सा.का.िन. 966(अ).—कᱶᮤीय सरकार, िवदेशी अिभदाय (िविनयमन) अिधिनयम, 2010 (2010 का 42) कᳱ धारा
48 ᳇ारा ᮧद᭜ त शि तयᲂ का ᮧयोग करते ᱟए िवदेशी अिभदाय (िविनयमन) िनयम, 2011 का और संशोधन करने के िलए
िनम् निलिखत िनयम बनाती है, अथाᭅत् :—
1. (1) इन िनयमᲂ का संिᭃ᭡ त नाम िवदेशी अिभदाय (िविनयमन) संशोधन िनयम, 2015 है ।
(2) ये िनयम राजपᮢ मᱶ इनके ᮧकाशन कᳱ तारीख से ᮧवृ᭜ त हᲂगे ।
2. िवदेशी अिभदाय (िविनयमन) िनयम, 2011 (िजसे इसमᱶ इसके प᭫ चात् मूल िनयम कहा गया है) मᱶ,
(i)
िनयम 9 मᱶ, -
(क) उपिनयम (1) मᱶ, -
(अ) खंड (क) के ᭭ थान पर िन᭥ निलिखत खंड रखा जाएगा, अथाᭅत्:-
''(क) िवदेशी अिभदाय कᳱ ᭭ वीकृित हेतु रिज᭭ ᮝीकरण के िलए आवेदन या धारा 11 के अधीन ᳰकसी ᭪ यि त
᳇ारा पूवᭅ अनु᭄ा अिभᮧा᭡ त करने के िलए आवेदन इलै ᮝािनकली ऑनलाइन ᮧᱨप एफसी-3 मᱶ ᳰकया
जाएगा ।
(आ) खंड (ख) और (ग) के ᭭ थान पर िन᭥ निलिखत खंड रखे जाएंगे, अथाᭅत्:-
''(ख) आवेदक, कᱶᮤीय सरकार ᳇ारा समय-समय पर यथािविन᳸द᭬ ट, ᭭ कैन ᳰकए गए द᭭ तावेजᲂ
सिहत ह᭭ ताᭃᳯरत या िडजीटली ह᭭ ताᭃᳯरत आवेदन अपलोड करेगा”;

(इ) खंड (ड.) मᱶ, ''सादे कागज पर'' श᭣ दᲂ के ᭭ थान पर ''इलै ᮝािनकली ऑन लाइन ᮧᱨप एफ
सी –6 मᱶ'' श᭣ द रखे जाएंगे;
(ख)
उपिनयम (2) मᱶ, -
(अ) खंड (क), (ख) और (ग) का लोप ᳰकया जाएगा;
(आ) खंड (ड.) मᱶ ''सादे कागज पर'' श᭣ दᲂ के ᭭ थान पर ''इलै ᮝािनकली ऑनलाइन ᮧᱨप एफ सी-6 मᱶ''
श᭣ द रखे जाएंगे;
(इ) उपिनयम (4) मᱶ खंड (घ) मᱶ अंत मᱶ िन᭥ निलिखत श᭣ द अंत:᭭ थािपत ᳰकए जाएंगे, अथाᭅत्:-
''या कᱶᮤीय सरकार ᳇ारा यथािविन᳸द᭬ ट ऑनलाइन इलै ᮝािनक संदाय गेटवे के मा᭟ यम से'';
(ii) िनयम 12 मᱶ, -
(क) उपिनयम (2) मᱶ ''एफ सी- 5'' अᭃरᲂ और अंक के ᭭ थान पर ''एफ सी- 3'' अᭃर और अंक रखे
जाएंगे;
(ख) उपिनयम (3) का लोप ᳰकया जाएगा;
(ग) उपिनयम (5) मᱶ अंत मᱶ िन᭥ निलिखत श᭣ द अंत:᭭ थािपत ᳰकए जाएंगे, अथाᭅत्:-
''या कᱶᮤीय सरकार ᳇ारा यथािविन᳸द᭬ ट ऑन लाइन इलै ᮝािनक संदाय गेटवे के मा᭟ यम से'';
(iii) िनयम 13 के ᭭ थान पर िन᭥ निलिखत िनयम रखा जाएगा, अथाᭅत् :-
