication of price
suppression/depression during the POI.
Economic parameters relating to the domestic industry
55. Annexure II to the Rules requires that the determination of injury shall involve an objective examination of the
consequent impact of these imports on domestic producers of the subject goods. Further Annexure II (iv) of the Rules
lays down as follows:-
"The examination of the impact of the dumped imports on the domestic industry concerned, shall include an evaluation
of all relevant economic factors and indices having a bearing or the state of the industry, including natural and
potential decline in sales, profits, output, market share, productivity, return on investments or utilization of capacity;
factors affecting domestic prices, the magnitude of the margin of dumping; actual and potential negative effects on cash
flow inventories, employment, wages, growth, ability to raise capital investments."

The Domestic Industry increased its capacity to meet the increasing demand of the product in India. The
production of domestic industry has also shown increasing trends in line with the increasing installed capacity
and the demand for the subject goods.
ii.
Sales volumes of the domestic industry have also increased. However, increase in sales is less than increase in
demand. This situation exists despite anti dumping duty in force and enhancement of capacity.
iii.
Capacity utilization of the domestic industry has declined in the POI in comparison to the previous years
despite increase in the demand and existence of anti dumping duty.

Factors affecting prices
67. Consideration of the import prices from the subject countries and other countries, change in the cost structure,
competition in the domestic market, factors other than dumped imports that might be affecting the prices of the domestic
industry in the domestic market show that the landed value (without ADD) of imported subject goods from Russia and Saudi
Arabia is below the selling price of the domestic industry, causing price undercutting in the Indian market. It is also noted
that demand for the subject goods was showing significant increase and this could not have been a factor affecting domestic
prices. Thus, the major factors responsible for the domestic industry prices are the landed prices of the subject goods from
the subject countries and the cost of production of the domestic industry.
Conclusion on injury parameters
68.
In view of the above, it is concluded that:
i)
Price undercutting/underselling (without ADD) from both the subject countries is positive in the POI.
ii) Performance of the domestic industry in terms of profits, return on investments, cash flow, inventories etc. has
declined in the POI.
iii) Despite anti dumping duty in force, the profits of the domestic industry have decreased.
iv) Further, the domestic industry has been prevented from utilizing its capacities to the fullest extent.
¹Hkkx Iµ[k.M 1º
Hkkjr dk jkti=k % vlk/kj.k
45
69.
The above mentioned parameters indicate that performance of the domestic industry after showing improvement in
2009-10, deteriorated from 2010-11 onwards indicating that domestic industry continues to suffer injury but the dumping
margin from Saudi Arabia is negligible and from Russia it is negative despite anti dumping duty in place.
Likelihood of Continuation or Recurrence of Dumping & Injury
70.
The domestic industry in its submissions claimed that the requirement under a sunset review is to examine whether
cessation of anti dumping duty is likely to lead to continuance or recurrence of injury to the domestic industry and, therefore,
any examination based on the factors listed for a threat analysis would be flawed. All factors brought to the notice of the
Authority have been examined to determine whether there is a likelihood of dumping and continuation of injury in the event
of withdrawal of the duty. The Authority notes that currently the subject goods from Russia are not entering in the Indian
market at dumped prices and imports from Saudi Arabia are negligible level despite anti dumping duty in place.
71.
In addition to the examination of continued dumping and injury, likelihood of continuation or recurrence of
dumping and injury to the domestic industry has also been examined by the Authority on the basis of information and
evidence as submitted by the interested parties during the course of the investigations. The Authority examined the
likelihood of continuation or recurrence of dumping and injury considering the parameters relating to the threat of material
injury in terms of Annexure II (vii) of the Rules, and its application on mutatis mutandis basis, which states as under:
"A determination of a threat of material injury shall be based on facts and not merely on allegation, conjecture or
remote possibility. The change in circumstances, which would create a situation in which the dumping would cause
injury, must be clearly foreseen and imminent. In making a determination regarding the existence of a threat of
material injury, the Designated Authority shall consider, inter alia, such factors and;
i) a significant rate of increase of dumped imports into India indicating the likelihood of substantially increased
importation.
ii) Sufficient freely disposable or an imminent, substantial increase in capacity of the exporter indicating the
likelihood of substantially increased dumped exports to Indian market, taking into account the availability of other
export markets to absorb any additional exports.
iii) Whether imports are entering at prices that will have a significant depressing or suppressing effect on domestic
prices, and would likely increase demand for further imports and,
iv) Inventories of the article being investigated."
