29 अ)ैल 2014, .ारा तिमलनाडु रा1य म ए3ूर से मदुरै तक वाया चगलप5टु-पांिडचेरी-ि(ची एलपीजी प7रवहन के िलए इंिडयन ऑयल

कॉप9रेशन िलिमटेड के .ारा एक पाइपलाइन िबछाने के )योजन के िलए उ# अिधसूचना से संल< अनुसूची म िविन=द> भूिम म उपयोग

के अिधकार का अजन के अपने आशय क& घोषणा क& थी।

और उ# आिधसूचना क& )ितयाँ जनता को तारीख 07.05.2014 को उपलFद करा दी गई थG ।

और उ# अिधिनयम क& धारा 6 क& उप-धारा (1) के अनुसरण म सHम )ािधकारी ने केीय सरकार को अपनी 7रपोट दे दी है।

और केीय सरकार का उ# 7रपोट पर िवचार करने के प!ात यह समाधान हो गया है क इस अिधसूचना से संल< अनुसूची म

िविन=द> भूिम म उपयोग के अिधकार का अजन कया जाना चािहए।

अत: अब, केीय सरकार,उ# अिधिनयम क& धारा 6 क& उप-धारा (1) .ारा )दI शि#यJ का )योग करते Kए यह घोषणा

करती है क इस अिधसूचना से संल< अनुसूची म िविन=द> उ# भूिम म पाइपलाइन िबछाने के िलए उपयोग का अिधकार अLजत कया

जाता है।

यह और क केीय सरकार, उ# अिधिनयम क& धारा 6 क& उप-धारा (4) .ारा )दI शि#यJ का )योग करते Kए यह िनदMश

देती है क उ# भूिम के उपयोग का अिधकार इस अिधसूचना के )काशन क& तारीख से केीय सरकार म िनिहत होने क& बजाए, सभी

िवलंगमJ से मु# हो कर इंिडयन ऑयल कॉप9रेशन िलिमटेड म िनिहत होगी।

पैोिलयम और खिनज पाइपलाइन अिधिनयम, 1962 क& धारा 10 के अधीन कसी भी HितपूLत के िलए इंिडयन ऑयल

कॉप9रेशन िलिमटेड पूणतया उIरदायी होगी और पाइपलाइन से स बिधत कसी भी मामले पर केीय सरकार के िवPQ कोई वाद

दावा या कानूनी कायवाही नहG हो सकेगी।

MINISTRY OF PETROLEUM AND NATURAL GAS

NOTIFICATION

New Delhi, the 3rd December, 2015

S.O. 3293(E).—Whereas, by the notification of the Government of India in the Ministry of

Petroleum and Natural Gas number S.O. No. 1198(E) dated: 29-04-2014 issued under sub-section (1) of

section 3 of the Petroleum and Minerals Pipelines (Acquisition of Right of User in Land) Act, 1962 (50 of

1962), (hereinafter referred to as the said Act) the Central Government declared its intention to acquire the

Right of User in the Lands specified in the Schedule appended to that notification for the purpose of laying

pipeline for the transportation of Liquefied Petroleum Gas from Ennore to Madurai (Via) Chengalpattu,

Pondicherry (UT) Trichy in the State of Tamil Nadu, a pipeline should be laid by the Indian Oil Corporation

Limited, for implementing the Ennore – Trichy – Madurai Pipeline Project.

And whereas, copies of the said notifications were made available to the public from 07.05.2014.

And whereas, the Competent Authority in pursuance of sub-section (1) of section 6 of the said Act

has submitted his report to the Central Government;

And whereas, the Central Government, after considering the said report is satisfied that the Right of

User in the Land specified in the Schedule appended to this notification should be acquired;

Now, therefore, in exercise of the powers conferred by sub-section (1) of section 6 of the said Act,

the Central Government hereby declares that the Right of User in the said Land specified in the Schedule

appended to this notification is hereby acquired for laying the pipeline.

And further, in exercise of the powers conferred by sub-section (4) of section 6 of the said Act, the

Central Government hereby directs that the Right of User in the said Land shall instead of vesting in the

Central Government, vest from the date of publication of this declaration, in the Indian Oil Corporation

Limited free from all encumbrances.

Indian Oil Corporation Limited shall be exclusively liable for any compensation in terms of section

10 of the P & M P Act, 1962 and no suit, claim or legal proceeding would lie against the Central Government

on any matter relating to pipeline.
