अिधसूचना

नई ᳰद᭨ली, 7 जनवरी, 2016

का.आ. 70(अ).— िन᳜िलिखत ᮧाᱨप अिधसूचना, िजसे के᭠ᮤीय सरकार, पयाᭅवरण (संरᭃण) अिधिनयम, 1986

(1986 का 29) कᳱ धारा 3 कᳱ उपधारा (2) के खंड (v) और खंड (xiv) तथा उपधारा (3) के साथ पᳯठत उपधारा (1) ᳇ारा

ᮧदᱫ शिᲦयᲂ का ᮧयोग करते ᱟए, जारी करने का ᮧ᭭ताव करती है, पयाᭅवरण (संरᭃण) िनयम, 1986 के िनयम 5 के

उपिनयम (3) कᳱ अपेᭃानुसार, जनसाधारण कᳱ जानकारी के िलए ᮧकािशत कᳱ जाती है; िजनके उससे ᮧभािवत होने कᳱ

संभावना है, और यह सूचना दी जाती है ᳰक उᲦ ᮧाᱨप अिधसूचना पर, उस तारीख से, िजसको इस अिधसूचना वाले भारत

के राजपᮢ कᳱ ᮧितयां जनसाधारण को उपल᭣ध करा दी जाती हᱹ, साठ ᳰदन कᳱ अविध कᳱ समाि᳙ पर या उसके प᳟ात् िवचार

ᳰकया जाएगा ;

ऐसा कोई ᳞िᲦ, जो ᮧाᱨप अिधसूचना मᱶ अंतᳶव᳥ ᮧ᭭तावᲂ के संबंध मᱶ कोई आᭃेप या सुझाव देने मᱶ िहतब᳍ है, इस

ᮧकार िविन᳸द᳥ अविध के भीतर, के᭠ᮤीय सरकार ᳇ारा िवचार ᳰकए जाने के िलए, आᭃेप या सुझाव सिचव, पयाᭅवरण, वन

और जलवायु पᳯरवतᭅन मंᮢालय, इंᳰदरा पयाᭅवरण भवन, जोर बाग रोड, अलीगंज, नई ᳰद᭨ली-110003 या ई-मेल पते: esz-

[email protected] पर िलिखत ᱨप मᱶ भेज सकेगा ।

ᮧाᱨप अिधसूचना

तामोर ᳲपगला व᭠यजीव अभयार᭛य छᱫीसगढ़ के सूरजपुर िज़ला मᱶ ि᭭थत है, यह मह᭜वपूणᭅ संरिᭃत ᭃेᮢ है जो

िविभ᳖ ᳰक᭭म कᳱ वन᭭पित और जीव जंतुᲐ िजनमᱶ तᱶदुआ, िचᱫीदार मृग, मुंजक, चौसᱭगा मृग, नीला सांड, बनैला सूअर,

भारतीय गवर, रीछ आᳰद से िमलकर बने समृ᳍ ᮧाकृितक आवास के िलए जाना जाता है और तामोर ᳲपगला व᭠यजीव

अभयार᭛य 608.527 वगᭅ ᳰकलोमीटर के ᭃेᮢ मᱶ फैला ᱟआ है ।

और, तामोर ᳲपगला व᭠यजीव अभयार᭛य गुᱨ घासीदास रा᳦ीय पाकᭅ के साथ-साथ झारखंड मᱶ बेतला रा᳦ीय पाकᭅ के

साथ और म᭟य ᮧदेश मᱶ संजय दूबेरी पाकᭅ ᳯरजवᭅ के साथ बाघᲂ के िलए एक गिलयारे का िनमाᭅण करता है ।

और, तामोर ᳲपगला व᭠यजीव अभयार᭛य के चारᲂ ओर के ᭃेᮢ को, िजसका िव᭭तार और सीमाएं इस अिधसूचना के

पैरा 1 मᱶ िविन᳸द᳥ हᱹ, पयाᭅवरण कᳱ दृि᳥ से पाᳯरि᭭थितक संवेदी जोन के ᱨप मᱶ सुरिᭃत और संरिᭃत करना तथा उᲦ

पाᳯरि᭭थितक संवेदी जोन मᱶ उ᳒ोगᲂ या उ᳒ोगᲂ के वगᲃ के ᮧचालन तथा ᮧसं᭭करण करने को ᮧितिष᳍ करना आव᭫यक है;

अतः, अब, के᭠ᮤीय सरकार, पयाᭅवरण (संरᭃण) िनयम, 1986 के िनयम 5 के उपिनयम (3) के साथ पᳯठत पयाᭅवरण

(संरᭃण) अिधिनयम, 1986 (1986 का 29) कᳱ धारा 3 कᳱ उपधारा (1), उपधारा (2) के खंड (v) और खंड (xiv) और

उपधारा (3) ᳇ारा ᮧदᱫ शिᲦयᲂ का ᮧयोग करते ᱟए, छᱫीसगढ़ रा᭔ य के सूरजपुर िजले मᱶ तामोर ᳲपगला व᭠यजीव

अभयार᭛य कᳱ सीमा के चारᲂ ओर 2 ᳰकलोमीटर के िव᭭ तार वाले ᭃेᮢ को तामोर ᳲपगला व᭠यजीव अभयार᭛य पाᳯरि᭭ थितकᳱ

संवेदी जोन (िजसे इसमᱶ इसके प᭫ चात् पाᳯरि᭭ थितक संवेदी जोन कहा गया है) के ᱨप मᱶ अिधसूिचत करती है, िजसके ᭣यौरे

िन᳜ानुसार है, अथाᭅत् :--

पाᳯरि᭭थितकᳱ संवेदी जोन का िव᭭तार और उसकᳱ सीमाएं--(1) तामोर ᳲपगला व᭠यजीव अभयार᭛य का

पाᳯरि᭭ थितक संवेदी जोन 23° 30’ 10.37” से 23^o50’34.56” उᱫरी अᭃांश और 82^o43’49.43” से 83^o10’9.77” पूवᱮ

देशांतर मᱶ ि᭭थत है तामोर ᳲपगला व᭠यजीव अभयार᭛य के पᳯरसर से 2 ᳰकलोमीटर के भीतर आने वाले पाᳯरि᭭ थितकᳱ संवेदी

जोन 362.80 वगᭅ ᳰकलोमीटर (िजसके अंतगᭅत 254.98 वगᭅ ᳰकलोमीटर आरिᭃत और संरिᭃत वन भी है) । भारतीय वन

अिधिनयम, 1927 (1927 का 16) वन (संरᭃण अिधिनयम, 1980) (1960 का 69) अनुसूिचत जनजाित और अ᭠य

परंपरागत वन िनवासी (वन अिधकारᲂ कᳱ मा᭠यता) अिधिनयम, 2006 (2007 का 2) है, और अ᭠य सुसंगत अिधिनयम जहां

कहᱭ लागू होते हᲂ, लागू हᲂगे ; जीपीएस के िनबंधानानुसार तामोर ᳲपगला व᭠यजीव अभयार᭛य और इसकᳱ पाᳯरि᭭थितकᳱ

