तक संशोिधत राीय राजमाग अिधिनयम, 1956 (1956 का 48) क धारा 8क (जो इसके आगे ‘‘िनयम’’ के 1प म) उि लिखत है) &ारा

,द त शिA तयE का ,योग करते -ए के सरकार, किथत खंड के िनमाण, अनुरGण, ,बंधन और ,चालन म) िनिहत H यय, िनवेिशत पूंजी

पर ? याज, यथोिचत ,ितलाभ, यातायात क मा$ा तथा ,ािधकरण और रयायतCाही के बीच संप न करार क अविध को I यान म) रखते

िलए तब तक हकदार नह/ होगा जब तक ऐसे यांि$क वाहन से लदा अितभार हटाया नह/ जाता ।

सभी परभाषाएं, यांि$क वाहनE क Uेणी, इनके अनुम य भार, छूट ,ा= त वाहनE क Uेणी, सXवस रोड, वैकि पक lM+d

इ याद किथत िनयमE म) िविनKद* ट परभाषाO के अनु1प हEगी ।

फस क दर) किथत िनयम के िनयम 12 के अनुसरण म) ,योA ताO के सूचनाथ ,दXशत करनी हEगी ।

यांि$क वाहनE से फस क वा% तिवक रािश तािलका-1 म) यथा-उि लिखत आधार वष 2007-08 के िलए ,ित कमी फस क

आधार दर के आधार पर ,भारत होगी और छूटE क गणना ,ािधकरण &ारा क जाएगी । ,ािधकरण &ारा इसे रयायतCाही के माI यम

से , येक अंCेजी और देशी भाषा म) कम से कम एक समाचार प$ म) ,कािशत कराया जाएगा और त प[ चात् किथत िनयमE के िनयम 5

और रयायत करार के उपबंध के अनुसरण म) वाXषक 1प से संशोिधत कराया और ,कािशत कराया जाएगा बशतV क फस के पूववत\

संशोधन क तारीख से 6 महीनE क अविध के भीतर कोई संशोधन नह/ कया जाएगा ।

NOTIFICATION

New Delhi, the 4th February, 2014

S.O. 315(E).— Whereas, by the notification of the Government of India in the erstwhile Ministry of Shipping,

Road Transport and Highways (Department of Road Transport & Highways), number S.O.1096 (E) dated 4^th August

2005 and 2248 (E) dated 28^th September, 2011 issued under section 5 of the National Highways Act, 1956 (48 of 1956),

the Central Government has entrusted National Highway no.11 (Excluding from Km. 42.525 to Km. 341.047)

(UP/Rajasthan Border-Bharartpur-Mahua-Jaipur-Ringus-Sikar)) in the State of Rajasthan to the State Government of

Rajasthan (hereinafter referred to as the “Authority”);

And whereas, the Authority has entered into an Agreement on 29.06.2012 (hereinafter referred to as said

“Agreement”) with M/s. Sikar Bikaner Highway Limited, having its Registered Office at IL & FS Financial Center,

Plot No.C-22, G Block, Bandra-Kurla Complex, Bandra (East) Mumbai-400051, Maharashtra, India, (hereinafter

referred to as “Concessionaire”), the successful bidder for bids submitted on 26.03.2012 for the development of the

Sikar – Bikaner Section from Km. 340.188 of NH-11 to Km. 557.775 of NH-11 via Sikar Bypass and Bikaner Bypass

from km. 553.869 of NH-11 to km. 267.325 of NH-89 on the Sikar – Bikaner Section (Design Length - 237.578 Km.)

of National Highway No. 11 by two/four laning (hereinafter referred to as the “said section”) in the State of Rajasthan

on Design, Build, Finance, Operate and Transfer (DBFOT) basis;

Now, therefore, in exercise of the powers conferred by section 8A of the National Highways Act, 1956 (48 of

1956), read with Rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 and

Amended upto the date of receipt of the bid (herein referred to as the “Rules”), the Central Government, having regard

to the expenditure involved in building, maintenance, management and operation of the said section, interest on the

capital invested, reasonable return, the volume of traffic and the period of the Agreement entered into between the

Authority and the Concessionaire, hereby notifies that there shall be levied and collected fees on mechanical vehicles

for the use of the said section at the rate specified in column (2) of the Table 1 for net road section length of 17.780

Km. for use of the four and more lane sections (hereinafter referred to as “base rate”) , at 60% of the base rate for net

road section length of 179.595 Km. for use of the two lane sections and at 90% of the base rate on three bypasses of

length 40.203 Km. on the Types of Vehicles specified in column (1) of the Table 1 below, and authorizes the said

Concessionaire to collect and retain the fees on and from the date of commercial operation (COD) declared by the

Authority and on getting the completion certificate or the provisional certificate, as the case may be, from the Authority

or publication of this notification in the Official Gazette, whichever is later, till the termination date as specified in the

Agreement;

The rate of monthly pass for a person who owns a mechanical vehicle registered for non-commercial purposes

and resides within a distance of twenty kilometers from the toll plaza is Rs. 215.00 (Rupees Two Hundred

Fifteen only) for the year 2013-14 and is subject to revision every year as per the provisions of the National

Highway fee (determination of Rates and collection) Rules, 2008.

For multiple journeys on the highway section, passes shall be issued at the following rates namely:

Fee for commercial vehicles (excluding vehicles plying under National Permit) registered in the district where

the fee plaza falls shall be 50% of the prescribed rate for that category of vehicle provided no service road or

alternative road is available for use of such commercial vehicles.

Mechanical vehicle which is loaded in excess of permissible load specified for its category under the Rules,

shall be liable to pay fee equal to ten times of the fee applicable to such category of the mechanical vehicles

and shall not be entitled to make use of the highway section unless the excess load has been removed from

such mechanical vehicle.

All definitions, including category of mechanical vehicles, its permissible load, category of exempted vehicles,

service road, alternative road etc. shall be as per definitions specified in the said Rule.

The fee rates shall be displayed for information of the users in accordance with rules 12 of the said Rules.

Based on the base rate of fee per km. for the base year 2007-08 as mentioned in Table-1, the actual amount of

fee to be charged from the mechanical vehicles and the discounts will be calculated by the Authority on the

basis of the completed portion of the length of the project Highway. The same shall be got published by the

Authority in at least one newspaper, each in English and vernacular language through the concessionaire and

thereafter revised annually in accordance with the rule 5 of the said rules and provision of Concession

Agreement and got published, provided that no revision shall be effected with in a period of six months from

the date of the preceding revision of fee.
