का.आ. 119(अ).—ननलखत ाप अधसूचना, िजसे के%&य सरकार, पया(वरण (संर,ण) अधनयम, 1986

(1986 का 29) क1 धारा 3 क1 उपधारा (2) के खंड (v) और खंड (xiv) और उपधारा (3) के साथ पठत उपधारा (1)

8वारा द9त शि;तय< का योग करते हुए, जार करने का Bताव करती है, पया(वरण (संर,ण) नयम, 1986 के

नयम 5 के उपनयम (3) क1 अपे,ानुसार, जनसाधारण क1 जानकार के लए काशत क1 जाती है; िजनके उससे

भाFवत होने क1 संभावना है, ; और यह सूचना द जाती है Gक उ;त ाप अधसूचना पर, उस तारख से, िजसको इस

अधसूचना वाले भारत के राजपI क1 तयां जनसाधारण को उपलJध करा द जाती हK, साठ दन क1 अवध क1

समािLत पर या उसके पMचात् Fवचार Gकया जाएगा ;

ऐसा कोई Pयि;त, जो ाप अधसूचना मQ अंतFव(Rट Bताव< के संबंध मQ कोई आ,ेप या सुझाव देने मQ

हतबW है, इस कार Fवनद(Rट अवध के भीतर, के%&य सरकार 8वारा Fवचार Gकए जाने के लए, आ,ेप या सुझाव

सचव, पया(वरण, वन और जलवायु पXरवत(न मंIालय, इंदरा पया(वरण भवन, जोर बाग रोड, अलगंज, नई दल-

और यह अभयार\य मछलय< क1 67 जातय<, आवासीय और वासी पe,य< क1 234 जातय< का आfय

Bथल है, िज%हQ बांध के खुले जल भाग< से दज( Gकया गया है और इस ,ेI से 215 टे;सा , अ%जोBपेस( क1 17

जातय< और 2 Fपटेरडोफाइट जातय< को भी दज( Gकया गया है ।

और इस ,ेI का पXरर,ण और संर,ण करना है तथा िजसक1 सीमाओं को इस अधसूचना के पैरा 1 मQ

पाXरिBथतक और पया(वरण क1 gिRट से जायकावाड़ी प,ी अभयार\य संरe,त ,ेI के चार< ओर पाXरिBथतक संवेद

जोन के प मQ Fवनद(Rट Gकया गया है और उ;त पाXरिBथतक जोन मQ उ8योग या उ8योग< के वगh को तथा उनक1

संGiयाओं और Giयाओं को तFषW करना आवMयक है ;

अतः, अब, के%&य सरकार, पया(वरण (संर,ण) नयम, 1986 के नयम 5 के उपनयम (3) और पया(वरण

(संर,ण) अधनयम, 1986 (1986 का 29) क1 धारा 3 क1 उपधारा (2) के खंड (v) और खंड (xiv) और उपधारा (3) के

साथ पठत उपधारा (1) 8वारा द9त शि;तय< का योग करते हुए, महाराR] रा^य मQ जायकावाड़ी प,ी अभयार\य क1

सीमा से 0 से 500 मीटर के FवBतार के ,ेI को जायकावाड़ी प,ी अभयार\य पाXरिBथतक संवेद जोन (िजसे इसQ इसके

पMचात् पाXरिBथतक संवेद जोन कहा गया है) के प मQ अधसूचत करती है, िजसका Fववरण ननानुसार है, अथा(त्:—

पारि%थ'तक संवेद* जोन का ,व%तार और उसक. सीमाएं--(1) पाXरिBथतक संवेद जोन का जायकावाड़ी प,ी

अभयार\य क1 सीमा से 0 से 500 मीटर के FवBतार पर 141.05 वग( Gकलोमीटर ,ेI तक फैला हुआ है और ऐसे जोन

क1 सीमा का वण(न उपाबंध I के प मQ दया गया है ।

(2) पाXरिBथतक संवेद जोन महाराR] के िजला ओरंगाबाद और अहमदनगर के 100 nाम< तक फैला हुआ है ।

(3) पाXरिBथतक संवेद जोन के अंतग(त आने वाले nाम< क1 सूची के साथ मुoय pब%दुओं का नदqशांक उपाबंध II के

