नई ᳰद᭨ ली, 16 ᳰदस᭥ बर, 2015

सा.का.िन.975 (अ)— रा᳦पित, संिवधान के अनु᭒छेद 309 के पर᭠तुक ᳇ारा ᮧदᱫ शिᲦयᲂ का ᮧयोग करते ᱟए, और ᭔ये᳥

िह᭠दी अनुवादक भतᱮ िनयम, 2008 तथा किन᳧ िह᭠दी अनुवादक िनयम, 2004 को उन बातᲂ के िसवाय अिधᮓांत करते ᱟए, िज᭠हᱶ ऐसे

अिधᮓमण से पूवᭅ ᳰकया गया है या करने का लोप ᳰकया गया है, िवᱫ मंᮢालय, राज᭭व िवभाग, के᭠ᮤीय उ᭜पाद-शु᭨क और सीमा-शु᭨क

बोडᭅ मᱶ ᭔ये᳧ अनुवादक और किन᳧ अनुवादक (समूह ‘ख’ अराजपिᮢत) के पद पर भतᱮ कᳱ प᳍ित का िविनयमन करने के िलए

िन᳜िलिखत िनयम बनाते हᱹ, अथाᭅत :-

1. संिᭃ᳙ नाम और ᮧारंभ :

(i) इन िनयमᲂ का संिᭃ᳙ नाम राज᭭व िवभाग, के᭠ᮤीय उ᭜पाद-शु᭨क और सीमा-शु᭨क बोडᭅ, ᭔ये᳧ अनुवादक और किन᳧ अनुवादक

(᮰ेणी ‘ख’ अराजपिᮢत, अननुसिचवीय पद) भतᱮ िनयम, 2015 है ।

(ii) ये राजपᮢ मᱶ ᮧकाशन कᳱ तारीख को लागू हᲂगे ।

2. िव᳒मान भतᱮ िनयमᲂ मᱶ िविन᳸द᳥ ᭔ये᳧ िह᭠दी अनुवादक और किन᳧ िह᭠दी अनुवादक के सभी पदᲂ को इन िनयमᲂ के अधीन ᭔ये᳧

अनुवादक और किन᳧ अनुवादक के ᱨप मᱶ पुन: पदािभिहत ᳰकए गए हᱹ और इन िनयमᲂ के ᮧारंभ से पूवᭅ संबं᳍ पदᲂ मᱶ ऐसे ᳞िᲦयᲂ ᳇ारा

कᳱ गई सेवाᲐ को ᭔ये᳧ता और ᮧो᳖ित, आᳰद के ᮧयोजन के िलए िनयिमत सेवा के ᱨप मᱶ गणना मᱶ िलया जाएगा। ऐसे अिधकाᳯरयᲂ कᳱ

᭔ये᳧ता को अिखल भारतीय आधार पर बनाए रखा जाएगा और कᱶᮤीय सरकार ᳇ारा समय-समय पर जारी आदेशᲂ या अनुदेशᲂ के अनुसार

िनयत ᳰकया जाएगा;

3. पदᲂ कᳱ सं᭎या, वगᱮकरण, वेतन बᱹड और ᮕेड वेतन या वेतनमान. - उᲦ पदᲂ कᳱ सं᭎या, उनका वगᱮकरण, वेतन बᱹड और ᮕेड वेतन

या वेतनमान वे हᲂगे, जो इन िनयमᲂ से उपाब᳍ अनुसूची के ᭭तंभ (2) से ᭭तंभ (4) मᱶ िविन᳸द᳥ हᱹ ।

4. भतᱮ कᳱ प᳍ित, आयु-सीमा, अ᭠य अहᭅताएं आᳰद.—उᲦ पदᲂ पर भतᱮ कᳱ प᳍ित, आयु-सीमा, अहᭅताएं और उनसे संबंिधत अ᭠य बातᱶ

वे हᲂगी जो उᲦ अनुसूची के ᭭तंभ (5) से ᭭तंभ (13) मᱶ िविन᳸द᳥ हᱹ।

5. िनरहᭅता : वह ᳞िᲦ :-

(क) िजसने ऐसे ᳞िᲦ से िजसका पित या िजसकᳱ प᳀ी जीिवत है, िववाह ᳰकया है, या िववाह कᳱ संिवदा कᳱ है; या

