का.आ. 118(अ).—ननलखत ाप अधसूचना, िजसे के$%य सरकार, पया'वरण (संर+ण) अधनयम, 1986

(1986 का 29) क0 धारा 3 क0 उपधारा (2) के खंड (v) और खंड (xiv) तथा उपधारा (3) के साथ पठत उपधारा (1)

7वारा द8त शि:तय; का योग करते हुए, जार करने का Aताव करती है, पया'वरण (संर+ण) नयम, 1986 के

नयम 5 के उपनयम (3) क0 अपे+ानुसार, जनसाधारण क0 जानकार के लए काशत क0 जाती है; िजनके उससे

भाFवत होने क0 संभावना है, ; और यह सूचना द जाती है Gक उ:त ाप अधसूचना पर, उस तारख से, िजसको इस

अधसूचना वाले भारत के राजपI क0 तयां जनसाधारण को उपलJध करा द जाती हK, साठ दन क0 अवध क0

समािLत पर या उसके पMचात् Fवचार Gकया जाएगा;

ऐसा कोई Pयि:त, जो ाप अधसूचना मQ अंतFव'Rट Aताव; के संबंध मQ कोई आ+ेप या सुझाव देने मQ

हतबW है, इस कार Fवनद'Rट अवध के भीतर, के$%य सरकार 7वारा Fवचार Gकए जाने के लए, आ+ेप या सुझाव

केरल रा[य के \मशः पला:काड और मालापुरम िजल; के म$नारकड और नीलांबुर तालुक; मQ 11^o2’ तथा

11^o13’ उ8 तर अ+ांश तथा 76^o24’ तथा 76^o32’ पूव^ देशांतर के बीच साइलQट वैल नेशनल पाक' िA थत है और

89.52 वग' Gकलोमीटर मQ फैला हुआ है ।

और, रइयां क0ट; का अभाव, जो कण'पटह कंपन के मा`यम से वन मQ Fवशेष GकAम क0 `वन उ8प$न करता है

और इनक0 ायकतः ऊRण कटबंधीय वन; मQ चुरता है िजनका संभवतया वन; को “साइलQट वैल” के cप मQ नाम देने

मQ योगदान है ।

और, राRdय पाक' मQ नम[जन कगार; वाला तरंगी भूभाग है और एम.एस.एल से ऊपर 900 मी. से लेकर

2300 मी. तक क0 ऊंचाई वाल बहुत सी छोट पहाgड़यां हK और कुंथीपुजहा नद के लए आवाह +ेI के प मQ काय'

करता है जो भारथापुजहा नद है और पलाकाड तथा मालापुरम िजल; मQ पीने का पानी तथा सचाi योजन का मुjय

AIोत है ।

और, साइलQट वैल का मुjय +ेI नीलगर जैव मंडल Xरजव' के मुjय +ेI के 5500 वग' Gक.मी. का के$%

तथा \ाि$तक भाग है और हाथी पXरयोजना, जो 1419 वग' मी. +ेI मQ फैला हुआ है, के अधीन AथाFपत नलांबर हाथी

Xरजव' का एक अभ$न अंग भी है ।

और, राRdय पाक' मQ Fवपुल पुRप वनAपत और ाणजात FवFवधता है िजसमQ 430 जेनेरा मQ आवृ8त बीजी

जातय; मQ से लगभग 966 जातयां और डाइकोट' क0 33 पXरवार हK िजनमQ आच'डस क0 108 जातयां तथा 139

जेनेरा तथा मोनोकोटस के 21 पXरवार लाइके$स क0 77 जातयां और FपटेXरडो फाइटस क0 77 जातयां उ7यान से

Xरपोट' क0 गई हK ।

और, Xरकाड' क0 गई ाणजात FवFवधता मQ AतनधाXरय; क0 41 जातयां, 15 पिMचमी घाट देशज; सहत

पo+य; क0 211 जातयां, सरसप; क0 42 जातयां, उभयचर; क0 146 जातयां, ताजा जल मछलय; क0 12

जातयां, ततलय; क0 92 जातयां और पतंग; क0 250 जातयां हK ।

और, साइलQट वैल नेशनल पाक' के चार; ओर के +ेI को, िजसका FवAतार और सीमाएं इस अधसूचना के पैरा

1 मQ Fवनद'Rट हK, पया'वरण क0 qिRट से पाXरिAथतक संवेद जोन के प मQ सुरo+त और संरo+त करना तथा उ:त

पाXरिAथतक संवेद जोन मQ उ7योग; या उ7योग; के वगr के चालन तथा संAकरण करने को तFषW करना आवMयक

है;

अतः, अब, के$%य सरकार, पया'वरण (संर+ण) नयम, 1986 के नयम 5 के उपनयम (3) के साथ पठत

पया'वरण (संर+ण) अधनयम, 1986 (1986 का 29) क0 धारा 3 क0 उपधारा (1), उपधारा (2) के खंड (v) और खंड

