MINISTRY OF CIVIL AVIATION

NOTIFICATION

New Delhi, the 17th January, 2014

S.O. 142 (E).—In exercise of the powers conferred by sub-section (3) of Section 8 of the Carriage by Air

Act, 1972 (69 of 1972) and in supersession of the Notification of the Government of India in the late Ministry of

Tourism and Civil Aviation, published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (ii), vide

number S.O. 186(E), dated the 30th March, 1973, except as respects things done or omitted to be done before such

supersession, the Central Government hereby directs that with effect from the date of publication of this notification in

the Official Gazette, the provisions of Section 5 of that Act and the rules contained in the Third Schedule to that Act

shall apply to all carriage by air not being international carriage by air as defined in the said Third Schedule, subject to

the following exceptions, adaptations and modifications, namely :—

1. In the said Act, in the Third Schedule,—

(a)

for the brackets, words, figure and letter “(see Section 4A)” occurring below the heading, the brackets

and words “(As applicable to carriage by air, not being international carriage)” shall be substituted.

(b)

in rule 1,—

(i)

in sub-rule (1) after the word “apply to all” the words “carriage by air, not being” shall be

inserted;

(ii)

sub-rule (2) shall be omitted;

(iii) for sub-rule (3), the following sub-rule shall be substituted, namely.—

“(3) For the purposes of these rules, ‘carriage by air, not being international carriage’ means any

carriage in which according to the agreement of the parties, the place of departure and

destination are both situated in India and there is no agreed stopping place outside India.”

(iv) in sub-rule (4), the portion beginning with the words ‘whether it had been agreed’ and ending

with words ‘within the territory of the same State’ shall be omitted;

(c) for rule 2, the following rule shall be substituted, namely :—

“2. These rules shall not apply—

(i)

to carriage by air in any aircraft belonging to, or exclusively employed for, the purposes of the

armed forces of the Union;

(ii) to carriage by air, performed by the Government, whether Central or State;

(iii) to carriage of mails;

(iv) to carriage by air of persons performed for the purpose of training of such persons;

(v)

to carriage by aircraft belonging to or operated by the Civil Aviation Training Centre of the

Government of India or a Club, whose main purpose is to impart training in flying or gliding,

whether such aircraft is engaged in carrying persons for the purposes of training or otherwise;

(vi) to carriage of cargo or persons performed for the purpose of dropping goods from an aircraft;

(vii) to carriage of employees of the carrier when they are carried for the purpose of performing any

duties assigned to them by the carrier on the aircraft.”

(d)

in rule 3, in sub-rule (1), clause (b) shall be omitted;

(e)

in rule 5, clause (b) shall be omitted.

(f)

in rule 21, in sub-rules (1) and (2) for the words “ one lakh Special Drawing Rights” the words

“rupees twenty lakh” shall be substituted;

(g)

in rule 22,—

(i)

in sub-rule (1), for words “four thousand one hundred and fifty Special Drawing Rights” the

words “rupees eighty thousand” shall be substituted;

(ii)

in sub-rule (2), for the words “one thousand Special Drawing Rights” the words “rupees twenty

thousand” shall be substituted;

(iii) in sub-rule (3) for the words “seventeen Special Drawing Rights” the words “rupees three

hundred fifty” shall be substituted;

(h)

rule 23 shall be omitted;

(i)

for rule 24, the following rule shall be substituted, namely :—

“24 without prejudice to the provisions of rule 25, the units of liability specified in rules 21 and 22

shall be reviewed by the Central Government at the interval of every five years based on cost of

inflation index as notified by the Central Government.”

(j)

rules 33, 34, 46 and 50 shall be omitted.

(k)

the Annexure occurring at the end shall be omitted.