“13. िवदेशी अिभदाय कᳱ ᮧाि᭡ त कᳱ घोषणा –
(क) कोई ᭪ यि त िजसे रिज᭭ ᮝीकरण ᮧमाणपᮢ या पूवᭅ अनु᭄ा ᮧदान कᳱ गई है िवदेशी अिभदाय कᳱ ᮧाि᭡ तयᲂ के
उपयोग के संपरीिᭃत िववरण के लेखे िजसके अंतगᭅत ᮧथम अᮧैल को ᮧारंभ होने वाले ᮧ᭜ येक वषᭅ के िलए आय
और ᭪ यय िववरण, आय और ᭪ यय लेखा और तुलन-पᮢ है, िव᭜ तीय वषᭅ के समापन के नौ मास के भीतर शासकᳱय
वैबसाइट या कᱶᮤीय सरकार ᳇ारा यथािविन᳸द᭬ ट वैबसाइट पर रखेगा ।
(ख) कोई ᭪ यि त जो िव᭜ तीय वषᭅ कᳱ ितमाही मᱶ िवदेशी अिभदाय ᮧा᭡ त करता है, ᮧा᭡ त िवदेशी अिभदाय के ᭣ यौरे
उस ितमाही, िजसमᱶ यह ᮧा᭡ त ᱟआ है, के अंितम ᳰदन के प᭫ चात् पंᮤह ᳰदन के भीतर दाताᲐ के ᭣ यौरे, ᮧा᭡ त रकम
और ᮧाि᭡ त कᳱ तारीख ᭭ प᭬ टतया उपदᳶशत करते ᱟए अपनी शासकᳱय वैबसाइट या कᱶᮤीय सरकार ᳇ारा
यथािविन᳸द᭬ ट वैबसाइट पर रखेगा ।”
(iv)
िनयम 16 के ᭭ थान पर िन᭥ निलिखत िनयम रखा जाएगा, अथाᭅत् :-
“16. िवदेशी अिभदाय कᳱ ᮧाि᭡ त का बᱹकᲂ ᳇ारा ᳯरपोटᭅ ᳰकया जाना –
बᱹक, कᱶᮤीय सरकार को ᳰकसी ᭪ यि त, चाहे ऐसा ᭪ यि त रिज᭭ ᮝीकृत है या नहᱭ या उसे अिधिनयम के अधीन पूवᭅ
अनु᭄ा ᮧदान कᳱ गई है या नहᱭ, ᳇ारा ᳰकसी िवदेशी अिभदाय कᳱ ᮧाि᭡ त या उपयोग के संबंध मᱶ ᳰकसी सं᭪ यवहार कᳱ ᳯरपोटᭅ
48 घंटᲂ के भीतर करेगा ।”;
(v)
िनयम 17 मᱶ, -
(क)
उपिनयम (1) के ᭭ थान पर िन᭥ निलिखत उपिनयम रखा जाएगा, अथाᭅत् :-
''(1) ᮧ᭜ येक ᭪ यि त जो अिधिनयम के अधीन िवदेशी अिभदाय ᮧा᭡ त करता है, ᮧथम अᮧैल को ᮧारंभ होने वाले के वषᭅ िलए
आय और ᭪ यय िववरण, आय और ᭪ यय लेखा और तुलन-पᮢ कᳱ ᭭ कैन कᳱ गई ᮧितयां सिहत िव᭜ तीय वषᭅ के समापन के नौ
मास के भीतर ह᭭ ताᭃᳯरत या िडजीटली ह᭭ ताᭃᳯरत ᳯरपोटᭅ इलै ᮝािनकली ऑन लाइन ᮧᱧप एफ सी-4 मᱶ ᮧस् तुत करेगा ।'';
(ख)
उपिनयम (2) मᱶ, -''एफ सी-6'' अᭃरᲂ और अंक के ᭭ थान पर ''एफ सी-4'' अᭃर और अंक रखे जाएंगे;
(ग)
उपिनयम (3) मᱶ, -''एफ सी-7'' अᭃरᲂ और अंक के ᭭ थान पर ''एफ सी- 1'' अᭃर और अंक रखे जाएंगे;
(घ)
उपिनयम (4) मᱶ, -''एफ सी-8'' अᭃरᲂ और अंक के ᭭ थान पर ''एफ सी-1'' अᭃर और अंक रखे जाएंगे;
(ड.)