(ख) िजसने अपने पित या अपनी प᳀ी के जीिवत रहते ᱟए ᳰकसी ᳞िᲦ से िववाह ᳰकया है, या िववाह कᳱ संिवदा कᳱ है ।

उᲦ पद पर िनयुिᲦ का पाᮢ नहᱭ होगा :

पर᭠तु यᳰद के᭠ᮤीय सरकार का यह समाधान हो जाता है ᳰक ऐसा िववाह ऐसे ᳞िᲦ और िववाह के अ᭠य पᭃकार को लागू ᭭वीय

िविध के अधीन अनु᭄ेय है और ऐसा करने के िलए अ᭠य आधार हᱹ तो वह ᳰकसी ᳞िᲦ को इस िनयम के ᮧवतᭅन से छूट दे सकेगी ।

6. िशिथल करने ᳰक शिᲦ : जहां के᭠ᮤीय सरकार कᳱ यह राय है ᳰक ऐसा करना आव᭫यक या समीचीन है, वहाँ वह उसके िलए जो

कारण हᱹ, उ᭠हᱶ लेखब᳍ करके संघ लोक सेवा आयोग से परामशᭅ करके इन िनयमᲂ के ᳰकसी उपबंध को ᳰकसी वगᭅ या ᮧवगᭅ के ᳞िᲦयᲂ कᳱ

बाबत, आदेश ᳇ारा िशिथल कर सकेगी।

7. ᳞ावृित.—इन िनयमᲂ कᳱ कोई बात, ऐसे आरᭃण, आयु-सीमा मᱶ छूट और अ᭠य ᳯरयायतᲂ पर ᮧभाव नहᱭ डालेगी, िजनका के᭠ᮤीय

सरकार ᳇ारा इस संबंध मᱶ समय-समय पर जारी ᳰकए गए आदेशᲂ के अनुसार अनुसूिचत जाितयᲂ, अनुसूिचत जनजाितयᲂ, अ᭠य िपछड़े

वगᲄ, भूतपूवᭅ सैिनकᲂ और अ᭠य िवशेष ᮧवगᭅ के ᳞िᲦयᲂ के िलए उपबंध करना अपेिᭃत है ।

पाँच वषᭅ कᳱ िनयिमत सेवा कᳱ है और िज᭠हᲂने रा᳦ीय

उ᭜पाद-शु᭨क, सीमा-शु᭨क , और ᭭वापक अकादमी मᱶ दो

स᳙ाह का ᮧिशᭃण सफलता पूवᭅक पूरा ᳰकया हो ।

ᳯट᭡पण 1 : जहां ऐसे किन᳧ ᳞िᲦयᲂ के संबंध मᱶ िज᭠होने

अपनी अहᭅक/पाᮢता सेवा पूरी कर ली है, ᮧो᳖ित के िलए

िवचार ᳰकया जा रहा हो वहां उनसे ᭔ये᳧ ᳞िᲦयᲂ के संबंध मᱶ

भी िवचार ᳰकया जाएगा पर᭠तु यह तब जब ᳰक उसके ᳇ारा

कᳱ गई ऐसी अहᭅक/पाᮢता सेवा, अपेिᭃत अहᭅक या पाᮢता

सेवा के आधे से अिधक से या दो वषᭅ से, इनमᱶ से जो भी कम

हो, कम न हो और उ᭠हᲂने अपने ऐसे किन᳧ ᳞िᲦयᲂ सिहत

िज᭠होने ऐसी अहᭅक या पाᮢता सेवा पहले ही पूरी कर ली है

अगली उᲬतर ᮰ेणी मᱶ ᮧो᳖ित के िलए अपने पᳯरवीᭃा कᳱ

अविध सफलतापूवᭅक पूरी कर ली हो ।

ᳯट᭡पण 2: ᮧो᳖ित के िलए ᭠यूनतम अहᭅक सेवा कᳱ संगणना

करने के ᮧयोजन के िलए ᳰकसी अिधकारी ᳇ारा, 01 जनवरी,

2006 से पहले या उस तारीख से िजससे छठे के᭠ᮤीय वेतन

आयोग कᳱ िसफ़ाᳯरशᲂ पर आधाᳯरत पुनरीिᭃत वेतन संरचना

का िव᭭तार ᳰकया गया है, िनयिमत आधार पर कᳱ गई सेवा

को वेतन आयोग कᳱ िसफाᳯरशᲂ पर आधाᳯरत िव᭭ताᳯरत

त᭜सथानी ᮕेडवेतन या वेतनमान मᱶ कᳱ गई सेवा समझी

जाएगी।

ᮧितिनयुिᲦ : के᭠ᮤीय सरकार से ऐसे अिधकारी

(क)

