पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय

अिधसूचना

नई ᳰद᭨ली, 31 ᳰदस᭥ बर, 2015

का.आ. 69(अ).—िन᳜िलिखत ᮧाᱨप अिधसूचना, िजसे के᭠ᮤीय सरकार, पयाᭅवरण (संरᭃण) अिधिनयम, 1986

(1986 का 29) कᳱ धारा 3 कᳱ उपधारा (2) के खंड (v) और खंड (xiv) तथा उपधारा (3) के साथ पᳯठत उपधारा (1) ᳇ारा

ᮧदᱫ शिᲦयᲂ का ᮧयोग करते ᱟए, जारी करने का ᮧ᭭ताव करती है, पयाᭅवरण (संरᭃण) िनयम, 1986 के िनयम 5 के

उपिनयम (3) कᳱ अपेᭃानुसार, जनसाधारण कᳱ जानकारी के िलए ᮧकािशत कᳱ जाती है; िजनके उससे ᮧभािवत होने कᳱ

संभावना है; और यह सूचना दी जाती है ᳰक उᲦ ᮧाᱨप अिधसूचना पर, उस तारीख से, िजसको इस अिधसूचना वाले भारत

के राजपᮢ कᳱ ᮧितयां जनसाधारण को उपल᭣ध करा दी जाती हᱹ, साठ ᳰदन कᳱ अविध कᳱ समाि᳙ पर या उसके प᳟ात् िवचार

ᳰकया जाएगा ;

ऐसा कोई ᳞िᲦ, जो ᮧाᱨप अिधसूचना मᱶ अंतᳶव᳥ ᮧ᭭तावᲂ के संबंध मᱶ कोई आᭃेप या सुझाव देने मᱶ िहतब᳍ है,

इस ᮧकार िविन᳸द᳥ अविध के भीतर, के᭠ᮤीय सरकार ᳇ारा िवचार ᳰकए जाने के िलए, आᭃेप या सुझाव सिचव,

पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय, इंᳰदरा पयाᭅवरण भवन, जोर बाग रोड, अलीगंज, नई ᳰद᭨ली-110003 या

ई-मेल पते: [email protected] पर िलिखत ᱨप मᱶ भेज सकेगा ।

ᮧाᱨप अिधसूचना

मालाबार व᭠यजीव अभयार᭛य केरल रा᭔य मᱶ कोजीकोडे िजले मᱶ ᳰकलांदी ता᭨लुक के चᳰᲥᱫापाडा और चे᭥बानोडा

राज᭭व ᮕामᲂ मᱶ उᱫरी अᭃांश 11^o75’ और 11^o76’ तथा पूवᱮ देशांतर 76^o20’ और 75^o38’ मᱶ अवि᭭थत है ;

और, मालाबार व᭠यजीव अभयार᭛य पि᳟मी घाट का अिभ᭠य भाग है और इसकᳱ तीᮯ ᭭थलाकृितक ᮧवणता

40 मीटर से 1506 मीटर तक है, इसकᳱ िवशेषताएँ खड़ी ढाल पहाड़ी, गहरी घाटी, कᲬी भूिम आᳰद के साथ छोटी पहाड़ी

और सदानीर जल ᳫोत है ।

और, अभयार᭛य उᲬ वन᭭पित िविवधता से जाना जाता है और ᭃेᮢ के पेड़ पौधे कᳱ िविवधता उᲬ पहाड़ी सदाबहार

वन से उ᭬ण कᳯटबंधी सदाबहार वन, अधᭅ-सदाहᳯरत वन और आᮤᭅ पणᭅपाती वनᲂ मᱶ ᮝमीनािलया बेलेᳯरका, पीटरोकरपस

मरसिपयम, ᭭टेᳯरयोसपᭅमम चलोनोइडस, ᮕेिवया तीलीफोिलया, िडलेिनया पᱶटागयान, लएिशयानथस ᭭पा, साइकोᳯटिशया

᭭पा, सोलानम ᭭पा, ᭭ᮝोिबलानथस ᭭पा. तक सि᭥मिलत है ।

और, अभयार᭛य मᱶ कई ᭭थािनक और अनेक पुनः आिव᭬कृत ᮧजाितयᲂ िजनमे कुछ ᮧजाितयां िसफᭅ अभयार᭛य कᳱ

भीतर मᱶ पायी जाती है को आ᮰य देता है और मालाबार व᭠यजीव अभयार᭛य सावᭅभौमक संकटाप᳖ ᭭तनधारी, पᭃी,

सरीसृप, मछली और उभयचरᲂ का वास है ।

और, मालाबार व᭠यजीव अभयार᭛य वयान᭠द हाथी ᳯरजवᭅ का भाग है और िविवध जीवजंतु का संभरण करती है

िजनमᱶ ᭭तनीयᲂ कᳱ 41 ᮧजाितयां तथा उनमे 6 पि᳟मी घाट मᱶ ᭭थािनक है, उभयचर कᳱ 38 ᮧजाितयां िजनमᱶ 26 ᭭थािनक

हᱹ, मछिलयᲂ कᳱ 52 ᮧजाितयां िजनमᱶ 21 ᭭थािनक है, सि᭥मिलत है ।

और, अभयार᭛य मᱶ संकटाप᳖ ᭭तनी ᮧजाितयां जैसे-᳞ाᮖ, तᱶदुआ, तᱶदुआ िब᭨ली, जंगली िब᭨ली, साल, तावंगु,

िपसूरी, जंगली कुᱫा, सूरज-भगत और रीछ भी आि᮰त है।

और, मालाबार व᭠यजीव अभयार᭛य के चारᲂ ओर के ᭃेᮢ को, िजसका िव᭭तार और सीमाएं इस अिधसूचना के पैरा

1 मᱶ िविन᳸द᳥ हᱹ, पयाᭅवरण कᳱ दृि᳥ से पाᳯरि᭭थितक संवेदी जोन के ᱨप मᱶ सुरिᭃत और संरिᭃत करना तथा उᲦ

पाᳯरि᭭थितक संवेदी जोन मᱶ उ᳒ोगᲂ या उ᳒ोगᲂ के वगᲃ के ᮧचालन तथा ᮧसं᭭करण करने को ᮧितिष᳍ करना आव᭫यक है ;