72.
The domestic industry has provided information regarding capacity, production and demand of the subject goods of
the exporting countries. The responding exporter from Saudi Arabia has also provided relevant information. The Authority,
based on the data presented by the interested parties, has determined whether the exports made by the producers from the
subject countries are at dumped prices. In this regard, the following data / trends have been noted by the Authority:
Excessive Capacity and Export Orientation in the Subject Countries
73.
The Authority notes that the export orientation of the responding producer in Saudi Arabia is more than 100% of
the installed capacity. Considering the installed capacities and production of the subject goods in Saudi Arabia, the Authority
notes that the exporters in Saudi Arabia are already utilising their full capacity (more than 100%) and do not have excessive
capacity. Therefore, the Authority has to now examine as to whether any percentage of the exports by Saudi Arabia to third
countries are likely to be at dumped as well as injurious prices, if diverted to India. As far as Russia is concerned, the
Authority notes that there is no response from any producer/exporter from Russia in the form of questionnaire response
giving country wise details of exports, export price, normal value, cost of production etc. This has also not been provided by
Ministry of Economic Development of the Russian Federation on behalf of the exporters. In the submissions made by
Metafrax, Russia through Ministry of Economic Development of the Russian Federation, Metafrax has informed that their
installed capacity is 35,000 MT per annum and they exported 16,669.50 MT in 2011 to other countries including USA,
Poland, China, Australia and India. From this the Authority concludes that the said exporter in Russia has export orientation
as it exported almost 50% of its capacity. Other information relating to export price, normal value, etc about the
producers/exporters in Russia has neither been provided by the exporters from Russia and Ministry of Economic
Development of the Russian Federation nor by the petitioners. However, the Authority has been able to find the information
regarding the exports from Russia to third countries in the POI from World Trade Atlas data which has been analysed by the
Authority hereunder.
Price attractiveness of the Indian market
74.
As can be seen from the table below, the landed value of imports from Saudi Arabia and Russia in the POI is at a
price which is significantly lower than the selling price of domestic industry in the absence of prevailing anti dumping duty.
The price undercutting during the POI is significantly positive in the case of both the subject countries. However, during the
post POI, landed value of imports from the subject countries has increased substantially, which indicates that price
undercutting in the post POI has declined substantially and export from the subject countries are coming at substantially
higher price as compared to the POI.

The information relating to exports to various countries globally were examined by the Authority country by
country on the basis of questionnaire response filed by the responding producer in Saudi Arabia. Considering these prices at
which exports have been made to various countries, dumping margin and injury margin were determined for these
transactions after due adjustments (from FOB to ex-factory in respect of dumping margin and from FOB to landed price in
case of injury margin). It is seen that the total volume of exports from Saudi Arabia to various countries globally other than
India during the period of investigation was 10,190 MT. All these exports were not at dumped prices. Out of 10,190 MT
exports from Saudi Arabia, 2,574 MT (i.e. 25.51%) were at dumped prices (without adding the ADD) and 7,760 MT (i.e.
76.90%) were at prices below the non injurious price of the domestic industry (without adding the ADD), in the event of
their likely diversion to India. However, after analysis of post POI data, it is seen that total volume of exports from Saudi
Arabia to various countries globally other than India during the post period of investigation has gone down to 10,144 MT.
Out of 10,144 MT exports from Saudi Arabia, 1,101 MT (i.e.,10.86%) were at dumped prices (without adding the ADD) and
4,831 MT (i.e., 46.62%) were at prices below the non injurious price of the domestic industry (without adding the ADD), in
the likely event of their diversion to India.
