का.आ. 137(अ).—ननलखत ाप अधसूचना, िजसे के%&य सरकार, पया(वरण (संर,ण) अधनयम, 1986

(1986 का 29) क1 धारा 3 क1 उपधारा (2) के खंड (v) और खंड (xiv) तथा उपधारा (3) के साथ पठत उपधारा (1)

7वारा द8त शि:तय; का योग करते हुए, जार करने का Aताव करती है, पया(वरण (संर,ण) नयम, 1986 के

नयम 5 के उपनयम (3) क1 अपे,ानुसार, जनसाधारण क1 जानकार के लए काशत क1 जाती है; िजनके उससे

भाGवत होने क1 संभावना है ; और यह सूचना द जाती है Hक उ:त ाप अधसूचना पर, उस तारख से, िजसको इस

अधसूचना वाले भारत के राजपJ क1 तयां जनसाधारण को उपलKध करा द जाती हL, साठ दन क1 अवध क1

समािMत पर या उसके पNचात् Gवचार Hकया जाएगा ;

ऐसा कोई Qयि:त, जो ाप अधसूचना मR अंतGव(Sट Aताव; के संबंध मR कोई आ,ेप या सुझाव देने मR

हतबX है, इस कार Gवनद(Sट अवध के भीतर, के%&य सरकार 7वारा Gवचार Hकए जाने के लए, आ,ेप या सुझाव

सचव, पया(वरण, वन और जलवायु पYरवत(न मंJालय, इंद रा पया(वरण भवन, जोर बाग रोड, अलगंज, नई दल-

गुडेकोटे रछ अभयार^ य, कना(टक मR िजला बेलार के कुदलजी और संदूर तालुकाओं मR 14⁰50 से 11⁰ 06

उ8 तर अ,ांश और 76⁰37 और 55⁰ 7 पूवb देशांतर के बीच मR िA थत है िजसके अंतग(त कुल भौगोलक ,ेJ 38.48

वग( Hकलोमीटर मुe यत: संकटfA त A तनपायी रछ के संर,ण के लए 2013 मR अधसूचत Hकया गया था ।

और, अभयार^ य क1 गुफाओं के साथ चhानीय शलाखंड, झाड़ीदार जंगल Aलोथ jबयर के लए एक आदश(

ाकृतक वास है और अभयार^ य मR लाल चंदन, फाइकस आद जैसी वृ, जातयां और चीता, साल, jबलाव, जंगल,

jब ल, जंगल, बनैला सूअर, सयार, साह N याम गुछlदार खरगोश, लाल नेवला आद जीवजंतु िजनमR से कुछ अनुसूची-

1 क1 जातयां हL और अभयार^ य 150 प,ी जातय; और सरसृप; जैसे ताYरक कछुआ, अजगर, दबोइया लालरेती

अजगर, कोबरा आद के लए भी एक ाकृतक वास का नमा(ण करता है ।

और, रछ अभयार^ य पYरसर के साथ साथ पाYरिA थतक संवेद जोन क1 A थापना करके रछ, चीता और अ% य

संकटfA त जीवजंतु जैव GवGवधता और उसके व% यजीव तथा उसके पया(वरण को संरm,त और सुरm,त करना आवN यक

हो गया है ।

और, गुडेकोटे रछ अभयार^ य के चार; ओर के ,ेJ को, िजसका GवAतार और सीमाएं इस अधसूचना के पैरा 1

मR Gवनद(Sट हL, पया(वरण क1 nिSट से पारि&थ(तक संवेद+ जोन के प मR सुरm,त और संरm,त करना तथा उ:त

पारि&थ(तक संवेद+ जोन मR उ7योग; या उ7योग; के वगo के चालन तथा संAकरण करने को तGषX करना आवNयक

है;

अतः, अब, के%&य सरकार, पया(वरण (संर,ण) नयम, 1986 के नयम 5 के उपनयम (3) के साथ पठ त

पया(वरण (संर,ण) अधनयम, 1986 (1986 का 29) क1 धारा 3 क1 उपधारा (1) और उपधारा (2) के खंड (v) और

खंड (xiv) और उपधारा (3) 7वारा द8त शि:तय; का योग करते हुए, कना(टक राr य मR गुडेकोटे रछ अभयार^ य

क1 सीमा के इद( गद( 275 मीटर से 4.75 Hकलोमीटर तक के GवA तार वाले ,ेJ को गुडेकोटे रछ अभयार^ य

पाYरिA थतक संवेद जोन (िजसे इसमR इसके पN चात् पाYरिA थतक संवेद जोन कहा गया है) के प मR अधसूचत करती

है, िजसके K यौरे ननानुसार है, अथा(त् :--

पारि&थ(तक संवेद+ जोन का -व&तार और उसक/ सीमाएं--(1) पाYरिAथतक संवेद जोन 95.258 वग(

Hकलोमीटर के ,ेJ मR फैला हुआ है और िजसका GवA तार गुडेकोटे रछ अभयार^ य क1 सीमा के इद( गद( 275 मीटर से