अतः, अब, के᭠ᮤीय सरकार, पयाᭅवरण (संरᭃण) िनयम, 1986 के िनयम 5 के उपिनयम (3) और पयाᭅवरण

(संरᭃण) अिधिनयम, 1986 (1986 का 29) कᳱ धारा 3 कᳱ उपधारा (2) के खंड (v) और खंड (xiv) के साथ पᳯठत और

उपधारा (1) ᳇ारा ᮧदᱫ शिᲦयᲂ का ᮧयोग करते ᱟए, केरल रा᭔ य मᱶ मालाबार व᭠यजीव अभयार᭛य कᳱ सीमा से 0.1

ᳰकलोमीटर से 1 ᳰकलोमीटर तक के िव᭭ताᳯरत ᭃेᮢ को मालाबार व᭠यजीव अभयार᭛य पाᳯरि᭭ थितकᳱ संवेदी जोन (िजसे इसमᱶ

इसके प᭫ चात् पाᳯरि᭭ थितक संवेदी जोन कहा गया है) के ᱨप मᱶ अिधसूिचत करती है, िजसका िववरण िन᳜ानुसार है,

अथाᭅत् :--

(1) पाᳯरि᭭थितक संवेदी जोन का िव᭭तार और उसकᳱ सीमाएं--(1) पाᳯरि᭭थितक संवेदी जोन का िव᭭तार मालाबार

व᭠यजीव अभयार᭛य कᳱ सीमा के चारᲂ ओर 0.1 ᳰकलोमीटर से 1 ᳰकलोमीटर तक है और यह 37.9 वगᭅ ᳰकलोमीटर के ᭃेᮢ

मᱶ फैला ᱟआ है। इसकᳱ सीमा का वणᭅन उपाबंध I पर ᳰदया गया है ।

(2) ᮧमुख िब᭠ दुᲐ के िनदᱷशांकᲂ के साथ पाᳯरि᭭थितक संवेदी जोन का मानिचᮢ उपाबंध II के ᱨप मᱶ उपाब᳍ है ।

(3) पाᳯरि᭭थितक संवेदी जोन दो राज᭭व ᮕामᲂ मᱶ फैला ᱟआ है, िजसमᱶ िनिहत वन सि᭥मिलत हᱹ। पाᳯरि᭭थितक संवेदी जोन के

भीतर आना वाले ᮕामᲂ और िनिहत वनᲂ कᳱ सूची उपाबंध III के ᱨप मᱶ उपाब᳍ हᱹ ।

2. पाᳯरि᭭थितक संवेदी जोन के िलए आंचिलक महायोजना – (1) रा᭔य सरकार, पाᳯरि᭭ थितक संवेदी जोन के ᮧयोजन

के िलए राजपᮢ मᱶ अंितम अिधसूचना के ᮧकाशन कᳱ तारीख से दो वषᭅ कᳱ अविध के भीतर ᭭थानीय लोगᲂ से परामशᭅ करके

और इस अिधसूचना मᱶ ᳰदए गए उपदशᲄ का अनुपालन करते ᱟए, ᭭थानीय ᳞िᲦयᲂ के परामशᭅ से आंचिलक महायोजना

तैयार करेगी ।

(2)

उ᭍ त योजना को रा᭔ य सरकार मᱶ सᭃम ᮧािधकारी ᳇ारा अनुमोᳰदत ᳰकया जाएगा।

(3)

पाᳯरि᭭ थितक संवेदी जोन के िलए आंचिलक महायोजना रा᭔ य सरकार ᳇ारा इस अिधसूचना मᱶ यथािविन᳸द᭬ ट रीित

मᱶ और सुसंगत कᱶᮤीय और रा᭔ य िविधयᲂ और कᱶᮤीय सरकार ᳇ारा जारी मागᭅदशᭅक िस᳍ांतो, यᳰद कोई हᲂ, के सामंज᭭य से

तैयार कᳱ जाएगी ।

(4) आंचिलक महायोजना उसमᱶ पयाᭅवरणीय और पाᳯरि᭭ थितकᳱ मु᳎ᲂ को सि᭥मिलत करने के िलए संबंिधत रा᭔य िवभागᲂ के

साथ परामशᭅ से तैयार कᳱ जाएगी, िजसके अंतगᭅत िन᳜िलिखत हᱹ, अथाᭅत्:--

(i)

पयाᭅवरण ;

(ii)

वन ;

(iii)

शहरी िवकास ;

(iv)

पयᭅटन ;

(v)

नगरपािलका ;

(vi)

राज᭭ व ;

(vii)

कृिष ;

(viii)

रा᭔ य ᮧदूषण िनयंᮢण बोडᭅ ;

(ix)

ᳲसचाई; और

(x)

लोक िनमाᭅण िवभाग ।

(5) आंचिलक महायोजना अनुमोᳰदत िव᳒मान भू-उपयोग, अवसंरचना और ᳰᮓयाकलापᲂ पर कोई िनबᲈधन अिधरोिपत नहᱭ

करेगी जब तक ᳰक इस अिधसूचना मᱶ िविन᳸द᭬ ट न हो और आचंिलक महायोजना सभी अवसंरचना और ᳰᮓयाकलापᲂ मᱶ और

अिधक दᭃता और पाᳯरि᭭ थितकᳱय अनुकूलता का संवधᭅन करेगी ।

आंचिलक महायोजना मᱶ अना᭒छाᳰदत ᭃेᮢᲂ के जीणᲃ᳍ार, िव᳒मान जल िनकायᲂ के संरᭃण, आवाह ᭃेᮢᲂ के

ᮧबंधन, जल-संभरᲂ के ᮧबंधन, भूतल जल के ᮧबंधन, मृदा और नमी संरᭃण, ᭭थानीय समुदायᲂ कᳱ आव᭫यकताᲐ तथा

पाᳯरि᭭थितकᳱ और पयाᭅवरण से संबंिधत ऐसे अ᭠य पहलूᲐ, िजन पर ᭟यान देना आव᭫यक है, के िलए उपबंध हᲂगे ।