संवेदी जोन के िनदᱷशांक उपाबंध I मᱶ ᳰदए गए हᱹ ।

(2) पाᳯरि᭭थितकᳱ संवेदी जोन के अंतगᭅत आने वाले कुल 22 ᮕाम अथाᭅत चकदेही, रकसगᱶदा, पᱶदरी, बᲂगा

बडवारकाला, रमकोला, धूᳯरया, भेलक᭒छ घुई, बपाᭅतीया, खोपᮤा, चुटकᳱ, को᭨डरी, पुटकᳱ, बेडमी, नवाᳰदही, करवां,

तामकᳱ, जजवाल, िचकᳱणी, बसनारा और देवरी हᱹ ।

(3) अᭃांश और देशांतर रेखा के साथ-साथ पाᳯरि᭭थितक संवेदी जोन कᳱ सीमा के ᭣यौरे मानिचᮢ उपाबंध II के ᱧप मᱶ

उपाब᳍ है ।

2. पाᳯरि᭭थितकᳱ संवेदी जोन के िलए आंचिलक महायोजना –(1) रा᭔य सरकार, पाᳯरि᭭ थितकᳱ संवेदी जोन के ᮧयोजन के

िलए राजपᮢ मᱶ अंितम अिधसूचना के ᮧकाशन कᳱ तारीख से दो वषᭅ कᳱ अविध के भीतर, ᭭थानीय ᳞िᲦयᲂ के परामशᭅ से और

इस अिधसूचना मᱶ अनुबंधᲂ का पालन करते ᱟए एक आंचिलक महायोजना तैयार कᳱ जाएगी।

(2)

उᲦ योजना का रा᭔ य सरकार मᱶ सᭃम ᮧािधकारी ᳇ारा अनुमोदन ᳰकया जाएगा ।

(3)

पाᳯरि᭭ थितकᳱ संवेदी जोन का आंचिलक महायोजना रा᭔य सरकार ᳇ारा ऐसी रीित से जो इस अिधसूचना मᱶ

िविन᳸द᭬ ट ᳰकया जाए और सुसंगत कᱶᮤीय और रा᭔ य िविधयᲂ के और कᱶᮤीय सरकार ᳇ारा जारी मागᭅदशᭅक िस᳍ांतᲂ के अनुᱧप

तैयार ᳰक जाएगी ।

(4)

आंचिलक महायोजना इसमᱶ पयाᭅवरणीय और पाᳯरि᭭थितकᳱ िवचारणᲂ को सि᭥मिलत करने के िलए सभी संबंिधत

रा᭔य िवभागᲂ के परामशᭅ से तैयार ᳰकया जाएगा, अथाᭅत्:--

(i)

पयाᭅवरण ;

(ii)

वन ;

(iii)

शहरी िवकास ;

(iv)

पयᭅटन ;

(v)

नगरपािलक ;

(vi)

राज᭭ व ;

(vii)

कृिष ;

(viii)

छᱫीसगढ़ रा᭔ य ᮧदूषण िनयंᮢण बोडᭅ ;

(ix)

ᳲसचाई; और

(x)

लोक िनमाᭅण िवभाग ।

आंचिलक महायोजना मᱶ जब तक इस अिधसूचना मᱶ ऐसा िविन᳸द᭬ ट न हो तब तक अनुमोᳰदत िव᳒मान भू-उपयोग,

अवसंरचना और ᳰᮓयाकलापᲂ पर कोई िनबᲈधन अिधरोिपत नहᱭ ᳰकया जाएगा और आंचिलक महायोजना सभी अवसंरचना के

सुधार और अिधक दᭃ तथा पाᳯरि᭭ थितकᳱ अनुकूल होने वाले ᳰᮓयाकलाप इस ᮧकार िविन᳸द᭬ ट न हो।

आंचिलक महायोजना मᱶ अना᭒छाᳰदत ᭃेᮢᲂ के जीणᲃ᳍ार, िव᳒मान जल िनकायᲂ के संरᭃण, आवाह ᭃेᮢᲂ के

ᮧबंधन, जल-संभरᲂ के ᮧबंधन, भूतल जल के ᮧबंधन, मृदा और नमी संरᭃण, ᭭थानीय समुदायᲂ कᳱ आव᭫यकताᲐ तथा

पाᳯरि᭭थितकᳱ और पयाᭅवरण से संबंिधत ऐसे अ᭠य पहलुᲐ, िजन पर ᭟यान देना आव᭫यक है, के िलए उपबंध हᲂगे ।

आंचिलक महायोजना सभी िव᳒मान और ᮧ᭭तािवत पूजा ᭭ थलᲂ, ᮕामᲂ और नगरीय बंदोब᭭तᲂ, वनᲂ के ᮧकार और

ᳰक᭭ मᲂ, कृिष ᭃेᮢᲂ, ऊपजाऊ भूिम, हᳯरत ᭃेᮢ जैसे उ᳒ान और उसी ᮧकार के ᭭ थान, उ᳒ान कृिष ᭃेᮢ, आ᳸कडᲂ, झीलᲂ और

अ᭠य जल िनकायᲂ का अ᭤यकंन करेगी ।

आंचिलक महायोजना पाᳯरि᭭ थितक संवेदी जोन मᱶ िवकास को िविनयिमत करेगी िजससे पाᳯरि᭭ थितकᳱ अनुकूल

िवकास ᭭ थानीय समुदायᲂ कᳱ जीवकोपाजᭅन सुरᭃा के िलए सुिनि᭫ चत ᳰकया जा सके ।

3. रा᭔य सरकार ᳇ारा ᳰकए जाने वाले उपाय-- रा᭔य सरकार इस अिधसूचना के उपबंधᲂ को ᮧभावी करने के िलए

िन᳜िलिखत उपाय करेगी, अथाᭅत् :--

(1) भू-उपयोग - पाᳯरि᭭ थितक संवेदी जोन मᱶ वनᲂ, उ᳒ान-कृिष ᭃेᮢᲂ, कृिष ᭃेᮢᲂ, आमोद-ᮧमोद के ᮧयोजन के िलए िचि᭠हत

ᳰकए गए पाकᲄ और खुले ᭭थानᲂ का वािणि᭔यक और औ᳒ोिगक संब᳍ िवकास ᳰᮓयाकलापᲂ के िलए उपयोग या संपᳯरवतᭅन

नहᱭ होगा :

परंतु पाᳯरि᭭थितक संवेदी जोन के भीतर कृिष भूिम का संपᳯरवतᭅन, मानीटरी सिमित कᳱ िसफाᳯरश पर और रा᭔य

सरकार के पूवᭅ अनुमोदन से, ᭭थानीय िनवािसयᲂ कᳱ आवासीय जᱨरतᲂ को पूरा करने के िलए और पैरा 4 कᳱ सारणी के ᭭तंभ

(2) के अधीन ᮓम सं. 10, 21, सं. 26, सं. 27 और सं. 28 के सामने सूचीब᳍ ᳰᮓयाकलापᲂ को पूरा करने के िलए अनु᭄ात

हᲂगे, अथाᭅत् :-

(i)

पाᳯरि᭭ थितकᳱ अनुकूल पयᭅटन ᳰᮓयाकलापᲂ के िलए, पयᭅटकᲂ के अ᭭ थायी अिधभोग के िलए पाᳯरि᭭ थितकᳱ

