जोन के <प म. घो>षत करने के िलए एक Aा<प अिधसूचना भारत सरकार के पयावरण, वन और जलवायु परवतन

मंालय क: अिधसूचना सं. का. आ. 1658(अ) तार ख 17 जून, 2015 Fारा उन सभी Hय>Iय3 से, 7जनके उससे Aभा>वत

होने क: संभावना थी, उस तार ख से, 7जसको उस राजप क: Aितयां, 7जसम. यह अिधसूचना अंत>वJ है, उपलLध करा

द गई थी, साठ दन क: अविध के भीतर आ5ेप और सुझाव आम>त करते हुए Aकािशत क: गई थी ;

और उI राजप, 7जसम. उP त अिधसूचना अंत>व, ट है, क: Aितयां जनता को 17 जून, 2015 को उपलLध करा द

गई थीं ;

और के/U य सरकार यह >वचार करती है क करनाला प5ी अभयार1य, महारा, - राX य के रायगढ़ 7जले म. 73^o 5'

से 73^o 9' पू. देशांतर और 18^o 51' 30" से 18^o 54' उ. अ5ांश के बीच 78 थत है और 12.10 वग कलोमीटर 5े पर

>व8 तृत है ;

और, अभयार1य वुडलaड प75य3 क: Aचुर क8 म3, 7जसके अंतगत दुलभ प5ी जाित स7V मिलत है और लगभग

147 िनवासी प5ी जाित है और 37 Aवासी प5ी जाित, 7जसके अंतगत धूसर सहेली और िचb तीदार छाती वाला

कठफोड़वा भी स7V मिलत है, को संfय देता है ;

और, करनाला व/ यजीव अभयार1य के चार3 ओर के 5े को, 7जसका >व8तार और सीमाएं इस अिधसूचना के

पैरा 1 म. >विनदJ हa, पयावरण क: h>J से पार78थितक संवेद जोन के <प म. सुर75त और संर75त करना तथा उI

पार78थितक संवेद जोन म. उiोग3 या उiोग3 के वगj के Aचालन तथा Aसं8करण करने को Aित>षk करना आवlयक

है;

अतः, अब, के/U य सरकार, पयावरण (संर5ण) िनयम, 1986 के िनयम 5 के उपिनयम (3) और पयावरण

(संर5ण) अिधिनयम, 1986 (1986 का 29) क: धारा 3 क: उपधारा (2) के खंड (v) और खंड (xiv) के साथ पठत और

उपधारा (1) Fारा Aदn श>Iय3 का Aयोग करते हुए, महारा, - राX य म. करनाला व/ यजीव अभयार1य क: सीमा से शू/ य

से 8 कलोमीटर तक के >व8 तारत 5े को करनाला व/ यजीव अभयार1य पार78 थितक:य संवेद जोन (7जसे इसम.

इसके पl चात् पार78 थितक:य संवेद जोन कहा गया है) के <प म. अिधसूिचत करती है, 7जसका L यौरा िनVनानुसार है,

अथात् :--

पार78थितक संवेद जोन का >व8तार और उसक: सीमाएं--(1) पार78थितक संवेद जोन 31.7 वग कलोमीटर

के 5े म. करनाला व/ यजीव अभयार1य क: सीमा से शू/ य से 8 कलोमीटर तक के >व8तार के साथ फैला होगा और

ऐसे जोन क: सीमाओं का वणन उपाबंध I म. दया गया है ।

(2) पार78 थितक संवेद जोन महारा, - के रायगढ़ 7जले के उरान और पनवल तालुक के 18 sाम3 तक >व8 तृत

है ।

(3) पार78 थितक संवेद जोन के भीतर आने वाले sाम3 क: सूची Aमुख >ब/ दुओं के सम/ वय के साथ उपाबंध

II के <प म. संलt न है ।

(4) अ5ांश और देशा/तर के साथ पार78थितक संवेद जोन का मानिच उपाबंध III के <प म. संलt न है ।

पार78थितक संवेद जोन के िलए आंचिलक महायोजना Ð(1) राXय सरकार, पार78 थितक संवेद जोन के