77.
In respect of Russia, the Authority has been able to find the information regarding the exports from Russia to third
countries from the World Trade Atlas Data. This data in the World Trade Atlas is available for the POI but not for the post
POI. In the absence of any questionnaire response from exporters/producers of the subject goods from Russia, the data for
the POI has been analysed by the Authority hereunder.

It is seen that the total volume of exports from Russia to various countries globally other than India during the
period of investigation was 15,244 MT. Out of 15,244 MT exports from Russia to other countries, 9,643 MT (i.e., 63.26%)
was at dumped prices (without adding the ADD) and 14,671 MT (i.e. 96.24 %) was at prices below the non injurious price of
the domestic industry (without adding the ADD), in the likely event of their diversion to India. Considering the demand of
12,137 MT of the subject goods in India, the volume of exports at dumped price (63.26%) and injurious price (96.24 %)
from Russia to third countries in the POI (2011-12) is considered significant.
79.
From the above, the Authority notes that there are exports from Saudi Arabia and Russia, the subject countries, to
third countries at dumped and injurious price if the existing anti dumping duty is revoked. However, in the case of Saudi
Arabia, the volume of such dumped and injurious exports has fallen in the post POI. No information is available for Russia
for post POI.
Causal link
80.
The submissions made by interested parties in respect of the issue of causal link have been examined. A detailed
examination was made with regards to the issues pertaining to the material injury to the domestic industry and causal link
¹Hkkx Iµ[k.M 1º
Hkkjr dk jkti=k % vlk/kj.k
47
between the material injury to the domestic industry and dumped imports. It is noted that the above facts establish that injury
to the domestic industry has been caused by the dumped imports. Paragraph (v) of Annexure II provides as follows with
regard to Causal Link:
"It must be demonstrated that the dumped imports are, through the effects of dumping, as set forth in paragraphs (ii)
and (iv) above, causing injury to the domestic industry. The demonstration of a causal relationship between the dumped
imports and the injury to the domestic industry shall be based on an examination of relevant evidence before the
Designated Authority. The Designated Authority shall also examine any known factors other than the dumped imports
which at the same time are injuring the domestic industry, and the injury caused by these other factors must not be
attributed to the dumped imports. Factors which may be relevant in this respect include, inter-alia, the volume and
prices of imports not sold at dumping prices, contraction in demand or changes in the patterns of consumption, trade
restrictive practices of and competition between the foreign and domestic producers, developments in technology and
the export performance and the productivity of the domestic industry."
a.
Volume and prices of imports from other sources
81.
It is noted that there are imports from other countries in addition to imports from the subject sources. It is noted that
imports from Iran are attracting anti dumping duty. The volumes of imports from all other countries are either low or the
prices from these countries are high.
b.
Contraction in demand and / or change in pattern of consumption
82.
Demand of the product under consideration has not registered any negative growth. Instead, it has increased and
shown a positive growth. Thus, contraction in demand is not a possible reason which could have contributed to the injury to
the domestic industry. Further, there is no reason to believe that demand is likely to decline.
c.
Trade restrictive practices of and competition between the foreign and domestic producers
83.
The subject goods are freely importable and there are no trade restrictive practices in the domestic market.
Therefore, this factor could not have been reason to cause injury to the domestic industry
d.
Development of technology and export performance
84.
Technology for production of the product has not undergone any change nor are there any likely changes in the
coming future. Developments in technology are, therefore, not a factor of injury.
e.
Export Performance
85.
The petitioning companies export some volumes of the product under consideration. However, information relating
to domestic sales has been taken into consideration for assessment of injury to the extent possible.
f.
Productivity of the Domestic Industry
86.
Productivity of the domestic industry has shown improvement. Therefore, productivity of the domestic industry
cannot be a reason to cause injury.
g.
Performance of other products produced and sold by the domestic industry
87.
