पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय

अिधसूचना

नई ᳰद᭨ली, 9 ᳰदस᭥ बर, 2015

का. आ. 3330(अ).-- िन᳜िलिखत ᮧाᱨप अिधसूचना, िजसे के᭠ᮤीय सरकार, पयाᭅवरण (संरᭃण) अिधिनयम, 1986 (1986 का

29) कᳱ धारा 3 कᳱ उपधारा (2) के खंड (v) और खंड (xiv) तथा उपधारा (3) के साथ पᳯठत उपधारा (1) ᳇ारा ᮧदᱫ शिᲦयᲂ का ᮧयोग

करते ᱟए, जारी करने का ᮧ᭭ताव करती है, पयाᭅवरण (संरᭃण) िनयम, 1986 के िनयम 5 के उपिनयम (3) कᳱ अपेᭃानुसार, जनसाधारण

कᳱ जानकारी के िलए ᮧकािशत कᳱ जाती है, िजनके उससे ᮧभािवत होने कᳱ संभावना है ; और यह सूचना दी जाती है ᳰक उᲦ ᮧाᱨप

अिधसूचना पर, उस तारीख से, िजसको इस अिधसूचना वाले भारत के राजपᮢ कᳱ ᮧितयां जनसाधारण को उपल᭣ध करा दी जाती हᱹ,

साठ ᳰदन कᳱ अविध कᳱ समाि᳙ पर या उसके प᭫ चात् िवचार ᳰकया जाएगा ;

ऐसा कोई ᳞िᲦ, जो ᮧाᱨप अिधसूचना मᱶ अंतᳶव᳥ ᮧ᭭तावᲂ के संबंध मᱶ कोई आᭃेप या सुझाव देने मᱶ िहतब᳍ है, इस ᮧकार

िविन᳸द᳥ अविध के भीतर, के᭠ᮤीय सरकार ᳇ारा िवचार ᳰकए जाने के िलए, आᭃेप या सुझाव सिचव, पयाᭅवरण, वन और जलवायु

पᳯरवतᭅन मंᮢालय, इंᳰदरा पयाᭅवरण भवन, जोर बाग रोड, अलीगंज, नई ᳰद᭨ली-110003 या ई-मेल पते: [email protected] पर िलिखत

ᱨप मᱶ भेज सकेगा ।

ᮧाᱨप अिधसूचना

िहमाचल ᮧदेश के िसरमौर िजले मᱶ अवि᭭थत और अᭃांश 30⁰23’ 13” उ. से 30⁰28’ 31” उ. और देशा᭠तर 77⁰ 27’ 40” पू. से 77⁰

33’ 55” पू. के बीच संबलबारा व᭠यजीव अभयार᭛य 27.88 वगᭅ ᳰकलोमीटर ᭃेᮢ मᱶ फैला ᱟआ है तथा संबलबारा व᭠यजीव अभयार᭛य

हᳯरयाणा रा᭔य के कालेसर रा᳦ीय ᭃेᮢ के संरिᭃत ᭃेᮢ कᳱ सीमाᲐ से भी जुड़ा है |

और, वन᭭ पित-जात और ᮧािण-जात इस अभयार᭛ य कᳱ स᭥ प᭠ न जैिवक मह᭜ ता को ᮧितिनिध᭜ व करते हᱹ तथा वन᭭ पित-जात और

ᮧािण-जात पि᳟मी िहमालय, पंजाब के मैदानᲂ और ऊपरी गांगेय मैदानᲂ से समानताएं दशाᭅते हᱹ तथा इस ᮧकार इस ᭃेᮢ मᱶ कोई ᭭ थािनक

ᮧजाित नहᱭ है । तथािप, यह पि᳟मी िहमालय कᳱ अनेक ᭭ थािनक ᮧजाितयᲂ को आ᮰य देता है तथा इस ᭃेᮢ मᱶ अनेक ᭭ तनपायी ᮧजाितयां

जैसे ᳰक लैपडᭅ, जंगल कैट, जैकाल, िहमालयी पाम िसवेट, येलो ᮣोटेड माटᱷन, सांबर, ᭭ पॉᳯटड डीयर, बा᳼कग डीयर, ᭣ लू बुल, गोरल,

वाइ᭨ ड िपग, कॉमन लंगूर, रहे सुस मकाक और पा᭍ यूᭅपाइन पायी जाती हᱹ तथा ऐितहािसक अिभलेखᲂ से इस ᭃेᮢ मᱶ हािथयᲂ कᳱ

उपि᭭थित का पता चलता है तथा यह माना जाता है ᳰक यमुना बैराज पर हाईडल चैनल ᮧवासी मागᭅ को बािधत करता है (भारतीय

व᭠ यजीव सं᭭ थान, 2003) तथा इस ᭃेᮢ मᱶ ᮧाय: हािथयᲂ के आवागमन कᳱ सूचना है तथा यह अभयार᭛ य पिᭃयᲂ से स᭥ प᭠ न है तथा इस

ᭃेᮢ मᱶ पिᭃयᲂ कᳱ 100 से अिधक ᮧजाितयां पाई जाती हᱹ तथा इस ᭃेᮢ मᱶ िशवािलकᲂ के ᮧᱨपी पᭃी पाए जाते हᱹ जैसे ᳰक मैरर ओᳯरअल,

ऑरᱶज हेडेड ᮣश और यह िहमालयᲂ मᱶ पाए जाने वाले पिᭃयᲂ, जैसे ᳰक कलीज फᳱजᱶट, रेडस् टाटᭅस कᳱ अनेक ᮧजाितयᲂ और वाल ᮓᳱपर कᳱ

तथा उन पिᭃयᲂ कᳱ उपि᭭थित दशाᭅता है जो सामा᭠ यतया नम पणᭅपाती वनᲂ जैसे ᳰक एमेरा᭨ ड डव मᱶ पाये जाते हᱹ तथा इस ᭃेᮢ मᱶ

िततिलयᲂ कᳱ लगभग 70 ᮧजाितयां पाई जाती हᱹ । इस ᭃेᮢ मᱶ टाइगर बीटल ᮧजाितयां भी बड़ी सं᭎ या मᱶ पाई जाती हᱹ ।

और, संबलबारा व᭠यजीव अभयार᭛य के चारᲂ ओर के ᭃेᮢ को, िजसका िव᭭तार और सीमाएं इस अिधसूचना के पैरा 1 मᱶ िविन᳸द᳥

हᱹ, पयाᭅवरण कᳱ दृि᳥ से पाᳯरि᭭थितक संवेदी जोन के ᱨप मᱶ सुरिᭃत और संरिᭃत करना तथा उᲦ पाᳯरि᭭थितक संवेदी जोन मᱶ उ᳒ोगᲂ

या उ᳒ोगᲂ के वगᲃ के ᮧचालन तथा ᮧसं᭭करण करने को ᮧितिष᳍ करना आव᭫यक है;