(i)

जो मूल काडर या िवभाग मᱶ िनयिमत

आधार पर स᭞श पद धारण ᳰकए ᱟए हᱹ; या

(ii)

िज᭠हᲂने मूल काडर या िवभाग मᱶ वेतन

बᱹड-2; 9300-34800 #पए + ᮕेड वेतन

4200/- #पए या समतु᭨य पदᲂ मᱶ िनयिमत

आधार पर िनयुिᲦ के प᳟ात उस ᮰ेणी मᱶ

पांच वषᭅ िनयिमत सेवा कᳱ है; और

(ख) िजसके पास िन᳜िलिखत शैिᭃक अहᭅता और अनुभव है।

ᳰकसी मा᭠यताᮧा᳙ िव᳡िव᳒ालय से िह᭠दी मᱶ मा᭭टर

िडᮕी िजसमᱶ िडᮕी ᭭तर पर अंᮕेजी अिनवायᭅ या वैकि᭨पक

िवषय के ᱨप मᱶ रहा हो या परीᭃा के मा᭟यम के ᱨप मᱶ रहा

हो;

ᳰकसी मा᭠यताᮧा᳙ िव᳡िव᳒ालय से अँᮕेजी मᱶ मा᭭टर

िडᮕी िजसमᱶ िडᮕी ᭭तर पर िह᭠दी अिनवायᭅ या वैकि᭨पक

िवषय के ᱨप मᱶ हो या परीᭃा के मा᭟यम के ᱨप मᱶ रहा हो;