The petitioner companies are multi product companies. The information provided for the product under
consideration does not contain any information of other products. Therefore, the performance of other products did not cause
any impact over injury to the domestic industry.
Magnitude of injury and injury margin
88.
The Authority has determined the non-injurious price for the domestic industry on the basis of principles laid down
in the Rules. This non-injurious price of the domestic industry has been compared with the landed values of the subject
imports from the subject countries to determine injury margin. The injury margins (without ADD) have, thus, been worked
out as follows:

INDIAN INDUSTRY'S INTEREST & OTHER ISSUES
89.
The Authority recognizes that the imposition of anti dumping duties might affect the price levels of the product in
India. However, fair competition on the Indian market will not be reduced by the anti dumping measures. On the contrary,
imposition of anti dumping measures would remove the unfair advantages gained by dumping practices, would prevent the
48

decline of the domestic industry and help maintain availability of wider choice to the consumers of subject goods. The
Authority notes that the imposition of anti dumping measures would not restrict imports from subject countries in any way,
and therefore, would not affect the availability of the product to the consumers. The consumers could still maintain two or
even more sources of supply.
90.
The purpose of anti-dumping duties, in general, is to eliminate injury caused to the Domestic Industry by the unfair
trade practices of dumping so as to re-establish a situation of open and fair competition in the Indian market, which is in the
general interest of the country. Imposition of anti-dumping measures would not restrict imports from the subject countries in
any way and, therefore, would not affect the availability of the product to the consumers.

POST DISCLOSURE STATEMENT SUBMISSIONS BY THE INTERESTED PARTIES
J.1
Post Disclosure Statement submissions by the opposing Interested Parties
91.
Following are in brief the post Disclosure Statement submissions made by Methanol Chemicals Company
(Chemanol), Kingdom of Saudi Arabia. No questionnaire response was received from any exporter/producer from Russian
Federation. However, the Trade Representation of the Russian Federation in the Republic of India made certain legal
submissions on behalf of the Russian Federation and the exporters Metafrax and RMF Chemicals S.A. which have been
considered in this Final Findings Notification to the extent found relevant to the investigation. They are in brief as under:
(a) Submissions by Chemanol
i)
DGAD cannot recommend continuance of an expired anti-dumping duty. With Customs Notification No
89/2007-Customs expiring on 24th July 2012 and Customs Notification No 38/2012-Customs(ADD) being
illegal for reviving an expired notification no anti-dumping exists on the product concerned for DGAD to
review the need for continuance of anti-dumping duty.
ii) From the data submitted by the respondent, it would be seen that there is there is no dumping of subject
goods into India from Saudi Arabia.
iii) Imports from subject countries are minimal and not causing injury. Imports from non-subject countries are
the major cause of injury, if any, suffered by the domestic industry. It can be observed that price
underselling is negative for post POI period for imports originating from Saudi Arabia. Therefore, the there
is no likelihood of recurrence of injury due to imports from Saudi Arabia.
iv) There is no likelihood of recurrence of injury to domestic injury due to imports from Saudi Arabia due to
substantial depreciation in Rupee.
v) There exists no likelihood of dumping of subject goods from Saudi Arabia. Whatever likelihood analysis
is done by the DGAD is based upon the higher constructed Normal Value of subject goods
vi) There is neither dumping nor likelihood of dumping into India from Saudi Arabia, any injury to domestic
industry cannot be attributed to such imports.
(b) Submissions by Metafrax and RMF Chemicals S.A.
vii) Metafrax is one of the biggest chemical plants not only in Russia, but in Europe as well. With production
rates of Methanol: over 1 million tpa; Hexamine: 35,000 tpa; Pentaerythritol: 25,000 tpa
viii) Hexamine is exported to more than 35 countries. No country has accused Metafrax of dumping on any
product or imposed anti dumping duty in the last 30 years of foreign business.
ix) Hexamine has been exported to India through Metafrax’s exporting partner, RMF Chemicals S.A. The
exports to India were at an average price of 700-730 US$ pmt on delivery terms FCA (inland & sea freights
are covered by RMF Chemicals SA).