4.75 Hकलोमीटर तक है िजसक1 सीमाओं का वण(न उपाबंध I मR दया गया है ।

(2) पाYरिA थतक संवेद जोन के अंतग(त आने वाले 7 fाम; क1 सूची मुe य jबंदुओं के नदsशांक; सहत उपाबंध II के

प मR संलt न है ।

(3) अ,ांश और देशांतर रेखा के साथ-साथ पाYरिAथतक संवेद जोन क1 सीमा के K यौरे मानचJ उपाबंध III के प मR

संलt न है ।

(4) पाYरिA थतक संवेद जोन और अभयार^ य सीमा के मुe य अवA थान उपाबंध IV के प मR संलt न हL ।

2. पारि& थ(तक संवेद+ जोन के 4लए आंच4लक महायोजना-- (1) राrय सरकार, पाYरिA थतक संवेद जोन के योजन के

लए राजपJ मR अंतम अधसूचना के काशन क1 तारख से दो वष( क1 अवध के भीतर Aथानीय लोग; से परामश(

करके और इस अधसूचना मR दए गए अनुबंध; का पालन करते हुए एक आंचलक महायोजना तैयार करेगी ।

(2)

उ: त योजना का राr य सरकार मR स,म ाधकार 7वारा अनुमोदन क1 जाएगी ।

(3)

पाYरिA थतक संवेद जोन क1 उ: त महायोजना राr य सरकार 7वारा ऐसी रत से जो इस अधसूचना मR

Gवनद(S ट Hक या जाए और सुसंगत के% &य और राr य Gवधय; के और के% &य सरकार 7वारा जार माग(दशb सXांत; के

अनुप तैयार Hक या जाएगा ।

(4) आंचलक महायोजना इसमR पया(वरण और पाYरिAथतक क1 बात; को समाकलत करने के लए सभी संबंध त

राr य Gव भाग; के परामश( से तैयार Hक या जाएगा, अथा(त् :--

(i)

पया(वरण ;

(ii)

वन ;

(iii)

शहर Gवकास ;

(iv)

पय(टन ;

(v)

नगरपालका ;

(vi)

राजA व ;

(vii)

कृGष ; और

(viii)

कना(टक राr य दूषण नयंJण बोड(;

(ix) संचाई; और

(x) लोक नमा(ण Gवभाग ।

महायोजना मR जब तक इस अध सूचना मR ऐसा Gव न( दS ट न हो तब तक अनुमोद त Gव 7यमान भू-उपयोग,

अवसंरचना और Huयाकलाप; पर कोई नबvधन अधरोGपत नहं Hक या जाएगा और आंचलक महायोजना सभी अवसंरचना

के सुधार और अधक द, तथा पाYरिA थतक अनुकूल होने वाले Huयाकलाप इस कार Gवनद(S ट न हो ।

आंचलक महायोजना मR अनाwछादत ,ेJ; के जीणoXार, Gव7यमान जल नकाय; के संर,ण, आवाह ,ेJ; के

बंधन, जल-संभर; के बंधन, भूतल जल के बंधन, मृदा और नमी संर,ण, Aथानीय समुदाय; क1 आवNयकताओं तथा

पाYरिAथतक और पया(वरण से संबंधत ऐसे अ%य पहलूओं, िजन पर xयान देना आवNयक है, के लए K यौरे उपलK ध

ह;गे ।

(7) आंचलक महायोजना योजना सभी Gव7यमान और A ताGवत पूजा A थल;, fाम; और नगरय बंदोबAत;, वन; के

कार और HकA म;, जनजातीय ,ेJ; कृGष ,ेJ;, ऊपजाऊ भूम, हYरत ,ेJ जैसे उ7यान और उसी कार के A थान,

उ7यान कृGष ,ेJ, फलो7यान, झील; और अ%य जल नकाय; का अzयकंन करेगी ।

उ: त योजना पाYरिA थतक संवेद जोन मR Gवकास को Gवनयमत करेगी िजससे पाYरिA थतक अनुकूल Gवकास

A थानीय समुदाय; क1 जीवकोपाज(न सुर,ा के लए सुनिN चत Hकया जा सके ।

3. रा7य सरकार 8वारा 9कए जाने वाले उपाय-- राrय सरकार इस अधसूचना के उपबंध; को भावी करने के लए

ननलखत उपाय करेगी, अथा(त् :--

(1) भू-उपयोग - पाYरिA थतक संवेद जोन मR वन;, उ7यान-कृGष ,ेJ;, कृGष ,ेJ;, आमोद-मोद के योजन के लए

चि%हत Hकए गए पाक{ और खुले Aथान; का वाणिrयक और औ7योगक संबX Gवकास Huयाकलाप; के लए उपयोग

या संपYरवत(न नहं होगा:

परंतु पाYरिAथतक संवेद जोन के भीतर कृGष भूम का संपYरवत(न, मानीटर समत क1 सफाYरश पर और