अतः, अब, के᭠ᮤीय सरकार, पयाᭅवरण (संरᭃण) िनयम, 1986 के िनयम 5 के उपिनयम (3) के साथ पᳯठत पयाᭅवरण (संरᭃण)

अिधिनयम, 1986 (1986 का 29) कᳱ धारा 3 कᳱ उपधारा (1), उपधारा (2) के खंड (v) और खंड (xiv) और उप धारा (3) ᳇ारा ᮧदᱫ

शिᲦयᲂ का ᮧयोग करते ᱟए, िहमाचल ᮧदेश रा᭔य के संबलबारा व᭠यजीव अभयार᭛य कᳱ सीमा के चारᲂ ओर 1.5 ᳰकलोमीटर तक के ᭃेᮢ

को संबलबारा व᭠यजीव अभयार᭛य पाᳯरि᭭ थितकᳱय संवेदी जोन (िजसे इसमᱶ इसके प᭫ चात् पाᳯरि᭭ थितक संवेदी जोन कहा गया है) के ᱨप

मᱶ अिधसूिचत करती है, िजसका िववरण िन᳜ानुसार है, अथाᭅत् :--

1. पाᳯरि᭭थितक संवेदी जोन का िव᭭तार और उसकᳱ सीमाएं--(1) पाᳯरि᭭थितकᳱय संवेदी जोन संबलबारा व᭠यजीव अभयार᭛य कᳱ

सीमा के 1.5 ᳰकलोमीटर चारᲂ ओर 31.24 वगᭅ ᳰकलोमीटर ᭃेᮢ मᱶ फैला ᱟआ है ।

(2) संबलबारा व᭠यजीव अभयार᭛य के सीमा का िववरण और इसका पाᳯरि᭭थितक संवेदी जोन जीपीएस िनदᱷशांकᲂ के संदभᭅ मᱶ

उपाबंध I पर उपाब᳍ है और पाᳯरि᭭थितकᳱय संवेदी जोन मᱶ आने वाले ᮕामᲂ कᳱ सूची उपाबंध II पर उपाब᳍ है ।

(3) पाᳯरि᭭थितकᳱय संवेदी जोन सीमा का िववरण और इसके अᭃांश और देशा᭠तर के साथ-साथ उपाबंध III पर उपाब᳍ है ।

2. पाᳯरि᭭थितक संवेदी जोन के िलए आंचिलक महायोजना – (1) रा᭔य सरकार, पाᳯरि᭭ थितक संवेदी जोन के ᮧयोजनᲂ के िलए

राजपᮢ मᱶ इस अिधसूचना के अंितम ᮧकाशन कᳱ तारीख से दो वषᭅ कᳱ अविध के भीतर, ᭭थानीय ᳞िᲦयᲂ के परामशᭅ से, और इस

अिधसूचना मᱶ ᳰदए गए अनुबंधᲂ का पालन करते ᱟए आंचिलक महायोजना तैयार करेगी ।

(2) आचंिलक महायोजना का अनुमोदन रा᭔य सरकार मᱶ सᭃम ᮧािधकारी ᳇ारा ᳰकया जाएगा |

(3) पाᳯरि᭭थितकᳱय संवेदी जोन के िलए आंचिलक महायोजना रा᭔य सरकार ᳇ारा ऐसी रीित जैसा इस अिधसूचना मᱶ िविन᳸द᳥ है

और सुसंगत के᭠ᮤीय और रा᭔य िविधयᲂ तथा के᭠ᮤीय सरकार ᳇ारा जारी मागᭅदशᭅक िस᳍ांतᲂ, यᳰद कोई हो, के अनुᱨप भी तैयार कᳱ

जाएगी |

(4) आंचिलक महायोजना सभी संब᳍ रा᭔य िव भागᲂ के साथ परामशᭅ से पयाᭅवरणीय और पाᳯरि᭭थितकᳱय िवचारणᲂ को उसमᱶ

एकᳱकृत करने के िलए तैयार कᳱ जाएगी, अथाᭅत्:--

(i)

पयाᭅवरण ;

(ii)

वन ;

(iii)

नगर िवकास ;

(iv)

पयᭅटन ;

(v)

नगरपािलक ;

(vi)

राज᭭ व ;

(vii)

कृिष ;

(viii)

िहमाचल ᮧदेश रा᭔ य ᮧदूषण िनयंᮢण बोडᭅ,

(ix)

ᳲसचाई; और

(x)

लोक िनमाᭅण िवभाग

(5) आंचिलक महायोजना अनुमोᳰदत िव᳒मान भू-उपयोग, अवसंरचना᭜ मक और ᳰᮓयाकलापᲂ पर कोई िनबᲈधन अिधरोिपत

नहᱭ करेगी जब तक ᳰक इस अिधसूचना मᱶ इस ᮧकार िविन᳸द᳥ न हो और आंचिलक महायोजना सभी अवसंरचना और कायᭅकलापᲂ मᱶ

दᭃता और पाᳯर ि᭭ थ ितकᳱय अनुकूलता का संव᳍ᭅन करेगी ।

(6) आंचिलक महायोजना मᱶ अना᭒छाᳰदत ᭃेᮢᲂ के जीणᲃ᳍ार, िव᳒मान जल िनकायᲂ के संरᭃण, आवाह ᭃेᮢᲂ के ᮧबंधन, जल-

संभरᲂ के ᮧबंधन, भूतल जल के ᮧबंधन, मृदा और नमी संरᭃण, ᭭थानीय समुदायᲂ कᳱ आव᭫यकताᲐ तथा पाᳯरि᭭थितकᳱ और पयाᭅवरण से

संबंिधत ऐसे अ᭠य पहलूᲐ, िजन पर ᭟यान देना आव᭫यक है, के िलए उपबंध हᲂगे ।

(7) आंचिलक महायोजना सभी िव᳒मान पूजा ᭭ थलᲂ, ᮕामᲂ और नगरीय बंदोब᭭तᲂ, वनᲂ के ᮧकार और ᳰक᭭ मᲂ, कृिष ᭃेᮢᲂ,

ऊपजाऊ भूिम, हᳯरत ᭃेᮢ जैसे उ᳒ान और उसी ᮧकार के ᭭ थान, उ᳒ान कृिष ᭃेᮢ, आ᳸कडᲂ, झीलᲂ और अ᭠य जल िनकायᲂ का अ᭤यकंन

करेगी ।

(8) आंचिलक महायोजना पाᳯरि᭭थितक संवेदी जोन मᱶ िवकास को िविनयिमत करेगी िजससे ᳰक ᭭ थानीय समुदायᲂ के

पाᳯरि᭭थितकज᭠य िवकास और जीिवका को सुिनि᭫ चत ᳰकया जा सके ।

(9) िहमाचल ᮧदेश रा᭔य सरकार अपनी अिधकाᳯरता के भीतर अलग से आंचिलक महायोजना तैयार करेगी |