(xiv) और उपधारा (3) 7वारा द8त शि:तय; का योग करते हुए, केरल रा[य मQ साइलQट वैल नेशनल पाक' क0 सीमा

से 9 Gकलोमीटर के FवAताXरत +ेI को, तमलनाडु रा[य क0 सीमा के साथ जुडे हुए हAसे को छोडकर, केरल रा[य मQ

साइलQट वैल नेशनल पाक' पाXरिA थतक0 संवेद जोन (िजसे इसमQ इसके पM चात् पाXरिA थतक संवेद जोन कहा गया है)

के प मQ अधसूचत करती है, िजसका Fववरण ननानुसार है, अथा'त् :--

(1) पारि%थ'तक संवेद* जोन का ,व%तार और उसक. सीमाएं--(1) पाXरिAथतक संवेद जोन का FवAतार केरल

रा[य मQ साइलQट वैल नेशनल पाक' क0 सीमा से 9 Gकलोमीटर तक है िजसके अंतग'त राRdय पाक' क0 उ8तर-पूवr8तर

दशा मQ तमलनाडु रा[य क0 सीमा को Fवभािजत करने वाला हAसा नहं है और सीमा का वण'न उपाबंध I के cप मQ

संलtन है ।

(2) मुख uब$ दुओं के नदvशांक; के साथ-साथ पाXरिAथतक संवेद जोन का मानचI उपाबंध II के प मQ

संलtन है ।

(3) पाXरिAथतक संवेद जोन मQ 148 Gक.मी. के भौगेलक +ेI आता है िजसमQ नहत वन और tयारह राजAव

xाम भी हK तथा पाXरिAथतक संवेद जोन के भीतर आना वाले xाम; क0 सूची उपाबंध III के प मQ संलtन हK ।

2. पारि%थ'तक संवेद* जोन के 3लए आंच3लक महायोजना –(1) रा[य सरकार, पाXरिA थतक संवेद जोन के

योजन के लए राजपI मQ अंतम अधसूचना के काशन क0 तारख से दो वष' क0 अवध के भीतर Aथानीय लोग; से

परामश' करके और इस अधसूचना मQ दए गए अनुबंध; का पालन करते हुए एक आंचलक महायोजना तैयार करेगी ।

(2)

उ: त योजना रा[ य सरकार मQ स+म ाधकार 7वारा अनुमोदत होगी ।

(3)

पाXरिA थतक संवेद जोन के लए उ:त महायोजना रा[ य सरकार 7वारा ऐसी रत से जो इस अधसूचना मQ

Fवनद'R ट Gकया जाए और सुसंगत कQ %य और रा[ य Fवधय; के और कQ %य सरकार 7वारा जार माग'दश^ सWांत; के

अनुcप तैयार Gकया जाएगा ।

(4) आंचलक महायोजना, इसमQ पया'वरणीय और पाXरिA थतक0 Fवचार; को समाकलत करने के लए रा[ य के सभी

संबW Fवभाग; के परामश' से तैयार होगी, अथा'त्:--

(i)

पया'वरण ;

(ii)

वन ;

(iii)

शहर Fवकास ;

(iv)

पय'टन ;

(v)

नगरपालक ;

(vi)

राजA व ;

(vii)

कृFष ;

(viii)

रा[ य दूषण नयंIण बोड' ;

(ix)

संचाई; और

(x)

लोक नमा'ण Fवभाग ।

आंचलक महायोजना अनुमोदत Fव7यमान भू-उपयोग, अवसंरचना और G\याकलाप; पर कोई नबzधन

अधरोFपत नहं करेगी जब तक Gक इस अधसूचना मQ Fवनद'R ट न ह; और आंचलक महायोजना मQ सभी अवसंरचना

और G\याकलाप; के सुधार के कारक तथा पाXरिA थतक0य अनुकूलता का संवध'न करेगी ।

आंचलक महायोजना मQ अना{छादत +ेI; के जीणrWार, Fव7यमान जल नकाय; के संर+ण, आवाह +ेI; के

बंधन, जल-संभर; के बंधन, भूतल जल के बंधन, मृदा और नमी संर+ण, Aथानीय समुदाय; क0 आवMयकताओं तथा

पाXरिAथतक0 और पया'वरण से संबंधत ऐसे अ$य पहलुओं, िजन पर `यान देना आवMयक है, के लए उपबंध ह;गे ।

उ:त महायोजना सभी Fव7यमान एवं AताFवत पूजा A थल;, xाम; और नगरय बंदोबAत;, वन; के कार और

GकA म;, जनजातीय +ेI, कृFष +ेI;, ऊपजाऊ भूम, हXरत +ेI जैसे उ7यान और उसी कार के A थान, उ7यान कृFष +ेI,

आGक' ड;, झील; और अ$य जल नकाय; का अ|यकंन करेगी ।

आंचलक महायोजना पाXरिA थतक संवेद जोन मQ Fवकास को Fवनयमत करेगी िजससे A थानीय समुदाय; क0