अनुकूल कुटीर जैसे टे᭠ट, का᳥ गृह ;

(ii) िव᳒मान सड़कᲂ को चौड़ा तथा मजबूत करना और नई सड़कᲂ का संिनमाᭅण करना ;

(iii) ᮧदूषण उ᭜प᳖ न करने वाले लघु उ᳒ोग ;

(iv) वषाᭅ जल संचयन; और

(v) कुटीर उ᳒ोग, िजसके अंतगᭅत ᮕामीण उ᳒ोग भी हᱹ ।

परंतु यह और ᳰक रा᭔य सरकार के पूवᭅ अनुमोदन और संिवधान के अनु᭒ छेद 244 या त᭜समय ᮧवृᱫ िविध के उपबंधᲂ

के अनुपालन के िबना, िजसके अंतगᭅत अनुसूिचत जनजाित और अ᭠य परंपरागत वन िनवासी (वन अिधकारᲂ कᳱ मा᭠यता)

अिधिनयम, 2006 (2007 का 2) भी है, वािणि᭔यक या उ᳒ोग िवकास ᳰᮓयाकलापᲂ के िलए जनजातीय भूिम का उपयोग

अनु᭄ात नहᱭ होगा :

परंतु यह और भी ᳰक पाᳯरि᭭ थितकᳱ संवेदी जोन के भीतर भू-अिभलेखᲂ मᱶ ᮧतीत होने वाली कोई ᮢुᳯट, मानीटरी

सिमित के िवचार ᮧा᳙ करने के प᳟ात् रा᭔य सरकार ᳇ारा ᮧ᭜येक मामले मᱶ एक बार संशोिधत होगी और उᲦ ᮢुᳯट के

संशोधन कᳱ कᱶᮤीय सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय को सूचना देनी होगी :

परंतु यह और भी ᳰक उपयुᭅᲦ ᮢुᳯट के संशोधन मᱶ इस उप पैरा के अधीन यथा उपबंिधत के िसवाय ᳰकसी भी दशा मᱶ

भू-उपयोग का पᳯरवतᭅन सि᭥मिलत नहᱭ होगा :

परंतु यह और भी ᳰक िजससे हᳯरत ᭃेᮢ मᱶ जैसे वन ᭃेᮢ, कृिष ᭃेᮢ आᳰद मᱶ कोई पाᳯरणािमक कटौती नहᱭ होगी और

अनᮧयु᭍ त या अनु᭜ पादक कृिष ᭃेᮢᲂ मᱶ पुन: वनीकरण करने के ᮧयास ᳰकए जाएंगे ।

(2) ᮧाकृितक जल-᮲ोत -- आंचिलक महायोजना मᱶ सभी ᮧाकृितक जल ᮲ोतᲂ के आवाह ᭃेᮢᲂ कᳱ पहचान कᳱ जाएगी और

उनके संरᭃण और नवीकरण के िलए योजना सि᭥ मिलत होगी और रा᭔ य सरकार ᳇ारा इन ᭃेᮢᲂ पर या उनके िनकट िवकास

ᳰᮓयाकलापᲂ, जो ऐसे ᭃेᮢᲂ के िलए हािनकारक हᱹ, को ᮧितिष᳍ करने के िलए ऐसी रीित से मागᭅिनदᱷश तैयार ᳰकए जाएंगे ।

(3) पयᭅटन – (क) पाᳯरि᭭थितकᳱ संवेदी जोन के भीतर पयᭅटन संबंधी ᳰᮓयाकलाप, के अनुसार हᲂगे, जो आंचिलक

महायोजना, आंचिलक महायोजना का भाग हᲂगे ।

(ख) पयᭅटन महायोजना पयᭅटन िवभाग, रा᭔य सरकार के वन और पयाᭅवरण िवभाग, के परामशᭅ से तैयार होगी ।

(ग) पयᭅटन संबंधी ᳰᮓयाकलाप िन᭥ निलिखत के अधीन िविनयिमत हᲂगे, अथाᭅत् :-

(i) पाᳯरि᭭थितक संवेदी जोन के भीतर सभी नए पयᭅटन ᳰᮓयाकलापᲂ या िव᳒मान पयᭅटन ᳰᮓयाकलापᲂ का िव᭭तार

कᱶᮤीय सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय के मागᭅदशᭅक िस᳍ांतᲂ के ᳇ारा तथा पाᳯरि᭭थितक

पयᭅटन रा᭬ ᮝीय ᭪ याᮖ संरᭃण ᮧािधकरण, ᳇ारा जारी (समय-समय पर यथा संशोिधत) मागᭅदशᭅक िस᳍ांतᲂ के

अनुसार, पाᳯरि᭭थितक पयᭅटन, पाᳯरि᭭थितक िशᭃा और पाᳯरि᭭थितक िवकास को मह᭜व देते ᱟए पाᳯरि᭭थितकᳱ

संवेदी जोन कᳱ वहन ᭃमता के अ᭟ययन पर आधाᳯरत होगा;

(ii) पाᳯरि᭭थितकᳱय अनुकूल पयᭅटक ᳰᮓयाकलापᲂ के संबंध मᱶ अ᭭थायी अिधभोग के िलए वास सुिवधा के िसवाय

तामोर ᳲपगला व᭠यजीव अभयार᭛य कᳱ सीमा से एक ᳰकलोमीटर भीतर होटल और ᳯरसोटᲄ का नया संिनमाᭅण

अनु᭄ात नहᱭ होगा

परंतु संरिᭃत ᭃेᮢᲂ कᳱ सीमा से एक ᳰकलोमीटर कᳱ दूरी से परे पाᳯरि᭭थितकᳱय संवेदी जोन कᳱ सीमा तक नए होटल

और ᳯरसोटᭅ के ᭭थापन पयᭅटन महायोजना के अनुसार पाᳯरि᭭थितकᳱय पयᭅटन सुिवधा के िलए पूवᭅ पᳯरभािषत और

िविन᳸द᳥ ᭭थान मᱶ ही अनु᭄ात ᳰकया जाएगा ।

(iii) आंचिलक महायोजना का अनुमोदन ᳰकए जाने तक, पयᭅटन के िलए िवकास और िव᳒मान पयᭅटन ᳰᮓयाकलापᲂ

के िव᭭तार को वा᭭तिवक ᭭थल िविन᳸द᳥ संवीᭃा तथा मानीटरी सिमित कᳱ िसफाᳯरश पर आधाᳯरत संबंिधत

िविनयामक ᮧािधकाᳯरयᲂ ᳇ारा अनु᭄ात ᳰकया होगा ।

(4) नैसᳶगक िवरासत -- पाᳯरि᭭थितकᳱ संवेदी जोन मᱶ मह᭜वपूणᭅ नैसᳶगक िवरासत के सभी ᭭थलᲂ जैसे सभी जीन कोश

आरिᭃत ᭃेᮢ, शैल िवरचनाएं, जल ᮧपातᲂ, झरनᲂ, घाटी मागᲄ, उपवनᲂ, गुफाᲐ, ᭭थलᲂ, ᮪मण, अ᳡रोहण, ᮧपातᲂ आᳰद कᳱ