3. रा᭔य सरकार ᳇ारा ᳰकए जाने वाले उपाय-- रा᭔य सरकार इस अिधसूचना के उपबंधᲂ को ᮧभावी करने के िलए िन᳜िलिखत उपाय

करेगी, अथाᭅत् :-

(1) भू-उपयोग - पाᳯरि᭭ थितक संवेदी जोन मᱶ वनᲂ, उ᳒ान-कृिष ᭃेᮢᲂ, कृिष ᭃेᮢᲂ आमोद-ᮧमोद के ᮧयोजन के िलए िचि᭠हत ᳰकए

गए पाकᲄ और खुले ᭭थानᲂ का वािणि᭔यक और औ᳒ोिगक संब᳍ िवकास ᳰᮓयाकलापᲂ के िलए उपयोग या संपᳯरवतᭅन नहᱭ होगा :

परंतु पाᳯरि᭭थितक संवेदी जोन के भीतर कृिष भूिम का संपᳯरवतᭅन के अधीन मानीटरी सिमित कᳱ िसफाᳯरश पर और रा᭔य सरकार

के पूवᭅ अनुमोदन से, ᭭थानीय िनवािसयᲂ कᳱ आवासीय जᱨरतᲂ को पूरा करने के िलए और पैरा 4 कᳱ सारणी के ᭭तंभ (2) के अधीन मद

सं. 10, 21, 32, 33 और 34 के सामने सूचीब᳍ ᳰᮓयाकलापᲂ को पूरा करने के िलए अनु᭄ात हᲂगे, अथाᭅत् :-

(i) पाᳯरि᭭थितकᳱय अनुकूल पयᭅटन ᳰᮓयाकलापᲂ के िलए पयᭅटकᲂ के अ᭭थायी आवासन के िलए पाᳯरि᭭थितकᳱय अनुकूल आरामगाह

जैसे टᱶट, लकड़ी के मकान आᳰद ;

(iiii) िव᳒मान सड़कᲂ को चौड़ा करना और नई सड़कᲂ का सि᳖माᭅण

(iii) ᮧदूषण उ᭜प᳖ न करने वाले लघु उ᳒ोग;

(iv) वषाᭅ जल संचय; और

(v) कुटीर उ᳒ोग, िजसके अंतगᭅत ᮕामीण उ᳒ोग, सुिवधा भंडार और ᭭थानीय सुिवधाएं हᱹ |

परंतु यह और ᳰक रा᭔य सरकार के पूवᭅ अनुमोदन और संिव धान के अनु᭒ छेद 244 तथा त᭜समय ᮧवृᱫ िविध के उपबंधᲂ के अनुपालन

के िबना, िजसके अंतगᭅत अनुसूिचत जनजाित और अ᭠य परंपरागत वन िनवासी (वन अिधकारᲂ कᳱ मा᭠यता) अिधिनयम, 2006 (2007

का 2) भी है, वािणि᭔यक या उ᳒ोग िवकास ᳰᮓयाकलापᲂ के िलए जनजातीय भूिम का उपयोग अनु᭄ात नहᱭ होगा :

परंतु यह और भी ᳰक पाᳯरि᭭ थितक संवेदी जोन के भीतर भू-अिभलेखᲂ मᱶ उपसंजात कोई ᮢुᳯट मानीटरी सिमित के िवचार ᮧा᳙

करने के प᳟ात् रा᭔य सरकार ᳇ारा ᮧ᭜येक मामले मᱶ एक बार संशोिधत होगी और उᲦ ᮢुᳯट के संशोधन कᳱ भारत सरकार के पयाᭅवरण,

वन और जलवायु पᳯरवतᭅन मंᮢालय को सूचना देनी होगी ।

परंतु यह और भी ᳰक उपयुᭅᲦ ᮢुᳯट का संशोधन मᱶ इस उप पैरा के अधीन यथा उपबंिधत के िसवाय ᳰकसी भी दशा मᱶ भू-उपयोग का

पᳯरवतᭅन सि᭥मिलत नहᱭ होगा ।

परंतु यह और भी ᳰक िजससे हᳯरत ᭃेᮢ मᱶ जैसे वन ᭃेᮢ, कृिष ᭃेᮢ आᳰद मᱶ कोई पाᳯरणािमक कटौती नहᱭ होगी और अनᮧयु᭍ त या

अनु᭜पादक कृिष ᭃेᮢᲂ मᱶ पुन: वनीकरण करने के ᮧयास ᳰकए जाएंगे ।

(2) ᮧाकृितक ᮲ोत – आंचिलक महायोजना मᱶ सभी ᮧाकृितक ᮲ोतᲂ कᳱ पहचान कᳱ जाएगी और उनके संरᭃण और पुननᭅवीकरण के

िलए योजना सि᭥मिलत होगी और रा᭔य सरकार ᳇ारा ऐसे ᭃेᮢᲂ पर या उनके िनकट िवकास ᳰᮓयाकलाप ᮧितिष᳍ करने के िलए ऐसी

रीित से मागᭅिनदᱷश तैयार ᳰकए जाएंगे ।

(3) पयᭅटन – (क) पाᳯरि᭭थितक संवेदी जोन के भीतर पयᭅटन संबंधी ᳰᮓयाकलाप, जो आंचिलक महायोजना का भाग ᱨप मᱶ

िन᳜िलिखत ᱨप मᱶ हᲂगे ।

(ख) पयᭅटन महायोजना, पयᭅटन िवभाग ᳇ारा वन और पयाᭅवरण िवभाग, रा᭔य सरकार के परामशᭅ से तैयार होगी ।

(ग) पयᭅटन संबंधी ᳰᮓयाकलाप िन᭥ निलिखत के अधीन िविनयिमत हᲂगे, अथाᭅत् :-

(i) पाᳯरि᭭थितक संवेदी जोन के भीतर सभी नए पयᭅटन ᳰᮓयाकलापᲂ या िव᳒मान पयᭅटन ᳰᮓयाकलापᲂ का िव᭭तार भारत

सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय के मागᭅदशᭅक िस᳍ांतᲂ के ᳇ारा तथा पाᳯरि᭭थितक पयᭅटन रा᭬ ᮝीय

᭪ याᮖ संरᭃण ᮧािधकरण, ᳇ारा जारी (समय-समय पर यथा संशोिधत) मागᭅदशᭅक िस᳍ांतᲂ के अनुसार, पाᳯरि᭭थितक पयᭅटन,

पाᳯरि᭭थितक िशᭃा और पाᳯरि᭭थितक िवकास को मह᭜व देते ᱟए पाᳯरि᭭थितक संवेदी जोन कᳱ वहन ᭃमता के अ᭟ययन पर

आधाᳯरत होगा;