Aयोजन के िलए, राजप म. इस अिधसूचना के Aकाशन क: तार ख से दो वष क: अविध के भीतर, 8थानीय Hय>Iय3 के

परामश से, इस अिधसूचना म. संलt न अनुबंध3 के सामंज8 य से आंचिलक महायोजना तैयार करेगी ।

(2)

आचंिलक महायोजना राX य सरकार म. स5म Aािधकार Fारा अनुमोदत होगी ।

(3)

पार78 थितक संवेद जोन के िलए आचंिलक महायोजना इस अिधसूचना म. >विनद, ट <प म. ऐसी र ित म. राX य

सरकार तथा सुसंगत क. U य और राX य >विधय3 के सामंज8 य म. भी तथा क. U य सरकार Fारा जार मागिनदvश, यद कोई

ह3, Fारा तैयार होगी ।

(4) आंचिलक महायोजना, इसम. पयावरणीय और पार78 थितक: >वचार3 को समाकिलत करने के िलए िनV निल7खत

सभी संबk राX य सरकार के >वभाग3 के परामश से तैयार होगी, अथात्:--

(i)

पयावरण,

(ii)

वन,

(iii)

नगर >वकास,

(iv)

पयटन,

(v)

नगरपािलक,

(vi)

राज8 व,

(vii) कृ>ष,

(viii) महारा, - राX य Aदूषण िनयंण बोड,

(ix)

िसंचाई, और

(x)

लोक िनमाण >वभाग ।

(5) आंचिलक महायोजना अनुमोदत >वiमान भू-उपयोग, अवसंरचना और Sयाकलाप3 पर कोई िनबxधन अिधरो>पत

नह ं करेगी जब तक क इस अिधसूचना म. >विनद, ट न हो और आचंिलक महायोजना सभी अवसंरचना और

Sयाकलाप3 म. और अिधक द5ता और पार78थितक अनुकूलता का संवधन करेगी ।

आंचिलक महायोजना म. अनाyछादत 5े3 के जीणjkार, >वiमान जल िनकाय3 के संर5ण, आवाह 5े3 के

Aबंधन, जल-संभर3 के Aबंधन, भूतल जल के Aबंधन, मृदा और नमी संर5ण, 8थानीय समुदाय3 क: आवlयकताओं तथा

पार78थितक और पयावरण से संबंिधत ऐसे अ/य पहलूओं, 7जन पर zयान देना आवlयक है, के िलए उपबंध ह3गे ।

(7) आंचिलक महायोजना सभी >वiमान पूजा 8 थल3, sाम3 और नगर य बंदोब8त3, वन3 के Aकार और क8 म3, कृ>ष

5े3, ऊपजाऊ भूिम, हरत 5े जैसे उiान और उसी Aकार के 8 थान, उiान कृ>ष 5े, फलोधान, झील3 और अ/य

जल िनकाय3 का अ|यकंन करेगी ।

आंचिलक महायोजना 8 थानीय समुदाय3 क: जीवकोपाजन को सुिन7l चत करने के िलए, पार78थितक संवेद

जोन म. >वकास को पार78थितक अनुकूल >वकास के िलए >विनयिमत करेगी ।

3. राXय सरकार Fारा कए जाने वाले उपाय-- राXय सरकार इस अिधसूचना के उपबंध3 को Aभावी करने के िलए

िनVनिल7खत उपाय करेगी, अथात् :--

(1) भू-उपयोग - पार78 थितक संवेद जोन म. वन3, उiान-कृ>ष 5े3, कृ>ष 5े3, आमोद-Aमोद के Aयोजन के िलए

िच7/हत कए गए पाक} और खुले 8थान3 का वा7ण7Xयक और औiोिगक संबk >वकास Sयाकलाप3 के िलए उपयोग या

संपरवतन नह ं होगा :

परंतु पार78थितक संवेद जोन के भीतर कृ>ष भूिम का संपरवतन, मानीटर सिमित क: िसफारश पर और

राXय सरकार के पूव अनुमोदन से, 8थानीय िनवािसय3 क: आवासीय ज<रत3 को पूरा करने के िलए और पैरा 4 क:

