(अ).- के ीय सरकार ने कोयला धारक े ( अजन और िवकास), अिधिनयम, 1957 (1957

का 20) (िजसे इसम इसके प चात् उ अिधिनयम कहा गया है) क धारा 4 क उप-धारा (1) के अधीन भारत

सरकार म कोयला मंालय के #ारा जारी क गई अिधसूचना सं%यांक का.आ. 922, तारीख 16 अ&ैल, 2013, जो

भारत के राजप के भाग II, खंड 3, उप-खंड (ii), तारीख 20 अ&ैल, 2013 म &कािशत क गई थी, उस

अिधसूचना से संल* अनुसूची म िविन,द- प.रे क भूिम म िजसका माप 1826.73 हेटर (लगभग) या

4513.85 एकड़ (लगभग) है, कोयले का पूव1ण करने के अपने आशय क सूचना दी थी ;

और कीय सरकार का यह समाधान हो गया है क इस अिधसूचना से संल4 न अनुसूची म िविन,द6 ट उ

भूिम के एक भाग म कोयला अिभ&ा; है ।

अतः, अब, कीय सरकार, उ त अिधिनयम क धारा 7 क उपधारा (1) #ारा &द< शिय= का &योग

करते >ए, इससे संल* अनुसूची म व?णत 1826.73 हेटर (लगभग ) या 4513.85 एकड़ (लगभग) माप क उ

भूिम का सतह अिधकार अजन करने क अपने आशय क सूचना देती है ;

उपायु, िजला धनबाद (झारखEड) के कायालय म या कोयला िनयंक, 1, काउिसल FGीट, कोलकाता–700001

के कायालय म या महा&बंधक, पिIमी झ.रया े, मुनीडीह, िजला धनबाद, झारखEड के कायालय म कया जा

सकता है ।

ट पण 2 : उ त अिधिनयम क धारा 8 के उपबध= क ओर Jयान आकृ- कया जाता है िजसम िनM निलिखत

उपबंध है:–

अजन क बाबत् आेप –

8(1) कोई Nि, जो कसी भूिम म, िजसक बाबत् धारा 7 के अधीन अिधसूचना िनकाली गयी है, िहतबO है,

अिधसूचना के िनकाले जाने से तीस दन के भीतर सMपूण भूिम या उसके कसी भाग या ऐसी भूिम म या उस पर के

कही अिधकार= का अजन कए जाने के बारे म आेप कर सकेगा ।

Fप-ीकरण :

इस धारा के अंतगत यह आपि< नहP मानी जायेगी क कोई Nि कसी भूिम म कोयला उQपादन के

िलए Fवयं खनन संRयाएं करना चाहता है और ऐसी संRयाएं कीय सरकार या कसी अय Nि को

नहP करनी चािहए ।

उप-धारा (1) के अधीन &Qयेक आेप सम अिधकारी को िलिखत Sप म क जायेगी और सम

&ािधकारी, आपि<कता को Fवयं सुने जाने का या िविध Nवसायी #ारा सुनवाई का अवसर देगा और

ऐसी सभी आपि<य= को सुनने के प चात् और ऐसी अित.र जाँच यद हो, करने के प चात्, जो वह

आवयक समझता है वह या तो धारा 7 क उप-धारा (1) के अधीन अिधसूिचत भूिम के या ऐसी भूिम म

या उस पर के अिधकार= के सMबध म एक .रपोट या ऐसी भूिम के िविभT टुकड़= या ऐसी भूिम म या

उस पर के अिधकार= के संबंध म आेप= पर अपनी िसफा.रश= और उसके #ारा क गई कायवाही के

अिभलेख सिहत िविभT .रपोट कीय सरकार को उसके िविन चय के िलए देगा ।

इस धारा के &योजन= के िलए वह Nि कसी भूिम म िहतबO समझा जायेगा जो &ितकर म िहत का

दावा करने का हक़दार होता यद भूिम या कसी ऐसी भूिम म या उस पर के अिधकार इस अिधिनयम के

अधीन अ?जत कर िलए जाते है ।

NOTIFICATION

New Delhi, the 29th October, 2014

S.O.3055(E).—Whereas by the notification of the Government of India in the Ministry of Coal number

S.O. 922, dated the 16th April 2013 issued under sub-section (1) of Section 4 of the Coal Bearing Areas (Acquisition and

Development) Act, 1957 (20 of 1957) (hereinafter referred to as the said Act), and published in the Gazette of India,

Part-II, Section-3, Sub-section (ii), dated the 20th April, 2013, the Central Government gave notice of its intention to

prospect for coal in 1826.73 hectares (approximately) or 4513.85 acres (approximately) of the lands in the locality

specified in the Schedule annexed to that notification;

And whereas, the Central Government is satisfied that coal is obtainable in a part of the said lands prescribed in

the Schedule appended to this notification;

Now, therefore, in exercise of the powers conferred by sub-section (1) of Section 7 of the said Act, the Central

Government hereby gives notice of its intention to acquire the land measuring 1826.73 hectares (approximately) or

4513.85 acres (approximately) and all rights in or over the said land described in the Schedule appended hereto;

Note 2: Attention is hereby invited to the provisions of section 8 of the said Act which provides as follows:—

Objection to acquisition:

8 (1) Any person interested in any land in respect of which a notification under section 7 has been issued, may, within

thirty days of the issue of the notification, object to the acquisition of the whole or any part of the land or any rights in or

over such land.

Explanation:

(1) It shall not be an objection within the meaning of this section for any person to say that he himself desires to

undertake mining operation in the land for the production of coal and that such operations should not be

undertaken by the Central Government or by any other person.

(2) Every objection under sub-section (1) shall be made to the competent authority in writing, and the competent

authority shall give the objector an opportunity of being heard either in person or by a legal practitioner and

shall, after hearing all such objections and after making such further inquiry, if any, as he thinks necessary,

either make a report in respect of the land which has been notified under sub-section (1) of Section 7 or of rights

in or over such land, or make different reports in respect of different parcels of such land or of rights in or over

such land, to the Central Government, containing his recommendations on the objections, together with the

record of the proceedings held by him, the decision of that Government.

(3) For the purposes of this section, a person shall be deemed to be interested in land who would be entitled to

claim an interest in compensation if the land or any rights in or over such land were acquired under this Act.