प मQ उपाबW है ।

(4) पाXरिBथतक संवेद जोन के साथ अ,ांश-देशांतर का मानचI उपाबंध III के प मQ उपाबW है ।

2. पारि%थ'तक संवेद* जोन के 4लए आंच4लक महायोजना – (1) रा^य सरकार, पाXरिB थतक संवेद जोन के योजन के

लए राजपI मQ अधसूचना के अंतम काशन क1 तारख से दो वष( क1 अवध के भीतर, Bथानीय Pयि;तय< के परामश(

से, इस अधसूचना मQ संलs न अनुबंध< के सामंजB य से आंचलक महायोजना तैयार करेगी ।

(2)

उ;त योजना रा^य सरकार मQ स,म ाधकार 8वारा अनुमोदत होगी ।

(3)

पाXरिB थतक संवेद जोन के लए आचंलक महायोजना इस अधसूचना मQ Fवनद(R ट प मQ ऐसी रत मQ रा^ य

सरकार तथा सुसंगत कQ &य और रा^ य Fवधय< के सामंजB य मQ भी तथा कQ &य सरकार 8वारा जार माग(नदqश, यद

कोई ह<, 8वारा तैयार होगी ।

(4) आंचलक महायोजना सभी संबW रा^ य सरकार के Fवभाग< के परामश( से तैयार होगी, अथा(त्:--

(i) पया(वरण ;

(ii) वन ;

(iii) नगर Fवकास ;

(iv) पय(टन ;

(v) नगरपालक ;

(vi) राजB व ;

(vii) कृFष ;

(viii) महाराR] रा^ य दूषण नयंIण बोड( ;

(ix) संचाई ;

(x) लोक नमा(ण Fवभाग ।

इसमQ पया(वरणीय और पाXरिB थतक1 Fवचार< को समाकलत करने के लए ह<गे।

आंचलक महायोजना अनुमोदत Fव8यमान भू-उपयोग, अवसंरचना और Giयाकलाप< पर कोई नबvधन

अधरोFपत नहं करेगी जब तक Gक इस अधसूचना मQ Fवनद(R ट न हो और आचंलक महायोजना सभी अवसंरचना और

Giयाकलाप< मQ और अधक द,ता और पाXरिB थतक1य अनुकूलता का संवध(न करेगी ।

आंचलक महायोजना मQ अनाwछादत ,ेI< के जीणxWार, Fव8यमान जल नकाय< के संर,ण, आवाह ,ेI< के

बंधन, जल-संभर< के बंधन, भूतल जल के बंधन, मृदा और नमी संर,ण, Bथानीय समुदाय< क1 आवMयकताओं तथा

पाXरिBथतक1 और पया(वरण से संबंधत ऐसे अ%य पहलूओं, िजन पर yयान देना आवMयक है, के लए उपबंध ह<गे ।

आंचलक महायोजना सभी Fव8यमान एवं BताFवत पूजा B थल<, nाम< और नगरय बंदोबBत<, वन< के कार

और GकB म<, कृFष ,ेI<, ऊपजाऊ भूम, हXरत ,ेI जैसे उ8यान और उसी कार के B थान, उ8यान कृFष ,ेI,

फलोधान, झील< और अ%य जल नकाय< का अ{यकंन करेगी ।

आंचलक महायोजना B थानीय समुदाय< क1 जीवकोपाज(न को सुनिM चत करने के लए, पाXरिBथतक संवेद

जोन मQ Fवकास को पाXरिBथक अनुकूल Fवकास के लए Fवनयमत करेगी ।

3. रा7य सरकार 8वारा 9कए जाने वाले उपाय-- रा^य सरकार इस अधसूचना के उपबंध< को भावी करने के लए

ननलखत उपाय करेगी, अथा(त् :--

(1) भू-उपयोग - पाXरिB थतक संवेद जोन मQ वन<, उ8यान-कृFष ,ेI<, कृFष ,ेI<, आमोद-मोद के योजन के लए

चि%हत Gकए गए पाकh और खुले Bथान< का वाणि^यक और औ8योगक संबW Fवकास Giयाकलाप< के लए उपयोग

या संपXरवत(न नहं होगा :