राrय सरकार के पूव( अनुमोदन से, Aथानीय नवासय; क1 आवासीय जरत; को पूरा करने के लए और पैरा 4 क1

सारणी के Aतंभ (2) के अधीन मद सं0 11,17, 23, 28 और सं. 31 के सामने सूचीबX Huयाकलाप; को पूरा करने के

लए अनु|ात ह;गे, अथा(त् :-

(i)

पाYर िA थ त क अनुकूल पय(टन Hu याकलाप; के ल ए, पय(टक; के अA थायी अध भोग के ल ए पाYर िA थ त क

अनुकूल कुटर जैसे टे% ट, काS ट गृह;

(ii)

Gव7यमान सड़क; को चौड़ा करना तथा उनका सnढकरण;

(iii) दूषण उ8प%न न करने वाले लघु उ7योग;

(iv) वषा( जल संचय; और

(v)

कुटर उ7योग, िजसके अंतग(त fामीण उ7योग भी हL :

परंतु यह और Hक राrय सरकार के पूव( अनुमोदन और संGवधान के अनुw छेद 244 या त8समय वृ8त Gवध के

उपबंध; के अनुपालन के jबना, िजसके अंतग(त अनुसूचत जनजात और अ%य परंपरागत वन नवासी (वन अधकार; क1

मा%यता) अधनयम, 2006 (2007 का 2) भी है, वाणिrयक या उ7योग Gवकास Huयाकलाप; के लए जनजातीय भूम

का उपयोग अनु|ात नहं होगा :

परंतु यह भी Hक पाYरिA थतक संवेद जोन के भीतर भू-अभलेख; मR तीत होने वाल कोई Jुट, मानीटर

समत के Gवचार ाMत करने के पNचात् राrय सरकार 7वारा 8येक मामले मR केवल एक बार ठlक क1 जाएगी और

उ:त Jुट के ठlक करने क1 के% &य सरकार के पया(वरण, वन और जलवायु पYरवत(न मंJालय को सूचना देनी होगी ।

परंतु यह भी Hक उपयु(:त Jुट का संशोधन मR इस उप पैरा के अधीन यथा उपबंधत के सवाय Hकसी भी दशा

मR भू-उपयोग का पYरवत(न सिमलत नहं होगा ।

परंतु यह भी Hक िजससे हYरत ,ेJ जैसे वन ,ेJ और कृGष ,ेJ मR कोई पाYरणामक कटौती नहं होगी और

अनुपयु: त या अनु8 पादक कृGष ,ेJ; मR पुन: वनीकरण करने के यास Hकए जाएंगे ।

(2) #ाकृ(तक जल =ोत- आचंलक महायोजना मR सभी ाकृतक जल •ोत; के आवाह ,ेJ; क1 पहचान क1 जाएगी और

उनके संर,ण और नवीकरण के लए योजना सि मलत होगी और राr य सरकार 7वारा इन ,ेJ; पर या उनके नकट

Gवकास Huयाकलाप;, जो ऐसे ,ेJ; के लए हानकारक हL, को तGषX करने के लए ऐसी रत से माग(नदsश तैयार

Hकए जाएंगे ।

(3) पयटन – (क) पाYरिAथतक संवेद जोन के भीतर पय(टन संबंधी Huयाकलाप, जो आंचलक महायोजना का भाग प

ह;गे ।

(ख) पय(टन महायोजना पय(टन Gवभाग, कना(टक सरकार के वन और पया(वरण Gवभाग, के परामश( से तैयार होगी ।

(ग) पय(टन संबंधी Huयाकलाप न नलखत के अधीन Gवनयमत ह;गे, अथा(त् :-

(i) पाYरिAथतक संवेद जोन के भीतर सभी नए पय(टन Huयाकलाप; या Gव7यमान पय(टन Huयाकलाप; का

GवAतार भारत सरकार के पया(वरण, वन और जलवायु पYरवत(न मंJालय के माग(दश(क सXांत; के 7वारा तथा

राS €य Q या• संर,ण ाधकरण, 7वारा जार पाYरिAथतक पय(टन (समय-समय पर यथा संशोधत) माग(दश(क

सXांत; के अनुसार, पाYरिAथतक पय(टन, पाYरिAथतक श,ा और पाYरिAथतक Gवकास को मह8व देते

हुए पाYरिAथतक संवेद जोन क1 वहन ,मता के अxययन पर आधाYरत होगा;

(ii) पाYरिA थतक1य अनुकूल पय(टक Huयाकलाप; के संबंध मR अAथायी अधभोग के लए वास सुGवधा के

सवाय गुडेकोटे रछ अभयार^ य क1 सीमा से एक Hकलोमीटर भीतर होटल और Yरसोट{ का नया संनमा(ण

अनु|ात नहं होगा ;

परंतु संरm,त ,ेJ क1 सीमा से एक Hकलोमीटर क1 दूर से परे पाYरिAथतक संवेद जोन क1 सीमा तक