आजीFवका को सुरo+त करने के लए पाXरिA थतक0 अनुकूल Fवकास सुनिM चत Gकया जा सके ।

(9) आंचलक महायोजना के उपबंध; के पया'Lत प से चाXरत Gकया जाएगा ।

3. रा6य सरकार 7वारा 8कए जाने वाले उपाय-- रा[य सरकार इस अधसूचना के उपबंध; को भावी करने के लए

ननलखत उपाय करेगी, अथा'त् :--

(1) भू-उपयोग - पाXरिA थतक संवेद जोन मQ वन;, उ7यान-कृFष +ेI;, कृFष +ेI;, आमोद-मोद के योजन के लए

चि$हत Gकए गए पाक} और खुले Aथान; का वाणि[यक और औ7योगक संबW Fवकास G\याकलाप; के लए उपयोग

या संपXरवत'न नहं होगा :

परंतु पाXरिAथतक संवेद जोन के भीतर कृFष भूम का संपXरवत'न, के अधीन मानीटर समत क0 सफाXरश

पर और रा[य सरकार के पूव' अनुमोदन से, Aथानीय नवासय; क0 आवासीय जरत; को पूरा करने के लए और पैरा 4

क0 सारणी के Aतंभ (2) के अधीन \म सं. 16, 21, 27, 33 और 36 के सामने सूचीबW G\याकलाप; को पूरा करने के

लए अनु~ात ह;गे, अथा'त् :-

(क) पाXरिA थतक0य अनुकूल पय'टन G\याकलाप; के लए पय'टक; के अA थायी आवासन के लए पाXरिA थतक0य

अनुकूल कुटर जैसे टे$ट, काRट गृह ;

(ख) Fव7यमान सड़क; को चौड़ा करना तथा सुqढ़ बनाना ;

(ग) दूषण काXरत न करने वाले लघु उ7योग ;

(घ) वषा' जल संचयन; और

(ड.) कुटर उ7योग, िजसके अंतग'त xामीण उ7योग, सुFवधा भंडार और A थानीय सुख-सुFवधाएं हK:

परंतु यह और भी Gक रा[य सरकार के पूव' अनुमोदन और संFवधान के अनु{ छेद 244 या त8समय वृ8त Fवध

के उपबंध; के अनुपालन के uबना, िजसके अंतग'त अनुसूचत जनजात और अ$य परंपरागत वन नवासी (वन अधकार;

क0 मा$यता) अधनयम, 2006 (2007 का 2) भी है, वाणि[यक या उ7योग Fवकास G\याकलाप; के लए जनजातीय

भूम का उपयोग अनु~ात नहं होगा :

परंतु यह और भी Gक पाXरिA थतक संवेद जोन के भीतर भू-अभलेख; मQ पाई जाने वाल कोई Iुट मानीटर

समत के Fवचार ाLत करने के पMचात् रा[य सरकार 7वारा 8येक मामले मQ केवल एक बार संशोधत होगी और उ:त

Iुट के संशोधन क0 भारत सरकार के पया'वरण, वन और जलवायु पXरवत'न मंIालय को सूचना देनी होगी:

परंतु यह और भी Gक उपयु':त Iुट के संशोधन मQ इस उप पैरा के अधीन यथा उपबंधत के सवाय Gकसी भी

दशा मQ भू-उपयोग का पXरवत'न सिमलत नहं होगा :

परंतु यह और भी Gक हXरत +ेI जैसे वन +ेI, कृFष +ेI मQ कोई पाXरणामक कटौती नहं होगी और अयु: त

या अनु8 पादक कृFष +ेI; मQ पुन: वनीकरण करने के यास Gकए जाएंगे ।

(2) "ाकृ'तक जल-=ोत -- आंचलक महायोजना मQ सभी ाकृतक जल €ोत; क0 पहचान क0 जाएगी और उनके संर+ण

और पुनन'वीकरण के लए योजना सि मलत होगी और रा[ य सरकार 7वारा इन +ेI; पर या उनके नकट Fवकास

G\याकलाप;, जो ऐसे +ेI; के लए हानकारक है, को तFषW करने के लए ऐसी रत से माग'नदvश तैयार Gकए

जाएंगे।

(3) पयटन – (क) पाXरिAथतक संवेद जोन के भीतर पय'टन संबंधी G\याकलाप, पय'टन महायोजना के अनुसार ह;गे, जो

आंचलक महायोजना का भाग प ह;गे ।

(ख) पय'टन महायोजना पय'टन Fवभाग, केरल सरकार 7वारा राजA व और वन Fवभाग, कना'टक सरकार के परामश' से

तैयार होगी ।

(ग) पय'टन संबंधी G\याकलाप ननानुसार Fवनयमत Gकए जाएंगे, अथा'त् :-

(i) पाXरिAथतक संवेद जोन के भीतर सभी नए पय'टन G\याकलाप; या Fव7यमान पय'टन G\याकलाप; का

FवAतार भारत सरकार के पया'वरण, वन और जलवायु पXरवत'न मंIालय के माग'दश'क सWांत; के 7वारा तथा