आंचिलक महायोजना सभी िव᳒मान पूजा ᭭ थलᲂ, ᮕामᲂ और नगरीय बंदोब᭭तᲂ, वनᲂ के ᮧकार और ᳰक᭭ मᲂ, कृिष

ᭃेᮢᲂ, ऊपजाऊ भूिम, हᳯरत ᭃेᮢ जैसे उ᳒ान और उसी ᮧकार के ᭭ थान, उ᳒ान कृिष ᭃेᮢ, फलोधान, झीलᲂ और अ᭠य जल

िनकायᲂ का अ᭤यकंन करेगी ।

आंचिलक महायोजना ᭭ थानीय समुदायᲂ कᳱ जीवकोपाजᭅन को सुिनि᭫ चत करने के िलए, पाᳯरि᭭थितक संवेदी जोन मᱶ

िवकास को पाᳯरि᭭थक अनुकूल िवकास के िलए िविनयिमत करेगी ।

(9) आंचिलक महायोजना के उपबंधᲂ को पयाᭅ᳙ ᮧचार ᮧदान ᳰकया जाएगा ।

3. रा᭔य सरकार ᳇ारा ᳰकए जाने वाले उपाय-- रा᭔य सरकार इस अिधसूचना के उपबंधᲂ को ᮧभावी करने के िलए

िन᳜िलिखत उपाय करेगी, अथाᭅत् :--

(1) भू-उपयोग - पाᳯरि᭭ थितक संवेदी जोन मᱶ वनᲂ, उ᳒ान-कृिष ᭃेᮢᲂ, कृिष ᭃेᮢᲂ, आमोद-ᮧमोद के ᮧयोजन के िलए िचि᭠हत

ᳰकए गए पाकᲄ और खुले ᭭थानᲂ का वािणि᭔यक और औ᳒ोिगक संब᳍ िवकास ᳰᮓयाकलापᲂ के िलए उपयोग या संपᳯरवतᭅन

नहᱭ होगा :

परंतु पाᳯरि᭭थितक संवेदी जोन के भीतर कृिष भूिम का संपᳯरवतᭅन, के अधीन मानीटरी सिमित कᳱ िसफाᳯरश पर

और रा᭔य सरकार के पूवᭅ अनुमोदन से, ᭭थानीय िनवािसयᲂ कᳱ आवासीय जᱨरतᲂ को पूरा करने के िलए और पैरा 4 कᳱ

सारणी के ᭭तंभ (2) के अधीन ᮓम सं. 17, 22, 28, 34 और 37 के सामने सूचीब᳍ ᳰᮓयाकलापᲂ को पूरा करने के िलए

अनु᭄ात हᲂगे, अथाᭅत् :-

(क) पाᳯरि᭭ थितकᳱ अनुकूल पयᭅटन ᳰᮓयाकलापᲂ के िलए पयᭅटकᲂ के अ᭭ थायी आवासन के िलए पाᳯरि᭭ थितकᳱ

अनुकूल आरामगाह जैसे टे᭠ट, लकड़ी का मकान आᳰद ;

(ख) िव᳒मान सड़कᲂ को चौड़ा करना तथा सुदृढ़ करना और नई सड़कᲂ का संिनमाᭅण ;

(ग) ᮧदूषण उ᭜प᳖ न करने वाले लघु उ᳒ोग;

(घ) वषाᭅ जल संचयन; और

(ड.) कुटीर उ᳒ोग, िजसके अंतगᭅत ᮕामीण उ᳒ोग, सुिवधाजनक भंडार और ᭭ थानीय सुिवधाएं भी हᱹ :

परंतु यह और भी ᳰक रा᭔य सरकार के पूवᭅ अनुमोदन और संिवधान के अनु᭒ छेद 244 या त᭜समय ᮧवृᱫ िविध के

उपबंधᲂ के अनुपालन के िबना, िजसके अंतगᭅत अनुसूिचत जनजाित और अ᭠य परंपरागत वन िनवासी (वन अिधकारᲂ कᳱ

मा᭠यता) अिधिनयम, 2006 (2007 का 2) भी है, वािणि᭔यक या उ᳒ोग िवकास ᳰᮓयाकलापᲂ के िलए जनजातीय भूिम का

उपयोग अनु᭄ात नहᱭ होगा :

परंतु यह और भी ᳰक पाᳯरि᭭ थितक संवेदी जोन के भीतर भू-अिभलेखᲂ मᱶ पाई जाने वाली कोई ᮢुᳯट मानीटरी सिमित

के िवचार ᮧा᳙ करने के प᳟ात् रा᭔य सरकार ᳇ारा ᮧ᭜येक मामले मᱶ एक बार संशोिधत होगी और उᲦ ᮢुᳯट के संशोधन कᳱ

भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय को सूचना देनी होगी :

परंतु यह और भी ᳰक उपयुᭅᲦ ᮢुᳯट के संशोधन मᱶ इस उप पैरा के अधीन यथा उपबंिधत के िसवाय ᳰकसी भी दशा मᱶ

भू-उपयोग का पᳯरवतᭅन सि᭥मिलत नहᱭ होगा :

परंतु यह और भी ᳰक हᳯरत ᭃेᮢ जैसे वन ᭃेᮢ, कृिष ᭃेᮢ मᱶ कोई पाᳯरणािमक कटौती नहᱭ होगी और अᮧयु᭍ त या

अनु᭜ पादक कृिष ᭃेᮢᲂ मᱶ पुन: वनीकरण करने के ᮧयास ᳰकए जाएंगे ।

(2) ᮧाकृितक जल-᮲ोत--आंचिलक महायोजना मᱶ सभी ᮧाकृितक जल ᮲ोतᲂ कᳱ पहचान कᳱ जाएगी और उनके संरᭃण और

पुननᭅवीकरण के िलए योजना सि᭥ मिलत होगी और रा᭔ य सरकार ᳇ारा इन ᭃेᮢᲂ पर या उनके िनकट िवकास ᳰᮓयाकलापᲂ, जो

ऐसे ᭃेᮢᲂ के िलए हािनकारक है, को ᮧितिष᳍ करने के िलए ऐसी रीित से मागᭅिनदᱷश तैयार ᳰकए जाएंगे ।