नए होटल और Yरसोट( के Aथापना पय(टन महायोजना के अनुसार पाYरिAथतक पय(टन सुGवधा के लए पूव(

पYरभाGषत और Gवनद(Sट Aथान मR ह अनु|ात Hकया जाएगा ।

(iii) आंचलक महायोजना का अनुमोदन Hकए जाने तक, पय(टन के लए Gवकास और Gव7यमान पय(टन

Huयाकलाप; के GवAतार को वाAतGवक Aथल Gवनद(Sट संवी,ा तथा मानीटर समत क1 सफाYरश पर

आधाYरत संबंधत Gवनयामक ाधकरण; 7वारा अनु|ात Hकया जाएगा ।

(4) नैसगक -वरासत – पाYरिAथतक संवेद जोन मR मह8वपूण( नैसग(क Gवरासत के सभी Aथल; जैसे सभी जीन कोश

आरm,त ,ेJ, शैल Gवरचनाएं, जल पात;, झरन;, घाट माग{, उपवन;, गुफाएं, Aथल;, ‚मण, अNवरोहण, पातो आद

क1 पहचान क1 जाएगी और उ%हR संरm,त Hकया जाएगा तथा उनक1 संर,ा क1 जाएगी और संर,ा के लए अंतम

अधसूचना के काशन क1 तारख से छह मास के भीतर, उपयु:त योजना बनाएगी और ऐसी योजना आंचलक

महायोजना का भाग होगा ।

(5) मानव (न4मत -वरासत & थल – पाYरिA थतक संवेद जोन मR भवन;, संरचनाओं, शप-तƒय, ऐतहासक, वाA तु

श पीय कला8मक और सांAकृतक मह8व के ,ेJ; और उप,ेJ; क1 पहचान करनी होगी और अंतम अधसूचना के

काशन क1 तारख से छह माह के भीतर उनके संर,ण क1 योजनाएं तैयार करनी होगी तथा आंचलक महायोजना मR

सिमलत क1 जाएगी ।

(6) A व(न #दूषण – पाYरिAथतक संवेद जोन मR x वन दूषण के नयंJण के लए राr य सरकार का पया(वरण Gवभाग

या कना(टक राr य दूषण नयंJण बोड(, वायु (दूषण नवारण और नयंJण) अधनयम, 1981 (1981 का 14) और

उसके अधीन बनाए गए नयम; के उपबंध; के अनुसार माग(दश(क सXांत और Gवनयम तैयार करेगा ।

(7) वायु #दूषण – पाYरिAथतक संवेद जोन मR, वायु दूषण के नयंJण के लए राrय सरकार का पया(वरण Gवभाग,

वायु (दूषण नवारण और नयंJण) अधनयम, 1981 (1981 का 14) और उसके अधीन बनाए गए नयम; के उपबंध;

के अनुसार मR माग(दश(क सXांत और Gवनयम तैयार करेगा ।

(8) बCह=ाव का (न&सारण – पाYरिAथतक संवेद जोन मR उपचाYरत बह•ाव का नAसारण, जल (दूषण नवारण तथा

नयंJण) अधनयम, 1974 (1974 का 6) और उसके अधीन बनाए गए नयम; के उपबंध; के अनुसार होगा ।

(9) ठोस अप4शFट – ठोस अपशSट; का नपटान ननलखत प मR होगा –

(i) पाYरिAथतक संवेद जोन मR ठोस अपशSट; का नपटान भारत सरकार के त8कालन पया(वरण और वन

मंJालय क1 समय-समय पर यथा संशोधत अधसूचना सं. का.आ. 908(अ), तारख 25 सतंबर, 2000

नगरपालक ठोस अपशSट (बंध और हथालन) नयम, 2000 के उपबंध; के अनुसार Hकया जाएगा ;

(ii) Aथानीय ाधकरण जैव ननीकरणीय और अजैव ननीकरणीय संघटक; मR ठोस अपशSट; के संपृथ:कन

के लए योजनाएं तैयार करRगे ;

(iii) जैव ननीकरणीय सामfी को अधमानतः खाद बनाकर या कृम खेती के माxयम से पुनःचHuत Hकया

जाएगा ;

(iv) अकाब(नक सामfी का नपटान पाYरिAथतक संवेद जोन के बाहर पहचान Hकए गए A थल पर Hकसी

पया(वरणीय प से Aवीकाय( रत मR होगा और पाYरिAथतक संवेद जोन मR ठोस अपशS ट; को जलाना या

भS मीकरण अनु|ात नहं होगा ।

(10) जैव च9कG सीय अप4शF ट- पाYरिAथतक संवेद जोन मR जैव चHक8सीय अपशSट; का नपटान भारत सरकार के

त8कालन पया(वरण और वन मंJालय क1 समय-समय पर यथासंशोधत अधसूचना सं.का.आ.630 (अ) तारख 20

जुलाई, 1998 7वारा काशत जैव चHक8सीय अपशSट (बंध और हथालन) नयम, 1998 के उपबंध; के अनुसार