परंतु पाXरिBथतक संवेद जोन के भीतर कृFष भूम का संपXरवत(न मानीटर समत क1 सफाXरश पर और

रा^य सरकार के पूव( अनुमोदन से, Bथानीय नवासय< क1 आवासीय जरत< को पूरा करने के लए और पैरा 4 क1

सारणी के Bतंभ (2) के अधीन iम सं0 11, 17, 23, 30 और 33 के सामने सूचीबW Giयाकलाप< को पूरा करने के

लए अनु|ात ह<गे, अथा(त् :-

(i) पाXरिBथतक अनुकूल पय(टन Giयाकलाप< से संबंधत पय(टक< के अBथायी अधभोग के लए पाXरिBथतक अनुकूल

कुटर जैसे टKट, लकड़ी के मकान आद ;

(ii) Fव8यमान सड़क< को चौड़ा करना और सुgढ़ करना ;

(iii) दूषण उ9प%न न करने वाले लघु उ8योग;

(iv) वषा( जल संचय; और

(v) कुटर उ8योग< िजसके अंतग(त nामीण उ8योग, सुFव धाजनक भंडार और B थानीय सुFव धाएं भी हK, :

परंतु यह और Gक जनजातीय भूम का उपयोग रा^य सरकार के पूव( अनुमोदन और संFवधान के अनुw छेद 244

या त9समय वृ9त Fवध के उपबंध< के अनुपालन के pबना, िजसके अंतग(त अनुसूचत जनजात और अ%य परंपरागत

वन नवासी (वन अधकार< क1 मा%यता) अधनयम, 2006 (2007 का 2) भी है, वाणि^यक या उ8योग Fवकास

Giयाकलाप< के लए अनु|ात नहं होगा :

परंतु यह और भी Gक पाXरिB थतक संवेद जोन के भीतर भू-अभलेख< मQ उपसंजात कोई Iुट, मानीटर समत

के Fवचार ाLत करने के पMचात् रा^य सरकार 8वारा 9येक मामले मQ एक बार संशोधत होगी और उ;त Iुट के

संशोधन क1 सूचना भारत सरकार के पया(वरण, वन और जलवायु पXरवत(न मंIालय को देनी होगी ।

परंतु यह और भी Gक उपयु(;त Iुट का संशोधन मQ इस उप पैरा के अधीन यथा उपबंधत के सवाय Gकसी भी

दशा मQ भू-उपयोग का पXरवत(न सिमलत नहं होगा ।

परंतु यह और भी Gक िजससे हXरत ,ेI मQ जैसे वन ,ेI, कृFष ,ेI आद मQ कोई पाXरणामक कटौती नहं

होगी और अनयु; त या अनउ9 पादक कृFष ,ेI< मQ पुन: वनीकरण करने के यास Gकए जाएंगे ।

(2) "ाकृ'तक जल >ोत? -- आचंलक महायोजना मQ सभी ाकृतक जल ‚ोत< क1 पहचान क1 जाएगी और उनके संर,ण

और पुनƒ„ूतकरण के लए योजना सि मलत होगी और रा^ य सरकार 8वारा ऐसे ,ेI< पर या उनके नकट Fवकास

Giयाकलाप तFषW करने के लए ऐसी रत से माग(नदqश तैयार Gकए जाएंगे ।

(3) पयटन – (क) पाXरिBथतक संवेद जोन के भीतर पय(टन संबंधी Giयाकलाप पय(टन महायोजना के अनुसार ह<गे जो

Gक आंचलक महायोजना के भाग प मQ होगी ।

(ख) पय(टन महायोजना पय(टन Fवभाग, महाराR] सरकार 8वारा राजB व और वन Fवभाग के परामश( से तैयार होगी ।

(ग) पय(टन संबंधी Giयाकलाप न नलखत के अधीन Fवनयमत ह<गे, अथा(त् :-

(i) पाXरिBथतक संवेद जोन के भीतर सभी नए पय(टन Giयाकलाप< या Fव8यमान पय(टन Giयाकलाप< का

FवBतार भारत सरकार के पया(वरण, वन और जलवायु पXरवत(न मंIालय के माग(दश(क सWांत< के 8वारा तथा राR ]य