सारणी के 8तंभ (2) के अधीन Sम सं~ यांक 10, 16, 22, 28 और 31 के सामने सूचीबk Sयाकलाप3 को पूरा करने के

िलए अनु•ात ह3गे, अथात् :-

(i)

पयावरण हतैषी पयटन Sयाकलाप3 के िलए, पयटक3 के अ8 थायी अिभभोग के िलए पयावरण हतैषी

कुट र जैसे तV बू का, ठ के घर,

(ii)

>वiमान सड़क3 को चौड़ा और मजबूत बनाना,

(iii)

Aदूषण उb प/ न न करने वाले लघु उiोग,

(iv)

वषा जल संचय, और

(v)

कुट र उiोग, 7जसके अंतगत sामीण उiोग, सु>वधा भंडार और 8 थानीय सुख सु>वधा भी हa :

परंतु यह और क राXय सरकार के पूव अनुमोदन और सं>वधान के अनुy छेद 244 या तbसमय Aवृn >विध के

उपबंध3 के अनुपालन के >बना, 7जसके अंतगत अनुसूिचत जनजाित और अ/य परंपरागत वन िनवासी (वन अिधकार3 क:

मा/यता) अिधिनयम, 2006 (2007 का 2) भी है, वा7ण7Xयक या उiोग >वकास Sयाकलाप3 के िलए जनजातीय भूिम

का उपयोग अनु•ात नह ं होगा :

परंतु यह और भी क पार78 थितक संवेद जोन के भीतर भू-अिभलेख3 म. उपसंजात कोई ुट, मानीटर सिमित

के >वचार Aा€ करने के पl चात् राXय सरकार Fारा Abयेक मामले म. केवल एक बार संशोिधत होगी और उI ुट के

संशोधन क: भारत सरकार के पयावरण, वन और जलवायु परवतन मंालय को सूचना देनी होगी ।

परंतु यह और भी क उपयुI ुट का संशोधन म. इस उप-पैरा के अधीन यथाउपबंिधत के िसवाय कसी भी

दशा म. भू-उपयोग का परवतन स7Vमिलत नह ं होगा :

परंतु यह और भी क 7जससे हरत 5े म. जैसे वन 5े, कृ>ष 5े आद म. कोई पारणािमक कटौती नह ं

होगी और अनAयुP त या अनउb पादक कृ>ष 5े3 म. पुन: वनीकरण करने के Aयास कए जाएंगे ।

(2) Aाकृितक जल •ोत3 -- आचंिलक महायोजना म. सभी Aाकृितक जल •ोत3 क: पहचान क: जाएगी और उनके

संर5ण और पुन‚ƒूतकरण के िलए योजना स7V मिलत होगी और राX य सरकार Fारा ऐसे 5े3 पर या उनके िनकट

>वकास Sयाकलाप Aित>षk करने के िलए ऐसी र ित से मागिनदvश तैयार कए जाएंगे ।

(3) पयटन Ð (क) पार78थितक संवेद जोन के भीतर पयटन संबंधी Sयाकलाप, जो आंचिलक महायोजना का भाग <प

म. िनVनिल7खत <प म. ह3गे ।

(ख) पयटन महायोजना पयटन >वभाग, महारा, - सरकार Fारा राज8 व और वन >वभाग, महारा, - सरकार के परामश से

तैयार होगी ।

(ग) पयटन संबंधी Sयाकलाप िनV निल7खत के अधीन >विनयिमत ह3गे, अथात् :-

(i) पार78थितक संवेद जोन के भीतर सभी नए पयटन Sयाकलाप3 या >वiमान पयटन Sयाकलाप3 का

>व8तार क. U सरकार के पयावरण, वन और जलवायु परवतन मंालय के मागदशक िसkांत3 के Fारा तथा रा, - य

H या„ संर5ण Aािधकरण, Fारा जार पार78थितक पयटन (समय-समय पर यथा संशोिधत) मागदशक िसkांत3

के अनुसार, पार78थितक पयटन, पार78थितक िश5ा और पार78थितक >वकास को महbव देते

हुए पार78थितक संवेद जोन क: वहन 5मता के अzययन पर आधारत होगा;