Hकया जाएगा ।

(11) यानीय परवहन - पYरवहन क1 यानीय गत आवास के अनुकूल रत मR Gवनयमत होगी और इस संबंध मR

आंचलक महायोजना मR Gवशेष उपबंध समाGवS ट Hकए जाएंगे और आंचलक महायोजना के तैयार होने और राr य

सरकार के स,म ाधकार के 7वारा अनुमोदत होने तक, राrय सरकार पाYरिAथतक संवेद जोन मानीटर समत

सुसंगत अधनयम; के अधीन तथा तXीन बनाए गए नयम; और Gवनयम; के अधीन यानीय गत के अनुपालन को

मानीटर करेगी ।

(12) औ8योगक इकाईयां :-

(क) A ताGवत पाYरिA थतक संवेद जोन के भीतर नए काS ठ उ7योग; क1 A थापना Gवध के अनुसार A थाGपत Gव7यमान

काS ठ आधाYरत उ7योग; के लए अनु|ात क1 जाएगी अ% यथा नहं ।

(ख) A ताGवत पाYरिA थतक संवेद जोन के भीतर जल, वायु, मृदा, x वन दूषण उ8 प% न करने वाले Hकसी नए उ7योग

क1 A थापना नहं क1 जाएगी ।

सीमा तक वाA तGवक A थानीय आवN यकताओं के लए संनमा(ण क1

अनु|ा द जाएगी और अ% य वाणिr यक संनमा(ण Huयाकलाप

आंचलक महायोजना के अनुप ह;गे।

(v) पया(वरण के ,ेJ मR काय( करने वाले गैर सरकार संगठन; (िजसके अंतग(त Gवरासत संर,ण भी है) का 8येक

मामले मR एक वष( क1 अवध के लए कना(टक राrय सरकार 7वारा नामनद(Sट एक तनध - सदAय ;

का.आ. 1533(अ) तारख 14 सतंबर, 2006 क1 अनुसूची मR के अधीन सिमलत Huयाकलाप; और इस अधसूचना के

पैरा 4 के अधीन सारणी मR यथा Gवनद(S ट तGषX गतGवधय; के सवाय आने वाले ऐसे Huयाकलाप; क1 दशा मR

वाAतGवक Gवनद(Sट Aथलय दशाओं पर आधाYरत मानीटर समत 7वारा संवी,ा क1 जाएगी और उ:त अधसूचना के

उपबंध; के अधीन पूव( पया(वरण नकासी के लए के%&य सरकार के पया(वरण, वन और जलवायु पYरवत(न मंJालय को

नद(Sट क1 जाएगी ।

NOTIFICATION

New Delhi, the 13th January, 2016

S.O. 137(E).—The following draft of the notification, which the Central Government proposes to issue in

exercise of the powers conferred by sub-section (1), read with clause (v) and clause (xiv) of sub-section (2) and sub-

section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) is hereby published, as required under

sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, for the information of the public likely to be affected

thereby; and notice is hereby given that the said draft notification shall be taken into consideration on or after the expiry

of a period of sixty days from the date on which copies of the Gazette containing this notification are made available to

the public;

Any person interested in making any objections or suggestions on the proposals contained in the draft

notification may forward the same in writing, for consideration of the Central Government within the period so specified

Draft Notification

WHEREAS, the Gudekote Sloth Bear Sanctuary situated in the Kudligi and Sandur Talukas of District Bellary,

Karnataka lies between 14^o50’ and 11^o06’N latitude and 76^o37’ and 55^o7’E longitude covering a total geographic area of

38.48 square kilometre was notified in 2013 primarily for the conservation of the endangered mammal, the Sloth Bear;

AND WHEREAS, the Sanctuary’s rocky boulder terrain with caves, scrub jungle is an ideal habitat for the

Sloth Bear and the sanctuary also has tree species such as Red Sandal, Ficus, etc and fauna such as Leopard, Pangolin,

Civet Cat, Jungle Cat, Wild Boar, Jackal, Porcupine, Black-naped Hare, Ruddy Mongoose, etc, some of which are

Schedule-I species and it also forms a habitat for about 150 species of birds and reptiles such as Star Tortoise, Python,

Russell’s Viper, Red Sand Boa, Cobra, etc.

AND WHEREAS, it is necessary to conserve and protect the Sloth Bear, Leopard and other endangered faunal

biodiversity and wildlife therein and its environment by establishing an Eco-Sensitive Zone along the periphery of the

Sloth Bear Sanctuary.

