22 "ारा द# त शि$य% का योग करते (ए, पया*वरण और वन मं-ालय, भारत सरकार अिधसूचना सं. सा.का.िन. 528(अ),

तारीख 11.07.2011 को उन बात% के िसवाय, िज ह3 ऐसे अिधमण से पूव* कया गया है या करने का लोप कया गया है,

अिधांत करते (ए, यह िविन6द7 ट करती है क इस अिधसूचना के काशन क! तारीख से िन< निलिखत पशु को तमाशा

दखाने वाले पशु के =प म3 द>शत अथवा िशि@त नहA कया जाएगा, अथा*त् :—

परंतु 'सांड%' को देश के कसी भी भाग म3, िन< निलिखत शतF के अधीन रहते (ए, कसी समुदाय क! =ढ़य% "ारा या

=ढ़य% के अधीन पारंपHरक I यवहार या संJ कृित के भाग के =प म3 तिमलनाडु म3 जिलकटटु और महारा7 L, कना*टक, पंजाब,

हHरयाणा, केरल और गुजरात म3 बैलगाड़ी दौड़ जैसे आयोजन% म3 तमाशा दखाने वाले पशु के =प म3 द>शत अथवा

िशि@त कया जाता रहेगा, अथा*त् :—

(i)

ऐसा काय*म कसी िजले म3, जहां इनको वा>षक =प से पार< पHरक =प से आयोिजत कया जाता है,

कलP टर या िजला मिजJ Lेट "ारा J प7 ट =प से अनुQात J थान पर आयोिजत कया जाएगा ;

(ii)

बैलगाड़ी दौड़ का कसी उिचत माग* पर आयोजन हो, िजसक! दूरी 2 कमी. से अिधक नहA होगी ।

जिलकUटू के मामले म3, जैसे ही सांड अपना बाड़ा छोड़ेगा, उसे 15 मीटर के घेरे के भीतर काबू कया

जाएगा ;

यह सुिनिZत कया जाएगा क पशु पालन और पशु िचक# सा िवभाग के ािधकाHरय% "ारा सांड% का

उिचत परी@ण यह सुिनिZत करने के िलए कया गया है क इस आयोजन म3 भाग लेने के िलए वे अ[ छी

शारीHरक दशा म3 है और सांड% को बेहतर दश*न करने के िलए कसी भी =प म3 औषध नहA दी है ; और

(iv)

यह सुिनिZत कया जाएगा क ऐसे आयोजन% के दौरान पशु के ित ूरता का िनवारण अिधिनयम,

1960 क! धारा 3 और धारा 11 क! उपधारा (1) के खंड (क) और खंड (ड) के अधीन पशु को द# त

अिधकार और उ[ चतम यायालय "ारा 2014 क! िसिवल अपील सं. 5387 म3 तारीख 07 मई, 2014 के

अपने आदेश म3 घोिषत पांच J वतं-ता को ऐसे आयोजन के दौरान पूण* =प से संरि@त कए गए हd ।

परंतु यह और क इस कार आयोिजत जिलकटटु या बैलगाड़ी दौड़ का आयोजन संबंिधत िजला ािधकाHरय% के पूव*

अनुमोदन से कया जाएगा :

परंतु यह और भी क इस कार आयोिजत जिलकटटु या बैलगाड़ी दौड़ का, यथािJ थित, पशु के ित ूरता का

ूरता िनवारण संबंधी िजला सोसायटी और राf य पशु क याण बोड* या िजला ािधकाHरय% "ारा यह सुिनिg चत करने के िलए

क ऐसे आयोजन के अनुम म3 या उसक! तैयारी म3 पशु को कसी तरीके से कोई अनावg यक क7 ट या पीड़ा न प(ंचायी जाए

या काHरत न क! जाए, स< यक् =प से मानीटर कया जाएगा ।

NOTIFICATION

New Delhi, the 7th January, 2016

G.S.R. 13(E).—In exercise of the powers conferred by Section 22 of the Prevention of

Cruelty to Animals Act, 1960 (59 of 1960), and in supersession of the notification of the Government

of India in the Ministry of Environment and Forest, Government of India number G.S.R. 528(E),

dated the 11th July, 2011, except as respects things done or omitted to be done before such

supersession, the Central Government, hereby specifies that the following animals shall not be

exhibited or trained as performing animal, with effect from the date of publication of this

notification, namely:—

1. Bears

2. Monkeys

3. Tigers

4. Panthers

5. Lions

6. Bulls

Provided that bulls may be continue to be exhibited or trained as a performing animal, at events such

as Jallikattu in Tamil Nadu and bullock cart races in Maharashtra, Karnataka, Punjab, Haryana, Kerala and

Gujarat in the manner by the customs of any community or practiced traditionally under the customs or as a

part of culture, in any part of the country subject to the following conditions, namely:—

(i)

such event shall take place in any Districtwhere it is being traditionally held annually, atsuch

place explicitly permitted by the District Collector or the District Magistrate;

(ii)

bullock cart race shall be organised on a proper track, which shall not exceed two kilometres.

In case of Jallikattu,the moment the bull leaves the enclosure, it shall be tamed within a radial

distance of 15 metre;

(iii) ensure that the bulls are put to proper testing by the authorities of the Animal Husbandry and

Veterinary Department to ensure that they are in good physical condition to participate in the

event and performance enhancement drugs are not administered to the bulls in any form; and

(iv) ensure that the rights conferred upon the animals under section 3 and clause (a) and clause (m)

of sub-section (1) of section 11 of the Prevention of Cruelty to Animals Act, 1960 (59 of 1960)

and five freedoms declared by the Hon’ble Supreme Court in its order dated 7th May, 2014 in

Civil Appeal No. 5387 of 2014 are fully protected during such events:

Provided further that any event of Jallikattu or bullock cart races so organised shall be held with the

prior approval of the District Authorities concerned:

Provided also further that the Jallikattu or bullock cart races so organised shall be duly monitored by

the District Society for Prevention of Cruelty to Animals and State Animal Welfare Board or the District

Authorities as the case may be, ensuring that no unnecessary pain or suffering is inflicted or caused, in any

manner, whatsoever, during the course of such events, or in preparation thereof.