पहचान कᳱ जाएगी और उ᭠हᱶ पᳯररिᭃत ᳰकया जाएगा तथा उनकᳱ सुरᭃा और संरᭃा के िलए इस अिधसूचना के ᮧकाशन कᳱ

तारीख से छह मास के भीतर, उपयुᲦ योजना बनाई जाएगी और ऐसी योजना आंचिलक महायोजना का भाग होगी ।

(5) मानव िनᳶमत िवरासत ᭭ थल - पाᳯरि᭭ थितकᳱ संवेदी जोन मᱶ भवनᲂ, संरचनाᲐ, िश᭨प-त᭝य, ऐितहािसक, वा᭭तु िश᭨पीय

कला᭜मक और सां᭭कृितक मह᭜व के ᭃेᮢᲂ और उपᭃेᮢᲂ कᳱ पहचान करनी होगी और इस अिधसूचना के ᮧकाशन कᳱ तारीख से

छह मास के भीतर उनके संरᭃण कᳱ योजनाएं तैयार करनी होगी तथा आंचिलक महायोजना मᱶ सि᭥मिलत कᳱ जाएंगी ।

(6) ᭟ विन ᮧदूषण -- पाᳯरि᭭थितकᳱ संवेदी जोन मᱶ ᭟ विन ᮧदूषण के िनयंᮢण के िलए रा᭔ य सरकार का पयाᭅवरण िवभाग या

छᱫीसगढ़ रा᭔ य ᮧदूषण िनयंᮢण बोडᭅ, वायु (ᮧदूषण िनवारण और िनयंᮢण) अिधिनयम, 1981 (1981 का 14) और उसके

अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनुसरण मᱶ मागᭅदशᭅक िस᳍ांत और िविनयम तैयार करेगा ।

(7) वायु ᮧदूषण -- पाᳯरि᭭थितकᳱ संवेदी जोन मᱶ, वायु ᮧदूषण के िनयंᮢण के िलए छᱫीसगढ़ रा᭔य या रा᭔ य सरकार का

पयाᭅवरण िवभाग या म᭟ य ᮧदेश रा᭔ य ᮧदूषण िनयंᮢण बोडᭅ, वायु (ᮧदूषण िनवारण और िनयंᮢण) अिधिनयम, 1981 (1981

का 14) और उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनुसरण मᱶ मागᭅदशᭅक िस᳍ांत और िविनयम तैयार करेगा ।

(8) बिह᮲ाव का िन᭭सारण -- पाᳯरि᭭थितकᳱ संवेदी जोन मᱶ उपचाᳯरत बिह᮲ाव का िन᭭सारण जल (ᮧदूषण िनवारण तथा

िनयंᮢण) अिधिनयम, 1974 (1974 का 6) और उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनुसार होगा ।

(9) ठोस अपिश᳥ -- ठोस अपिश᳥ᲂ का िनपटान िन᳜िलिखत ᱨप मᱶ होगा -

(i)

पाᳯरि᭭थितकᳱ संवेदी जोन मᱶ ठोस अपिश᳥ᲂ का िनपटान भारत सरकार के त᭜कालीन पयाᭅवरण और वन

मंᮢालय कᳱ समय-समय पर यथा संशोिधत अिधसूचना सं. का.आ. 908(अ), तारीख 25 िसतंबर, 2000

को ᮧकािशत नगरपािलक ठोस अपिश᳥ (ᮧबंध और हथालन) िनयम, 2000 के उपबंधᲂ के अनुसार ᳰकया

जाएगा ;

(ii)

᭭थानीय ᮧािधकरण जैव िन᳜ीकरणीय और अजैव िन᳜ीकरणीय संघटकᲂ मᱶ ठोस अपिश᳥ᲂ के संपृथᲥन के

िलए योजनाएं तैयार करᱶगे ;

(iii)

जैव िन᳜ीकरणीय सामᮕी को अिधमानतः खाद बनाकर या कृिम खेती के मा᭟यम से पुनःचᳰᮓत ᳰकया

जाएगा ;

(iv)

अकाबᭅिनक सामᮕी का िनपटान पाᳯरि᭭थितकᳱ संवेदी जोन के बाहर पहचान ᳰकए गए ᭭ थल पर ᳰकसी

पयाᭅवरणीय ᭭वीकृत रीित मᱶ होगा और पाᳯरि᭭थितकᳱ संवेदी जोन मᱶ ठोस अपिश᭬ टᲂ को जलाना या

भ᭭ मीकरण अनु᭄ात नहᱭ होगा ।

(10) जैव िचᳰक᭜ सीय अपिश᭬ ट- पाᳯरि᭭थितकᳱ संवेदी जोन मᱶ जैव िचᳰक᭜सीय अपिश᳥ᲂ का िनपटान भारत सरकार के

त᭜कालीन पयाᭅवरण और वन मंᮢालय कᳱ समय-समय पर यथासंशोिधत अिधसूचना सं.का.आ.630 (अ) तारीख 20 जुलाई,

1998 ᳇ारा ᮧकािशत जैव िचᳰक᭜सीय अपिश᳥ (ᮧबंध और हथालन) िनयम, 1998 के उपबंधᲂ के अनुसार ᳰकया जाएगा ।

(11) यानीय पᳯरवहन - पᳯरवहन कᳱ यानीय गित आवास के अनुकूल रीित मᱶ िविनयिमत होगी और इस संबंध मᱶ आंचिलक

महायोजना मᱶ िवशेष उपबंध समािव᳥ ᳰकए जाएंगे और आंचिलक महायोजना के तैयार होने और पयाᭅवरण और वन मंᮢालय

के ᳇ारा अनुमोᳰदत होने तक, रा᭔य ᭭तरीय पाᳯरि᭭थितकᳱ संवेदी जोन मानीटरी सिमित ᮧवृᱫ िनयमᲂ और िविनयमᲂ के

अनुसार यानीय गितिविधयᲂ के अनुपालन को मानीटर करेगी ।

(12) औ᳒ोिगक इकाᭅइयां.-

(क) ᮧ᭭ तािवत ᮧाᳯरि᭭ थितकᳱ संवेदी जोन के भीतर नए का᳧ उ᳒ोगᲂ कᳱ ᭭थापना िविध के अनुसार ᭭थािपत िव᳒मान का᳧

आधाᳯरत उ᳒ोगᲂ के िलए अनु᭄ात कᳱ जाएगी अ᭠यथा नहᱭ ।

(ख) ᮧ᭭ तािवत पाᳯरि᭭ थितकᳱ संवेदी जोन के भीतर जल, वायु, मृदा, ᭟ विन ᮧदूषण उ᭜प᳖ करने वाले नए उ᳒ोग कᳱ ᭭ थापना

नहᱭ कᳱ जाएगी।

गोवा फाउंडेशन बनाम भारत सरकार के मामले मᱶ तारीख 21

अ᭭थायी अिधभोग के िलए वास सुिवधा के िसवाय तामोर

ᳲपगला व᭠यजीव अभयार᭛य कᳱ सीमा से एक ᳰकलोमीटर

भीतर होटल और ᳯरसोटᲄ का नया संिनमाᭅण अनु᭄ात नहᱭ

होगा ।

तामोर ᳲपगला व᭠यजीव अभयार᭛य कᳱ सीमा से एक

ᳰकलोमीटर से परे और पाᳯरि᭭थितकᳱ संवेदी

जोन तक सभी नए पयᭅटन ᳰᮓयाकलापᲂ या िव᳒मान

ᳰᮓयाकलापᲂ का िव᭭तार पयᭅटन महायोजना के अनुᱧप होगा ।

11.