(3) पयᭅटन–(क) पाᳯरि᭭थितक संवेदी जोन के भीतर पयᭅटन संबंधी ᳰᮓयाकलाप, पयᭅटन महायोजना के अनुसार हᲂगे, जो

आंचिलक महायोजना का एक भाग बनेगᱶ ।

(ख) पयᭅटन महायोजना पयᭅटन िवभाग, केरल सरकार ᳇ारा राज᭭ व और वन िवभाग, केरल सरकार के परामशᭅ से तैयार

होगी ।

(ग) पयᭅटन संबंधी ᳰᮓयाकलाप िन᳜ानुसार िविनयिमत ᳰकए जाएंगे, अथाᭅत् :-

(i) पाᳯरि᭭थितक संवेदी जोन के भीतर सभी नए पयᭅटन ᳰᮓयाकलापᲂ या िव᳒मान पयᭅटन ᳰᮓयाकलापᲂ का िव᭭तार

भारत सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय के मागᭅदशᭅक िस᳍ांतᲂ के ᳇ारा तथा पाᳯरि᭭थितक

पयᭅटन रा᭬ ᮝीय ᭪ याᮖ संरᭃण ᮧािधकरण, ᳇ारा जारी (समय-समय पर यथा संशोिधत) मागᭅदशᭅक िस᳍ांतᲂ के

अनुसार, पाᳯरि᭭थितक पयᭅटन, पाᳯरि᭭थितक िशᭃा और पाᳯरि᭭थितक िवकास को मह᭜व देते ᱟए पाᳯरि᭭थितक

संवेदी जोन कᳱ वहन ᭃमता के अ᭟ययन पर आधाᳯरत होगा;

(ii) पाᳯरि᭭ थितक अनुकूल पयᭅटन ᳰᮓयाकलापᲂ से संबंिधत पयᭅटकᲂ के अ᭭ थायी िनवास के िलए आवासन के िसवाय

पाᳯरि᭭थितक संवेदी जोन के भीतर होटल और ᳯरसोटᭅ के नए संिनमाᭅण अनु᭄ात नहᱭ हᲂगा ;

परंतु आंचिलक महायोजना के अनुसार िव᳒मान ᮧित᳧ापनᲂ के िव᭭तार को अनु᭄ात ᳰकया जाएगा ।

(iii) आंचिलक महायोजना का अनुमोदन ᳰकए जाने तक, पयᭅटन के िलए िवकास और िव᳒मान पयᭅटन ᳰᮓयाकलापᲂ

के िव᭭तार को वा᭭तिवक ᭭थल िविन᳸द᳥ संवीᭃा तथा मानीटरी सिमित कᳱ िसफाᳯरश पर आधाᳯरत संबंिधत

िविनयामक ᮧािधकाᳯरयᲂ ᳇ारा अनु᭄ात ᳰकया होगा ।

(4) नैसᳶगक िवरासत–पाᳯरि᭭थितक संवेदी जोन मᱶ मह᭜वपूणᭅ नैसᳶगक िवरासत के सभी ᭭थलᲂ जैसे सभी जीन कोश आरिᭃत

ᭃेᮢ, शैल िवरचनाएं, जल ᮧपातᲂ, झरनᲂ, घाटी मागᲄ, उपवनᲂ, गुफाᲐ, ᭭थलᲂ, ᮪मण, अ᳡रोहण, ᮧपातो आᳰद कᳱ पहचान

कᳱ जाएगी और उ᭠हᱶ पᳯररिᭃत ᳰकया जाएगा तथा उनकᳱ सुरᭃा और संरᭃा के िलए अंितम अिधसूचना के ᮧकाशन कᳱ

तारीख से छह मास के भीतर, उपयुᲦ योजना बनाई जाएगी और ऐसी योजना आंचिलक महायोजना का भाग होगा ।

(5) मानव िनᳶमत िवरासत ᭭ थल--पाᳯरि᭭ थितक संवेदी जोन मᱶ भवनᲂ, संरचनाᲐ, िश᭨प-त᭝य, ऐितहािसक, कला᭜मक और

सां᭭कृितक मह᭜व के ᭃेᮢᲂ कᳱ पहचान कᳱ जाएगी और अंितम अिधसूचना के ᮧकाशन कᳱ तारीख से छह मास के भीतर उनके

संरᭃण कᳱ योजनाएं तैयार कᳱ जाएंगी तथा आंचिलक महायोजना मᱶ सि᭥मिलत कᳱ जाएगी ।

(6) ᭟ विन ᮧदूषण–पाᳯरि᭭थितक संवेदी जोन मᱶ ᭟ विन ᮧदूषण के िनयंᮢण के िलए रा᭔ य सरकार का पयाᭅवरण िवभाग या केरल

रा᭔ य ᮧदूषण िनयंᮢण बोडᭅ, वायु (ᮧदूषण िनवारण और िनयंᮢण) अिधिनयम, 1981 (1981 का 14) और उसके अधीन

बनाए गए िनयमᲂ के उपबंधᲂ के अनुसरण मᱶ मागᭅदशᭅक िस᳍ांत और िविनयम तैयार करेगा ।

(7) वायु ᮧदूषण–पाᳯरि᭭थितक संवेदी जोन मᱶ, वायु ᮧदूषण के िनयंᮢण के िलए रा᭔ य सरकार का पयाᭅवरण िवभाग या रा᭔ य

ᮧदूषण िनयंᮢण बोडᭅ, वायु (ᮧदूषण िनवारण और िनयंᮢण) अिधिनयम, 1981 (1981 का 14) और उसके अधीन बनाए गए

िनयमᲂ के उपबंधᲂ के अनुसरण मᱶ मागᭅदशᭅक िस᳍ांत और िविनयम तैयार करेगा ।

(8) बिह᮲ाव का िन᭭सारण–पाᳯरि᭭थितक संवेदी जोन मᱶ उपचाᳯरत बिह᮲ाव का िन᭭सारण जल (ᮧदूषण िनवारण तथा

िनयंᮢण) अिधिनयम, 1974 (1974 का 6) और उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनुसार होगा ।