उपिनयम (6) मᱶ, -''एफ सी-7'' अᭃरᲂ और अंक के ᭭ थान पर ''एफ सी-4'' अᭃर और अंक रखे जाएंगे;
(च) उपिनयम (8) मᱶ िन᭥ निलिखत परंतुक अंत:᭭ थािपत ᳰकया जाएगा, अथाᭅत् :-

''परंतु जहां ᳰकसी िव᭜ तीय वषᭅ के दौरान िवदेशी अिभदाय ᮧा᭡ त या उपयोग नहᱭ ᳰकए गए हᱹ, वहां चाटᭅडᭅ
लेखाकार से ᮧमाणपᮢ या ᮧᱧप एफ सी-4 के साथ आय और ᭪ यय िववरण या ᮧाि᭡ त और संदाय लेखा या तुलन-पᮢ
संल न करने कᳱ अपेᭃा नहᱭ कᳱ जाएगी ।'';
(vi) िनयम 17 के प᭫ चात् िन᭥ निलिखत िनयम अंत:᭭ थािपत ᳰकया जाएगा, अथाᭅत् :-
''17क. अिभिहत बᱹक लेखा, नाम, पता, ल᭯ यᲂ, उे᭫ यᲂ या संगम के मु य सद᭭ यᲂ का पᳯरवतᭅन-
कोई ᭪ यि त िजसे रिज᭭ ᮝीकरण ᮧमाणपᮢ या अिधिनयम कᳱ धारा 11 के अधीन पूवᭅ अनु᭄ा ᮧदान कᳱ गई है
िन᭥ निलिखत मᱶ ᳰकसी पᳯरवतᭅन को 15 ᳰदन के भीतर इलै ᮝािनकली ऑनलाइन ᮧᱧप एफ सी-6 मᱶ सूिचत करेगा,
अथाᭅत् :-
(i)
रा᭔ य के भीतर संगम का नाम और उसका पता िजसके िलए अिधिनयम के अधीन रिज᭭ ᮝीकरण/पूवᭅ अनु᭄ा
ᮧदान कᳱ गई है;
(ii)
इसकᳱ ᮧकृित, ल᭯ य और उे᭫ य तथा ᭭ थानीय/सुसंगत ᮧािधकाᳯरयᲂ से रिज᭭ ᮝीकरण;
(iii)
बᱹक और/या बᱹक कᳱ शाखा और/या अिभिहत िवदेशी अिभदाय खाता सं यांक; और
(iv)
अिधिनयम के अधीन रिज᭭ ᮝीकरण करने/रिज᭭ ᮝीकरण कᳱ पूवᭅ अनु᭄ा/नवीनीकरण के िलए आवेदन मᱶ
यथाᳯरपो᳷टत संगम के मु य सद᭭ य, यᳰद ᳰकसी समय ऐसे पᳯरवतᭅन के कारण मूल मु य सद᭭ यᲂ के पचास ᮧितशत
या अिधक बदल जाते हᱹ।'';
(vii)
िनयम 18 मᱶ, ''एफ-9'' अᭃरᲂ और अंक के ᭭ थान पर, ''एफसी-1'' अᭃर और अंक रखे जाएंगे;
(viii)
िनयम 24 मᱶ,--
(क)
उपिनयम (1) मᱶ ''एफसी-10'' अᭃरᲂ और अंक के ᭭ थान पर, ''एफसी-5'' अᭃर और अंक रखे जाएंगे;
(ख)
उपिनयम (4) मᱶ ''एफसी-6'' अᭃरᲂ और अंक के ᭭ थान पर, ''एफसी-4'' अᭃर और अंक रखे जाएंगे;
(ix)
ᮧᱨप एफसी-1 से एफसी-10 तक के ᭭ थान पर, िन᭥ निलिखत ᮧᱨप रखे जाएंगे, अथाᭅत्:--

2010 का 42) कᳱ धारा 19 मᱶ िनधाᭅᳯरत अनुरᭃण ᳰकया है।
(vi) इस ᮧमाणपᮢ मᱶ और संल न तुलनपᮢ मᱶ ᮧदान कराई गई जानकारी और ᮧाि᳙यᲂ एवं भुगतान का िववरण सही है
यᲂᳰक उसकᳱ मᱹने/हमने जांच कर ली है।
(vii) संगम ने िवदेशी अिभदाय (िविनयमन) अिधिनयम, 2010 के अधीन रिज᭭ ᮝीकरण/ᮧदान कᳱ गई पूवᭅ अनु᭄ा के

NOTIFICATION
New Delhi, the 14th December, 2015
G.S.R. 966(E).—In exercise of the powers conferred by section 48 of the Foreign Contribution (Regulation)
Act, 2010 (42 of 2010), the Central Government hereby makes the following rules, further to amend the Foreign
Contribution (Regulation) Rules, 2011, namely:-
1. (1) These rules may be called the Foreign Contribution (Regulation) Amendment Rules, 2015.
(2)
They shall come into force on the date of their publication in the Official Gazette.
2.