संिनमाᭅण ᳰᮓयाकलाप ।

(क) संरिᭃत ᭃेᮢᲂ तामोर ᳲपगला व᭠यजीव अभयार᭛य कᳱ

सीमा से दो ᳰकलोमीटर के भीतर ᳰकसी भी ᮧकार के नए

वािणि᭔ यक संिनमाᭅण अनु᭄ात नहᱭ ᳰकया जाएगा :

परंतु ᭭ थानीय लोगᲂ को पैरा 3 के उप पैरा (1) मᱶ सूचीब᳍

ᳰᮓयाकलापᲂ सिहत उनके आवासीय उपयोग के िलए उनकᳱ

भूिम मᱶ संिनमाᭅण करने कᳱ अनुमित दी जाएगी ;

परंतु ऐसे लघु उ᳒ोगᲂ जो ᮧदूषण उ᭜प᳖ नहᱭ करते हᱹ, से

संबंिधत संिनमाᭅण ᳰᮓयाकलाप िविनयिमत ᳰकए जाएंगे और

लागू िनयम यᳰद कोई हᲂ और िविनयमᲂ, के अनुसार सᭃम

ᮧािधकारी के पूवᭅ अनुमित से ही ᭠यूनतम पर रखे जाएंगे ।

(ख) तामोर ᳲपगला व᭠यजीव अभयार᭛य कᳱ सीमा से एक

ᳰकलोमीटर से आगे, और पाᳯरि᭭ थितकᳱ संवेदी जोन कᳱ

सीमा तक वा᭭तिवक ᭭थानीय आव᭫यकताᲐ के िलए

संिनमाᭅण कᳱ अनु᭄ा दी जाएगी और अ᭠य वािणि᭔यक

संिनमाᭅण ᳰᮓयाकलाप आंचिलक महायोजना के अनुᱧप हᲂगे।

12.

भूिम खुदाई ।

नई भूिम कᳱ खुदाई कᳱ ᭭थापना ᮧितिष᳍ है और पुरानी

भूिम कᳱ खुदाई लागू िविधयᲂ के अधीन िविनयिमत कᳱ

जाएगी ।

13.

ᮧाकृितकजलिनकायᲂयासतही

ᭃेᮢ मᱶ अनुपचाᳯरत बिह᮲ाᭅव और

ठोस अपिश᳥ᲂ का िन᭭सारण ।

लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।

14.

वायु और यािनक ᮧदूषण ।

लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।

15.

᭟विन ᮧदूषण ।

लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।

16.

भू-जल िन᭬कषᭅण।

लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।

17.

वृᭃᲂकᳱकटाई।

(क) रा᭔य सरकार मᱶ सᭃम ᮧािधकारी कᳱ पूवᭅ अनुमित के

िबना वन, सरकारी या राज᭭व या िनजी भूिम पर या वनᲂ मᱶ

᳴कही वृᭃᲂ कᳱ कटाई नहᱭ होगी ।

(ग) आरिᭃत वनᲂ और संरिᭃत वनᲂ कᳱ दशा मᱶ कायᭅ योजना

का अनुसरण ᳰकया जाएगा ।

18.

ᮧवासी चरने वाले पशु ।

लागू िविधयᲂ के अधीनऔर आंचिलक महायोजना के अनुसार

िविनयिमत हᲂगे ।

19.

िव᳒मान ᭭थापना ।

लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।

20.

िव᳒ुत लाइनᲂ का रोधन ।

भूिमगत केबल डालने को बढ़ावा ᳰदया जाएगा और

पाᳯरि᭭थितकᳱ संवेदी जोन से होकर गुजरने वाली सभी

िव᳒मान िव᳒ुत लाइनᲂ को आंचिलक महायोजना के अधीन

िविहत समय सीमा मᱶ पयाᭅ᳙ ᱧप से रोिधत ᳰकया जाएगा ।

21.

िव᳒मानसड़कᲂकोचौड़ाकरना

और उ᭠हᱶ सुदृढ करना ।

उिचतपयाᭅवरण समाघात िनधाᭅरण और ᭠ यूनीकरण उपाय

यथा लागू अनुसार हᲂगे ।

22.

होटलᲂ और लॉज के िव᳒मान

पᳯरसरᲂ मᱶ बाड़ लगाना ।

लागू िविधयᲂ के अधीन िविनयिमत हᲂगे ।

पाᳯरि᭭थितकᳱ संवेदी जोन के भीतर व᭠य जीव के अबाध चलन

को अनु᭄ात करने के िलए होटलᲂ या अ᭠य वािणि᭔यक ᭭थापनᲂ

को कांटेदार तार से उनकᳱ संपिᱫयᲂ कᳱ बाड़ एक मीटर से

अिधक कᳱ नहᱭ होगी तथा इस अनुबंध का अनुपालन न करने

वाली िव᳒मान बाड को आंचिलक महायोजना मᱶ उि᭨लिखत

समय सीमाᲐ के अनुसार उपांतᳯरत ᳰकया जाएगा ।

संवᳶधत ᳰᮓयाकलाप :

23.

᭭थानीय समुदायᲂ ᳇ारा चल रही

कृिष और बागबानी ᳞वसायᲂ के

साथ पशुपालन, पशुपालन कृिष,

जल कृिष और मछली पालन ।

आधाᳯरत उ᳒ोग, जो मᱶ देशीय माल से औ᳒ोिगक उ᭜ पादᲂ का

उ᭜ पादन करते हᱹ और जो पयाᭅवरण पर कोई िवपरीत ᮧभाव

नहᱭ डालते हᱹ, को अनु᭄ाक ᳰकया जाएगा ।

29.

नवीकरणीयऊजाᭅ᮲ोतकाउपयोग।

सᳰᮓयᱨपसेबढावाᳰदयाजाएगा ।

5. मानीटरी सिमित.- (1) कᱶᮤीय सरकार, छᱫीसगढ़ रा᭔य के िलए पाᳯरि᭭थितक संवेदी जोन कᳱ ᮧभावी मानीटरी के िलए

एक मानीटरी सिमित का गठन करेगी िजसके नाम मानीटरी सिमित होगा, अथाᭅत् :-

(i) ᮧभागीय आयुᲦ, सरगुजा अंिबकापुर - अ᭟यᭃ ;

(ii) छᱫीसगढ़ सरकार ᳇ारा नामिन᳸द᭬ ट पाᳯरि᭭ थितक और पयाᭅवरण ᭃेᮢ ᮧ᭜येक मामले मᱶ एक वषᭅ कᳱ अविध के िलए

एक िवशेष᭄– सद᭭ य ;

(iii) िजला पंचायत, सूरजपुर का मु᭎य कायᭅकारी अिधकारी- सद᭭ य;

(iv) पयाᭅवरण के ᭃेᮢ मᱶ कायᭅ करने वाले गैर सरकारी संगठनᲂ (िजसके अंतगᭅत िवरासत संरᭃण भी है) का ᮧ᭜येक मामले

