िनिलिखत ाप, के ीय सरकार, मोटर यान अिधिनयम, 1988 (1988 का 59) क धारा 212 क उपधारा (1) क

अपेानुसार उन सभी ि य क जानकारी के िलए िजनके उससे भािवत होने क संभावना है, कािशत कया जाता है

और यह सूचना दी जाती है क उ ाप िनयम को उस तारीख से, िजसको भारत के उस राजप& िजसम' यह अिधसूचना

कािशत क गई थी, क ितयां जनता को उपल)ध करा दी जाती ह, तीस दन क अविध क समाि- के प.ात् िवचार कया

जाएगा;

इन ाप िनयम पर आेप या सुझाव, यद कोई ह, संयु सिचव (प2रवहन), सड़क प2रवहन और राजमाग4

1. (1) इन िनयम का संि- नाम के ीय मोटर यान (..........संशोधन) िनयम, 2015 है ।

(2) ये िनयम राजप& म' उनके अंितम काशन क तारीख को वृ; हगे ।

2. के ीय मोटर यान िनयम, 1989 (िजसे इसम' इसके प< चात मूल िनयम कहा गया है) के िनयम 62 म',--

(क) उपिनयम (1) म',--

(i) पहले परंतुक म' ''िनरीण अिधकारी'' के प< चात् ''''िनरीण अिधकारी'' श) द रखे जाएंगे ;

(ii) दूसरे परंतुक के प< चात् िन निलिखत परंतुक अंत:? थािपत कया जाएगा, अथा4त् :-

''परंतु यह भी क पूव8B त सारणी म' िविनCदD ट परीण का संचालन रिज? Fीकरण ािधकारी के

काया4लय म' िनरीण अिधकारी से िभ न कसी िनरीण अिधकारी 5ारा कया जाता है तो वह िनरीण

अिधकारी, िजसने परीण का संचालन कया है, उसी दन या अगले काय4 दवस को अपनी िनरीण

2रपोट4 को प 38क म' ......... पोट4ल पर अपलोड करेगा और यद िनरीण ािधकारी 5ारा यान को

अिधिनयम और िनयम के उपबंध का अनुपालन करने वाला पाया जाता है तो वह ? वयं के ह? तार और

मुहर के अधीन िनरीण 2रपोट4 को रिज? Fीकरण ािधकारी को ? पीड पो? ट के माJ यम से रिज? Fीकरण

ािधकरी 5ारा िनरीण 2रपोट4 क तारीख से 15 दन के भीतर उपयुB तता माणप& जारी करने के िलए

भेजेगा और उसक एक ित यान के चालक को दी जाएगी ।'';

(iii) प टीकरण म', ''राL य सरकार 5ारा िनयुB त'' श) द के ? थान पर ''राL य सरकार 5ारा िनयुB त'' श) द रखे

जाएंगे ;

(ख) उपिनयम (2) के प< चात् िन निलिखत उपिनयम अंत:? थािपत कया जाएगा, अथा4त् :--

''(3) रिज? Fीकरण ािधकारी के काया4लय म' िनरीण अिधकारी से िभ न कसी िनरीण अिधकारी 5ारा

जांच कए जाने पर कसी यान के जांच के िलए फस िनयम 81 म' यथा िविनCदD ट होगी ।''

NOTIFICATION

New Delhi, the 8th December, 2015

G.S.R. 951(E).— The following draft rules further to amend the Central Motor Vehicles Rules, 1989, which

the Central Government proposes to make in exercise of the powers conferred by sections 56 and 64 of the Motor

Vehicles Act, 1988 (59 of 1988) is hereby published as required by sub-section (1) of Section 212 of the said Act for

information of all persons likely to be affected thereby; and notice is hereby given that the said draft will be taken into

consideration after expiry of a period of thirty days from the date on which the copies of this notification as published in

the Official Gazette are made available to the public;

Objections or suggestions, if any, may be sent to the Joint Secretary (Transport ), Ministry of Road Transport

and Highways, Transport Bhawan, Parliament Street, New Delhi 110 001;

The objections or suggestions which may be received from any person with respect to the said draft rules within

the period so specified will be taken into consideration by the Central Government.

DRAFT RULES

(1) These rules may be called the Central Motor Vehicles (__Amendment) Rules, 2015.

(2) They shall come into force on the date of their final publication in the Official Gazette.

In the Central Motor Vehicles Rules, 1989 (hereinafter referred as the principal rules), in rule 62,-

(a) in sub-rule (1),-

(i) in the first proviso, for the words “after the Inspecting Officer”, by the words “after an Inspecting

Officer” shall be substituted;

(ii) after the second proviso the following proviso shall be inserted, namely:-

“Provided also that if the tests specified in the above Table are conducted by an Inspecting Officer

other than the Inspecting Officer in the office of the registering authority, the Inspecting Officer who conducted

the tests shall,on the same day or on the following working day, upload his inspection report in Form 38A at the

portal ________________and also send the inspection report signed under his hand and seal to the registering

authority by speed post for issue of certificate of fitness by the registering authority within fifteen days from the

date of the inspection report, if the vehicle is found by the Inspecting Officer to be in compliance with the

provisions of the Act and Rules and a copy shall be given to the driver of the vehicle.”;

(iii) in the Explanation, for the words “appointed by the State Government” the words “appointed by a State

Government” shall be substituted;

(b) after sub-rule (2), the following sub-rule shall be inserted, namely:-

“(3) The fee for testing of a vehicle when tested by an Inspecting Officer other than the Inspecting Officer in the

office of the registering authority shall be as specified in rule 81.”

3. In the principal rules, in rule 81, in the Table, after the serial number 10 and the entries related thereto, the

following serial number and entries shall be inserted, namely:-

Report of inspection conducted on a transport vehicle by an Inspecting Officer other than the

Inspecting Officer in the office of the registering authority

Vehicle bearing registration number ………………………….. has been inspected by the undersigned today

and it is certified that it complies with the provisions of the Motor Vehicles Act, 1988 (59 of 1988) and the Central

Motor Vehicles Rules, 1989 and is fit for issue of a Fitness Certificate by the registering authority.

This report will be uploaded at the portal ________________ and the inspection report signed under my hand

and seal will be sent to the registering authority by speed post either today or on the next working day for processing the

application for issue of certificate of fitness in respect of the vehicle by the registering authority.