पाXरिAथतक पय'टन राR dय P या संर+ण ाधकरण, 7वारा जार (समय-समय पर यथा संशोधत) माग'दश'क

सWांत; के अनुसार, पाXरिAथतक पय'टन, पाXरिAथतक श+ा और पाXरिAथतक Fवकास को मह8व देते

हुए पाXरिAथतक संवेद जोन क0 वहन +मता के अ`ययन पर आधाXरत होगा;

(ii) पाXरिA थतक0य अनुकूल पय'टन G\याकलाप; के संबंधत पय'टक; के अA थायी नवास के लए आवासन के

सवाय पाXरिA थतक संवेद जोन के भीतर होटल और Xरसोट' के नए संनमा'ण अनु~ात नहं ह;गे ।

परंतु संरo+त +ेI; क0 सीमा से एक Gकलोमीटर क0 दूर से परे पाXरिAथतक0य संवेद जोन क0 सीमा तक नए

होटल और Xरसोट' के Aथापन पय'टन महायोजना के अनुसार पाXरिAथतक0य पय'टन सुFवधा के लए पूव'

पXरभाFषत और Fवनद'Rट Aथान मQ ह अनु~ात Gकया जाएगा ।

(iii) आंचलक महायोजना का अनुमोदन Gकए जाने तक, पय'टन के लए Fवकास और Fव7यमान पय'टन

G\याकलाप; के FवAतार को वाAतFवक Aथल Fवनद'Rट संवी+ा तथा मानीटर समत क0 सफाXरश पर

आधाXरत संबंधत Fवनयामक ाधकाXरय; 7वारा अनु~ात Gकया जाएगा ।

(4) नैसगक ,वरासत – पाXरिAथतक संवेद जोन मQ मह8वपूण' नैसग'क Fवरासत के सभी Aथल; जैसे सभी जीन कोश

आरo+त +ेI, शैल Fवरचनाएं, जल पात;, झरन;, घाट माग}, उपवन;, गुफाओं, Aथल;, ‚मण, अMवरोहण, पात; आद

क0 पहचान क0 जाएगी और उ$हQ पXररo+त Gकया जाएगा तथा उनक0 सुर+ा और संर+ा के लए इस अधसूचना के

काशन क0 तारख से छह मास के भीतर, उपयु:त योजना बनाई जाएगी और ऐसी योजना आंचलक महायोजना का

भाग होगी ।

(5) मानव 'न3मत ,वरासत % थल -- पाXरिA थतक संवेद जोन मQ भवन;, संरचनाओं, शप-तƒय, ऐतहासक, कला8मक

और सांAकृतक मह8व के +ेI; क0 पहचान क0 जाएगी और इस अधसूचना के काशन क0 तारख से छह मास के

भीतर उनके संर+ण क0 योजनाएं तैयार क0 जाएंगी तथा आंचलक महायोजना मQ सिमलत क0 जाएंगी ।

(6) @ व'न "दूषण – पाXरिAथतक संवेद जोन मQ ` वन दूषण के नयंIण के लए रा[ य सरकार का पया'वरण Fवभाग

या कना'टक रा[ य दूषण नयंIण बोड', वायु (दूषण नवारण और नयंIण) अधनयम, 1981 (1981 का 14) और

उसके अधीन बनाए गए नयम; के उपबंध; के अनुसरण मQ माग'दश'क सWांत और Fवनयम तैयार करेगा ।

(7) वायु "दूषण – पाXरिAथतक संवेद जोन मQ, वायु दूषण के नयंIण के लए रा[ य सरकार का पया'वरण Fवभाग या

कना'टक रा[ य दूषण नयंIण बोड', वायु (दूषण नवारण और नयंIण) अधनयम, 1981 (1981 का 14) और उसके

अधीन बनाए गए नयम; के उपबंध; के अनुसरण मQ माग'दश'क सWांत और Fवनयम तैयार करेगा ।

(8) बBह=ाव का 'न%सारण – पाXरिAथतक संवेद जोन मQ उपचाXरत बह€ाव का नAसारण जल (दूषण नवारण तथा

नयंIण) अधनयम, 1974 (1974 का 6) और उसके अधीन बनाए गए नयम; के उपबंध; के अनुसार होगा ।

(9) ठोस अप3शEट – ठोस अपशRट; का नपटान ननलखत प मQ होगा –

(i) पाXरिAथतक संवेद जोन मQ ठोस अपशRट; का नपटान भारत सरकार के त8कालन पया'वरण और वन

मंIालय क0 समय-समय पर यथा संशोधत अधसूचना सं. का.आ. 908(अ), तारख 25 सतंबर, 2000 को

काशत नगरपालक ठोस अपशRट (बंध और हथालन) नयम, 2000 के उपबंध; के अनुसार Gकया जाएगा ;

(ii) Aथानीय ाधकरण जैव ननीकरणीय और अजैव ननीकरणीय संघटक; मQ ठोस अपशRट; के संपृथ:कन

के लए योजनाएं तैयार करQगे ;