(ii) पाᳯरि᭭थितक अनुकूल पयᭅटन ᳰᮓयाकलापᲂ से संबंिधत पयᭅटकᲂ के अ᭭थायी अिधभोग के िलए आवास के िसवाए संबलबारा

व᭠यजीव अभयार᭛य कᳱ सीमा के एक ᳰकलोमीटर के भीतर नए होटलᲂ और िव᮰ाम ᭭थलᲂ के िनमाᭅण कᳱ अनु᭄ा नहᱭ दी

जाएगी;

(iii) आंचिलक महायोजना का अनुमोदन ᳰकए जाने तक, पयᭅटन के िलए िवकास और िव᳒मान पयᭅटन ᳰᮓयाकलापᲂ के िव᭭तार

को वा᭭तिवक ᭭थल िविन᳸द᳥ संवीᭃा तथा मानीटरी सिमित कᳱ िसफाᳯरश पर आधाᳯरत संबंिधत िविनयामक ᮧािधकाᳯरयᲂ

᳇ारा अनु᭄ात ᳰकया होगा ।

(4) नैसᳶगक िवरासत -- पाᳯरि᭭थितक संवेदी जोन मᱶ मह᭜वपूणᭅ नैसᳶगक िवरासत के सभी ᭭थलᲂ जैसे सभी जीन कोश आरिᭃत

ᭃेᮢ, शैल िवरचनाएं, जल ᮧपातᲂ, झरनᲂ, घाटी मागᲄ, उपवनᲂ, गुफाएं, ᭭थलᲂ, ᮪मण, अ᳡रोहण, ᮧपातो आᳰद कᳱ पहचान कᳱ जाएगी

और उ᭠हᱶ संरिᭃत ᳰकया जाएगा तथा उनकᳱ सुरᭃा और संरᭃा के िलए इस अिधसूचना के ᮧकाशन कᳱ तारीख से छह मास के भीतर,

उपयुᲦ योजना बनाएगी और ऐसी योजना जोनल मा᭭टर ᭡लान का भाग होगा ।

(5) मानव िनᳶमत िवरासत ᭭ थल - पाᳯरि᭭ थितक संवेदी जोन मᱶ भवनᲂ, संरचनाᲐ, िश᭨प-त᭝य, ऐितहािसक, कला᭜मक और

सां᭭कृितक मह᭜व के ᭃेᮢᲂ कᳱ पहचान करनी होगी और इस अिधसूचना के ᮧकाशन कᳱ तारीख से छह माह के भीतर उनके संरᭃण कᳱ

योजनाएं तैयार करनी होगी तथा आंचिलक महायोजना मᱶ सि᭥मिलत कᳱ जाएगी ।

(6) ᭟ विन ᮧदूषण -- पाᳯरि᭭थितक संवेदी जोन मᱶ ᭟ विन ᮧदूषण के िनयंᮢण के िलए रा᭔ य सरकार या िहमाचल ᮧदेश रा᭔य ᮧदूषण

िनयंᮢण बोडᭅ का पयाᭅवरण िवभाग वायु (ᮧदूषण िनवारण और िनयंᮢण) अिधिनयम, 1981 (1981 का 14) और उसके अधीन बनाए गए

िनयमᲂ के उपबंधᲂ के अनुसरण मᱶ मागᭅदशᭅक िस᳍ांत और िविनयम तैयार करेगा ।

(7) वायु ᮧदूषण -- पाᳯरि᭭थितक संवेदी जोन मᱶ, वायु ᮧदूषण के िनयंᮢण के िलए रा᭔य सरकार या िहमालचल ᮧदेश रा᭔य

ᮧदूषण िनयंᮢण बोडᭅ का पयाᭅवरण िवभाग वायु (ᮧदूषण िनवारण और िनयंᮢण) अिधिनयम, 1981 (1981 का 14) और उसके अधीन

बनाए गए िनयमᲂ के उपबंधᲂ के अनुसरण मᱶ मागᭅदशᭅक िस᳍ांत और िविनयम तैयार करेगा ।

(8) बिह᮲ाव का िन᭭सारण -- पाᳯरि᭭थितक संवेदी जोन मᱶ उपचाᳯरत बिह᮲ाव का िन᭭सारण जल (ᮧदूषण िनवारण तथा िनयंᮢण)

अिधिनयम, 1974 (1974 का 6) और उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनुसार होगा ।

(9) ठोस अपिश᳥ -- ठोस अपिश᳥ᲂ का िनपटान िन᳜िलिखत ᱨप मᱶ होगा -

(i)

पाᳯरि᭭थितक संवेदी जोन मᱶ ठोस अपिश᳥ᲂ का िनपटान भारत सरकार के त᭜कालीन पयाᭅवरण और वन मंᮢालय कᳱ

समय-समय पर यथा संशोिधत अिधसूचना सं. का.आ. 908(अ), तारीख 25 िसतंबर, 2000 नगरपािलक ठोस

अपिश᳥ (ᮧबंध और हथालन) िनयम, 2000 के उपबंधᲂ के अनुसार ᳰकया जाएगा ;

(ii)

᭭थानीय ᮧािधकरण जैव िन᳜ीकरणीय और अजैव िन᳜ीकरणीय संघटकᲂ मᱶ ठोस अपिश᳥ᲂ के संपृथᲥन के िलए

योजनाएं तैयार करᱶगे ;

(iii)

जैव िन᳜ीकरणीय सामᮕी को अिधमानतः खाद बनाकर या कृिम खेती के मा᭟यम से पुनःचᳰᮓत ᳰकया जाएगा ;

अकाबᭅिनक सामᮕी का िनपटान पाᳯरि᭭थितक संवेदी जोन के बाहर पहचान ᳰकए गए ᭭ थल पर ᳰकसी पयाᭅवरणीय

᭭वीकृत रीित मᱶ होगा और पाᳯरि᭭थितक संवेदी जोन मᱶ ठोस अपिश᭬ टᲂ को जलाना या भ᭬ मीकरण अनु᭄ात नहᱭ

होगा ।

(10) जैव िचᳰक᭜ सीय अपिश᭬ ट- पाᳯरि᭭थितक संवेदी जोन मᱶ जैव िचᳰक᭜सीय अपिश᳥ᲂ का िनपटान भारत सरकार के त᭜कालीन

᳇ारा पयाᭅवरण और वन जलवायु पᳯरवतᭅन मंᮢालय कᳱ समय-समय पर यथासंशोिधत अिधसूचना सं.का.आ.630 (अ) तारीख 20 जुलाई,

1998 ᳇ारा ᮧकािशत जैव िचᳰक᭜सीय अपिश᳥ (ᮧबंध और हथालन) िनयम, 1998 के उपबंधᲂ के अनुसार ᳰकया जाएगा ।

(11) यानीय पᳯरवहन - पᳯरवहन कᳱ यानीय गितिविध ᮧाणीयᲂ के अनुकूल रीित से िविनयिमत कᳱ जाएगी और इस संबंध मᱶ