(ii) पयावरण हतैषी पयटन Sयाकलाप3 संबंधी पयटक3 के अ8 थायी अिधभोग के िलए वास सु>वधा के िसवाए

करनाला व/ यजीव अभयार1य क: सीमाओं के एक कलोमीटर के भीतर होटल और सैरगाह3 के नए संिनमाण

अनु•ात नह ं ह3गे :

परंतु यह क संर75त 5े क: सीमा से एक कलोमीटर क: दूर से परे पार78 थितक संवेद जोन के

>व8 तार तक, पयटन महायोजना के अनुसार पयावरण पयटन सु>वधाओं के िलए केवल पूव परिन7l चत और

अिभहत 5े3 म. नए होटल3 और सैरगाह3 के 8 थापन क: अनुमित द जाएगी ।

(iii) आंचिलक महायोजना का अनुमोदन कए जाने तक, पयटन के िलए >वकास और >वiमान पयटन

Sयाकलाप3 के >व8तार को वा8त>वक 8थल >विनदJ संवी5ा तथा मानीटर सिमित क: िसफारश पर आधारत

संबंिधत >विनयामक Aािधकरण3 Fारा अनु•ात कया होगा ।

(4) नैसिगक >वरासत -- पार78थितक संवेद जोन म. महbवपूण नैसिगक >वरासत के सभी 8थल3 जैसे सभी जीन कोश

आर75त 5े, शैल >वरचनाएं, जल Aपात3, झरन3, घाट माग}, उपवन3, गुफाएं, 8थल3, …मण, अ†रोहण, Aपात3 आद

क: पहचान क: जाएगी और उ/ह. संर75त कया जाएगा तथा उनक: सुर5ा और संर5ा के िलए इस अिधसूचना के

Aकाशन क: तार ख से छह मास के भीतर, उपयुI योजना बनाएगी और ऐसी योजना आंचिलक महायोजना का भाग

होगा ।

(5) मानव िनिमत >वरासत 8 थल3 - पार78 थितक संवेद जोन म. भवन3, संरचनाओं, िशप-त‡य, ऐितहािसक, कलाbमक

और सां8कृितक महbव के 5े3 क: पहचान करनी होगी और इस अिधसूचना के Aकाशन क: तार ख से छह माह के

भीतर उनके संर5ण क: योजनाएं तैयार करनी होगी तथा आंचिलक महायोजना म. स7Vमिलत क: जाएगी ।

(6) z विन Aदूषण -- पार78थितक संवेद जोन म. z विन Aदूषण के िनयंण के िलए राX य सरकार का पयावरण >वभाग

या महारा, - राX य Aदूषण िनयंण बोड, वायु (Aदूषण िनवारण और िनयंण) अिधिनयम, 1981 (1981 का 14) और

उसके अधीन बनाए गए िनयम3 के उपबंध3 के अनुसरण म. मागदशक िसkांत और >विनयम तैयार करेगा ।

(7) वायु Aदूषण -- पार78थितक संवेद जोन म., वायु Aदूषण के िनयंण के िलए राXय सरकार का पयावरण >वभाग

(8) बह•ाव का िन8सारण -- पार78थितक संवेद जोन म. उपचारत बह•ाव का िन8सारण, जल (Aदूषण िनवारण

तथा िनयंण) अिधिनयम, 1974 (1974 का 6) और उसके अधीन बनाए गए िनयम3 के उपबंध3 के अनुसार होगा ।

(9) ठोस अपिशJ -- ठोस अपिशJ3 का िनपटान िनVनिल7खत <प म. होगा -

(i)

पार78थितक संवेद जोन म. ठोस अपिशJ3 का िनपटान भारत सरकार के तbकालीन पयावरण और वन

मंालय क: समय-समय पर यथा संशोिधत अिधसूचना सं. का.आ. 908(अ), तार ख 25 िसतंबर,

2000 नगरपािलक ठोस अपिशJ (Aबंध और हथालन) िनयम, 2000 के उपबंध3 के अनुसार कया

जाएगा ;