x) In 2011, exports to India were 312 MT out of a total export of 16,669.50 MT; comprising 1.87% of the total
exports. Such small volume can by no means cause any economic injury to the Indian domestic enterprises.
xi) The other Russian supplier, JSC “Shchekinoazot”, has suspended production indefinitely from 2011
onwards. Therefore, exports from Russia to India have declined in the last two years.
xii) Metafrax is receiving several requisitions from Indian trading companies. However, after addition of anti
dumping duty the production cost becomes higher than selling price. It appears from the number of
requisitions that the demand of Hexamine in India is higher than the local supplying capacity. Metafrax is
interested in selling its product in close cooperation with Indian hexamine producers by means of
distribution chain of the domestic companies. Metafrax is interested in meeting representatives of Ministry
of Commerce and Industry to conduct negotiations with them (price undertaking).
xiii) RMF Chemicals SA is approaching Kanoria and Simalin to propose cooperation on behalf of Metafrax under
the conditions mentioned previously.
xiv) Request to withdraw anti dumping duty on Metafrax and consider constructive dialogue with the company.
(c) Submissions by Department of Coordination, Development & Regulation Foreign Trade, Ministry of Economic
Development of the Russian Federation

xv)
During the period from 2008 to 2012, the share of Russia in the Indian market did not exceed 2.7%. This
figure indicates the extremely small presence on the market and cannot have an overwhelming or reducing
effect on prices of Indian manufacturers.
xvi)
Moreover, data on sales prices for Russian commodity on the Indian market indicate its sustainable growth.
The annual price growth as compared with 2009-10 was 13% in 2010-11 and 36% in 2011-12.
xvii) The Indian domestic producers have expanded the production capacity from 8,000 MT in 2002-03 to 12,000
MT in 2011-12.
xviii) Volume of domestic production has been doubled from 6,000MT in 2002-03 to 11,000 MT in 2011-12.
xix)
The sales of the domestic producers on the home market show a positive trend from 9,130 MT in 2008-09 to
10,113 MT in 2011-12 (11% growth).
xx)
The domestic producers are dominating at the market. The share of domestic producers in consumption
shows positive trend. The decline of the share in 2011-12 year was 4.6% relative to 2008-09 and was
insignificant.
xxi)
The domestic producers expanded export deliveries. There was practically no export in 2008-09 and 2009-
10, the domestic producers exported 368 MT in 2010-11 and 962 MT in 2011-12. Export rose up to 63 times
in 2011-12 relative to 2008-09.
xxii) The indicators of capacity workload remained positive. Decrease of capacity workload in 2011-12 to 92%
was caused by increase of production capacity by 2,000 MT relative to 2010-11, while consumption of
commodity at the market increased from 11,118 MT in 2010-11 to 11,638 MT in 2011-12, that is only by
500.
xxiii) The number of employees stable increased from 100 in 2008-09 to 168 in 2011-12.
xxiv) Salary rates are also stably growing from 100 in 2008-09 to 168 in 2011-12.
xxv) Efficiency shows stable evolution – per day growth from 25 in 2008-09 to 30 in 2011-12 and per capita
shows insignificant reduction from 100 in 2008-09 to 95 in 2011-12.
xxvi) Investments in gross fixed asset show stable growth. So, gross fixed asset increased from 100 units in 2008-
09 to 183 units in 2011-12 (83% growth) and net fixed asset increased from 100 units in 2008-09 to 208
units in 2011-12 (108% growth).
xxvii)
Anti dumping duty has been in effect for more than 10 years. For this period the national industry developed
production capacities, increased the production of hexamine and presently occupied predominant position in
the Indian market. Growth in the above parameters testifies the absence of damage to the Indian industry at
the present point in time.
xxviii) Ascertainment of the availability of the threat of the material damage in the future relies on facts but not only
on allegations, suppositions or on the remote possibility. Extension of anti dumping duty is not justified in
view of the absence of the objective grounds, as a probability that the damaging will resume in case of anti
dumping measure is abrogated on the results of the present review.