(iii) जैव ननीकरणीय सामxी को अधमानतः खाद बनाकर या कृम खेती के मा`यम से पुनःचG\त Gकया

जाएगा ; और

(iv) अकाब'नक सामxी का नपटान पाXरिAथतक संवेद जोन के बाहर पहचान Gकए गए A थल पर Gकसी

पया'वरणीय Aवीकृत रत मQ होगा और पाXरिAथतक संवेद जोन मQ ठोस अपशR ट; को जलाना या भA मीकरण

अनु~ात नहं होगा ।

(10) जैव च8कF सीय अप3शE ट- पाXरिAथतक संवेद जोन मQ जैव चGक8सीय अपशRट; का नपटान भारत सरकार के

त8कालन पया'वरण और वन मंIालय क0 समय-समय पर यथासंशोधत अधसूचना सं.का.आ. 630(अ) तारख

20 जुलाई, 1998 7वारा काशत जैव चGक8सीय अपशRट (बंध और हथालन) नयम, 1998 के उपबंध; के अनुसार

Gकया जाएगा ।

(11) यानीय परवहन - पXरवहन क0 यानीय गतFवधयां आवास के अनुकूल रत मQ Fवनयमत ह;गी और इस संबंध

मQ आंचलक महायोजना मQ Fवशेष उपबंध समाFवRट Gकए जाएंगे और आंचलक महायोजना के तैयार होने और रा[ य

सरकार मQ स+म ाधकार के 7वारा अनुमोदत होने तक, पाXरिAथतक संवेद जोन मानीटर समत सुसंगत

अधनयम; के अधीन तथा तWीन बनाए गए नयम; और Fवनयम; के अधीन यानीय गतFवधय; के अनुपालन को

मानीटर करेगी ।

(12) औ7योगक इकाइयां- (क) A ताFवत पाXरिA थतक संवेद जोन के भीतर नए काR ठ उ7योग; क0 A थापना Fवध के

अनुसार A थाFपत काR ठ आधाXरत उ7योग; के लए अनु~ात क0 जाएगी अ$यथा नहं ।

(ख) A ताFवत पाXरिA थतक संवेद जोन के भीतर जल, वायु, मृदा, ` वन दूषण उ8प$न करने वाले Gकसी नए उ7योग

क0 Aथापना नहं क0 जाएगी ।

MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE

NOTIFICATION

New Delhi, the 6^th January, 2016

S.O. 118(E).—The following draft of the notification, which the Central Government proposes to issue in

exercise of the powers conferred by sub-section (1), read with clause (v) and clause (xiv) of sub-section (2) and sub-

section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) is hereby published, as required under

sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, for the information of the public likely to be affected

thereby; and notice is hereby given that the said draft notification shall be taken into consideration on or after the expiry

of a period of sixty days from the date on which copies of the Gazette containing this notification are made available to

the public;

Any person interested in making any objections or suggestions on the proposals contained in the draft

notification may forward the same in writing, for consideration of the Central Government within the period so specified

Draft Notification

WHEREAS, the Silent Valley National Park is situated between the North latitudes 11^o2’ and 11^o13’ and the

East longitudes 76^o24’ and 76^o32’ in Mannarkkad and Nilambur Taluks of Palakkad and Malapurram Districts,

respectively, in the State of Kerala and is spread over an area of 89.52 square kilometres;

AND WHEREAS, the absence of Cicada insects, which produce typical sound in the forest through their

tympanal vibrations and are usually abundant in tropical forests possibly contributed to the naming of the forests as

“Silent Valley”;

AND WHEREAS, the National Park has undulating terrain with steep escarpments and many hillocks with

elevation ranging from 900 m. to 2,300 metres above MSL and serve as catchment for River Kunthipuzha, which is the

tributary of Bharathapuzha, a major source of water for drinking and irrigation purposes in the Districts of Palakkad and

Malappuram;

AND WHEREAS, the core area of Silent Valley National Park is central and critical part of 5500 square

kilometre of core area of Niligiri Biosphere Reserve and also forms an integral part of Nilambur Elephant Reserve

constituted under the project elephant spread over an area of 1419 square kilometres;

AND WHEREAS, the National Park has rich floral and faunal diversity, with about 966 species of angiosperm

species in 430 genera and 33 families of dicots including 108 species of orchids and 139 genera and 21 families of

monocots, about 77 species of lichens and 77 species of pteridophytes have been reported from the Park;

AND WHEREAS, the recorded faunal diversity consists of 41 species of mammals, 211 species of birds

including 15 Western Ghat endemics, 42 species of reptiles, 46 species of amphibians, 12 species of freshwater fish, 92

species of butterflies and 250 species of moths;

AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of which are

specified in paragraph 1 of this notification around the protected area of Silent Valley National Park as Eco- sensitive

Zone from ecological and environmental point of view and to prohibit industries or class of industries and their

operations and processes in the said Eco-sensitive Zone;