(ii)

8थानीय Aािधकरण जैव िनVनीकरणीय और अजैव िनVनीकरणीय संघटक3 म. ठोस अपिशJ3 के

संपृथPकन के िलए योजनाएं तैयार कर.गे ;

(iii)

जैव िनVनीकरणीय सामsी को अिधमानतः खाद बनाकर या कृिम खेती के माzयम से पुनःचSत

कया जाएगा ;

(iv)

अकाबिनक सामsी का िनपटान पार78थितक संवेद जोन के बाहर पहचान कए गए 8 थल पर कसी

पयावरणीय 8वीकृत र ित म. होगा और पार78थितक संवेद जोन म. ठोस अपिश, ट3 को जलाना या

भ, मीकरण अनु•ात नह ं होगा ।

(10) जैव िचकb सीय अपिश, ट - पार78थितक संवेद जोन म. जैव िचकbसीय अपिशJ3 का िनपटान भारत सरकार के

तbकालीन पयावरण और वन मंालय क: समय-समय पर यथासंशोिधत अिधसूचना सं. का.आ. 630 (अ) तार ख

20 जुलाई, 1998 Fारा Aकािशत जैव िचकbसीय अपिशJ (Aबंध और हथालन) िनयम, 1998 के उपबंध3 के अनुसार

कया जाएगा ।

(11) यानीय परवहन - परवहन क: यानीय गित>विधयां आवास के अनुकूल >विनयिमत ह3गी और इस संबंध म.

आंचिलक महायोजना म. >वशेष उपबंध अिधकिथत कए जाएंगे और आंचिलक महायोजना के तैयार होने और राX य

सरकार के स5म Aािधकार के Fारा अनुमोदत होने तक, मानीटर सिमित Aवृn िनयम3 और >विनयम3 के अनुसार

यानीय गित>विधय3 के अनुपालन को मानीटर करेगी ।

(12) औiोिगक इकाइयां Ð

(क) A8 ता>वत पार78 थितक संवेद जोन के भीतर का, ठ पर आधारत नए उiोग3 िसवाय >विध के अनुसार

8 था>पत का, ठ पर आधारत >वiमान उiोग3 का 8 थापन अनु•ात नह ं कया जाएगा ।

(ख) A8 ता>वत पार78 थितक संवेद जोन के भीतर जल, वायु, मृदा, z विन Aदूषण कारत करने वाले नए उiोग3

का 8 थापन अनु•ात नह ं कया जाएगा ।

4. पार78थितक संवेद जोन म. Aित>षk और >विनयिमत Sयाकलाप3 क: सूची - पार78थितक संवेद जोन म. सभी

Sयाकलाप पयावरण (संर5ण) अिधिनयम, 1986 के उपबंध3 Fारा शािसत ह3गे और नीचे द गई तािलका म. >विनदJ

लागू >विधय3 के अनुसार Aित>षk (अ/ यथा उपबंिधत के िसवाय) ।

तथा>प, एक कलोमीटर से परे और पार78 थितक संवेद जोन के >व8 तार

तक सभी नए पयटन Sयाकलाप3 या >वiमान Sयाकलाप3 का >व8 तार

पयटन महायोजना और रा, - य H या„ संर5ण Aािधकरण के मागदशक

िसkांत3 क: अनु<पता म. होगा।

स7/ नमाण Sयाकलाप ।

(क) संर75त 5े क: सीमा से एक कलोमीटर के भीतर कसी भी Aकार

के नए वा7ण7X यक स7/ नमाण क: अनु•ा नह ं होगी :

परंतु 8 थानीय लोग3 को पैरा 3 के उप पैरा (1) म. सूचीबk

Sयाकलाप3 सहत उनके आवासीय उपयोग के िलए उनक: भूिम म.