(9) ठोस अपिश᳥–ठोस अपिश᳥ᲂ का िनपटान िन᳜िलिखत ᱨप मᱶ होगा –

(i) पाᳯरि᭭थितक संवेदी जोन मᱶ ठोस अपिश᳥ᲂ का िनपटान भारत सरकार के त᭜कालीन पयाᭅवरण और वन मंᮢालय

कᳱ समय-समय पर यथा संशोिधत अिधसूचना सं. का.आ. 908(अ), तारीख 25 िसतंबर, 2000 को ᮧकािशत

नगरपािलका ठोस अपिश᳥ (ᮧबंध और हथालन) िनयम, 2000 के उपबंधᲂ के अनुसार ᳰकया जाएगा ;

(ii) ᭭थानीय ᮧािधकरण जैव िन᳜ीकरणीय और अजैव िन᳜ीकरणीय संघटकᲂ मᱶ ठोस अपिश᳥ᲂ के संपृथᲥन के िलए

योजनाएं तैयार करᱶगे ;

(iii) जैव िन᳜ीकरणीय सामᮕी को अिधमानतः खाद बनाकर या कृिम खेती के मा᭟यम से पुनःचᳰᮓत ᳰकया जाएगा ;

(iv) अकाबᭅिनक सामᮕी का िनपटान पाᳯरि᭭थितक संवेदी जोन के बाहर पहचान ᳰकए गए ᭭ थल पर ᳰकसी

पयाᭅवरणीय ᭭वीकृत रीित मᱶ होगा और पाᳯरि᭭थितक संवेदी जोन मᱶ ठोस अपिश᭬ टᲂ को जलाना या भ᭭ मीकरण

अनु᭄ात नहᱭ होगा ।

(10) जैव िचᳰक᭜ सीय अपिश᭬ ट.—पाᳯरि᭭थितक संवेदी जोन मᱶ जैव िचᳰक᭜सीय अपिश᳥ᲂ का िनपटान भारत सरकार के

त᭜कालीन पयाᭅवरण और वन मंᮢालय कᳱ समय-समय पर यथासंशोिधत अिधसूचना सं.का.आ.630 (अ) तारीख 20 जुलाई,

1998 ᳇ारा ᮧकािशत जैव िचᳰक᭜सीय अपिश᳥ (ᮧबंध और हथालन) िनयम, 1998 के उपबंधᲂ के अनुसार ᳰकया जाएगा ।

(11) यानीय पᳯरवहन - पᳯरवहन कᳱ यानीय गितिविधयां आवास के अनुकूल रीित मᱶ िविनयिमत हᲂगी और इस संबंध मᱶ

आंचिलक महायोजना मᱶ िवशेष उपबंध समािव᳥ ᳰकए जाएंगे और आंचिलक महायोजना के तैयार होने और रा᭔ य सरकार मᱶ

सᭃम ᮧािधकारी ᳇ारा अनुमोᳰदत होने तक, पाᳯरि᭭थितक संवेदी जोन मानीटरी सिमित यानीय गितिविधयᲂ के अनुपालन को

सुसंगत अिधिनयमᲂ के अधीन बनाए गए िनयमᲂ और िविनयमᲂ के अधीन मानीटर करेगी ।

(12) औ᳒ोिगक इकाᭅइयां.—(क) ᮧ᭭ तािवत पाᳯरि᭭ थितक संवेदी जोन मᱶ नए का᭬ ठ आधाᳯरत उ᳒ोगᲂ कᳱ ᭭ थापना को िसवाए

िविध के अनुसार ᭭ थािपत िव᳒मान कु᭬ ठ आधाᳯरत उ᳒ोगᲂ के अनु᭄ात नहᱭ ᳰकया जाएगा ।

(ख) जल, वायु, मृदा, ᭟ विन ᮧदूषण काᳯरत करने वाले ᳰकसी नए उ᳒ोग कᳱ ᮧ᭭ तािवत पाᳯरि᭭ थतक संवेदी जोन मᱶ ᭭थापना को

अनु᭄ात नहᱭ ᳰकया जाएगा ।

4. पाᳯरि᭭थितक संवेदी जोन मᱶ ᮧितिष᳍ और िविनयिमत ᳰकए जाने वाले ᳰᮓयाकलापᲂ कᳱ सूची - पाᳯरि᭭थितक संवेदी जोन

(क) भूिम के अिधभोगी के वा᭭तिवक कृिष उपयोग और घरेलू खपत

के िलए ही जल का िन᭬कषᭅण सतही और भूिमगत जल अनु᭄ात

होगा।

(ख) औ᳒ोिगक, वािणि᭔यक उपयोग के िलए सतही और भूिमगत

िलिखत अनु᭄ा अपेिᭃत होगी िजसके अंतगᭅत ᳰकतने पᳯरणाम मᱶ वह

िन᭬कषᭅण करेगा, भी है ।

(ग) सतही या भूजल का िवᮓय अनु᭄ात नहᱭ होगा ।

(घ) जल के संदूषण या ᮧदूषण, िजसके अंतगᭅत कृिष भी है, को रोकने

के िलए सभी उपाय ᳰकए जाएंगे ।

अ᭭ थायी िनवास के िलए आवासन के िसवाय पाᳯरि᭭थितक संवेदी

जोन के भीतर होटल और ᳯरसोटᭅ के नए संिनमाᭅण अनु᭄ात नहᱭ

हᲂगा;

परंतु आंचिलक महायोजना के अनुसार िव᳒मान ᮧित᳧ापनᲂ के

िव᭭तार को अनु᭄ात ᳰकया जाएगा।

(18)

संिनमाᭅण ᳰᮓयाकलाप ।

(क) रा᳦ीय पाकᭅ कᳱ सीमा से 1 ᳰकलोमीटर के भीतर नए

वािणि᭔यक संिनमाᭅण अनु᭄ात नहᱭ ᳰकया जाएगा :

परंतु ᭭ थानीय िनवािसयᲂ को उनके आवासीय उपयोग के िलए उनकᳱ

भूिम मᱶ संिनमाᭅण, िजसके अंतगᭅत पैरा 3 के उप पैरा (1) मᱶ सूचीब᳍

ᳰᮓयाकलाप भी हᱹ, को करने के िलए अनु᭄ात ᳰकया जाएगा ;

