शत7 के अधीन रहते $ए, जो वह मामले क8 पMरि5 थितय! को O यान म0 रखते $ए और उन कारण! के िलए जो लेखब9 कए

जांए, यथाि5 थित, आयुD तालय या िनदेशालय म0 उसी या तु य पद! क तु जो, यथाि5 थित, के 'ीय उ पाद शु क या

सीमाशु क बोड7 के अधीन कसी अ य आयुD तालय या िनदेशालय के काडर के ह<, धारण करने P यिD तय! के आमेलन ारा भरे

जाने वाले कसी पद का आदेश कर सकेगा।

ण 1 :- जहां ऐसे किन ठ P यिD तय! के संबंध म0, िज ह!ने अपनी अह7क या पा4ता सेवा पूरी कर ली है, ो नित के िलए

िवचार कया जा रहा हो, वहां उनके V ये ठ P यिD तय! के संबंध म0 भी िवचार कया जाएगा परंतु यह तब जब क उसके ारा

क8 गई ऐसी अह7क या पा4ता सेवा, अपेि@त अह7क या पा4ता सेवा के आधे से अिधक से या दो वष7 से, इनम0 से जो भी कम

िव5 तार कया गया है, िनयिमत आधार पर क8 गई सेवा उD त वेतन आयोग क8 िसफाMरश! पर आधाMरत िव5 ताMरत

त 5 थानी Fेड वेतन या वेतनमान पर क8 गई सेवा समझी जाएगी।

जाित या अनुसूिचत जन जाित का नहQ है वहां िवभाग से बाहर का अनुसूिचत जाित या

अनुसूिचत जन जाित का एक समूह ‘क’ अिधकारी िवभागीय ो नित सिमित के सद5 य

के Tप म0 भी सहयोिजत होगा।

(II) संयुD त आयुD तालय अथा7त् दो या अिधक आयुD तालय िजनका सामा य काडर हो;

(i) येक आयुD तालय से V ये ठतम अपर आयुD त (उनम0 से V ये ठतम अिधकारी

अO य@ होगा)

(ii) अपर आयुD त या संयुD त आयुD त, मुE यालय काडर िनयं4ण आयुD तालय

िजसके न हो सकने पर कोई अ य V ये ठतम अपर आयुD त या संयुD त आयुD त

NOTIFICATION

New Delhi, the 10th January, 2014

G. S. R. 12(E).— In exercise of the powers conferred by the proviso to article 309 of the Constitution, and

in supersession of Central Excise and Customs Department Tax Assistant (Group C post) Recruitment Rules, 2003,

except as respects things done or omitted to be done before such supersession, the President hereby makes the

following rules regulating the method of recruitment to the post of Tax Assistant (Group C post) in the Central Excise

and Customs Department under the control of the Central Board of Excise and Customs, Department of Revenue in

the Ministry of Finance, namely:

Short title and commencement. — (1) These rules may be called Central Excise and Customs Department

Tax Assistant, (Group C post) Recruitment Rules, 2014.

(2) They shall come into force on the date of their publication in the Official Gazette.

Number of post, classification, pay band and grade pay or pay scale.— The number of said post, its

classification, pay band and grade pay or pay scale attached thereto, shall be as specified in columns (2) to (4) of the

Schedule annexed to these rules.

Special Provision: (1) Each Commissionerate shall have its own separate cadre, unless other-wise directed by

the Central Board of Excise and Customs,

(2) Notwithstanding anything contained in sub-rule (1) the Chief Commissioner of Central Excise or Chief

Commissioner of Customs having jurisdiction over the concerned Commissionerate may, if he considers to be

necessary or expedient in the public interest so to do and subject to such condition as he may specify having regard to

the circumstances of the case and for the reasons to be recorded in writing, orders any post in the Commissionerate or

Directorate as the case may be, to be filled by absorption of persons holding the same or comparable posts but

belonging to the cadre of another Commissionerate or Directorate or any other office under Central Board of Excise

and Customs, as the case may be.

Method of recruitment, age limit, qualifications, etc. — The method of recruitment, age limits, qualification

and other matters relating to the said post shall be as specified in columns (5) to (13) of the said Schedule.

Disqualification. - No person, —

(a) who has entered into or contracted a marriage with a person having a spouse living or

(b) who having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law

applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any

person from the operation of this rule.

Power to relax. — Where the Central Government is of the opinion that it is necessary or expedient so to do,

it may, by order and for reason to be recorded in writing, relax any of the provisions of these rules with respect to any

class or category of persons.

Saving. — Nothing in these rules shall affect reservation, relaxation of age limit and other concessions

required to be provided for the Scheduled Castes, the Scheduled Tribes, ex-serviceman, and other special categories of

persons in accordance with the orders issued by the Central Government from time to time in this regard.