P या… संर,ण ाधकरण, 8वारा जार पाXरिBथतक पय(टन (समय-समय पर यथा संशोधत) माग(दश(क सWांत< के

अनुसार, पाXरिBथतक पय(टन, पाXरिBथतक श,ा और पाXरिBथतक Fवकास को मह9व देते हुए पाXरिBथतक संवेद जोन

क1 वहन ,मता के अyययन पर आधाXरत होगा;

(ii) पाXरिBथतक1य अनुकूल पय(टक Giयाकलाप< के संबंध मQ पय(टक< के अB थायी अधभोग के लए वास

सुFवधा के सवाय पाXरिBथतक संवेद जोन के भीतर होटल और Xरसोटh का नया संनमा(ण अनु|ात नहं होगा ;

(iii) आंचलक महायोजना का अनुमोदन Gकए जाने तक, पय(टन के लए Fवकास और Fव8यमान पय(टन

Giयाकलाप< के FवBतार को वाBतFवक Bथल Fवनद(Rट संवी,ा तथा मानीटर समत क1 सफाXरश पर आधाXरत

संबंधत Fवनयामक ाधकाXरय< 8वारा अनु|ात Gकया जाएगा ।

(4) नैसगक ,वरासत -- पाXरिBथतक संवेद जोन मQ मह9वपूण( नैसग(क Fवरासत के सभी Bथल< जैसे सभी जीन कोश

आरe,त ,ेI, शैल Fवरचनाएं, जल पात<, झरन<, घाट मागh, उपवन<, गुफाएं, Bथल<, †मण, अMवरोहण, पातो आद

क1 पहचान क1 जाएगी और उ%हQ संरe,त Gकया जाएगा तथा उनक1 lqj{kk और संर,ा के लए इस अधसूचना के

काशन क1 तारख से छह मास के भीतर, उपयु;त योजना बनाएगी और ऐसी योजना आंचलक महायोजना का भाग

होगा ।

(5) मानव 'न4मत ,वरासत % थल - पाXरिB थतक संवेद जोन मQ भवन<, संरचनाओं, शप-त‡य, ऐतहासक, कला9मक

और सांBकृतक मह9व के ,ेI< क1 पहचान करनी होगी और इस अधसूचना के काशन क1 तारख से छह माह के

भीतर उनके संर,ण क1 योजनाएं तैयार करनी होगी तथा आंचलक महायोजना मQ सिमलत क1 जाएगी ।

(6) B व'न "दूषण -- पाXरिBथतक संवेद जोन मQ y वन दूषण के नयंIण के लए रा^ य सरकार का पया(वरण Fवभाग,

वायु (दूषण नवारण और नयंIण) अधनयम, 1981 (1981 का 14) और उसके अधीन बनाए गए नयम< के उपबंध<

के अनुसरण मQ माग(दश(क सWांत और Fवनयम तैयार करेगा ।

(7) वायु "दूषण -- पाXरिBथतक संवेद जोन मQ, वायु दूषण के नयंIण के लए रा^य सरकार का पया(वरण Fवभाग,

वायु (दूषण नवारण और नयंIण) अधनयम, 1981 (1981 का 14) और उसके अधीन बनाए गए नयम< के उपबंध<

के अनुसरण मQ माग(दश(क सWांत और Fवनयम तैयार करेगा ।

(8) बDह>ाव का 'न%सारण -- पाXरिBथतक संवेद जोन मQ उपचाXरत बह‚ाव का नBसारण, जल (दूषण नवारण तथा

नयंIण) अधनयम, 1974 (1974 का 6) और उसके अधीन बनाए गए नयम< के उपबंध< के अनुसार होगा ।

(9) ठोस अप4शGट -- ठोस अपशRट< का नपटान ननलखत प मQ होगा -

(i)

पाXरिBथतक संवेद जोन मQ ठोस अपशRट< का नपटान भारत सरकार के त9कालन पया(वरण और

वन मंIालय क1 समय-समय पर यथा संशोधत अधसूचना सं. का.आ. 908(अ), तारख 25 सतंबर,

2000 नगरपालक ठोस अपशRट (बंध और हथालन) नयम, 2000 के उपबंध< के अनुसार Gकया

जाएगा ;