AND WHEREAS, it is necessary to conserve and protect the geographical area the extent and boundaries of

which are specified in paragraph 1 of this notification around the protected area of Gudekote Sloth Bear Sanctuary as

Eco-sensitive Zone from ecological and environmental aspects, to conserve and protect the biodiversity and wildlife

therein and its environment and to prohibit industries or class of industries and their operations and process in the said

Eco-sensitive Zone;

NOW THEREFORE, in exercise of the power conferred by sub section(1) and clauses (v) and (xiv) of sub-

section (2) and sub-section (3) of section 3 of the Environment (Protection) Act 1986 (29 of 1986) read with sub-rule (3)

of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area with an extent

varying from 275metre to 4.75 kilometre all around the boundary of Gudekote Sloth Bear Sanctuary in the State of

Karnataka as the Gudekote Sloth Bear Sanctuary Eco-sensitive Zone (herein after referred to as the Eco-sensitive Zone)

details of which are as under, namely:-

1. Extent and boundaries of Eco-sensitive Zone.- (1) The Eco-sensitive Zone is spread over an area of 95.258

square kilometre with an extent varying from 275 meter to 4.75 kilometres around the boundary of Gudekote Sloth Bear

Sanctuary and the boundary details of such Zone are given in Annexure-I.

(2)

The list of seven villages falling within Eco-sensitive Zone along with co-ordinates of prominent points is

appended as Annexure-II.

(3)

The map of the Eco-sensitive Zone along with boundary details and latitudes and longitudes is appended as

Annexure-III.

(4)

Key locations of the eco-sensitive zone as well as of the sanctuary boundary are appended as Annexure-IV.

2. Zonal Master Plan for the Eco-sensitive Zone.- (1) The State Government shall, for the purpose of the Eco-

sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of final

notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this

notification.

(2)

The said Plan shall be approved by the competent authority in the State Government.

(3)

The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such a manner

as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines

issued by the Central Government, if any.

(4)

The Zonal Master Plan shall be prepared in consultation with all concerned State Departments, namely:-

(i) Environment,

(ii) Forest,

(iii) Urban Development,

(iv) Tourism,

(v) Municipal,

(vi) Revenue,

(vii) Agriculture,

(viii) Karnataka State Pollution Control Board,

(ix) Irrigation,

(x) Public Works Department.

for integrating environmental and ecological considerations into it.

The Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities,

unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and

activities to be more efficient and eco-friendly.

(6)

The Zonal Master plan shall provide for restoration of denuded areas, conservation of existing water bodies,

management of catchment areas, watershed management, groundwater management, soil and moisture conservation,

needs of local community and such other aspects of the ecology and environment that needs attention.

(7)

The Zonal Master Plan shall demarcate all the existing worshipping places, village and urban settlements, types

and kinds of forests, tribal areas, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural

areas, orchards, lakes and other water bodies.

(8)

The Zonal Master Plan shall regulate development in Eco-sensitive Zone so as to ensure eco-friendly

development for livelihood security of local communities.

Measures to be taken by State Government.-The State Government shall take the following measures for

giving effect to the provisions of this notification, namely:-

(1) Land use.- Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes

in the Eco-sensitive Zone shall not be used or converted into areas for commercial or industrial related development

activities:

Provided that the conversion of agricultural lands within the Eco-sensitive Zone may be permitted on the

recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet the

residential needs of local residents, and for the activities listed against serial numbers 11, 17, 23, 28 and 31 in column (2)

of the Table in paragraph 4, namely:-

(i)

Eco-friendly cottages for temporary occupation of tourists, such as tents, wooden houses, etc. for eco-friendly

tourism activities,

(ii)

Widening and strengthening of existing roads and construction of new roads,

(iii)

Small scale industries not causing pollution,

(iv)

Rainwater harvesting, and

(v)

Cottage industries including village industries, convenience stores and local amenities:

Provided further that no use of tribal land shall be permitted for commercial and industrial development

activities without the prior approval of the State Government and without compliance of the provisions of article 244 of

the constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest

Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):

Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by

the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said

error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:

Provided also that the above correction of error shall not include change of land use in any case except as

provided under this sub-paragraph.

Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural

area and efforts shall be made to reforest the unused or unproductive agricultural areas.

(2) Natural springs.-The catchment areas of all natural springs shall be identified and plans for their

conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the

State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to

such areas.

(3) Tourism.- (a) The activity relating to tourism within the Eco-sensitive Zone shall be as per Tourism Master Plan,

which shall form part of the Zonal Master Plan.

(b) The Tourism Master Plan shall be prepared by Department of Tourism, in consultation with Department of Forests

and Environment of the State Government.

(i)

all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in

accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate

Change and the eco-tourism guidelines issued by the National Tiger Conservation Authority, (as amended from time to

time) with emphasis on eco-tourism, eco-education and eco-development and based on carrying capacity study of the

Eco-sensitive Zone;

(ii)

new construction of hotels and resorts shall not be permitted within one kilometer from the boundary of the

Gudekote Sloth Bear Sanctuary except for accommodation for temporary occupation of tourists related to eco-friendly

tourism activities:

Provided that beyond the distance of one kilometer from the boundary of the protected areas till the extent of the

Eco-sensitive Zone, the establishment of new hotels and resorts shall be permitted only in pre-defined and designated

areas for eco-tourism facilities as per Tourism Master Plan.