मᱶ एक वषᭅ कᳱ अविध के िलए छᱫीसगढ़ रा᭔य सरकार ᳇ारा नामिन᳸द᳥ एक ᮧितिनिध - सद᭭ य;

(v) छᱫीसगढ़ पयाᭅवरण संरᭃण बोडᭅ का ᮧितिनिध – सद᭭ य ;

(vi) कल᭍टर, सूरजपुर – सद᭭ य ;

(vii) अधीᭃण इंजीिनयर, लोक िनमाᭅण िवभाग, सूरजपुर– सद᭭ य ;

(viii) अधीᭃण इंजीिनयर, जन ᭭वा᭭᭝य इंजीिनयरी, सूरजपुर– सद᭭ य ;

(ix) नगर और ᮕा᭥य िनयोजन का ᮧितिनिध– सद᭭ य ;

(x) िजला वन अिधकारी, सूरजपुर– सद᭭ य ;

(xi) वन संरᭃक (व᭠यजीव) और ᭃेᮢ िनदेशक हाथी ᳯरजवᭅ, अंिबकापुर – सद᭭ य-सिचव ।

6. िनदᱷश िनबंधन :-

(1) मािन टरी सिमित इस अिधसूचना के उपबंधᲂ के अनुपालन को मानीटर करेगी ।

(2) पाᳯरि᭭थितकᳱ संवेदी जोन मᱶ भारत सरकार के त᭜ कालीन पयाᭅवरण और वन मंᮢालय कᳱ अिधसूचना सं. का.आ.

1533(अ) तारीख 14 िसतंबर, 2006 कᳱ अनुसूची के अधीन सि᭥मिलत ᳰᮓयाकलापᲂ और इस अिधसूचना के पैरा 4 के अधीन

ᮧितिष᳍ गितिविधयᲂ के िसवाय आने वाले ऐसे ᳰᮓयाकलापᲂ कᳱ दशा मᱶ वा᭭तिवक िविन᳸द᳥ ᭭थलीय दशाᲐ पर आधाᳯरत

मानीटरी सिमित ᳇ारा संवीᭃा कᳱ जाएगी और उᲦ अिधसूचना के उपबंधᲂ के अधीन पूवᭅ पयाᭅवरण िनकासी के िलए के᭠ᮤीय

सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय को िन᳸द᳥ कᳱ जाएगी ।

(3) इस अिधसूचना के पैरा 4 के अधीन यथा िविन᳸द᳥ ᮧितिष᳍ ᳰᮓयाकलापᲂ के िसवाय, भारत सरकार के पयाᭅवरण

और वन मंᮢालय कᳱ अिधसूचना सं᭎यांक का.आ. 1533(अ) तारीख 14 िसतंबर, 2006 कᳱ अिधसूचना के अनुसूची के अधीन

ऐसे ᳰᮓयाकलापᲂ, िज᭠हᱶ सि᭥मिलत नहᱭ ᳰकया गया है, परंतु पाᳯरि᭭थितक संवेदी जोन मᱶ आते हᱹ, ऐसे ᳰᮓयाकलापᲂ कᳱ

वा᭭तिवक िविन᳸द᳥ ᭭थलीय दशाᲐ पर आधाᳯरत मानीटरी सिमित ᳇ारा संवीᭃा कᳱ जाएगी और उसे संब᳍ िविनयामक

ᮧािधकरणᲂ को िन᳸द᳥ ᳰकया जाएगा ।

(4) मानीटरी सिमित का सद᭭य-सिचव या संब᳍ कल᭍टर या संबंिधत मु᭎ य वन संरᭃक (व᭠ यजीव) ऐसे ᳞िᲦ के

िवᱨ᳍, जो इस अिधसूचना के ᳰकसी उपबंध का उ᭨लंघन करता है, पयाᭅवरण (संरᭃण) अिधिनयम, 1986 कᳱ धारा 19 के

अधीन पᳯरवाद फाइल करने के िलए सᭃम होगा ।

(5) मानीटरी सिमित मु᳎ᲂ के आधार पर अपेᭃाᲐ पर िनभᭅर रहते ᱟए संब᳍ िवभागᲂ के ᮧितिनिधयᲂ या िवशेष᭄ᲂ,

औ᳒ोिगक संगमᲂ या संब᳍ पणधाᳯरयᲂ के ᮧितिनिधयᲂ को अपने िवचार-िवमशᭅ मᱶ सहायता के िलए आमंिᮢत कर सकेगी ।

(6) मानीटरी सिमित ᮧ᭜येक वषᭅ कᳱ 31 माचᭅ तक रा᭔ य के मु᭎ य व᭠ यजीव वाडᭅन को अपनी वाᳶषक कारᭅवाई ᳯरपोटᭅ

उपाबंध III मᱶ उपबंिधत ᱨप मᱶ उ᭍ त वषᭅ के 30 जून तक ᮧ᭭तुत करेगी ।

(7) के᭠ᮤीय सरकार का पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय मानीटरी सिमित को अपने कृ᭜यᲂ के ᮧभावी

िनवᭅहन के िलए समय-समय पर ऐसे िनदेश दे सकेगा, जो वह ठीक समझे ।

इस अिधसूचना के उपबंध , भारत के माननीय उᲬतम ᭠यायालय या उᲬ ᭠यायालय या रा᭬ ᮝीय हᳯरत ᮧािधकरण

᳇ारा पाᳯरत कोई आदेश या पाᳯरत होने वाले ᳰकसी आदेश, यᳰद कोई हᲂ, के अधीन हᲂगे ।

MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE

NOTIFICATION

New Delhi, the 7^th January, 2016

S.O. 70(E).— The following draft of the notification, which the Central Government proposes to issue in exercise of the

powers conferred by sub-section (1), read with clause (v) and clause (xiv) of sub-section (2) and sub-section (3) of

section 3 of the Environment (Protection) Act, 1986 (29 of 1986) is hereby published, as required under sub-rule (3) of

rule 5 of the Environment (Protection) Rules, 1986, for the information of the public likely to be affected thereby; and

notice is hereby given that the said draft notification shall be taken into consideration on or after the expiry of a period of

sixty days from the date on which copies of the Gazette containing this notification are made available to the public;

Any person interested in making any objections or suggestions on the proposals contained in the draft

notification may forward the same in writing, for consideration of the Central Government within the period so specified

Draft Notification

WHEREAS, the Tamor Pingla Wildlife Sanctuary located in district Surajpur, Chhattisgarh is an important

protected area known for its rich habitat consisting of a variety of flora and fauna including Leopard, Spotted Deer,

Barking Deer, Four Horned Antelope, Blue Bull, Wild Boar, Indian Bison, Sloth Bear, etc and the Tamor Pingla Wildlife

Sanctuary is spread over an area of 608.527 square kilometre.

AND WHEREAS, the Tamor Pingla Wildlife Sanctuary along with Ghurughasi Das National Park forms a

national corridor for tigers with Betala National Park in Jharkhand and with Sanjay Dubari Tiger Reserve in Madhya

Pradesh.