(ii)

Bथानीय ाधकरण जैव ननीकरणीय और अजैव ननीकरणीय संघटक< मQ ठोस अपशRट< के

संपृथ;कन के लए योजनाएं तैयार करQगे ;

(iii)

जैव ननीकरणीय सामnी को अधमानतः खाद बनाकर या कृम खेती के माyयम से पुनःचGiत

Gकया जाएगा ;

(iv)

अकाब(नक सामnी का नपटान पाXरिBथतक संवेद जोन के बाहर पहचान Gकए गए B थल पर Gकसी

पया(वरणीय Bवीकृत रत मQ होगा और पाXरिBथतक संवेद जोन मQ ठोस अपशR ट< को जलाना या

भR मीकरण अनु|ात नहं होगा ।

(10) जैव च9कH सीय अप4शG ट- पाXरिBथतक संवेद जोन मQ जैव चGक9सीय अपशRट< का नपटान भारत सरकार के

त9कालन 8वारा पया(वरण और वन मंIालय क1 समय-समय पर यथासंशोधत अधसूचना सं.का.आ. 630(अ) तारख

20 जुलाई, 1998 8वारा काशत जैव चGक9सीय अपशRट (बंध और हथालन) नयम, 1998 के उपबंध< के अनुसार

Gकया जाएगा ।

(11) यानीय परवहन - पXरवहन क1 यानीय गतFवधयां आवास के अनुकूल Fवनयमत ह<गी और इस संबंध मQ

आंचलक महायोजना मQ Fवशेष उपबंध अधकथत Gकए जाएंगे और आंचलक महायोजना के तैयार होने और रा^ य

सरकार के स,म ाधकार के 8वारा अनुमोदत होने तक, मानीटर समत वृ9त नयम< और Fवनयम< के अनुसार

यानीय गतFवधय< के अनुपालन को मानीटर करेगी ।

(12) औ8योगक इकाइयां –

(क) BताFवत पाXरिBथतक संवेद जोन के भीतर नए काRठ आधाXरत उ8योग< का Bथाप%न Fवध के अनुसार

BथाFपत Fव8यमान काRठ आधाXरत उ8योग के सवाय तFषW नहं Gकए जाएंगे ।

(ख) BताFवत पाXरिBथतक संवेद जोन के भीतर जल, वायु, मृदा, yवनी दूषण के कोई नए उ8योग का

Bथाप%न नहं होगा ।

(सFवल) सं. 1995 का 202 ट.एन. गौडाबम(न थƒमूलपाद बनाम

भारत सरकार के मामले मQ आदेश तारख 4.8.2006 और Xरट याचका

(सी) सं. 2012 का 435 गोवा फाउंडेशन बनाम भारत सरकार के

मामले मQ तारख 21.04.2014 के अंतXरम आदेश के अनुसरण मQ

सव(दा चालन होगा ।

पाXरिBथतक संवेद जोन के भीतर नई और Fव8यमान आरा मील< का

FवB तार अनु|ात नहं होगा ।

(3)

जल या वायु या मृदा या y वन दूषण

काXरत करने वाले उ8योग< क1 B थापना ।

पाXरिBथतक संवेद जोन के भीतर नए और Fव8यमान दूषण काXरत

करने वाले उ8योग का FवB तार अनु|ात नहं होगा ।

जलावन लकड़ी का वाणि^यक उपयोग ।

लागू Fवधय< के अनुसार तFषW (अ% यथा उपबंधत के सवाय) ।

जोन के भीतर कोई नया वाणि^यक होटल और Xरसोट( अनु|ात नहं

भूम मQ संनमा(ण िजसके अंतग(त पैरा 3 के उपपैरा (1) मQ सूचीबW

Giयाकलाप भी हK, को करने के लए अनु|ात Gकया जाएगा ।

(ख) दूषण काXरत न करने वाले लघु उ8योग< से संबंधत संनमा(ण

Giयाकलाप Fवनयमत Gकए जाएंगे और लागू नयम< और Fवनयम<,

यद कोई ह<, के अनुसार स,म ाधकार के पूव( अनु|ा लेकर ऐसे

दूषण को कम Gकया जाएगा ।

महायोजना के अनुसार ह<गे।

MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE

NOTIFICATION

New Delhi, the 6^th January, 2015

S.O. 119(E).—The following draft of the notification, which the Central Government proposes to issue in

exercise of the powers conferred by sub-section (1), read with clause (v) and clause (xiv) of sub-section (2) and

sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) is hereby published, as required

under sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, for the information of the public likely to be

affected thereby; and notice is hereby given that the said draft notification shall be taken into consideration on or after the

expiry of a period of sixty days from the date on which copies of the Gazette containing this notification are made

available to the Public;