NOW THEREFORE, in exercise of the powers conferred by sub section(1) and clauses (v) and (xiv) of sub-

section (2) and sub-section (3) of section 3 of the Environment (Protection) Act 1986 (29 of 1986) read with sub-rule (3)

of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent of

up to 9 kilometres from the boundary of Silent Valley National Park in the State of Kerala as the Silent Valley National

Park Eco-sensitive Zone (herein after referred to as the Eco-sensitive Zone) excluding the portion sharing boundary with

the State of Tamil Nadu details of which are as under, namely:-

1. Extent and boundaries of Eco-sensitive Zone.- (1)The extent of Eco-Sensitive Zone is up to 9 kilometres from the

boundary of Salient Valley National Park in the State of Kerala excluding the portion sharing boundary with the State of

Tamil Nadu on the north-north eastern side of the National Park and the description of the boundary are appended as

Annexure-I.

(2)

The map of the Eco-sensitive Zone along with co-ordinates of prominent points is appended as Annexure II

(3)

The Eco-sensitive Zone covers a geographical area of 148 square kilometres which includes vested forests and

eleven revenue villages and the list of the villages falling within the Eco-sensitive Zone is appended as Annexure III.

2. Zonal Master Plan for the Eco-sensitive Zone.- (1) The State Government shall, for the purpose of the Eco-

sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of final

notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this

notification.

(2)

The said Plan shall be approved by the competent authority in the State Government.

(3)

The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as

is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued

by the Central Government, if any.

(4)

The Zonal Master Plan shall be prepared in consultation with all concerned State Departments, namely:-

(i) Environment;

(ii) Forest;

(iii) Urban Development;

(iv) Tourism;

(v) Municipal;

(vi) Revenue;

(vii) Agriculture;

(viii) State Pollution Control Board;

(ix Irrigation;

(x) Public Works Department.

for integrating environmental and ecological considerations into it.

The Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities,

unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and

activities to be more efficient and eco-friendly.

(6)

The Zonal Master plan shall provide for restoration of denuded areas, conservation of existing water bodies,

management of catchment areas, watershed management, groundwater management, soil and moisture conservation,

needs of local community and such other aspects of the ecology and environment that need attention.

(7)

The Zonal Master Plan shall demarcate all the existing worshipping places, village and urban settlements, types

and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas,

orchards, lakes and other water bodies.

(8)

The Zonal Master Plan shall regulate development in Eco-sensitive Zone as to ensure eco-friendly development

for livelihood security of local communities.

(9)

Adequate publicity shall be given to the provisions of the Zonal Master Plan.

3.

Measures to be taken by State Government.-The State Governments shall take the following measures for

giving effect to the provisions of this notification, namely:-

(1) Land use.- Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes

in the Eco-sensitive Zone shall not be used or converted into areas for commercial or industrial related development

activities:

Provided that the conversion of agricultural lands within the Eco-sensitive Zone may be permitted on the

recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet the

residential needs of local residents, and for the activities listed against serial numbers 16, 21, 27, 33 and 36 in column (2)

of the Table in paragraph 4, namely:-

(i)

Eco-friendly cottages for temporary occupation of tourists, such as tents, wooden houses, etc. for eco-friendly

tourism activities;

(ii)

Widening and strengthening of existing roads;

(iii)

Small scale industries not causing pollution;

(iv)

Rainwater harvesting; and

(v)

Cottage industries including village industries, convenience stores and local amenities:

Provided further that no use of tribal land shall be permitted for commercial and industrial development

activities without the prior approval of the State Government and without compliance of the provisions of article 244 of

the constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest

Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):

Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by

the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said

error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:

Provided also that the above correction of error shall not include change of land use in any case except as

provided under this sub-paragraph.

Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural

area and efforts shall be made to reforest the unused or unproductive agricultural areas.

(2) Natural Springs.-The catchment areas of all natural springs shall be identified and plans for their conservation and

rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State

Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such

areas.

(3) Tourism.- (a) The activity relating to tourism within the Eco-sensitive Zone shall be as per Tourism Master Plan,

which shall form part of the Zonal Master Plan.

(b) The Tourism Master Plan shall be prepared by the Department of Tourism, Government of Kerala in consultation

with Department of Revenue and Forest, Government of Kerala.

(c) The activity of tourism shall be regulated as under, namely:-

(i)

all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in

accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forests and Climate

Change and the eco-tourism guidelines issued by the National Tiger Conservation Authority, (as amended from time to

time) with emphasis on eco-tourism, eco-education and eco-development and based on carrying capacity study of the

Eco-sensitive Zone;

(ii)

new construction of hotels and resorts shall not be permitted within the eco-sensitive Zone except for

accommodation for temporary occupation of tourists related to Eco-friendly tourism activities.

Provided that beyond the distance of one kilometre from the boundary of the Protected Areas till the extent of

the eco-sensitive Zone, the establishment of new hotels and resorts shall be permitted only in pre-defined and designated

areas for Eco-tourism facilities as per Tourism Master Plan.