AND WHEREAS, it is necessary to conserve and protect the area the extent and boundaries of which are

specified in paragraph 1 of this notification around the protected area of Tamor Pingla Wildlife Sanctuary as Eco-

sensitive zone (ESZ) from ecological, environmental and biodiversity point of view and to prohibit industries or class of

industries and their operations and processes in the said Eco-sensitive Zone.

NOW THEREFORE, in exercise of the power conferred by sub section(1) and clauses (v) and (xiv) of sub-

section (2) and sub-section (3) of section 3 of the Environment (Protection) Act 1986 (29 of 1986) read with sub-rule (3)

of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area with an extent

upto two kilometres around the boundary of Tamor Pingla Wildlife Sanctuary in district Surajpur, in the State of

Chhattisgarh as the Tamor Pingla Wildlife Sanctuary Eco-sensitive Zone (herein after referred to as the Eco-sensitive

Zone) details of which are as under, namely:-

Extent and Boundaries of Eco-sensitive Zone:- (1) The eco-sensitive zone of the Tamor Pingla Widllife

Sanctuary lies between 23⁰30^’10.37” to 23^o50’34.56” N latitude and 82^o43’49.43” to 83^o10’9.77” E longitude. The Eco-

sensitive Zone shall be 362.80 square kilometres (including 254.98 square kilometre reserve and protected forest and

107.82 sq.km Revenue area) with an extent of 2 kilo meter from the periphery of the Tamor Pingla Wildlife Sanctuary

and the provisions of the Indian Forest Act, 1927 (16 of 1927), Forest (Conservation) Act, 1980 (69 of 1980), the

Schedule Tribes and other Traditional Forest Dwellers ( Recognition of Forest Rights) Act, 2006 (2 of 2007) and other

relevant acts wherever applicable shall also apply; the boundary details of Tamor Pingla Wildlife Sanctuary and its eco-

sensitive zone in terms of Global Positioning System coordinates are given in Annexure-I.

(2) A total of twenty two villages fall within the Eco-sensitive Zone, namely Chakdehi, Rakasganda, Pendri, Bonga,

Badwarkala, Ramkola, Dhuria, Bhelkachh, Ghui, Barpatia, Khopdra, Chutki, Koldri, Putki, Bedmi, Nawadih, Karwan,

Tamki, Jajwal, Chikni, Basnara and Deori.

(3) The map of the Eco-sensitive Zone along with boundary details and latitudes and longitudes is appended as

Annexure-II.

Zonal Master Plan for Eco-sensitive Zone.- (1) The State Government shall, for the purpose of the Eco-

sensitive Zone prepare a Zonal Master Plan, within a period of two years from the date of publication of final

notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this

notification.

(2)

The said Plan shall be approved by the Competent Authority in the State Government.

(3)

The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such a manner

as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines

issued by the Central Government, if any.

(4)

The Zonal Master Plan shall be prepared in consultation with all concerned State Departments, namely:-

(i)

Environment;

(ii)

Forest;

(iii)

Urban Development;

(iv)

Tourism;

(v)

Municipal;

(vi)

Revenue;

(vii)

Agriculture;

(viii) Chhattisgarh Environment Conservation Board;

(ix)

Irrigation;

(x)

Public Works Department ,

for integrating environmental and ecological consideration into it.

The Zonal Plan shall not impose any restriction on the approved existing land use, infrastructure and activities,

unless so specified in this notification and the said Master Plan shall factor in improvement of all infrastructure and

activities to be more efficient and eco-friendly.

(6)

The Zonal Master plan shall provide for restoration of denuded areas, conservation of existing water bodies,

management of catchment areas, watershed management, groundwater management, soil and moisture conservation,

needs of local community and such other aspects of the ecology and environment that needs attention.

(7)

The Zonal Master Plan shall demarcate all the existing worshipping places, village and urban settlements, types

and kinds of forests, tribal areas, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural

areas, orchards, lakes and other water bodies.

(8)

The Zonal Master Plan shall regulate development in Eco-sensitive Zone so as to ensure Eco-friendly

development for livelihood security of local communities.

Measures to be taken by State Government.- The State Government shall take the following measures for

giving effect to the provisions of this notification, namely:-

(1)

Land use.- Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational

purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or industrial related

development activities:

Provided that the conversion of agricultural lands within the Eco-sensitive Zone may be permitted on the

recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet the

residential needs of local residents, and for the activities listed against serial numbers 10,21,26,27,28 in column (2) of the

Table in paragraph 4, namely:-

(i)

eco-friendly cottages for temporary occupation of tourists, such as tents, wooden houses, etc. for Eco-friendly

tourism activities;

(ii)

widening and strengthening of existing roads and construction of new roads;

(iii)

small scale industries not causing pollution;

(iv)

rainwater harvesting; and

(v)

cottage industries including village industries, convenience stores and local amenities:

Provided further that no use of tribal land shall be permitted for commercial and industrial development

activities without the prior approval of the State Government and without compliance of the provisions of article 244 of

the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest

Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):

Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by

the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said

error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:

Provided also that the above correction of error shall not include change of land use in any case except as

provided under this sub-paragraph.

Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural

area and efforts shall be made to reforest the unused or unproductive agricultural areas.

(2)

Natural springs.-The catchment areas of all natural springs shall be identified and plans for their conservation

and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State

Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such

areas.

(3)

Tourism.- (a) The activity relating to tourism within the Eco-sensitive Zone shall be as per Tourism Master

Plan, which shall form part of the Zonal Master Plan.

(b) The Tourism Master Plan shall be prepared by Department of Tourism, in consultation with Department of Forests

and Environment, Government of Chattisgarh.

(i)

all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in

accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate

Change with emphasis on eco-tourism, eco-education and eco-development and based on carrying capacity study of the

Eco-sensitive Zone;

(ii)

new construction of hotels and resorts shall not be permitted within one kilometre from the boundary of the

Tamor Pingla Wildlife Sanctuary except for accommodation for temporary occupation of tourists related to Eco-friendly

tourism activities:

Provided that beyond the distance of one kilometre from the boundary of the protected area till the extent of the

Eco-sensitive Zone, the establishment of the hotels and resorts shall be permitted only in pre-defined and designated

areas for Eco-tourism facilities as per Tourism master Plan;

(iii)

till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities

shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation

of the Monitoring Committee.

(4)

Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool

reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be

identified and preserved and plan shall be drawn up for their protection and conservation, within six months from the

date of publication of this notification and such plan shall form part of the Zonal Master Plan.

Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural,

aesthetic, and cultural significance shall be indentified in the Eco-sensitive Zone and plans for their conservation shall be

prepared within six months from the date of publication of this notification and incorporated in the Zonal Master Plan.

(6)

Noise pollution.- The Environment Department of the State Government or Chhattisgarh Environment

Conservation Board shall draw up guidelines and regulations for the control of noise pollution in the Eco-sensitive Zone

in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981(14 of 1981) and the rules

made thereunder.

Air pollution.- The Environment Department of the State Government or Chhattisgarh Environment

Conservation Board shall draw up guidelines and regulations for the control of air pollution in the Eco-sensitive Zone in

accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules

made thereunder.

(8)

Discharge of effluents.- The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the

provisions of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974) and the rules made there under.