संिनमाण अनु•ात कया जाएगा ।

NOTIFICATION

New Delhi, the 22nd January, 2016

S.O. 230(E).—WHEREAS, a draft notification, declaring Eco-sensitive Zone around Karnala Wildlife

Sanctuary in Maharashtra, was published in the Gazette of India, Extraordinary, vide notification of the Government of

India in the Ministry of Environment, Forest and Climate Change number S.O. 1658(E), dated the 17^th June 2015,

inviting objections and suggestions from all persons likely to be affected thereby within a period of sixty days from the

date on which copies of the Gazette containing the said notification were made available to the public;

AND WHEREAS, copies of the Gazette containing the said notification were made available to the public on

the 17^th June 2015;

AND WHEREAS, objections and suggestions received from all persons and stakeholders in response to the

draft notification have been duly considered by the Central Government;

AND WHEREAS, the Central Government considers that Karnala Bird Sanctuary is situated between 73° 5' to

73°9' E Longitudes and 18°51'30” to 18°54' N Latitudes in Raigad District of Maharashtra State and extends over an

area of 12.10 square kilometers;

AND WHEREAS, the sanctuary harbors rich variety of woodland birds including rare bird species and has

about 147 resident bird species and 37 migrant bird species including Ashy Minivet and Heart Spotted Woodpecker;

AND WHEREAS, it is necessary to conserve and protect the area the extent and boundaries of which is

specified in paragraph 1 of this notification around the protected area of Karnala Wildlife Sanctuary as Eco- sensitive

Zone from ecological and environmental point of view and to prohibit industries or class of industries and their

operations and processes in the said Eco-sensitive Zone;

NOW THEREFORE, in exercise of the powers conferred by sub-section (1) and clauses (v) and (xiv) of sub-

section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub- rule

(3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies the area to an extent

varying from zero to 8 kilometers from the boundary of Karnala Wildlife Sanctuary in the State of Maharashtra as the

Karnala Wildlife Sanctuary Eco-sensitive Zone (hereinafter referred to as the Eco-sensitive Zone) details of which are as

under, namely:-

1. Extent and boundaries of Eco-sensitive Zone.- (1) The Eco-sensitive Zone is spread over an area of around 31.7

square kilometre with an extent varying from zero to 8 kilometers from the boundary of Karnala Wildlife Sanctuary and

the boundary description of such zone is given in Annexure I.

(2) The Eco-sensitive Zone is spread across 18 villages in Uran and Panvel Talukas of Raigad District in Maharashtra.

(3) The list of the villages falling within Eco-sensitive Zone along with co-ordinates of prominent points is appended as

Annexure II.

(4) The map of the Eco-sensitive Zone along with latitude and longitude is appended as Annexure III.

2. Zonal Master Plan for the Eco-sensitive Zone.- (1) The State Government shall, for the purpose of the Eco-

sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of this

notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this

notification.

(2)

The said Plan shall be approved by the competent authority in the State Government.

(3)

The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as

is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued

by the Central Government, if any.

(4)

The Zonal Master Plan shall be prepared in consultation with all concerned State Departments, namely:-

(i) Environment,

(ii) Forest,

(iii) Urban Development,

(iv) Tourism,

(v) Municipal,

(vi) Revenue,

(vii) Agriculture

(viii) Maharashtra State Pollution Control Board,

(ix) Irrigation,

(x) Public Works Department

for integrating environmental and ecological considerations into it.

The Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities,

unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and

activities to be more efficient and eco-friendly.

(6)

The Zonal Master plan shall provide for restoration of denuded areas, conservation of existing water bodies,

management of catchment areas, watershed management, groundwater management, soil and moisture conservation,

needs of local community and such other aspects of the ecology and environment that need attention.

(7)

The Zonal Master Plan shall demarcate all the existing worshipping places, village and urban settlements, types

and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas,

orchards, lakes and other water bodies.

(8)

The Zonal Master Plan shall regulate development in Eco-sensitive Zone as to ensure Eco-friendly development

for livelihood security of local communities.