(iii)

till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities

shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation

of the Monitoring Committee.

(4) Natural Heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve

areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and

preserved and plan shall be drawn up for their protection and conservation, within six months from the date of

publication of this notification and such plan shall form part of the Zonal Master Plan.

(5)

Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural,

aesthetic, and cultural significance shall be indentified in the Eco-sensitive Zone and plans for their conservation shall be

prepared within six months from the date of publication of this notification and incorporated in the Zonal Master Plan.

(6) Noise pollution.- The Environment Department of the State Government shall draw up guidelines and regulations for

the control of noise pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and

Control of Pollution) Act, 1981 (14 of 1981) and the rules made thereunder.

(7) Air pollution.- The Environment Department of the State Government shall draw up guidelines and regulations for

the control of air pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and

Control of Pollution) Act, 1981 (14 of 1981) and the rules made thereunder.

(8)

Discharge of effluents.- The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the

provisions of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974) and the rules made thereunder.

(9) Solid wastes. - Disposal of solid wastes shall be as under:-

(i) the solid waste disposal in Eco-sensitive Zone shall be carried out as per the provisions of the Municipal Solid Waste

(Management and Handling) Rules, 2000 published by the Government of India in the erstwhile Ministry of

Environment and Forests vide notification number S.O. 908 (E), dated the 25^th September 2000 as amended from time to

time;

(ii) the local authorities shall draw up plans for the segregation of solid wastes into biodegradable and non-biodegradable

components;

(iii) the biodegradable material shall be recycled preferably through composting or vermiculture;

(iv) The inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-

sensitive Zone and no burning or incineration of solid wastes shall be permitted in the Eco-sensitive Zone.

(10)

Bio-medical waste.- The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out as per the

provisions of the Bio-Medical Waste (Management and Handling) Rules, 1998 published by the Government of India in

the erstwhile Ministry of Environment and Forests vide notification number S.O. 630(E), dated the 20^th July, 1998 as

amended from time to time.

(11) Vehicular traffic. - The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific

provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal master plan is

prepared and approved by Competent Authority in the State Government, the Monitoring Committee shall monitor

compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.

(12) Industrial Units.- (a) No establishment of new wood based industries within the proposed Eco-sensitive zone shall

be permitted except the existing wood based industries set up as per the law.

(b) No establishment of any new industry causing water, air, soil, noise pollution within the proposed Eco-sensitive zone

shall be permitted.

4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.- All activities in the Eco sensitive

Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made

thereunder, and be regulated in the manner specified in the Table below, namely:-

No new or expansion of existing saw mills shall be permitted

within the Eco-sensitive Zone.

Setting up of industries causing water or air or

soil or noise pollution.

No new or expansion of polluting industries in the Eco-sensitive

Zone shall be permitted.

Commercial use of firewood.

Provided the existing wood-based industry may continue as per

law.

10.

Commercial water resources including ground

water harvesting.

(a) Extraction of surface water and ground water for industrial or

commercial use including for commercial mineral water plants

and aerated drinks, bottling plants shall not be permitted in the

Eco-sensitive Zone.

(b) The extraction of surface water and ground water shall be

permitted only for bona fide agricultural use and domestic

consumption of the occupier of the land.

(c) no sale of surface water or ground water shall be permitted;

(d) steps shall be taken to prevent contamination or pollution of

water from any source including agriculture.

11.

Dumping of solid wastes/plastic wastes

/chemical wastes in the river and the land

area.

Prohibited (except as otherwise provided) as per applicable laws.

12.

Commercial Fishing and unscientific fishing.

existing activities would in conformity of tourism master Plan and

National Tiger Conservation Authority guidelines

17.

Construction activities.

(a) No new commercial construction of any kind shall be

permitted within the Eco-sensitive Zone:

Provided that, local people shall be permitted to undertake

construction in their land for their residential use including the

activities listed in sub-paragraph (1) of paragraph 3;

(b) the construction activity related to small scale industries not

causing pollution shall be regulated and kept at the minimum,

with the prior permission from the competent authority as per

applicable rules and regulations, if any.

(c) Beyond one kilometre and upto extent of Eco-sensitive Zone

construction for bona fide local needs shall be permitted and other

commercial construction activities shall be regulated as per Zonal

Master Plan.

(c) construction activity in the Eco-sensitive Zone shall be as per

Zonal Master Plan.

18.

Felling of trees.

(a) There shall be no felling of trees on the forest or Government

or revenue or private lands without prior permission of the

competent authority in the State Government;

(b) the felling of trees shall be regulated in accordance with the

provisions of the concerned Central or State Act and the rules

made thereunder.

(c) in case of Reserve Forests and Protected Forests the Working

Plan prescriptions shall be followed.

19.

Erection

of

electrical

cables

and

telecommunication towers.

Promote underground cabling.

20.

Fencing of existing premises of hotels and

lodges.