आंचिलक महायोजना मᱶ िवशेष उपबंध सि᭥मिलत ᳰकए जाएंगे और जब तक ऐसी आंचिलक महायोजना रा᭔य सरकार के सᭃम ᮧािधकारी

᳇ारा तैयार और अनुमोᳰदत नहᱭ ᳰकया जाता है | मानीटरी सिमित सुंसगत अिधिनयमᲂ और उसके अधीन बनाए गए िनयमᲂ िनयमᲂ और

िविनयमᲂ के अधीन यानीय गितिविधयᲂ के अनुपालन को मानीटर करेगी ।

(12) औ᳒ोिगक इकाईयां –

(क) ᮧ᭭तािवत पाᳯरि᭭थितक संवेदी जोन के भीतर नए का᳧ आधाᳯरत उ᳒ोगᲂ के ᳰकसी ᭭थापन कᳱ अनु᭄ा िविध के अनुसार

᭭थािपत िव᳒मान का᳧ आधाᳯरत उ᳒ोगᲂ के िसवाए नहᱭ दी जाएगी |

(ख) ᮧ᭭तािवत पाᳯरि᭭थितक संवेदी जोन के भीतर जल, वायु, मृदा, ᭟विन ᮧदूषण काᳯरत करने वाले ᳰकसी नए उ᳒ोग के ᳰकसी

ᮧ᭭थापन कᳱ अनु᭄ा नहᱭ दी जाएगी |

4. पाᳯरि᭭थितक संवेदी जोन मᱶ ᮧितिष᳍ और िविनयिमत ᳰᮓयाकलापᲂ कᳱ सूची - पाᳯरि᭭थितक संवेदी जोन मᱶ सभी ᳰᮓयाकलाप

अिधभोग के िलए आवास के िसवाय संरिᭃत ᭃेᮢ कᳱ सीमा से 1 ᳰकलोमीटर

के भीतर ᳰकसी नए वािणि᭔यक होटलᲂ और िव᮰ाम᭭थलᲂ कᳱ अनु᭄ा नहᱭ दी

जाएगी; लेᳰकन संरिᭃत ᭃेᮢ कᳱ सीमा के एक ᳰकलोमीटर से

पाᳯरि᭭थतकᳱय संवेदी जोन के िव᭭तार तक होटल और िव᮰ाम᭭थलᲂ कᳱ

᭭थापना आंचिलक महायोजना के अनुसार कᳱ जा सकती है |

11.

सि᳖माᭅण ᳰᮓयाकलाप।

(क) संरिᭃत ᭃेᮢ कᳱ सीमा से एक ᳰकलोमीटर के भीतर ᳰकसी भी ᮧकार के

नए वािणि᭔यक सि᳖माᭅण कᳱ अनु᭄ा नहᱭ दी जाएगी |

पर᭠तु ᭭थानीय लोगᲂ को पैरा 3 के उप पैरा (1) मᱶ सूचीब᳍ ᳰᮓयाकलापᲂ

सिहत अपने ᳯरहायशी उपयोग के िलए अपनी भूिम पर सि᳖माᭅण करने कᳱ

अनु᭄ा दी जाएगी |

पर᭠तु यह और ᳰक ᮧदूषण न काᳯरत करने वाले लघु उ᳒ोगᲂ से संबंिधत

सि᳖माᭅण ᳰᮓयाकलापᲂ को िविनयिमत ᳰकया जाएगा और लागू िनयमᲂ और

िविनयमᲂ, यᳰद कोई हᱹ, के अनुसार सᭃम ᮧािधकारी से पूवᭅ अनु᭄ा के साथ

᭠यूनतम तक रखा जाएगा |

इसके अितᳯरᲦ पाᳯरि᭭थितक संवेदी के जोन के िव᭭तार तक से एक

ᳰकलोमीटर परे वा᭭तिवक ᭭थानीय आव᭫यकताᲐ के िलए सि᳖माᭅण कᳱ

अनु᭄ा दी जाएगी और अ᭠य सि᳖माᭅण ᳰᮓयाकलापᲂ का िविनयमन आंचिलक

महायोजना के अनुसार ᳰकया जाएगा |

12.

खाई का मैदान।

नए खाई खोदने के मैदान का ᭭थािपत ᳰकया जाना ᮧितिष᳍ है | पुराने खाई

के मैदान लागू िविधयᲂ के अधीन िविनयिमत ᳰकए जाएं |

13.

ᮧाकृितक जल िनकायᲂ या सतही ᭃेᮢ मᱶ

उपचाᳯरत बिह᮲ाᭅव ठोस अपिश᳥ का

िन᭭सारण।

लागू िविधयᲂ के अधीन िविनयिमत हᲂगे |

14.

वायु और यानीय ᮧदूषण।

(ग) आरिᭃत वनᲂ और संरिᭃत वनᲂ कᳱ दशा मᱶ कायᭅ योजना अनुदेशᲂ का

पालन ᳰकया जाएगा |

ᮧवासी चरने वाले।

लागू िविधयᲂ के अधीन और आंचिलक महायोजना के अनुसार िविनयिमत

हᲂगे ।

19.

िव᳒मान ᭭थापन।

लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।

िव᳒ुत लाइनᲂ को खड़ा करना।

भूिमतगत केबलᲂ का ᮧो᳖यन | पाᳯरि᭭थितक संवेदी जोन के भीतर से गुजरने

वाली सभी िव᳒मान िव᳒ुत लाइनᲂ को आंचिलक महायोजना के अधीन

िविहत समय सीमा के भीतर पयाᭅ᳙ ᱨप से पृथ᭍कृत ᳰकया जाएगा |

21.

िव᳒मान सड़कᲂ को चौड़ा करना और उ᭠हᱶ

सुदृढ करना तथा नई सड़कᲂ का संिनमाᭅण।

उिचत पयाᭅवरण समाघात िनधाᭅरण और ᭠ यूिनकरण उपाय यथा लागू

अनुसार हᲂगे ।

22.

होटलᲂ और लॉज के िव᳒मान पᳯरसरᲂ मᱶ

बाड लगाना।

लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।

(क)व᭠यजीव के मुᲦ संचरण को अनु᭄ात करने के िलए, पाᳯरि᭭थितक संवेदी

जोन के भीतर होटलᲂ या अ᭠य वािणि᭔यक ᭭थापनᲂ कᳱ कटीली तार से

उनकᳱ संपिᱫयᲂ को नहᱭ घेरा जाएगा और कोई घेरा 1 मीटर से ऊंचा

नहᱭ होगा |

(ख)इस अनुबंध का पालन न करने वाले ᳰकसी िव᳒मान घेरे को आंचिलक

महायोजना मᱶ समय-सीमा के उपा᭠तᳯरत ᳰकया जाएगा |

23.