(ख) परंतु यह और ᳰक ᮧदूषण काᳯरत न करने वाले लघु उ᳒ोगᲂ से

संबंिधत संिनमाᭅण कायᭅकलापᲂ को िविनयिमत ᳰकया जाएगा और

लागू िनयमᲂ और िविनयमᲂ के अनुसार, यᳰद कोई हᲂ तो, सᭃम

ᮧािधकारी कᳱ पूवᭅ अनु᭄ा से ᭠यूनतम रखा जाएगा।

(ग) एक ᳰकलोमीटर से परे पाᳯरि᭭थितकᳱ संवेदी जोन के िव᭭तार

तक वा᭭तिवक ᭭थानीय आव᭫यकताᲐ के संिनमाᭅण ᳰᮓयाकलापᲂ

को महायोजना के अनुसार िविनयिमत ᳰकया जाएगा।

(19)

वृᭃᲂकᳱकटाई।

(क) रा᭔य सरकार मᱶ सᭃम ᮧािधकारी कᳱ पूवᭅ अनुमित के िबना वन,

सरकारी या राज᭭व या िनजी भूिम पर या वनᲂ मᱶ ᳴कही वृᭃᲂ कᳱ

कटाई नहᱭ होगी ।

(ख) वृᭃᲂ कᳱ कटाई, संबंिधत कᱶᮤीय या रा᭔य अिधिनयम या उसके

5. मानीटरी सिमित- (1) कᱶᮤीय सरकार, पाᳯरि᭭थितकᳱ संवेदी जोन कᳱ ᮧभावी मानीटरी के िलए एक मानीटरी सिमित का

गठन करती है, जो िन᳜िलिखत से िमलकर बनेगी, अथाᭅत् :-

i. िजला कले᭍टर, कोजीकोडे - अ᭟यᭃ ;

ii. वेयानाड़ िजला कले᭍टर का ᮧितिनिध - सद᭭ य ;

iii. िवधान सभा सद᭭य, पेरा᭥बरा - सद᭭ य ;

(इस शतᭅ के अधीन रहते ᱟए ᳰक केरल सरकार अ᭠य बातᲂ के साथ केरल िवधान सभा के सभापित से अनु᭄ा सिहत

सुसंगत अनुमोदन, यᳰद अपेिᭃत हो, ᮧा᳙ करेगी)

iv. िवधान सभा सद᭭य, बेलू᭭सेरी - सद᭭ य ;

सुसंगत अनुमोदन, यᳰद अपेिᭃत हो, ᮧा᳙ करेगी)

v. अ᭟यᭃ, िजला पंचायत, कोजीकोडे - सद᭭ य ;

vi. पयाᭅवरण के ᭃेᮢ मᱶ कायᭅ करने वाले गैर सरकारी संगठनᲂ (िजसके अंतगᭅत िवरासत संरᭃण भी है) का ᮧ᭜येक मामले

मᱶ एक वषᭅ कᳱ अविध के िलए केरल रा᭔य सरकार ᳇ारा नामिन᳸द᳥ एक ᮧितिनिध - सद᭭ य ;

vii. केरल सरकार ᳇ारा नामिन᳸द᭬ ट ᮧ᭜येक मामले मᱶ एक वषᭅ कᳱ अविध के िलए पाᳯरि᭭ थितक और पयाᭅवरण ᭃेᮢ का

एक िवशेष᭄– सद᭭ य ;

viii. िजला अिधकारी, केरल ᮧदूषण िनयंᮢण बोडᭅ, कोजीकोडे – सद᭭ य ;

ix. ᮧभागीय वन अिधकारी, कोजीकोडे - सद᭭ य-सिचव ।

6. िनदᱷश िनबंधन

(2) मानीटरी सिमित इस अिधसूचना के उपबंधᲂ के अनुपालन को मानीटर करेगी ।

(3) पाᳯरि᭭थितकᳱ संवेदी जोन मᱶ भारत सरकार के त᭜ कालीन पयाᭅवरण और वन मंᮢालय कᳱ अिधसूचना सं. का.आ.

1533(अ) तारीख 14 िसतंबर, 2006 कᳱ अनुसूची के अधीन सि᭥मिलत ᳰᮓयाकलापᲂ और इस अिधसूचना के पैरा 4 के अधीन

सारणी मᱶ िविन᳸द᭬ ट ᮧितिष᳍ गितिविधयᲂ के िसवाय आने वाले ऐसे ᳰᮓयाकलापᲂ कᳱ दशा मᱶ वा᭭तिवक िविन᳸द᳥ ᭭थलीय

दशाᲐ पर आधाᳯरत मानीटरी सिमित ᳇ारा संवीᭃा कᳱ जाएगी और उᲦ अिधसूचना के उपबंधᲂ के अधीन पूवᭅ पयाᭅवरण

िनकासी के िलए के᭠ᮤीय सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय को िन᳸द᳥ कᳱ जाएगी ।

(4) इस अिधसूचना के पैरा 4 के अधीन यथा िविन᳸द᳥ ᮧितिष᳍ ᳰᮓयाकलापᲂ के िसवाय, भारत सरकार के पयाᭅवरण और

वन मंᮢालय कᳱ अिधसूचना सं᭎यांक का.आ. 1533(अ) तारीख 14 िसतंबर, 2006 कᳱ अिधसूचना के अनुसूची के अधीन ऐसे

ᳰᮓयाकलापᲂ, िज᭠हᱶ सि᭥मिलत नहᱭ ᳰकया गया है, परंतु पाᳯरि᭭थितक संवेदी जोन मᱶ आते हᱹ, ऐसे ᳰᮓयाकलापᲂ कᳱ वा᭭तिवक

NOTIFICATION

S.O. 69(E).—The following draft of the notification, which the Central Government proposes to issue in

exercise of the powers conferred by sub-section (1), read with clause (v) and clause (xiv) of sub-section (2) and sub-

section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) is hereby published, as required under

sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, for the information of the public likely to be affected

thereby; and notice is hereby given that the said draft notification shall be taken into consideration on or after the expiry

of a period of sixty days from the date on which copies of the Gazette containing this notification are made available to

the public;