(9)

Solid wastes.- Disposal of solid wastes shall be as under:-

(i) the solid waste disposal in Eco-sensitive Zone shall be carried out as per the provisions of the Municipal Solid Waste

(Management and Handling) Rules, 2000 published by the Government of India in the erstwhile Ministry of

Environment and Forests vide notification number S.O. 908 (E), dated the 25^th September, 2000 as amended from time

to time;

(ii) the local authorities shall draw up plans for the segregation of solid wastes into biodegradable and non-biodegradable

components;

(iii) the biodegradable material shall be recycled preferably through composting or vermiculture;

(iv) the inorganic material may be disposed in an environmentally acceptable manner at site(s) identified outside the

Eco-sensitive Zone and no burning or incineration of solid wastes shall be permitted in the Eco-sensitive Zone

Bio-medical waste.- The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out as per the

provisions of the Bio-Medical Waste (Management and Handling) Rules, 1998 published by the Government of India in

the erstwhile Ministry of Environment and Forests vide Notification number S.O. 630(E), dated the 20^th July, 1998 as

amended from time to time.

(11)

Vehicular traffic.- The vehicular movement of traffic shall be regulated in a habitat friendly manner and

specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal master

plan is prepared and approved by the competent authority in the State Government, Monitoring Committee shall monitor

compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.

(12)

Industrial Units.-

(a) No establishment of new wood based Industries within the proposed Eco-sensitive zone shall be permitted

except the existing wood based Industries set up as per the law.

(b) No establishment of any new Industry causing water, air, soil, noise pollution within the proposed Eco-

sensitive zone shall be permitted.

List of activities prohibited or to be regulated within the Eco-sensitive Zone.- All activities in the Eco

sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules

made thereunder, and be regulated in the manner specified in the Table below, namely:-

10.

Establishment of hotels and resorts

No new commercial hotels and resorts shall be permitted

within one km of the boundary of the Wildlife Sanctuary

Tamor Pingla Wildlife Sanctuary and upto the extent of

11.

Construction activities

a) No new commercial construction of any kind shall be

permitted within two kilometre from the boundary of the

Tamor Pingla Wildlife Sanctuary:

Provided that, local people shall be permitted to undertake

construction in their land for their residential use including

the activities listed in sub-paragraph (1) of paragraph 3:

Provided further that the construction activity related to

small scale industries not causing pollution shall be

regulated and kept at the minimum, with the prior

permission from the Competent Authority as per applicable

rules and regulations, if any.

(b)Beyond one kilometre of the boundary of the Tamor

Pingla Wildlife Sanctuary and upto the extent of the Eco-

sensitive Zone, construction for bonafide local needs shall

be permitted and other construction activities shall be

regulated as per Zonal Master Plan.

12.

Trenching ground

Establishing of new trenching ground is prohibited and old

trenching grounds shall be regulated under applicable laws.

13.

Discharge of effluents and solid waste in

natural water bodies or land area.

Regulated under applicable laws.

14.

Air and vehicular pollution

Regulated under applicable laws.

15.

Noise pollution

Regulated under applicable laws.

16.

Extraction of ground water

Regulated under applicable laws.

17.

Felling of trees.

(a) There shall be no felling of trees in the forest or

Government or revenue or private lands without prior

permission of the Competent Authority in the State

Government;

(b) the felling of trees shall be regulated in accordance with

the provisions of the concerned Central or State Acts and

the rules made thereunder.

Working Plan prescriptions shall be followed.

18.

Migratory graziers

Regulated under applicable laws and as per Zonal Master

Plan.

19.

Existing establishments

Regulated under applicable laws

20.

Insulation of electric lines

Underground cabling shall be promoted and all existing

electric lines passing through the Eco-sensitive Zone shall

be adequately insulated in the time frame prescribed under

the Zonal Master Plan.

21.

Widening and strengthening of existing roads

Shall be done with proper Environment Impact Assessment

and mitigation measures, as applicable.

22.

Fencing of existing premises of hotels and

lodges.

Regulated under applicable laws.

In order to allow free movement of wildlife, hotels or other

commercial establishments within the Eco-sensitive Zone

shall not fence their properties with barbed wire and no

fence shall be higher than one meter and any existing fence

not complying with this stipulation shall be modified as per

the time lines mentioned in the Zonal Master Plan.

Promoted Activities

Ongoing agriculture and horticulture

practices by local communities along

dairy farming, aquaculture and fisheries

5. Monitoring Committee.- (1) The Central Government hereby constitutes a Monitoring Committee for effective

monitoring of the Eco-sensitive Zone, which shall comprises of the following members, namely:-

(i)

Divisional Commissioner, Surguja, Ambikapur

Chairman

(ii)

An expert in the area of ecology and environment -

Member

to be nominated by the Government of Chhattisgarh for a period of one year.

(iii)

Chief Executive Officer of District Panchayat, Surajpur

Member

(v)

One representatives of Non-governmental Organisation -

Member

(working in the field of environment including heritage conservation) to be

nominated by the Government of India for a period of one year.

(vi)

Representative of Chhattisgarh Environment Conservation Board

Member

(vii)

Collector, Surajpur-

Member

(viii)

Superintendent Engineer, Public Works Department, Surajpur -

Member

(ix)

Superintendent Engineer, PHE, Surajpur-

Member

(x)

Representative of Town and Country Planning

Member

(xi)

District Forest Officer, North Surguja, Ambikapur

Member

Chief Conservator of Forest (Wildlife) and Field Director,

6. Terms of Reference

(1)

The Monitoring Committee shall monitor the compliance of the provisions of this notification.

(2)

The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile

Ministry of Environment and Forest number S.O. 1533(E), dated the 14^th September, 2006, and are falling in

the Eco-sensitive Zone, except the prohibited activities as specified in column(3) of the Table under paragraph

4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and

referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior

environmental clearances under the provisions of the said notification.

(3)

The activities that are not covered in the Schedule to the notification of the Government of India in the

erstwhile Ministry of Environment and Forest number S.O. 1533(E), dated the 14^th September, 2006 but are

falling in the Eco-sensitive Zone, except the prohibited activities as specified in column (3) of the Table under

paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific

conditions and referred to the concerned Regulatory Authorities.

(4)

The Member Secretary of the Monitoring Committee or the concerned Collector or the concerned park in-

charge shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986

against any person who contravenes the provisions of this notification.

(5)

The Monitoring Committee may invite representatives or experts from concerned Departments, representatives

from Industry Associations or concerned stakeholders to assist in its deliberations depending on the

requirements on issue to issue basis.

(6)

The Monitoring Committee shall submit the annual action taken report of its activities as on 31^st March of

every year by 30^th June of that year to the Central Government in the Ministry of Environment, Forest and

Climate Change as per proforma given in Annexure III.

28.

Small scale industries not causing

pollution.

Non polluting, non-hazardous, small-scale and service

industry, agriculture, floriculture, horticulture or agro-

based industry producing products from indigenous goods

from the Eco-sensitive Zone, and which do not cause any

adverse impact on environment shall be permitted.

29.

Use of renewable energy sources

Shall be actively promoted.

The Central Government in the Ministry of Environment, Forest and Climate Change may give such

directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.

The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon’ble

Supreme Court of India or the High Court or National Green Tribunal.