In the Foreign Contribution (Regulation) Rules, 2011 (hereinafter referred to as the principal rules), -
(i)
in rule 9,-
(a)
in sub-rule (1), -
(A) for clause (a), the following clause shall be substituted, namely:-
“(a) An application for registration, or an application for obtaining prior permission by a person under
section 11, for acceptance of foreign contribution, shall be made electronically online in Form FC-3.
(B) for clauses (b) and (c), the following clause shall be substituted, namely:-
“(b) The applicant shall upload the signed or digitally signed application along with scanned
documents as specified by the Central Government from time to time”;
(C) in clause (e), for the words “on plain paper”, the words “electronically online in form FC-6” shall be
substituted;
(b)
in sub-rule (2), -
(A) clauses (a), (b) and (c) shall be omitted;
(B) in clause (e), for the words “on plain paper”, the words “electronically online in Form FC-6” shall be
substituted;
(c) in sub-rule(4), in clause(d), the following words shall be inserted at the end, namely :-
“or through online electronic payment gateway as specified by the Central Government”;
(ii) in rule 12, -
(a)
in sub-rule (2), for the letters and figure “FC-5”, the letters and figure “FC-3” shall be substituted;
(b)
sub-rule (3) shall be omitted;
(c)
in sub-rule (5), the following words shall be inserted in the end, namely:-
“or through online electronic payment gateway as specified by the Central Government”;
(iii) for rule 13, the following rule shall be substituted, namely:-
“13. Declaration of receipt of foreign contribution.-
(a)
A person who has been granted a certificate of registration or prior permission shall place the audited statement
of accounts on receipts and utilisation of the foreign contribution, including income and expenditure statement, receipt
and payment account and balance sheet for every financial year beginning on the first day of April within nine months of
the closure of the financial year on its official website or on the website as specified by the Central Government.
(b)
A person receiving foreign contribution in a quarter of the financial year shall place details of foreign
contribution received on its official website or on the website as specified by the Central Government within fifteen
days following the last day of the quarter in which it has been received clearly indicating the details of donors, amount
received and date of receipt.”

(iv)
for rule 16, the following rule shall be substituted, namely:-
“16. Reporting by banks of receipt of foreign contribution.-
The bank shall report to the Central Government within forty-eight hours any transaction in respect of receipt or
utilisation of any foreign contribution by any person whether or not such person is registered or granted prior permission
under the Act.”;
(v)
in rule 17, -
(a)
for sub-rule (1), the following sub-rule shall be substituted, namely:-
“(1) Every person who receives foreign contribution under the Act, shall submit a signed or digitally signed
report electronically online in Form FC-4 with scanned copies of income and expenditure statement, receipt and
payment account and balance sheet for every financial year beginning on the 1st day of April within nine months of the
closure of the financial year.”;
(b)
in sub-rule (2), for the letters and figure “FC-6”, the letters and figure “FC-4” shall be substituted;
(c)
in sub-rule (3), for the letters and figure “FC-7”, the letters and figure “FC-1” shall be substituted;
(d)
in sub-rule (4), for the letters and figure “FC-8”, the letters and figure “FC- 1” shall be substituted;
(e)
in sub-rule (6), for the letters and figure “FC-7”, the letters and figure “FC-4” shall be substituted;
(f)
in sub-rule (8), the following proviso shall be inserted, namely:-
“Provided that where foreign contribution has not been received or utilised during a financial year, it shall not be
required to enclose certificate from Chartered Accountant or income and expenditure statement or receipt and payment
account or balance sheet with Form FC-4. ”;
(vi)
after rule 17, the following rule shall be inserted, namely:-
“17A. Change of designated bank account, name, address, aims, objectives or Key members of the association.-
A person who has been granted a certificate of registration or prior permission under section 11 of the Act shall intimate
electronically online in Form FC-6, within fifteen days, of any change in the following, namely:-
(i)
name of the association or its address within the State for which registration/ prior permission has been granted
under the Act;
(ii)
its nature, aims and objects and registration with local/relevant authorities,;
(iii)
bank and/or branch of the bank and/or designated foreign contribution account number; and
(iv)
key members of the association if at any point of time such change causes replacement of fifty percent or more
of the original key members as reported in the application for grant of registration/ prior permission/ renewal of
registration under the Act.”;
(vii)
in rule 18, for the letters and figure “FC-9”, the letters and figure “FC- 1” shall be substituted;
(viii)
in rule 24,-
(a)
in sub-rule(1), for the letters and figure “FC-10”, the letters and figure “FC- 5” shall be substituted;
(b)
in sub-rule (4), for the letters and figure “FC-6”, the letters and figure “FC-4” shall be substituted;
(ix)