(iii)

till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities

shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation

of the Monitoring Committee.

(4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve

areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and

preserved and plan shall be drawn up for their protection and conservation, within six months from the date of

publication of final notification and such plan shall form part of the Zonal Master Plan.

(5)

Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural,

aesthetic, and cultural significance shall be indentified in the Eco-sensitive Zone and plans for their conservation shall be

prepared within six months from the date of publication of final notification and incorporated in the Zonal Master Plan.

(6) Noise pollution.- The Environment Department of the State Government or Karnataka State Pollution Control Board

shall draw up guidelines and regulations for the control of noise pollution in the Eco-sensitive Zone in accordance with

the provisions of the Air (Prevention and Control of Pollution) Act, 1981(14 of 1981) and the rules made there under.

(7) Air pollution.- The Environment Department of the State Government or Karnataka State Pollution Control Board

shall draw up guidelines and regulations for the control of air pollution in the Eco-sensitive Zone in accordance with the

provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made there under.

Discharge of effluents.- The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the

provisions of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974)and the rules made there under.

(9) Solid wastes. - Disposal of solid wastes shall be as under:-

(i) the solid waste disposal in Eco-sensitive Zone shall be carried out as per the provisions of the Municipal Solid Waste

(Management and Handling) Rules, 2000 published by the Government of India in the erstwhile Ministry of

Environment and Forests vide notification number S.O. 908 (E), dated the 25^th September, 2000 as amended from time

to time;

(ii) the local authorities shall draw up plans for the segregation of solid wastes into biodegradable and non-biodegradable

components;

(iii) the biodegradable material shall be recycled preferably through composting or vermiculture;

(iv) the inorganic material may be disposed in an environmentally acceptable manner at site(s) identified outside the Eco-

sensitive Zone and no burning or incineration of solid wastes shall be permitted in the Eco-sensitive Zone.

(10)

Bio-medical waste.- The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out as per the

provisions of the Bio-Medical Waste (Management and Handling) Rules, 1998 published by the Government of India in

the erstwhile Ministry of Environment and Forests vide notification number S.O. 630(E), dated the 20^th July, 1998 as

amended from time to time.

(11) Vehicular traffic. - The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific

provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master Plan is

prepared and approved by the competent authority in the State Government, Monitoring Committee shall monitor

compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.

(12) Industrial units.- (a) No establishment of new wood based industries within the proposed Eco-sensitive Zone shall

be permitted except the existing wood based industries set up as per the law.

(b) No establishment of any new industry causing water, air, soil, noise pollution within the proposed Eco-sensitive Zone

shall be permitted.

4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.- All activities in the Eco sensitive

Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made

thereunder, and be regulated in the manner specified in the table below, namely:-

Setting up of saw mills.

No new or expansion of existing saw mills shall be permitted

within the Eco-sensitive Zone.

Setting up of industries causing water or air or

Commercial use of firewood.

Prohibited (except as otherwise provided) as per applicable laws.

Establishment of new thermal and major

Regulated activities

10.

Use of plastic carry bags, laminates and tetra

packs.

Disposal of plastic articles laminates and tetra packs shall be

strictly regulated and monitored and shall be regulated under

applicable laws.

11.

Establishment of hotels and resorts.

No new commercial hotels and resorts shall be permitted within

one kilometer of the boundary of the protected area except for

accommodation for temporary occupation of tourists related to

eco-friendly tourism activities.

However, beyond one kilometer and upto the extent of the

Eco-sensitive Zone, all new tourism activities or expansion of

existing activities would in conformity with the Tourism Master

Plan.

12.

Construction activities.

(a) No new commercial construction of any kind shall be

permitted within one kilometre from the boundary of the

protected area:

Provided that, local people shall be permitted to undertake

construction in their land for their residential use including the

activities listed in sub-paragraph (1) of paragraph 3:

(b) The construction activity related to small scale industries not

causing pollution shall be regulated and kept at the minimum,

with the prior permission from the competent authority as per

applicable rules and regulations, if any.

construction for bone fide local needs shall be allowed and other

construction activities shall be regulated as per Zonal Master

Plan.

13.

Felling of trees.

(a) There shall be no felling of trees in the forest or Government

or revenue or private lands without prior permission of the

competent authority in the State Government;

(b)The felling of trees shall be regulated in accordance with the

provisions of the concerned Central or State Acts and the rules

made thereunder.

Plan prescriptions shall be followed.

14.

Commercial water resources including ground

water harvesting.

(a) The extraction of surface water and ground water shall be

permitted only for bona fide agricultural use and domestic

consumption of the occupier of the land;

(b) Extraction of surface water and ground water for industrial or

commercial use including the

amount that can be extracted, shall require prior written

permission from the concerned regulatory authority;

(d) Steps shall be taken to prevent contamination or pollution of

water from any source including agriculture.

15.

Erection of electrical cables, transmission

lines and telecommunication towers.

Promote underground cabling.