या

ᳰकसी मा᭠यताᮧा᳙ िव᳡िव᳒ालय से िह᭠दी या अंᮕेजी

से िभ᳖ ᳰकसी भी िवषय मᱶ िह᭠दी मा᭟यम से मा᭭टर िडᮕी

और िडᮕी ᭭तर पर अंᮕेजी अिनवायᭅ या वैकि᭨पक िवषय के

ᱨप मᱶ हो या परीᭃा के मा᭟यम के ᱨप मᱶ रहा हो; या

ᳰकसी मा᭠यताᮧा᳙ िव᳡िव᳒ालय से िह᭠दी या

अंᮕेजी से िभ᳖ ᳰकसी भी िवषय मᱶ अंᮕेजी मा᭟यम से मा᭭टर

िडᮕी िजसमᱶ िडᮕी ᭭तर पर िह᭠दी अिनवायᭅ या वैकि᭨पक

िवषय के ᱨप मᱶ रहा हो या परीᭃा के मा᭟यम के ᱨप मᱶ रहा

हो; या

ᳰकसी मा᭠यताᮧा᳙ िव᳡िव᳒ालय से िह᭠दी या अंᮕेजी

से िभ᳖ ᳰकसी भी िवषय मᱶ मा᭭टर िडᮕी िजसमᱶ िडᮕी ᭭तर

पर िह᭠दी और अंᮕेजी अिनवायᭅ या वैकि᭨पक िवषय के ᱨप मᱶ

रहा हो या दोनᲂ मᱶ से एक परीᭃा के मा᭟यम के ᱨप मᱶ रहा

हो और दूसरा अिनवायᭅ या वैकि᭨पक िवषय के ᱨप मᱶ रहा

हो; और

िह᭠दी से अंᮕेजी तथा अंᮕेजी से िह᭠दी मᱶ अनुवाद

कायᭅ का मा᭠यताᮧा᳙ िड᭡लोमा या ᮧमाणपᮢ पाᲹᮓम या

के᭠ᮤीय या रा᭔य सरकार के ᳰकसी कायाᭅलयᲂ मᱶ, िजनके

अंतगᭅत भारत सरकार के उपᮓम भी हᱹ, अंᮕेजी से िह᭠दी मᱶ

और िह᭠दी से अंᮕेजी मᱶ अनुवाद कायᭅ का तीन वषᭅ का

अनुभव।

ᳯट᭡पण 1 : पोषक ᮧवगᭅ के ऐसे िवभागीय अिधकारी जो

ᮧो᳖ित कᳱ सीधी पंिᲦ मᱶ है, ᮧितिनयुिᲦ पर िनयुिᲦ के िलए

िवचार ᳰकए जाने के पाᮢ नहᱭ हᲂगे । इसी ᮧकार ᮧितिनयुᲦ

᳞िᲦ ᮧो᳖ित ᳇ारा िनयुिᲦ के िलए िवचार ᳰकए जाने के

पाᮢ नहᱭ हᲂगे ।

ᳯट᭡पण 2 : ᮧितिनयुिᲦ कᳱ अविध, िजसके अंतगᭅत के᭠ᮤीय

सरकार के उसी या ᳰकसी अ᭠य संगठन या िवभाग मᱶ इस

िनयुिᲦ से ठीक पहले धाᳯरत ᳰकसी

अ᭠य काडर बा᳭

पद पर ᮧितिनयुिᲦ कᳱ अविध है, साधारणतया तीन वषᭅ से

अिधक नहᱭ हᲂगी। ᮧितिनयुिᲦ ᳇ारा िनयुिᲦ के िलए

अिधकतम आयु सीमा आवेदन ᮧा᳙ करने कᳱ अंितम तारीख

को 56 वषᭅ से अिधक नहᱭ होगी ।

ᳯट᭡पण 3 : ᮧितिनयुिᲦ के आधार पर िनयुिᲦ के ᮧयोजन

के िलए, ᳰकसी अिधकारी ᳇ारा 01 जनवरी, 2006 से पहले

या (उस तारीख से िजससे छठे के᭠ᮤीय वेतन आयोग कᳱ

िसफ़ाᳯरशᲂ पर आधाᳯरत पुनरीिᭃत वेतन संरचना का

िव᭭तार ᳰकया गया है) िनयिमत अधार पर कᳱ गई सेवा को,

िसवाय उस दशा के जहां एक से अिधक पूवᭅ पुनरीिᭃत

वेतनमान का साधारण ᮕेड वेतन या वेतनामान सिहत एक

᮰ेणी मᱶ िवलय कर ᳰदया गया है और वहां यह लाभ केवल उन

पद (उन पदᲂ) पर िव᭭ताᳯरत होगा िजसके िलए ᮕेड वेतन या

वेतनमान िबना ᳰकसी उ᳖यन का साधारण ᮧित᭭थापन ᮕेड

है, आयोग कᳱ िसफाᳯरशᲂ पर आधाᳯरत िव᭭ताᳯरत त᭜᭭थानी

ᮕेड वेतन या वेतनमान मᱶ कᳱ गई सेवा समझी जाएगी ।

यᳰद िवभागीय ᮧो᳖ित सिमित है, तो उसकᳱ संरचना

भतᱮ करने मᱶ ᳰकन पᳯरि᭭थितयᲂ मᱶ संघ लोक सेवा आयोग से

परामशᭅ ᳰकए जाएगा ।

G.S.R.975 (E).—In the exercise of the powers conferred by the proviso to Article 309 of the Constitution and

in supersession of the Senior Hindi Translator Recruitment Rules,2008 and Junior Hindi Translators Recruitment Rules,

2004 except as respects things done or omitted to be done before the supersession, the President hereby makes the

following rules for regulating the method of recruitment to the posts of Senior Translator and Junior Translator (Group

‘B’ Non-Gazetted) in the Ministry of Finance, Department of Revenue, Central Board of Excise and Customs, namely:-

1. Short title and commencement.- (1) These rules may be called the Department of Revenue, Central Board of

Excise and Customs, Senior Translator and Junior Translator (Group ‘B’, Non–Gazetted, Non Ministerial Posts )

Recruitment Rules, 2015 .

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Initial Constitution. – All the posts of Senior Hindi Translator and Junior Hindi Translator mentioned in the existing

recruitment rules are hereby re-designated as Senior Translator and Junior Translator under these rules and the services

rendered by such persons in the respective posts before commencement of these rules shall be taken into account as

regular service for the purpose of seniority and promotion etc. The seniority of such officers shall be maintained on all

India basis and will be fixed as per orders or instructions on seniority issued by the Central Government from time to

time.

3. Number of Posts, Classification, pay band and grade pay or scale of pay.- The number of the said posts, their

classification, pay band and grade pay or the scale of pay attached thereto shall be as specified in columns (2) to (4) of

the Schedule annexed to these rules.