Any person interested in making any objections or suggestions on the proposals contained in the draft

notification may forward the same in writing, for consideration of the Central Government within the period so specified

Draft Notification

WHEREAS, the Malabar Wildlife Sanctuary is situated between 11⁰ 75' and 11⁰76' North latitude and between 76⁰ 20’

and 75⁰38' East longitude in the Chakkittapara and Chembanoda revenue villages of Quilandy taluk in Kozhikode

District of Kerala State;

AND WHEREAS, Malabar Wildlife Sanctuary is an integral part of the Western Ghats and has sharp topographical

gradient ranging from 40 to 1506 metres characterised by steep hills, deep valleys, marshy lands etc. with hillocks, and

has perennial water sources;

AND WHEREAS, the Sanctuary is characterised with high diversity of flora and the vegetation of the region varies from

hill top evergreen forests to tropical evergreen forests, semi evergreen forests and moist deciduous forests including

Terminalia bellerica, Pterocarpus marsupium, Stereospermum chelonoides, Grewia tilifolia, Dillenia pentagyna,

Lasianthus Sp, Psychotria Sp, Solanam Sp, Strobilanthus Sp;

AND WHEREAS, the sanctuary harbours several endemics and many rediscovered species with a a few species

occuring only within the sanctuary and the Malabar Wildlife Sanctuary is also the abode of a number of globally

threatened mammals, birds, reptiles, fishes and amphibians;

AND WHEREAS, the Malabar Wildlife Sanctuary is part of the Wayanad Elephant Reserve and supports diverse fauna

which include 41 species of mammals, of which 6 are endemic to Western Ghats, 38 species of amphibians of which 26

are endemics, 52 species of fishes, of which 21 are endemic;

AND WHEREAS, the sanctuary also harbours threatened mammal species such as tiger, leopard, leopard cat, jungle cat,

pangolin, slender loris, mouse deer, wild dog, flying squirrel and sloth bear;

AND WHEREAS, it is necessary to conserve and protect the area, extent and boundaries of which are specified in

paragraph 1 of this notification around the protected area of Malabar Wildlife Sanctuary as Eco- sensitive Zone from

ecological and environmental point of view and to prohibit industries or class of industries and their operations and

processes in the said Eco-sensitive Zone.

NOW THEREFORE, in exercise of the powers conferred by sub section (1) and clauses (v) and (xiv) of sub-section (2)

and sub-section (3) of section 3 of the Environment (Protection) Act 1986 (29 of 1986) read with sub-rule (3) of rule 5 of

the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area with an extent varying from

0.1 kilometre to 1 kilometer from the boundary of Malabar Wildlife Sanctuary in the State of Kerala as the Malabar

Wildlife Sanctuary Eco-sensitive Zone (herein after referred to as the Eco-sensitive Zone), details of which are as under,

namely:-

1. Extent and boundaries of Eco-sensitive Zone.—(1) The extent of Eco-Sensitive Zone varies from 0.1 kilometer to 1

kilometer around the boundary of Malabar Wildlife Sanctuary and is spread over an area of 37.9 square kilometre.

Details of boundary are appended as Annexure-I.

(2)

The map of the Eco-sensitive Zone along with co-ordinates of prominent points is appended as Annexure II.

(3)

The Eco-sensitive Zone covers two revenue villages including vested forests. The list of the villages and vested

forests falling within the Eco-sensitive Zone is appended as Annexure III.

2. Zonal Master Plan for the Eco-sensitive Zone.—(1) The State Government shall, for the purpose of the Eco-

sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of final

notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this

notification.

The said Plan shall be approved by the competent authority in the State Government.

(3)

The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as

is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued

by the Central Government, if any.

(4)

The Zonal Master Plan shall be prepared in consultation with all concerned State Departments, namely:-

(i)

Environment,

(ii)

Forest,

(iii)

Urban Development,

(iv)

Tourism,

(v)

Municipal,

(vi)

Revenue,

(vii)

Agriculture

(viii) State Pollution Control Board,

(ix)

Irrigation, and

(x)

Public Works Department

for integrating environmental and ecological considerations into it.

The Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities,

unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and

activities to be more efficient and eco-friendly.

(6)

The Zonal Master plan shall provide for restoration of denuded areas, conservation of existing water bodies,

management of catchment areas, watershed management, groundwater management, soil and moisture conservation,

needs of local community and such other aspects of the ecology and environment that need attention.

(7)

The Zonal Master Plan shall demarcate all the existing worshipping places, village and urban settlements, types

and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas,

orchards, lakes and other water bodies.

(8)

The Zonal Master Plan shall regulate development in Eco-sensitive Zone as to ensure eco-friendly development

for livelihood security of local communities.

(9)

Adequate publicity shall be given to the provisions of the Zonal Master Plan.

Measures to be taken by State Government.-The State Governments shall take the following measures for

giving effect to the provisions of this notification, namely:-

(1) Land use.—Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational

purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or industrial related

development activities:

Provided that the conversion of agricultural lands within the Eco-sensitive Zone may be permitted on the

recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet the

residential needs of local residents, and for the activities listed against serial numbers 17, 22, 28, 34 and 37 in column (2)

of the Table in paragraph 4, namely:-

(i)

eco-friendly cottages for temporary occupation of tourists, such as tents, wooden houses, etc. for eco-friendly

tourism activities,

(ii)

widening and strengthening of existing roads,

(iii)

small scale industries not causing pollution,

(iv)

rainwater harvesting, and

(v)

cottage industries including village industries, convenience stores and local amenities:

Provided further that no use of tribal land shall be permitted for commercial and industrial development

activities without the prior approval of the State Government and without compliance of the provisions of article 244 of

the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest

Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):

Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by

the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said

error shall be intimated to the Central Government in the Ministry of Environment, Forests and Climate Change:

Provided also that the above correction of error shall not include change of land use in any case except as

provided under this sub-paragraph:

Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural

area and efforts shall be made to reforest the unused or unproductive agricultural areas.

(2) Natural springs.-The catchment areas of all natural springs shall be identified and plans for their

conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the

State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to

such areas.

(3) Tourism.—(a) The activity relating to tourism within the Eco-sensitive Zone shall be as per Tourism Master Plan,

which shall form part of the Zonal Master Plan.