Monitoring Committee.- The Central Government hereby constitutes a Monitoring Committee, for effective

monitoring of the Eco-sensitive Zone which shall comprise of the following namely:-

(i)

Regional Commissioner, Gulbarga –Chairman;

(ii)

Hon’ble Member of Legislative Assembly, Kudligi Constituency, Ballari District – Member;

(iii)

Representative of the Department of Environment, Government of Karnataka -Member;

(iv)

Representative of the Department of Urban Development, Government of Karnataka -Member;

(v)

Representative of Non-governmental Organisations working in the field of natural conservation

(including heritage conservation) to be nominated by the Government of Karnataka

Member;

(vi)

The Regional Officer, Karnataka State Pollution Control Board, -Member;

(vii)

One expert in Ecology from reputed Institution or University of the State of Karnataka to be

nominated by the Government of Karnataka –Member;

(viii) Deputy Commissioner or his representative, Bellary District -Member

(ix)

The Deputy Conservator of Forests, Bellary Division, Bellary – Member- Secretary.

Terms of Reference.- (1) The Monitoring Committee shall monitor the compliance of the provisions of this

Notification.

(2)

The activities that are covered in the schedule to the notification of the Government of India in the erstwhile

Ministry of Environment and Forests number S.O. 1533 (E), dated the 14^th September, 2006, and are falling in

the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof,

shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to

the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental

clearances under the provisions of the said notification.

(3)

The activities that are not covered in the schedule to the notification of the Government of India in the

erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14^th September, 2006 and are

falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph

16.

Fencing of existing premises of hotels and

lodges.

Regulated under applicable laws.

17.

Widening and strengthening of existing roads.

Shall be done with proper Environment Impact Assessment and

mitigation measures, as applicable.

18.

Movement of vehicular traffic at night.

Regulated for commercial purpose, under applicable laws.

Forest Produce (NTFP).

4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and

referred to the concerned regulatory authorities.

The Member-Secretary of the Monitoring Committee or the concerned Collector(s) or the concerned park

Deputy Conservator of Forests shall be competent to file complaints under section 19 of the Environment

(Protection) Act, 1986 (29 of 1986) against any person who contravenes the provisions of this notification.

(5)

The Monitoring Committee may invite representatives or experts from concerned Departments, representatives

from industry associations or concerned stakeholders to assist in its deliberations depending on the

requirements on issue to issue basis.

(6)

The Monitoring Committee shall submit the annual action taken report of its activities as on 31^st March of

every year by 30^th June of that year to the Chief Wildlife Warden of the State as per pro- forma appended at

Annexure-V.

(7)

The Central Government in the Ministry of Environment, Forest and Climate Change may give such

directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.

The Central Government and State Government may specify additional measures, if any, for giving effect to

provisions of this notification.

The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon’ble

Supreme Court of India or the High Court or National Green Tribunal .

BOUNDARY DESCRIPTION OF GUDEKOTE SLOTH BEARSANCTUARY ECOSENSITIVE ZONE

The point number -1(N 14 54 21.10; E 76 38 26.34) is located at the crossing of Road Shaliyappanahalli-

Appenhalli Road with Shaliyappanahalli Reserve forest boundary near Shaliyappanahalli village then the boundary

line runs west all along the boundary of the Shaliyappanahalli Reserve forest boundary throught point no-2 to 20 and

up to point no.-21 (N 14 54 40.74 ; E 76 40 38.74), then the boundary line moves south and meets Appenhalli

Reserve Forest boundary, then boundary line turns towards east at point no-22 and runs along the Appenhalli RF

boundary, through point no-23, 24, 25 and upto point no- 26 then the boundary moves in south direction upto point

no-27 which is located on Road Appenhalli- Gudekote , then boundary line moves along the road upto point no-28,

then the boundary line runs towards south-east along nallahupto point no-29 Halasagara Village settlement then the

boundary line runs towards east through point no-30 and upto point no-31, then the boundary line runs along the

nallaha leading to the Rayapura Tank through point no-32, 33 and upto point 34 located on the southern edge of the

Rayapura Tank Bund, then the boundary line runs south up to point no-35, then the boundary line turns towards west

through point no-36 and up to point no-37 and then boundary line runs south to reach point no 38 located at the turn

of Road Talvarhalli to chikkerhalli , then the boundary line moves west to reach Hangal-Gudekote Road and moves

point no-43, then the boundary moves towards east direction and reach point no 44 and then moves north-west

direction through point no-45, and to reach point no-46 located on the Gudekote Tank Bund , then the boundary line

runs along the tank boundary through point no-47 and to reach point no-48 then the boundary line moves in north-

west direction through point no-49, 50,and to reach point no- 51 located on the Ramdurga- Shaliyappanahalli Road,

then the boundary line runs through point no-52, 53,54 and reach point no-56 along the Ramdurga- Shaliyappanahalli

Road, then the boundary line runs outside the Shaliyappanahalli village settlement and then along the Road to reach

starting point no-1.
