का.आ. 3387(अ).—कᱶᮤीय सरकार, पयाᭅवरण संरᭃण अिधिनयम, 1986 (1986 का 29) कᳱ धारा 3 कᳱ

उपधारा (3) ᳇ारा ᮧद᭜ त शि᭍ तयᲂ का ᮧयोग करते ᱟए और भारत सरकार के त᭜ कालीन पयाᭅवरण और वन मंᮢालय कᳱ

अिधसूचना सं᭎ या का.आ. 1533(अ) तारीख 14 िसतंबर, 2006 (िजसे इसमᱶ इसके प᭫ चात् उ᭍ त अिधसूचना कहा गया है)

के अनुसरण मᱶ रा᭔ य ᭭ तरीय पयाᭅवरण समाघात िनधाᭅरण ᮧािधकरण, ओिड़शा (िजसे इसमᱶ इसके प᭫ चात् ᮧािधकरण,

ओिड़शा कहा गया है) गᳯठत करती है, िजसमᱶ िन᭥ निलिखत सद᭭ य हᲂगे, अथाᭅत् :—

2. ᮧािधकरण, ओिड़शा के अ᭟ यᭃ और सद᭭ य, राजपᮢ मᱶ इस अिधसूचना के ᮧकाशन कᳱ तारीख से 3 वषᭅ कᳱ अविध

के िलए पद धारण करᱶगे ।

3. ᮧािधकरण, ओिड़शा ऐसी शि᭍ तयᲂ का ᮧयोग करेगी और ऐसी ᮧᳰᮓयाᲐ का पालन करेगी जो उ᭍ त अिधसूचना

मᱶ िन᳸द᭬ ट हᲂ ।

4. ᮧािधकरण, ओिड़शा का िविन᭫ चय ओिड़शा रा᭔ य के िलए पैरा 5 के अधीन गᳯठत रा᭔ य ᭭ तरीय िवशेष᭄

मू᭨ यांकन सिमित कᳱ िसफाᳯरशᲂ पर आधाᳯरत होगा ।

5. ᮧािधकरण, ओिड़शा कᳱ सहायता करने के ᮧयोजनᲂ के िलए, कᱶᮤीय सरकार ओिड़शा सरकार से परामशᭅ करके,

रा᭔ य ᭭ तरीय िवशेष᭄ मू᭨ यांकन सिमित, ओिड़शा का गठन करती है, िजसमᱶ िन᭥ निलिखत सद᭭ य हᲂगे, अथाᭅत् :—

अनुसरण करेगी जो उ᭍ त अिधसूचना मᱶ िविन᳸द᭬ ट कᳱ जाएं ।

8. रा᭔ य ᭭ तरीय िवशेष᭄ मू᭨ यांकन सिमित, ओिड़शा सामूिहक उ᭜ तरदािय᭜ व के िस᳍ांत पर कायᭅ करेगी और अ᭟ यᭃ

ᮧ᭜ येक मामले मᱶ सवᭅस᭥ मित पर पᱟंचने का ᮧयास करेगा, और यᳰद सवᭅस᭥ मित पर नहᱭ पᱟंचा जाता है तो बᱟमत कᳱ राय

अिभभावी होगी।

9. ओिड़शा सरकार, ᮧािधकरण, ओिड़शा तथा रा᭔ य ᭭ तरीय िवशेष᭄ मू᭨ यांकन सिमित, ओिड़शा के िलए

सिचवालय के ᱨप मᱶ कायᭅ करने हेतु एक अिभकरण अिधसूिचत करेगी और सभी िव᭜ तीय तथा संभारतंᮢीय सहायता, िजसके

अंतगᭅत आवास, पᳯरवहन उसके और सभी कानूनी कृ᭜ यᲂ कᳱ बाबत ऐसी अ᭠ य सुिवधाएं भी हᱹ, उपल᭣ ध कराएगी ।

10. ओिड़शा, ᮧािधकरण के अ᭟ यᭃ और सद᭭ यᲂ तथा रा᭔ य ᭭ तरीय िवशेष᭄ मू᭨ यांकन सिमित, ओिड़शा को बैठक

कᳱ फᳱस, याᮢा भ᭜ ते, महंगाई भ᭜ ते, ओिड़शा सरकार के संबंिधत िनयमᲂ के अनुसार संद᭜ त ᳰकए जाएंगे ।

NOTIFICATION

New Delhi, the 15th December, 2015

S.O. 3387(E).—In exercise of the powers conferred by sub-section (3) of Section 3 of the

Environment (Protection) Act, 1986 (29 of 1986) and in pursuance of the notification of the Government of

India in the erstwhile Ministry of Environment and Forests number S.O. 1533(E), dated the 14th September,

2006 (hereinafter referred to as the said Gazette notification), the Central Government hereby constitutes the

State Level Environment Impact Assessment Authority, Odisha (hereinafter referred to as the Authority for

Odisha) comprising of the following members, namely:—

(a)

Sri Suresh Chandra Mohanty,

Plot No. 237/A, Saheed Nagar, Bhubaneswar – 751007.

(b)

Dr. Saumindra Prasad Das,

Plot No. 591, Saheed Nagar, Bhubaneswar – 751007.

2. The Chairman and Member of the Authority for Odisha shall hold office for a term of three years from the

date of publication of this notification in the Official Gazette.

3. The Authority for Odisha shall exercise such powers and follow such procedures as specified in the said

Gazette notification.

4. The Authority for Odisha shall take its decision on the recommendations of the State Level Expert

Appraisal Committee for the State of Odisha constituted under paragraph 5.

5. For the purposes of assisting the Authority for Odisha, the Central Government, in consultation with the

State Government of Odisha, hereby constitutes the State Level Expert Appraisal Committee, Odisha, comprising of the

following members, namely :—

6. The Chairman and Members of State Level Expert Appraisal Committee, Odisha shall hold office for a

term of three years from the date of publication of this notification in the Official Gazette.

7. The State Level Expert Appraisal Committee, Odisha shall exercise such powers and follow such

procedures as specified in the said Gazette notification.

8. The State Level Expert Appraisal Committee, Odisha shall function on the principle of collective

responsibility and the Chairman shall endeavor to reach a consensus in each case, and if consensus cannot be reached,

the opinion of the majority shall prevail.

9. The Government of Odisha shall notify an agency to act as Secretariat for the Authority for Odisha and the

State Level Expert Appraisal Committee, Odisha, and shall provide all financial and logistic support including

accommodation, transportation and such other facilities in respect of all its statutory functions.

10. The sitting fee, travelling allowance and dearness allowance to the Chairman and Members of the

Authority for Odisha and the Chairman and Members of the State Level Expert Appraisal Committee, Odisha shall be

paid in accordance with the concerned rules of the Government of Odisha.