Any person interested in making any objections or suggestions on the proposals contained in the draft

notification may forward the same in writing, for consideration of the Central Government within the period so specified

to the Secretary, Ministry of Environment, Forest and Climate Change, Indira Paryavaran Bhawan, Jorbagh Road,

Aliganj, New Delhi-110 003, or send it to the e-mail address of the Ministry at [email protected].

Draft Notification

WHEREAS, Jaikawadi Bird Sanctuary is situate in Aurangabad and Ahmadnagar districts of Maharashtra and is

spread over an area 341.05 square kilometer;

AND WHEREAS, the sanctuary harbors 67 species of fishes, 234 species of resident and migratory birds which

have been recorded from the open water stretches of the dam and 215 taxa, 17 species of angiosperms and 2 pteridophyte

species have also been recorded from the area;

AND WHEREAS, it is necessary to conserve and protect the area the extent and boundaries of which is

specified in paragraph 1 of this notification around the protected area of Jaikawadi Bird Sanctuary as Eco- sensitive Zone

from ecological and environmental point of view and to prohibit industries or class of industries and their operations and

processes in the said Eco-sensitive Zone;

NOW THEREFORE, in exercise of the powers conferred by sub-section(1) and clauses (v) and (xiv) of sub-

section (2) and sub-section (3) of section 3 of the Environment (Protection) Act 1986 (29 of 1986) read with sub- rule (3)

of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent

varying from 0 to 500 meters from the boundary of Jaikawadi Bird Sanctuary in the State of Maharashtra as the

Jaikawadi Bird Sanctuary Eco-sensitive Zone (hereinafter referred to as the Eco-sensitive Zone) details of which are as

under, namely:-

1. Extent and boundaries of Eco-sensitive Zone.- (1) The Eco-Sensitive Zone is spread over an area of 141.05 square

kilometre with an extent varying from 0 to 500 meters from the boundary of Jaikawadi Bird Sanctuary and the boundary

description of such Zone is given in Annexure I.

(2) The Eco-sensitive Zone is spread across 100 villages in Aurangabad and Ahmadnagar District of Maharashtra.

(3) The list of the villages falling within Eco-sensitive Zone along with co-ordinates of prominent points is appended as

Annexure II.

(4) The map of the Eco-sensitive Zone along with latitude and longitude is appended as Annexure III.

2. Zonal Master Plan for the Eco-sensitive Zone.- (1) The State Government shall, for the purpose of the Eco-

sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of final

notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this

notification.

(2)

The said Plan shall be approved by the competent authority in the State Government.

(3)

The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as

is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued

by the Central Government, if any.

(4)

The Zonal Master Plan shall be prepared in consultation with all concerned State Departments, namely:-

(i) Environment,

(ii) Forest,

(iii) Urban Development,

(iv) Tourism,

(v) Municipal,

(vii) Agriculture

(viii) Maharashtra State Pollution Control Board,

(ix) Irrigation

(x) Public Works Department

for integrating environmental and ecological considerations into it.

The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and

activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all

infrastructure and activities to be more efficient and eco-friendly.

(6)

The Zonal Master plan shall provide for restoration of denuded areas, conservation of existing water bodies,

management of catchment areas, watershed management, groundwater management, soil and moisture conservation,

needs of local community and such other aspects of the ecology and environment that need attention.

(7)

The Zonal Master Plan shall demarcate all the existing and proposed worshipping places, village and urban

settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places,

horticultural areas, orchards, lakes and other water bodies.

(8)

The Zonal Master Plan shall regulate development in Eco-sensitive Zone as to ensure Eco-friendly development

for livelihood security of local communities.