3. Measures to be taken by State Government.-The State Government shall take the following measures for giving

effect to the provisions of this notification, namely:-

(1) Land use.- Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes

in the Eco-sensitive Zone shall not be used or converted into areas for commercial or industrial related development

activities:

Provided that the conversion of agricultural lands within the Eco-sensitive Zone may be permitted on the

recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet the

residential needs of local residents, and for the activities listed against serial numbers 10, 16, 22, 28 and 31 in column (2)

of the table in paragraph 4, namely:-

(i)

eco-friendly cottages for temporary occupation of tourists, such as tents, wooden houses, etc. for Eco-friendly

tourism activities,

(ii)

widening and strengthening of existing roads;

(iii)

small scale industries not causing pollution;

(iv)

rainwater harvesting; and

(v)

cottage industries including village industries, convenience stores and local amenities:

Provided further that no use of tribal land shall be permitted for commercial and industrial development

activities without the prior approval of the State Government and without compliance of the provisions of article 244 of

the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest

Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):

Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by

the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said

error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:

Provided also that the above correction of error shall not include change of land use in any case except as

provided under this sub-paragraph:

Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural

area and efforts shall be made to reforest the unused or unproductive agricultural areas.

(2) Natural springs.-The catchment areas of all natural springs shall be identified and plans for their conservation and

rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State

Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such

areas.

(3) Tourism.- (a) The activity relating to tourism within the Eco-sensitive Zone shall be as per Tourism Master Plan,

which shall form part of the Zonal Master Plan.

(b) The Tourism Master Plan shall be prepared by Department of Tourism, Government of Maharashtra in consultation

with Department of Revenue and Forests, Government of Maharashtra.

(i)

all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in

accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate

Change and the eco-tourism guidelines issued by National Tiger Conservation Authority, (as amended from time to time)

with emphasis on eco-tourism, eco-education and eco-development and based on carrying capacity study of the Eco-

sensitive Zone;

(ii)

new construction of hotels and resorts shall not be permitted within one kilometer from the boundary of the

Karnala Wildlife Sanctuary except for accommodation for temporary occupation of tourists related to eco-friendly

tourism activities:

Provided that, beyond the distance of one kilometer from the boundary of the Protected Area till the extent of

the Eco-sensitive Zone, the establishment of new hotels and resorts shall be permitted only in pre-defined and designated

areas for eco-tourism facilities as per Tourism Master Plan;

(iii)

till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities

shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation

of the Monitoring Committee.

(4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve

areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and

preserved and plan shall be drawn up for their protection and conservation, within six months from the date of

publication of this notification and such plan shall form part of the Zonal Master Plan.

(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic,

and cultural significance shall be indentified in the Eco-sensitive Zone and plans for their conservation shall be prepared

within six months from the date of publication of this notification and incorporated in the Zonal Master Plan.

(6) Noise pollution.- The Environment Department of the State Government or Maharashtra State Pollution Control

Board shall draw up guidelines and regulations for the control of noise pollution in the Eco-sensitive Zone in accordance

with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made

thereunder.

(7) Air pollution.- The Environment Department of the State Government or Maharashtra State Pollution Control Board

shall draw up guidelines and regulations for the control of air pollution in the Eco-sensitive Zone in accordance with the

provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made thereunder.

(8) Discharge of effluents.- The discharge of treated effluents in Eco-sensitive Zone shall be in accordance with the

provisions of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974) and the rules made thereunder.

(9) Solid wastes. - Disposal of solid wastes shall be as under:-

(i) the solid waste disposal in Eco-sensitive Zone shall be carried out as per the provisions of the Municipal Solid Waste

(Management and Handling) Rules, 2000 published by the Government of India in the erstwhile Ministry of

Environment and Forests vide notification number S.O. 908 (E), dated the 25^th September 2000 as amended from time to

time;

(ii) the local authorities shall draw up plans for the segregation of solid wastes into biodegradable and non-biodegradable

components;

(iii) the biodegradable material shall be recycled preferably through composting or vermiculture;

(iv) The inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-

sensitive Zone and no burning or incineration of solid wastes shall be permitted in the Eco-sensitive Zone.

(10) Bio-medical waste.- The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out as per the

provisions of the Bio-Medical Waste (Management and Handling) Rules, 1998 published by the Government of India in

the erstwhile Ministry of Environment and Forests vide notification number S.O. 630(E), dated the 20^th July, 1998 as

amended from time to time.