कृिष ᮧणालीयᲂ मᱶ आमूल पᳯरवतᭅन।

लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।

24.

ᮧाकृितक जल संसाधनᲂ का वािणि᭔यक

उपयोग िजसमᱶ भूिमगत जल संचयन भी

िवदेशी ᮧजाितयᲂ को लाना।

लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।

27.

साइनबोडᭅ और होᳺडग।

लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।

28.

पहाड़ी ढालᲂ और नदी तटᲂ का संरᭃण।

1 से 10 से अिधक ढलानᲂ वाली पहाड़ी पर और ᳰकसी नदी और ᮧाकृितक

नालᲂ के ᳰकनारᲂ से 100 मीटर तक आंचिलक महायोजना के अधीन अनु᭄ात

के िसवाए कोई सि᳖माᭅण ᳰᮓयाकलाप नहᱭ ᳰकया जाएगा |

᭡लाि᭭टक बैग का उपयोग।

जैिवक खेती।

सᳰᮓ य ᱨप से बढावा ᳰदया जाए ।

सभी गितिविधयᲂ के िलए हᳯरत ᮧौ᳒ोिगकᳱ

पाᳯरि᭭ थितक संवेदी जोन से गैर ᮧदूषण, गैर पᳯरसंकटमय, लघु और सेवा

उ᳒ोग, कृिष उ᳒ान, कृिष या कृिष आधाᳯरत देशीय माल से औ᳒ोिगक

उ᭜पादᲂ का उ᭜पादन उ᳒ोग और जो पयाᭅवरण पर कोई िवपरीत ᮧभाव नहᱭ

डालते हᱹ ।

34.

वषाᭅ जल संचयन ।

सᳰᮓ य ᱨप से बढावा ᳰदया जाए ।

35.

कुटीर उ᳒ोगᲂ िजसके अंतगᭅत ᮕामीण

कारीगर आᳰद भी हᱹ।

5. मानीटरी सिमित- (1) कᱶᮤीय सरकार, पाᳯरि᭭थितक संवेदी जोन के ᮧभावी मानीटरी के िलए एक मानीटरी सिमित का गठन

करेगी जो िन᳜िलिखत से िमलकर बनेगी, अथाᭅत् :-

(i)

(ii)

िहमाचल ᮧदेश सरकार ᳇ारा नामिन᳸द᭬ ट ᮧ᭜येक मामले मᱶ एक वषᭅ कᳱ अविध के िलए

पाᳯरि᭭ थितक और पयाᭅवरण ᭃेᮢ का एक िवशेष᭄ -

(iii)

पयाᭅवरण के ᭃेᮢ मᱶ कायᭅ करने वाले गैर सरकारी संगठनᲂ (िजसके अंतगᭅत िवरासत

(3) पाᳯरि᭭थितक संवेदी जोन मᱶ भारत सरकार के त᭜ कालीन पयाᭅवरण और वन मंᮢालय कᳱ अिधसूचना सं. का.आ. 1533(अ)

तारीख 14 िसतंबर, 2006 कᳱ अनुसूची मᱶ के अधीन सि᭥मिलत ᳰᮓयाकलापᲂ और इस अिधसूचना के पैरा 4 के अधीन ᮧितिष᳍

गितिविधयᲂ के िसवाय आने वाले ऐसे ᳰᮓयाकलापᲂ कᳱ दशा मᱶ वा᭭तिवक िविन᳸द᳥ ᭭थलीय दशाᲐ पर आधाᳯरत और मानीटरी सिमित

᳇ारा संवीᭃा कᳱ जाएगी और उᲦ अिधसूचना के उपबंधᲂ के अधीन पूवᭅ पयाᭅवरण िनकासी के िलए के᭠ᮤीय सरकार के पयाᭅवरण, वन और

जलवायु पᳯरवतᭅन मंᮢालय को िन᳸द᳥ कᳱ जाएगी ।

(4) इस अिधसूचना के पैरा 4 के अधीन यथा िविन᳸द᳥ ᮧितिष᳍ ᳰᮓयाकलापᲂ के िसवाय, भारत सरकार के पयाᭅवरण और वन

मंᮢालय कᳱ अिधसूचना सं᭎यांक का.आ. 1533(अ) तारीख 14 िसतंबर, 2006 कᳱ अिधसूचना के अनुसूची के अधीन ऐसे ᳰᮓयाकलापᲂ,

िज᭠हᱶ सि᭥मिलत नहᱭ ᳰकया गया है, परंतु पाᳯरि᭭थितक संवेदी जोन मᱶ आते हᱹ, ऐसे ᳰᮓयाकलापᲂ कᳱ वा᭭तिवक िविन᳸द᳥ ᭭थलीय दशाᲐ

पर आधाᳯरत मानीटरी सिमित ᳇ारा संवीᭃा कᳱ जाएगी और उसे संब᳍ िविनयामक ᮧािधकरणᲂ को िन᳸द᳥ ᳰकया जाएगा ।

(5) मानीटरी सिमित का सद᭭य-सिचव या संब᳍ कल᭍टर या संरिᭃत ᭃेᮢ का ᮧभारी ऐसे ᳞िᲦ के िवᱨ᳍, जो इस अिधसूचना के

ᳰकसी उपबंध का उ᭨लंघन करता है, पयाᭅवरण (संरᭃण) अिधिनयम, 1986 कᳱ धारा 19 (1986 का 29) के अधीन पᳯरवाद फाइल करने

के िलए सᭃम होगा ।

(6) मानीटरी सिमित मु᳎ᲂ के आधार पर अपेᭃाᲐ पर िनभᭅर रहते ᱟए संब᳍ िवभागᲂ के ᮧितिनिधयᲂ या िवशेष᭄ᲂ, औ᳒ोिगक

संगमᲂ या संब᳍ पणधाᳯरयᲂ के ᮧितिनिधयᲂ को अपने िवचार-िवमशᭅ मᱶ सहायता के िलए आमंिᮢत कर सकेगी ।

(7) मानीटरी सिमित ᮧ᭜येक वषᭅ कᳱ 31 माचᭅ तक कᳱ अपनी वाᳶषक कारᭅवाई ᳯरपोटᭅ रा᭔य के मु᭎य व᭠य जीव वाडᭅन को उपाबंध

III मᱶ उपबंिधत ᱨप िवधान के अनुसार उ᭍ त वषᭅ के 30 जून तक ᮧ᭭तुत करेगी ।

(8) के᭠ᮤीय सरकार का पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय मानीटरी सिमित को अपने कृ᭜यᲂ के ᮧभावी िनवᭅहन के िलए

समय-समय पर ऐसे िनदेश दे सकेगा, जो वह ठीक समझे ।

MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE

NOTIFICATION

New Delhi, the 9th December, 2015

S.O.3330(E).—The following draft of the notification, which the Central Government proposes to issue in

exercise of the powers conferred by sub-section (1), read with clause (v) and clause (xiv) of sub-section (2) and sub-

section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) is hereby published, as required under

sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, for the information of the public likely to be affected

thereby; and notice is hereby given that the said draft notification shall be taken into consideration on or after the expiry

of a period of sixty days from the date on which copies of the Gazette containing this notification are made available to

the public;

Any person interested in making any objections or suggestions on the proposals contained in the draft

notification may forward the same in writing, for consideration of the Central Government within the period so specified

Draft Notification

WHEREAS, the Simbalbara Wildlife Sanctuary located in Sirmour District, Himachal Pradesh and lying

between latitude 30⁰23’ 13” N to 30⁰28’ 31” N, longitude 77⁰ 27’ 40” E to 77⁰ 33’ 55” E is spread over an area of

27.88 sq. km and the Simbalbara Wildlife Sanctuary also shares boundaries with protected areas of Kalesar National

Park in the state of Haryana.