5. Monitoring Committee.- (1) The Central Government hereby constitutes a Monitoring Committee, for effective

monitoring of the Eco-sensitive Zone, which shall comprise of the following namely:-

(i) The District Collector, Palakkad

- Chairman;

(ii)

Representative of District Collector, Malappuram – Member;

(ii)

The Member of Legislative Assembly, Mannarkkad – Member;

(Subject to the State Government of Kerala obtaining relevant approvals inter alia including permission from

the Speaker of Legislative Assembly, Kerala, if required)

(iii)

The Member of Legislative Assembly, Wandoor – Member;

(Subject to the State Government of Kerala obtaining relevant approvals inter alia including permission from

the Speaker of Legislative Assembly, Kerala, if required)

(iv)

President, District Panchayat, Palakkad – Member;

(v)

President, District Panchayat, Malappuram – Member;

(vi)

One representative of Non Governmental Organisation working in the field of environment to be nominated by

the Government of Kerala for a term of one year in each case – Member;

(vii)

one expert in the area of ecology and environment from a reputed institution of University in the State to be

nominated by the Government of Kerala for a term of one year in each case – Member;

(viii)

Representative of Kerala Pollution Control Board, District Officer -

Member;

(ix)

Concerned Divisional Forest Officer (Territorial) – Member;

(x)

The Wildlife Warden, Silent Valley Division - Member-Secretary.

21.

Widening and strengthening of existing roads.

Shall be done with proper Environment Impact Assessment and

mitigation measures, as applicable.

22.

Movement of vehicular traffic at night.

Regulated for commercial purpose, under applicable laws.

23.

Introduction of exotic species.

Regulated for commercial purpose, under applicable laws.

The Monitoring Committee shall monitor the compliance of the provisions of this notification.

(3)

The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile

Ministry of Environment and Forest number S.O. 1533(E), dated the 14^th September, 2006, and are falling in the Eco-

sensitive Zone, except the prohibited activities as specified in column(3) of the Table under paragraph 4 thereof, shall

be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central

Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the

provisions of the said notification.

(4)

The activities that are not covered in the schedule to the notification of the Government of India in the

erstwhile Ministry of Environment and Forest number S.O. 1533(E), dated the 14^th September, 2006 but are falling in

the Eco-sensitive Zone, except the prohibited activities as specified in column (3) of the Table under paragraph 4

thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to

the concerned regulatory authorities.

(5)

The Member-Secretary of the Monitoring Committee or the concerned Collector or the concerned park in-

charge shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 against any

person who contravenes the provisions of this notification.

(6)

The Monitoring Committee may invite representatives or experts from concerned Departments, representatives

from Industry Associations or concerned stakeholders to assist in its deliberations depending on the requirements on

issue to issue basis.

The Monitoring Committee shall submit the annual action taken report of its activities as on 31^st March of

every year by 30^th June of that year to the Central Government in the Ministry of Environment, Forest and Climate

Change as per the proforma given in Annexure IV.

(8)

The Central Government in the Ministry of Environment, Forest and Climate Change may give such

directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.

6.

The Central Government and State Government may specify additional measures, if any, for giving effect to the

provisions of this notification.

7.

The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon’ble

Supreme Court of India or the High Court or National Green Tribunal.

BOUNDARY DESCRIPTION OF THE ECO-SENSITIVE ZONE

NORTH AND

EAST

From Anginda(2383 M), it runs along interstate boundary upto Bhavani river, then South along

the left bank of Bhavani river till the point the river takes eastward turn at Mukkali , then

towards South till it reaches Mannarkkad- Chinnathadakam road at Forest Check Post, Mukkali,

thence along the road upto Mandampottithodu excluding the private lands and habitation of

approximatley 50 Ha area at Mukkali (N 76 ⁰ 53´ 30.36˝ E 11⁰09´26.96˝ and N 76⁰54´35.53 E

11⁰05´75.93˝)

SOUTH

From Mandampottithodu towards west along southern boundary of Attapady forest range up to

North Eastern Boundary of Thathengalam Vested Forests (VFC-1) of Mannarkkad Range. Then

from North- Eastern boundary of Thanthenglam Vested Forests (VFC-1) It follows the southern

boundary till it reaches the south Eastern boundary of Thathengalam Vested Forests (VFC-1)

thence along the southern boundaries of VFC-1,18,17 and 92) till it reaches Palakkad –

Malappuram District boundary).

WEST

From the above point in Palakkad – Malappuram district boundary towards North all along the

Western boundaries of the vested forests bits Cherumba Malavaram (VFC-15(1) and 15(2),

Kannoth Malavaram (VFC-2) and Kozhipara (VFC-10) unit till reaches the Kotapuzha river-

excluding approximatly an area of 50 Ha private land at Kottapuzha lying the north west

corner(N 76⁰39´25.84˝ E 11⁰23´04.02˝ and N 76⁰42´09.70˝ E 11⁰22´29.44˝)

NORTH

Thence towards east along the left bank of Kotapuzha river till it finally joins the interstate

boundary of Kerala and Tamil Nadu, then along the interstate boundary till it reaches Anginda

Peak (2383 M).