(11) Vehicular traffic. - The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific

provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master Plan is

prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor

compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.

(12) Industrial units. -

(a) No establishment of new wood based industries within the proposed Eco-sensitive Zone shall be permitted except the

existing wood based industries set up as per the law.

(b) No establishment of any new industry causing water, air, soil, noise pollution within the proposed Eco-sensitive Zone

shall be permitted.

4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.- All activities in the Eco sensitive

Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made

thereunder, and be regulated in the manner specified in the table below, namely:-

Goa Foundation Vs. UOI in W.P.(C) No.435 of 2012.

Setting up of saw mills.

No new or expansion of existing saw mills shall be permitted within the

Eco-sensitive Zone.

Setting up of industries causing water or

Regulated Activities

10.

Establishment of hotels and resorts.

No new commercial hotels and resorts shall be permitted within one

kilometer of the boundary of the Protected Area except for

accommodation for temporary occupation of tourists related to eco-

friendly tourism activities. However, beyond one kilometer and upto the

extent of the Eco-sensitive Zone, all new tourism activities or expansions

of existing activities would be conformity with Tourism Master Plan and

National Tiger Conservation Authority guidelines.

11.

Construction activities.

(a) No new commercial construction of any kind shall be permitted within

one kilometer from the boundary of the Protected Area:

Provided that local people shall be permitted to undertake construction in

their land for residential use including the activities listed in sub-

paragraph (1) of paragraph 3;

(b) the construction activity related to small scale industries not causing

pollution shall be regulated and kept at the minimum, with the prior

permission from the competent authority as per applicable rules and

regulations, if any;

construction for bona fide local needs shall be permitted and other

commercial construction activities shall be regulated as per Zonal Master

Plan;

(d) construction activity in the Eco- sensitive Zone shall be as per Zonal

Master Plan.

12.

Felling of trees.

(a) There shall be no felling of trees on the forest or Government or

revenue or private lands without prior permission of the competent

authority in the State Government;

(b) the felling of trees shall be regulated in accordance with the provisions

of the concerned Central or State Act and the rules made thereunder;

prescriptions shall be followed.

13.

Commercial water resources including

ground water harvesting.

(a) The extraction of surface water and ground water shall be permitted

only for bona fide agricultural use and domestic consumption of the

occupier of the land;

(b) extraction of surface water and ground water for industrial or

5. Monitoring Committee:- (1) The Central Government hereby constitutes a Monitoring Committee, for effective

monitoring of the Eco-sensitive Zone, which shall comprise of the following namely:-

(a)

Terms of Reference:

(1)

The Monitoring Committee shall monitor the compliance of the provisions of this notification.

(2)

The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile

Ministry of Environment and Forests number S.O. 1533 (E), dated the 14^th September, 2006, and are falling in

the Eco-sensitive Zone, except for the prohibited activities as specified in the table under paragraph 4 thereof,

shall be scrutinized by the Monitoring Committee based on the actual site-specific conditions and referred to

the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental

clearances under the provisions of the said notification.

(3)

The activities that are not covered in the Schedule to the notification of the Government of India in the

erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14^th September, 2006 and are

falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the table under paragraph 4

thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and

referred to the concerned regulatory authorities.

The Member Secretary of the Monitoring Committee or the concerned Collector(s) or the concerned Park

Deputy Conservator of Forests shall be competent to file complaints under section 19 of the Environment

(Protection) Act, 1986 against any person who contravenes the provisions of this notification.

(5)

The Monitoring Committee may invite representatives or experts from concerned departments, representatives

from Industry associations or concerned stakeholders to assist in its deliberations depending on the

requirements on issue to issue basis.

(6)

The Monitoring Committee shall submit the annual action taken report of its activities as on 31^st March of

every year by 30^th June of that year to the Chief Wildlife Warden of the State as per pro forma appended at

Annexure IV.

(7)

The Central Government in the Ministry of Environment, Forest and Climate Change may give such

directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.

The Central Government and State Government may specify additional measures, if any, for giving effect to

provisions of this notification.

The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon’ble

Supreme Court of India or the High Court or National Green Tribunal.