Measures to be taken by State Governments.-The State Governments shall take the following measures for

giving effect to the provisions of this notification, namely:-

(1) Land use.- Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes

in the Eco-sensitive Zone shall not be used or converted into areas for commercial or industrial related development

activities:

Provided that the conversion of agricultural lands within the Eco-sensitive Zone may be permitted on the

recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet the

residential needs of local residents, and for the activities listed against serial numbers 11, 17, 23, 30 and 33 in column (2)

of the Table in paragraph 4, namely:-

(i)

Eco-friendly cottages for temporary occupation of tourists, such as tents, wooden houses, etc. for Eco-friendly

tourism activities,

(ii)

Widening and strengthening of existing roads .

(iii)

Small scale industries not causing pollution,

(iv)

Rainwater harvesting, and

(v)

Cottage industries including village industries, convenience stores and amenities etc:

Provided further that no use of tribal land shall be permitted for commercial and industrial development

activities without the prior approval of the State Government and without compliance of the provisions of article 244 of

the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest

Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):

Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by

the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said

error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:

Provided also that the above correction of error shall not include change of land use in any case except as

provided under this sub-paragraph.

Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural

area and efforts shall be made to reforest the unused or unproductive agricultural areas.

(2) Natural springs.-The catchment areas of all natural springs shall be identified and plans for their conservation and

rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State

Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such

areas.

(3) Tourism.- (a) The activity relating to tourism within the Eco-sensitive Zone shall be as per Tourism Master Plan,

which shall form part of the Zonal Master Plan.

(b) The Tourism Master Plan shall be prepared by Department of Tourism, Government of Maharashtra in consultation

with Department of Revenue and Forests, Government of Maharashtra.

(i)

all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in

accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forests and Climate

Change and the eco-tourism guidelines issued by National Tiger Conservation Authority, (as amended from time to time)

with emphasis on eco-tourism, eco-education and eco-development and based on carrying capacity study of the Eco-

sensitive Zone;

(ii)

new construction of hotels and resorts shall not be permitted within the Eco-sensitive Zone except for

accommodation for temporary occupation of tourists related to Eco-friendly tourism activities:

(iii)

till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities

shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation

of the Monitoring Committee.

(4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve

areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and

preserved and plan shall be drawn up for their protection and conservation, within six months from the date of

publication of final notification and such plan shall form part of the Zonal Master Plan.

(5)

Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural,

aesthetic, and cultural significance shall be indentified in the Eco-sensitive Zone and plans for their conservation shall be

prepared within six months from the date of publication of final notification and incorporated in the Zonal Master Plan.

(6) Noise pollution.- The Environment Department of the State Government or Maharashtra State Pollution Control

Board shall draw up guidelines and regulations for the control of noise pollution in the Eco-sensitive Zone in accordance

with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made

thereunder.

(7) Air pollution.- The Environment Department of the State Government or Maharashtra State Pollution Control Board

shall draw up guidelines and regulations for the control of air pollution in the Eco-sensitive Zone in accordance with the

provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made thereunder.

Discharge of effluents.- The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the

provisions of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974) and the rules made thereunder.

(9) Solid wastes. - Disposal of solid wastes shall be as under:-

(i) the solid waste disposal in Eco-sensitive Zone shall be carried out as per the provisions of the Municipal Solid Waste

(Management and Handling) Rules, 2000 published by the Government of India in the erstwhile Ministry of

Environment and Forests vide notification number S.O. 908 (E), dated the 25^th September 2000 as amended from time to

time;

(ii) the local authorities shall draw up plans for the segregation of solid wastes into biodegradable and non-biodegradable

components;

(iii) the biodegradable material shall be recycled preferably through composting or vermiculture;

(iv) the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-

sensitive Zone and no burning or incineration of solid wastes shall be permitted in the Eco-sensitive Zone

Bio-medical waste.- The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out as per the

provisions of the Bio-Medical Waste (Management and Handling) Rules, 1998 published by the Government of India in

the erstwhile Ministry of Environment and Forests vide notification number S.O. 630(E), dated the 20^th July, 1998 as

amended from time to time.

(11) Vehicular traffic. - The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific

provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master Plan is

prepared and approved by Competent Authority in the State Government, the Monitoring Committee shall monitor

compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.