AND WHEREAS, the flora and fauna represent rich biological significance of this Sanctuary and the flora and

fauna shows affinities to Western Himalayas, Punjab plains and Upper gangetic plains and there are no endemic Species

in this area as such. However it supports many species which are endemic to Western Himalayas and a number of

mammals species like Leopard, Jungle cat, Jackal, Himalayan palm civet, Yellow throated marten, sambar, spotted deer,

Barking deer, Blue bull, Goral, Wild pig, Common Iangur, Rhesus macaque and porcupine are found in the area and

historical records indicate the presence of elephants in this area and it is believed that the hydel channel at Yamuna

barrage cut off migratory routes (WII, 2003) and elephants are reported to come occasionally to this area and the

sanctuary is rich in bird life. More than 100 species of birds are found in this area and the area has birds that are typical

of Shiwaliks such as marror oriol, orange headed thrush and also shows presence of birds found in Himalayas such as

kaleej pheasant several spp. of redstarts and wall creeper and it also shows presence of birds that arc normally found in

moist deciduous forests such as forests such as emerald dove and around 70 species of butterflies arc found in this area.

Large number or Tiger beetle spp. are also found in this zone;

AND WHEREAS, it is necessary to conserve and protect the area the extent and boundaries of which is

specified in paragraph 1 of this notification around the Simbalbara Wildlife Sanctuary as Eco-sensitive Zone from

ecological and environmental point of view and to prohibit industries or class of industry and their operations and

processes in the said Eco-sensitive Zone;

NOW THEREFORE, in exercise of the power conferred by sub section(1) and clauses (v) and (xiv) of sub-

section (2) and sub-section (3) of section 3 of the Environment (Protection) Act 1986 (29 of 1986) read with sub-rule (3)

of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area with an extent

upto 1.5 kilo meter meters around the boundary of Simbalbara Wildlife Sanctuary in the State of Himachal Pradesh as

the Simbalbara Wildlife Sanctuary Eco-sensitive Zone (herein after referred to as the Eco-sensitive Zone) details of

which are as under, namely:-

Extent and Boundaries of Eco-sensitive Zone.- (1) The Eco-Sensitive Zone shall be of 31.24 sq. kms with an

extent upto 1.5 kilometre around the boundary of Simbalbara Wildlife Sanctuary.

(2)

The boundary details of Simbalbara Wildlife Sanctuary and its eco-sensitive zone in terms of GPS coordinates

are given in Annexure-I and the list of villages are falling in Eco-sensitive Zone are given at Annexure-II.

(3)

The map of the Eco-sensitive Zone along with boundary details and latitudes and longitudes is appended as

Annexure-III.

Zonal Master Plan for the Eco-sensitive Zone.- (1) The State Government shall, for the purpose of the Eco-

sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of final

notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this

notification.

(2)

The said Plan shall be approved by the Competent Authority in the State Government.

(3)

The said Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such a manner as

is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued

by the Central Government, if any.

The said Master Plan shall be prepared in consultation with all concerned State Departments, namely:-

(i) Environment;

(ii) Forest;

(iii) Urban Development;

(iv) Tourism;

(v) Municipal;

(vi) Revenue;

(vii) Agriculture;

(ix) Himachal Pradesh State Pollution Control Board;

(x) Irrigation; and

(xi) Public Works Department ;

for integrating environmental and ecological considerations into it.

The said Plan shall not impose any restriction on the approved existing land use, infrastructure and activities,

unless so specified in this notification and the said Master Plan shall factor in improvement of all infrastructure and

activities to be more efficient and eco-friendly.

(6)

The said Master plan shall provide for restoration of denuded areas, conservation of existing water bodies,

management of catchment areas, watershed management, groundwater management, soil and moisture conservation,

needs of local community and such other aspects of the ecology and environment that needs attention.

(7)

The said Master Plan shall demarcate all the existing worshipping places, village and urban settlements, types

and kinds of forests, tribal areas, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural

areas, orchards, lakes and other water bodies.

(8)

The said Master Plan shall regulate development in Eco-sensitive Zone so as to ensure Eco-friendly

development for livelihood security of local communities.

Measures to be taken by State Government.-The State Government shall take the following measures for

giving effect to the provisions of this notification, namely:-

(1)

Land use.- Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational

purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or industrial related

development activities:

Provided that the conversion of agricultural lands within the Eco-sensitive Zone may be permitted on the

recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet the

residential needs of local residents, and for the activities listed against serial numbers 10,21,32,33,34 in column (2) of

the Table in paragraph 4, namely:-

(i)

Eco-friendly cottages for temporary occupation of tourists, such as tents, wooden houses, etc. for Eco-friendly

tourism activities,

(ii)

Widening and strengthening of existing roads and construction of new roads.

(iii)

Small scale industries not causing pollution,

(iv)

Rainwater harvesting, and

(v)

Cottage industries including village industries, convenience stores and local amenities:

Provided further that no use of tribal land shall be permitted for commercial and industrial development

activities without the prior approval of the State Government and without compliance of the provisions of Article 244 of

the Constitution of India or the law for the time being in force, including the Scheduled Tribes and other Traditional

Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):

Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by

the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said

error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:

Provided also that the above correction of error shall not include change of land use in any case except as

provided under this sub-paragraph;

Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural

area and efforts shall be made to reforest the unused or unproductive agricultural areas.

(2)

Natural springs.-The catchment areas of all natural springs shall be identified and plans for their conservation

and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State

Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such

areas.

(3)

Tourism.- (a) The activity relating to tourism within the Eco-sensitive Zone shall be as per Tourism Master

Plan, which shall form part of the Zonal Master Plan.

(b) The Tourism Master Plan shall be prepared by Department of Tourism, in consultation with Department of Forests

and Environment of the State Government.