(b) The Tourism Master Plan shall be prepared by Department of Tourism, Government of Kerala in consultation with

Department of Revenue and Forests, Government of Kerala.

(i)

all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in

accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forests and Climate

Change and the eco-tourism guidelines issued by National Tiger Conservation Authority, (as amended from time to time)

with emphasis on eco-tourism, eco-education and eco-development and based on carrying capacity study of the Eco-

sensitive Zone;

(ii)

new construction of hotels and resorts shall not be permitted within the Eco-sensitive Zone except for

accommodation for temporary occupation of tourists related to Eco-friendly tourism activities:

Provided that extension of existing establishments may be permitted in accordance with the Zonal Master Plan.

(iii)

till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities

shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation

of the Monitoring Committee.

(4) Natural heritage.—All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve

areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and

preserved and plan shall be drawn up for their protection and conservation, within six months from the date of

publication of this notification and such plan shall form part of the Zonal Master Plan.

(5) Man-made heritage sites.—Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic,

and cultural significance shall be indentified in the Eco-sensitive Zone and plans for their conservation shall be prepared

within six months from the date of publication of final notification and incorporated in the Zonal Master Plan.

(6) Noise pollution.—The Environment Department of the State Government shall draw up guidelines and regulations

for the control of noise pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and

Control of Pollution) Act, 1981 (14 of 1981) and the rules made thereunder.

(7) Air pollution.—The Environment Department of the State Government shall draw up guidelines and regulations for

the control of air pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and

Control of Pollution) Act, 1981 (14 of 1981) and the rules made thereunder.

(8) Discharge of effluents.—The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the

provisions of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974) and the rules made thereunder.

(9) Solid wastes. - Disposal of solid wastes shall be as under:-

(i) the solid waste disposal in Eco-sensitive Zone shall be carried out as per the provisions of the Municipal Solid Waste

(Management and Handling) Rules, 2000 published by the Government of India in the erstwhile Ministry of

Environment and Forests vide notification number S.O. 908 (E), dated the 25^th September, 2000 as amended from time

to time;

(ii) the local authorities shall draw up plans for the segregation of solid wastes into biodegradable and non-biodegradable

components;

(iii) the biodegradable material shall be recycled preferably through composting or vermiculture;

(iv) The inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-

sensitive Zone and no burning or incineration of solid wastes shall be permitted in the Eco-sensitive Zone.

(10) Bio-medical waste.—The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out as per the

provisions of the Bio-Medical Waste (Management and Handling) Rules, 1998 published by the Government of India in

the erstwhile Ministry of Environment and Forests vide Notification number S.O. 630(E), dated the 20^th July, 1998 as

amended from time to time.

(11) Vehicular traffic. - The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific

provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal master plan is

prepared and approved by the Competent Authority in the State government, the Monitoring Committee shall monitor

compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.

(12) Industrial Units.-

(a) No establishment of new wood based Industries within the proposed Eco-sensitive zone shall be permitted except the

existing wood based Industries set up as per the law.

(b) No establishment of any new Industry causing water, air, soil, noise pollution within the proposed Eco-sensitive zone

shall be permitted.

4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.—All activities in the Eco sensitive

Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made

thereunder, and be regulated in the manner specified in the Table below, namely:-

5. Monitoring Committee.—(1) The Central Government hereby constitutes a Monitoring Committee, for effective

monitoring of the Eco-sensitive Zone, which shall comprise of the following namely:-

(i) The District Collector, Kozhikode-Chairman

(ii)

Representative of District Collector, Wayanad –Member

(iii)

The Member of Legislative Assembly, Perambra -Member

(Subject to the State Government of Kerala obtaining relevant approvals inter alia including permission from the

Speaker of Legislative Assembly, Kerala, if required)

(iv)

The Member of Legislative Assembly, Balussery - Member

(Subject to the State Government of Kerala obtaining relevant approvals inter alia including permission from the

Speaker of Legislative Assembly, Kerala, if required)

(v)

President, District Panchayat, Kozhikode –Member

(vi)

One representative of Non Governmental Organisation working in the field of environment to be nominated by

the Government of Kerala for a term of one year in each case –Member

(vii) one expert in the area of ecology and environment from a reputed institution of University in the State to be

nominated by the Government of Kerala for a term of one year in each case –Member

(viii) Kerala Pollution Control Board, District Officer, Kozhikode -Member

(ix)

The Divisional Forest Officer, Kozhikode –Member-Secretary

Terms of Reference:

The Monitoring Committee shall monitor the compliance of the provisions of this notification.

(3)

The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile

Ministry of Environment and Forest number S.O. 1533(E), dated the 14^th September, 2006, and are falling in the

Eco-sensitive Zone, except the prohibited activities as specified in column (3) of the Table under paragraph 4

thereof, shall be scrutinized by the Monitoring Committee based on the actual site-specific conditions and

referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior

environmental clearances under the provisions of the said notification.

The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile

Ministry of Environment and Forests number S.O. 1533(E), dated the 14^th September, 2006 but are falling in

the Eco-sensitive Zone, except the prohibited activities as specified in column (3) of the Table under paragraph

4 thereof, shall be scrutinized by the Monitoring Committee based on the actual site-specific conditions and

referred to the concerned regulatory authorities.

(5)

The Member-Secretary of the Monitoring Committee or the concerned Collector or the concerned park

incharge shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986

against any person who contravenes the provisions of this notification.

(6)

The Monitoring Committee may invite representatives or experts from concerned Departments, representatives

from Industry Associations or concerned stakeholders to assist in its deliberations depending on the

requirements on issue to issue basis.

(7)

The Monitoring Committee shall submit the annual action taken report of its activities as on 31^st March of every

year by 30^th June of that year to the Central Government in the Ministry of Environment, Forest and Climate

Change as per proforma given in Annexure IV.

The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions,

as it deems fit, to the Monitoring Committee for effective discharge of its functions.

The Central Government and State Government may specify additional measures, if any, for giving effect to

provisions of this notification.

The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon’ble

Supreme Court of India or the High Court or National Green Tribunal.

100 m width after Muthattupuzha along the southern inhabited area of Chempanoda village up to a