(12) Industrial units.- (a) No establishment of new wood based industries within the proposed Eco-sensitive Zone shall

be permitted except the existing wood based industries set up as per the law.

(b) No establishment of any new industry causing water, air, soil, noise pollution within the proposed Eco-

sensitive Zone shall be permitted.

4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.- All activities in the Eco sensitive

Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made

thereunder, and be regulated in the manner specified in the table below, namely:-

Setting up of saw mills.

No new or expansion of existing saw mills shall be permitted

within the Eco-sensitive zone.

Setting up of industries causing water or air or

soil or noise pollution.

No new or expansion of polluting industries in the Eco-sensitive

Zone shall be permitted.

Commercial use of firewood.

Prohibited (except as otherwise provided) as per applicable laws.

Establishment of new major hydroelectric

No person shall use, store manufacture, deal in supply throw or

dispose off plastic bags in Zone Area.

Regulated activities

11.

Establishment of hotels and resorts.

No new commercial hotels and resorts shall be permitted within

the Eco-sensitive Zone except for accommodation for temporary

occupation of tourists related to eco-friendly tourism activities.

12.

Construction activities.

(a) No new commercial construction of any kind shall be

permitted within the Eco-sensitive Zone:

Provided that, local people shall be permitted to undertake

construction in their land for their residential use including the

activities listed in sub-paragraph (1) of paragraph 3;

(b) the construction activity related to small scale industries not

causing pollution shall be regulated and kept at the minimum,

with the prior permission from the competent authority as per

applicable rules and regulations, if any.

Zonal Master Plan

13.

Felling of trees.

(a) There shall be no felling of trees on the forest or Government

or revenue or private lands without prior permission of the

competent authority in the State Government;

(b) the felling of trees shall be regulated in accordance with the

provisions of the concerned Central or State Act and the rules

made thereunder.

Plan prescriptions shall be followed.

14.

Commercial water resources including ground

water harvesting.

(a) The extraction of surface water and ground water shall be

permitted only for bona fide agricultural use and domestic

consumption of the occupier of the land;

(b) extraction of surface water and ground water for industrial or

commercial use including the amount that can be extracted, shall

require prior written permission from the concerned regulatory

authority;

(d) steps shall be taken to prevent contamination or pollution of

water from any source including agriculture.

agriculture, floriculture, horticulture or agro-based industry

producing products from indigenous goods from the Eco-sensitive

Zone, and which do not cause any adverse impact on

environment.

Collection of Forest produce or Non-Timber

Forest Produce (NTFP).

5. Monitoring Committee.- (1) The Central Government hereby constitutes a Monitoring Committee, for effective

monitoring of the Eco-sensitive Zone, which shall comprise of the following, namely:-

Terms of Reference.- (1) The Monitoring Committee shall monitor the compliance of the provisions of this

notification.

(2)

The activities that are covered in the schedule to the notification of the Government of India in the erstwhile

Ministry of Environment and Forests number S.O. 1533 (E), dated the 14^th September, 2006, and are falling in

the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof,

shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to

the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental

clearances under the provisions of the said notification.

(3)

The activities that are not covered in the schedule to the notification of the Government of India in the

erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14^th September, 2006 and are

falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph

4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and

referred to the concerned regulatory authorities.

The Member-Secretary of the Monitoring Committee or the concerned Collector or the concerned park Deputy

Conservator of Forests shall be competent to file complaint under section 19 of the Environment (Protection)

Act, 1986 against any person who contravenes the provisions of this notification.

(5)

The Monitoring Committee may invite representatives or experts from concerned Departments, representatives

from Industry Associations or concerned stakeholders to assist in its deliberations depending on the

requirements on issue to issue basis.

(6)

The Monitoring Committee shall submit the annual action taken report of its activities as on 31^st March of

every year by 30^th June of that year to the Chief Wildlife Warden of the State as per pro forma appended at

Annexure IV.

(7)

The Central Government in the Ministry of Environment, Forests and Climate Change may give such

directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.

The Central Government and State Governments may specify additional measures, if any, for giving effect to

provisions of this notification.

The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon’ble

Supreme Court of India or the High Court or National Green Tribunal.