xxix) The Russian side does not dispute the right of the Indian side to apply measures to protect local market. At
the same time we consider that extremely important aspect is the keeping of balance between aspiration of
national industry to close market from foreign products and maintaining of healthy competition on the basis
of fair measures of market protection. There are no preconditions for worsening situation in industry in case
of cancellation of anti dumping measure concerning imports of hexamine originating in Russia.
xxx) The Russian side hopes that the Ministry of Commerce and Industry of India will carry out an unbiased
analysis of extension of measure for another 5 years and with the above mentioned arguments will take a fair
decision on results of this procedure.
J.2
Post Disclosure Statement submissions by the Domestic Industry
92. Following are in brief the post Disclosure Statement submissions made by the domestic industry:
i)
The disclosure statement establishes that except Methanol Chemicals Company (Chemanol), Saudi Arabia;
none of the foreign producers have cooperated.
ii)
The producers in subject countries have continued to export the product at a price which is below normal
value and non injurious price. Thus, cessation of anti dumping duty shall imply significant imports into India
at a dumped and injurious price.
iii)
It has not been established by the exporters that cessation of anti dumping duty shall not lead to injury to the
domestic industry.
iv)
Price undercutting/underselling from both the subject countries is positive.
v)
Performance of the domestic industry in terms of profits, return on investments, cash flow, inventories etc.
has declined in the POI.
vi)
Despite anti dumping duty in force, the profits of the domestic industry have decreased.
50
THE GAZETTE OF INDIA : EXTRAORDINARY
[PART I—SEC. 1]
vii)
Further, the domestic industry has been prevented from utilizing its capacities to the fullest extent.
viii) If the existing anti dumping duty is revoked, there is likelihood that significant volume of exports from the
subject countries would be exported to India at dumped and injurious prices, as the export price from subject
countries to third countries in respect of significant volumes are at dumped price and injurious price and
these would be diverted to India in the event of cessation of anti dumping duty. This volume will be
substantial in comparison to the demand in India.
ix)
The dumping margin and injury margin both are quite significantly low as determined by the Authority.
x)
The volume of dumped and injurious exports from subject countries in global market are at dumped and
injurious prices.
xi)
The petitioners request the Authority to kindly recommend continuation of fixed form of duty in the present
sunset review, expressed as duty in US$.
xii)
The disclosure statement thus establishes that the present anti dumping duties are required to be extended
further. Petitioners request accordingly.
J.3
Examination by the Authority
93. The following is the examination by the Authority:
i)
As regards the submissions that the current exports from Saudi Arabia to India are not at dumped
prices, it is noted though there is not much dumping in the POI but in a sunset review, the Authority is also
required to determine dumping during current period and likelihood thereof in the event of cessation of anti
dumping duties. No current dumping of the product at present does not imply that the product is unlikely to
be dumped in the event of cessation of anti dumping duties. The facts have clearly established that goods
from Saudi Arabia were exported to third countries at dumping and injurious prices in the POI but the
volume of such exports has fallen in the post POI.
ii)
As regards substantial depreciation in Indian Rupee in the most recent period, the Authority is
required to consider parameters pertaining to the investigation period. Further, temporary changes in
exchange rate in the recent period are insufficient to draw any conclusion particularly when such changes in
exchange rate impacts not only the product price but also the raw material prices.
iii)
It is noted that no questionnaire response in the form and manner prescribed by the Authority has
been filed either by Metafrax or by RMF Chemicals SA. Even though some submissions have been made by
these parties, the Authority notes that response to questionnaire in the form and manner prescribed is
necessary to determine continuation or likelihood of dumping and injury to the domestic industry. In the
absence of questionnaire response in the form and manner prescribed from the producers/ exporters from
Russia, the Authority is constrained to make present determination based on best available information.