4. Method of Recruitment, age limit, other qualifications, etc. - The method of recruitment, age limit, qualification

and other matters relating to the said post shall be as specified in columns (5) to (13) of the said Schedule.

5. Disqualification. - No person,-

(a) who has entered into or contracted a marriage with a person having a spouse living, or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post:

Provided that the Central Government may, if it is satisfied that such marriage is permissible under the personal law

applicable to such person and the other party to the marriage and that there are other grounds for so doing , exempt any

person from the operation of this rule.

6. Power to relax. - Where the Central Government is of the opinion that it is necessary or expedient so to do, it may,

by order, and for reasons to be recorded in writing and in consultation with Union Public Service Commission, relax any

of the provision of these rules with respect to any class or category of persons.

7. Saving.- Nothing in these rules shall affect reservation, relaxations of age limits and other concessions required to be

provided for the Scheduled Castes, the Scheduled Tribes, the Other Backward Classes, the Ex- Servicemen and other

special categories of persons in accordance with the orders issued by the Central Government from time to time in this

regard.

Promotion:

Junior Translators in Pay Band -2 , Rs 9300- 34800/-

with Grade Pay of Rs, 4200/- with five years regular

service in the grade and successfully completed the

training of two weeks in the National Academy of

Customs, Excise and Narcotics.

Note 1: Where juniors who have completed their

qualifying or eligibility service are being considered

for promotion, their seniors would also be considered

provided they are not short of the requisite qualifying

or eligibility service by more than half of such

qualifying or eligibility service or two years,

whichever is less and have successfully completed

their probation period for promotion to the next higher

grade along with their junior who have already

completed such qualifying or eligibility service.

Note 2: For the purpose of computing minimum

qualifying service for Promotion, the service rendered

on a regular basis by an officer prior to 1^st January,

2006 or the date from which the revised pay structure

based on the Sixth Central Pay Commission

recommendations has been extended, shall be deemed

to be service rendered in the corresponding Grade pay

or pay scale extended based on the recommendations

of the Pay Commission.

Deputation:

Officers from the Central Government:-

(A) (i) holding analogous posts on regular basis in the

parent cadre or Department; or

(ii) with five years regular service in the Grade

rendered after appointment thereto on a regular basis

in posts in Pay Band 2, Rs. 9300-34800/- with Grade

Pay Rs 4200/- or equivalent in the parent cadre or

Department; and

(B)Possessing the following educational qualification

and experience:

Master’s degree from a recognised University in

Hindi with English as a compulsory or elective subject

or as the medium of examination at the degree level,

Master Degree from a recognised University in

English with Hindi as a Compulsory or elective subject

or as the medium of examination at the degree level.

Master Degree from a recognised University in any

subject other than Hindi or English, with Hindi

Medium and English as a compulsory or elective

subject or as the medium of Examination at the degree

level.

Master’s degree from a recognised University in any

subject other than Hindi or English, with English

medium and Hindi as compulsory or elective subject

or as the medium of examination at the degree level;

Master Degree from a recognised University in any

subject other than Hindi or English with Hindi and

English as Compulsory or elective subject or either of

the two as a medium of examination and the other as a

compulsory or elective subject at the degree level.

And

Recognised diploma or certificate course in translation

from Hindi to English and vice versa or three years’

experience or translation work from Hindi to English

and vice versa in a Central or State Government office,

including Government of India Undertakings.

Note 1: The Departmental officers in the feeder

category who are in direct line of promotion will not

be eligible for consideration for appointment on

deputation. Similarly deputationists shall not be

eligible

deputation in another ex-cadre post held immediately

The maximum age limit for appointment by deputation

shall be not exceeding 56 years as on the closing date

of receipt of applications.

Note 3: For the purpose of appointment on deputation

basis. The service rendered on a regular basis by an

officer prior to 01.01.2006(the date from which the

revised pay structure based on the 6^th Central Pay

Commission recommendation has been extended) shall

be deemed to be service rendered in the corresponding

Grade Pay or Pay Scale extended based on the

recommendations of the Pay Commission except

where there has been merger of more than one pre-

revised scale of pay into one grade with a common

grade pay or pay scale. And where this benefit will

extend only for the post(s), for which that grade pay or

pay scale is the normal replacement Grade without any

up gradation.