(i)

all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in

accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate

Change and the Eco-tourism guidelines issued by National Tiger Conservation Authority with emphasis on Eco-tourism,

Eco-education and Eco-development and based on carrying capacity study of the Eco-sensitive Zone;

(ii)

new construction of hotels and resorts shall not be permitted within one kilometer from the boundary of the

Simbalbara Wildlife Sanctuary except for accommodation for temporary occupation of tourists related to Eco-friendly

tourism activities:

Provided that beyond the distance of one kilometre from the boundary of the protected area till the extent of the

Eco-sensitive Zone, the establishment of new hotels and resorts shall be permitted only in pre-defined and designated

areas for Eco-tourism facilities as per tourism Master Plan;

(iii)

till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities

shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation

of the Monitoring Committee.

(4)

Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool

reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be

identified and preserved and plan shall be drawn up for their protection and conservation, within six months from the

date of publication of this notification and such plan shall form part of the Zonal Master Plan.

(5)

Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural,

aesthetic, and cultural significance shall be indentified in the Eco-sensitive Zone and plans for their conservation shall be

prepared within six months from the date of publication of this notification and incorporated in the Zonal Master Plan.

(6)

Noise pollution.- The Environment Department of the State Government or Himachal Pradesh State Pollution

Control Board shall draw up guidelines and regulations for the control of noise pollution in the Eco-sensitive Zone in

accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981(14 of 1981) and the rules

made there under.

Air pollution.- The Environment Department of the State Government or Himachal Pradesh State Pollution

Control Board shall draw up guidelines and regulations for the control of air pollution in the Eco-sensitive Zone in

accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules

made there under.

(8)

Discharge of effluents.- The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the

provisions of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974)and the rules made there under.

(9)

Solid wastes. - Disposal of solid wastes shall be as under:-

(i) the solid waste disposal in Eco-sensitive Zone shall be carried out as per the provisions of the Municipal Solid Waste

(Management and Handling) Rules, 2000 published by the Government of India in the erstwhile Ministry of

Environment and Forests vide notification number S.O. 908 (E), dated the 25^th September, 2000 as amended from time

to time;

(ii) the local authorities shall draw up plans for the segregation of solid wastes into biodegradable and non-bio-

degradable components;

(iii) the bio-degradable material shall be recycled preferably through composting or vermiculture;

(iv) The inorganic material may be disposed in an environmentally acceptable manner at site(s) identified outside the

Eco-sensitive Zone and no burning or incineration of solid wastes shall be permitted in the Eco-sensitive Zone.

Bio-medical waste.- The Bio-medical waste disposal in the Eco-sensitive Zone shall be carried out as per the

provisions of the Bio-Medical Waste (Management and Handling) Rules, 1998 published by the Government of India in

the erstwhile Ministry of Environment and Forests vide Notification number S.O. 630(E), dated the 20^th July, 1998 as

amended from time to time.

(11)

Vehicular traffic. - The vehicular movement of traffic shall be regulated in a habitat friendly manner and

specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal master

plan is prepared and approved by the competent authority in the State Government, Monitoring Committee shall monitor

compliance of vehicular movement under the relevant Acts and the rules and regulations made there under.

(12)

Industrial Units.-(a) No establishment of new wood based Industries within the proposed Eco-sensitive zone

shall be permitted except the existing wood based Industries set up as per the Law.

(b) No establishment of any new Industry causing water, air, soil, noise pollution within the proposed Eco-

sensitive zone shall be permitted.

4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.- All activities in the Eco-sensitive

Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made

thereunder, and be regulated in the manner specified in the Table below, namely:-

within one kilometer of the boundary of the Protected Area

except for accommodation for temporary occupation of

tourists related to Eco-friendly tourism activities.

However, beyond one kilometer and upto the extent of the

Eco-sensitive Zone all new tourism activities or expansion

of existing activities would in conformity with the Tourism

Master Plan

11.

Construction activities.

a) No new commercial construction of any kind shall be

permitted within one kilometer from the boundary of the

Protected Area:

Provided that, local people shall be permitted to

undertake construction in their land for their residential use

including the activities listed in sub-paragraph (1) of

paragraph 3:

Provided further that the construction activity

related to small scale industries not causing pollution shall

be regulated and kept at the minimum, with the prior

permission from the Competent Authority as per

applicable rules and regulations, if any.

Further, beyond one kilometer upto the extent of

Eco-Sensitive Zone construction for bone fide local needs

shall be allowed and other construction activities shall be

regulated as per Zonal Master Plan.

12.

Trenching ground.

Establishing of new trenching ground is prohibited. Old

trenching grounds are to be regulated under applicable

laws.

13.

Discharge of treated effluents and solid

waste in natural water bodies or land area.

Regulated under applicable laws.

14.

Air and Vehicular Pollution.

Regulated under applicable laws.

15.

Noise pollution.

Regulated under applicable laws.

16.

Extraction of ground water.

17.

Felling of trees.

(a) There shall be no felling of trees in the forest or

5. Monitoring Committee.- (1) The Central Government hereby constitutes a Monitoring Committee for effective

monitoring of the Eco-sensitive Zone, which shall comprise of the following members, namely:-

i) Deputy Commissioner, Sirmour

ii)

An expert in the area of ecology and environment

to be nominated by the Government of Himachal Pradesh

for a term of one year in each case.

iii) One representatives of Non-governmental Organization

(working in the field of environment including heritage

The Monitoring Committee shall monitor the compliance of the provisions of this Notification.

(3)

The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile

Ministry of Environment and Forest number S.O. 1533(E), dated the 14^th September, 2006, and are falling in

the Eco-sensitive Zone, except the prohibited activities as specified in column(3) of the Table under paragraph

4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and

referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior

environmental clearances under the provisions of the said Notification.

The activities that are not covered in the Schedule to the notification of the Government of India in the

erstwhile Ministry of Environment and Forest number S.O. 1533(E), dated the 14^th September, 2006 butare

falling in the Eco-sensitive Zone, except the prohibited activities as specified in column (3) of the Table under

paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific

conditions and referred to the concerned Regulatory Authorities.

The Member-Secretary of the Monitoring Committee or the concerned Collector or the concerned park in-

charge shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986

against any person who contravenes the provisions of this notification.

(6)

The Monitoring Committee may invite representatives or experts from concerned Departments,

representatives from Industry Associations or concerned stakeholders to assist in its deliberations depending

on the requirements on issue to issue basis.

(7)

The Monitoring Committee shall submit the annual action taken report of its activities as on 31^st March of

every year by 30^th June of that year to the Chief Wildlife Warden of the State as per pro forma given in

Annexure IV.

(8)

The Central Government in the Ministry of Environment, Forest and Climate Change may give such

directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.

The Central government and State Government may specify additional measures, if any, for giving effect to

provisional of this notification.

7. The provisions of this Notification are subject to the orders, if any, passed, or to be passed, by the Hon’ble

Supreme Court of India or the High Court or National Green Tribunal (NGT).