iv)
As regards the contention that the Russian producers have not been accused of dumping by
producers in third countries, the Authority notes that the present investigations are required to be conducted in
accordance with the legal provisions. The fact that no other country has taken up an anti dumping case against
Russian exports does not establish no likelihood of dumping and consequent injury to the domestic industry in
case the present anti dumping duty is allowed to cease.
v)
With regard to exports to India and third country information provided by the Russian producers
and adopting the same for the present purposes, the Authority notes that no country wise breakdown of
exports has been given. No information on price of these exports has been provided. The information is not
sufficient to establish that there is no likelihood of dumping and consequent injury in case the present anti
dumping duties are withdrawn. Further, the investigation has established that significant exports of the
product under consideration from Russia are at dumped prices and these exports to India shall cause injury to
the domestic industry, in case the present anti dumping duties are withdrawn.
vi) As regards the contention that Russian exports form a small proportion in total Indian imports, the
Authority notes that imports from various sources are competing inter-se and with the domestic industry. It
has not been established that the exports from Russia are not competing with exports by other suppliers from
third countries. If Russian exports are competing in the Indian market with third countries, the same clearly
establishes likelihood of intensified dumping and injury in the event of cessation of present anti dumping
duties. It is noted in this regard that the responding exporter from Russia has admitted having exported
significant volumes of the product to third countries.
vii) As regards submissions concerning current performance of the domestic industry in respect of various
injury parameters, the Authority notes that the current performance of the domestic industry is relevant only to
decide whether the domestic industry has at present suffered injury as a result of dumped imports in the
current period. Improvement in performance of the domestic industry during current injury period at best
establishes that the domestic industry has at present not suffered injury. This, however, does not establish that
¹Hkkx Iµ[k.M 1º
Hkkjr dk jkti=k % vlk/kj.k
51
injury to the domestic industry is unlikely in the event of cessation of anti dumping duty. The volume and
price of exports to third countries and share of dumped and injurious imports therein is relevant in deciding
whether the domestic industry is likely to suffer injury in case the present anti dumping duty is withdrawn.
K.
CONCLUSION AND RECOMMENDATION
94.
Having regard to the contentions raised, information provided and submissions made by the domestic industry and
the opposing interested parties and facts available before the Authority and on the basis of above analysis including
analysis of likelihood of continuation of dumping and injury, the Authority concludes and recommends that:
i)
As far as Saudi Arabia is concerned, based on the information submitted by Chemanol and verified by
the Authority, it is seen that Chemanol has exported the subject goods to India at dumped prices in the
period of investigation which has caused injury to the domestic industry. The Authority, therefore,
determines the level of duty for cooperative produce/exporter Chemanol, Saudi Arabia based on their
verified data.
ii)
As far as Russia is concerned, the Authority concludes that in the absence of cooperation by the
Russian exporters in the manner prescribed by the Authority and consequent non verification of their
data, likelihood analysis is important. There is clear evidence that if the existing duties are allowed to
be revoked, the volume of dumped and injurious exports of the subject goods from Russia to India are
likely to increase and likely to cause injury to the domestic industry. The volume of such dumped and
injurious exports is significant considering demand for the product under consideration in India. There
is every likelihood of dumping and consequential injury to the domestic industry from Russia if the
existing duties are allowed to be revoked.
iii)
The Authority, thus, in order to remove dumping and injury to the domestic industry from exports of
the subject goods from the subject countries, considers it necessary to recommend continuation of
definitive anti dumping duty on all imports of the subject goods in respect of Russia as levied by the
Central Government vide notification No.89/2007-Customs dated 25th July 2007 and in respect of
Saudi Arabia as modified as per the duty table below.
iv)
Having regard to the lesser duty rule followed by the Authority, the Authority recommends imposition
of definitive anti-dumping duty equal to the lesser of the margin of dumping and the margin of injury,
so as to remove the injury to the domestic industry. Accordingly, definitive antidumping duty as per
amount specified in the table below is recommended to be imposed from the date of the Notification
to be issued by the Central Government, on all imports of the subject goods originating in or exported
from Russia and Saudi Arabia as per the duty table below.
