अ* तूबर, 2014 के तहत अ य बात- के साथ-साथ के /ीय िवधान मंडल 1ारा उिचत िविध िनमा2ण कए जाने तक गुड सेमेरटन

के बचाव के संबंध म आव7 यक िनद8श जारी करने का िनदेश दया है;

और जबक, के /ीय सरकार ने सड़क पर कसी घायल < यि* त अथवा कसी पीिड़त < यि* त क= सहायता करने वाले गुड

सेमेरटन जो एक बाई?ट@डर अथवा राहगीर हो सकता है, के बचाव के िलए, भारत के राजपB, , , , भाग-I, , , , खंड-I म दनांक 12 मई,

2015 को दशािनद8श Gकािशत कए थे;

और जबक, दनांक 12 मई, 2015 को Gकािशत दशा-िनद8श- के पैरा सं या-1 (7) और (8) के तहत पुिलस 1ारा

अथवा Hायल के दौरान गुड सेमेरटन- क= जांच के िलए मानक संचालन GJयाय- को तैयार कया जाना है;

और जबक, के /ीय सरकार, , , , पुिलस 1ारा अथवा Hायल के दौरान गुड सेमेरटन- क= जांच पड़ताल के िलए मानक

संचालन GJया जारी करना आव7 यक समझती है तथा एतLारा िनM निलिखत मानक संचालन GJया जारी करती है, अथा2त्:-

गुड सेमेरटन के साथ सM मानपूव2क और Qलग, धम2, राR Hीयता, जाित या कसी अ य आधार पर भेदभाव कए िबना

< यवहार कया जाएगा ।

(2)

कसी GS यTदशU के अलावा, कोई < यि* त जो कसी दुघ2टना म घायल < यि* त अथवा मृतक के बारे म सूचना देने के

िलए पुिलस िनयंBण कT अथवा पुिलस थाने म फोन कॉल करता है, को पूरा नाम, पता, फोन नंबर आद जैसा

< यि* तगत िववरण देने क= आव7 यकता नहX है ।

कोई पुिलस अिधकारी घटना? थल पर पZंचने पर गुड सेमेरटन को रकाड2 फाम2 या लॉग रिज? टर म, अपना नाम,

पहचान, पता और इस Gकार का अ य [ यौरा बताने के िलए बा\ य नहX करेगा ।

कोई पुिलस अिधकारी या कोई अ य < यि* त कसी घायल < यि* त क= मदद करने वाले कसी गुड सेमेरटन को, उस

मामले म गवाह बनने के िलए बा\ य नहX करेगा । मामले म गवाह बनने का िवक प केवल गुड सेमेरटन पर िनभ2र

करेगा ।

सड़क पर घायल कसी < यि* त के बारे म पुिलस को सूचना देने के प7 चात् संबंिधत पुिलस अिधकारी(य-) 1ारा गुड

सेमेरटन को जाने क= अनुमित दी जाएगी और यद गुड सेमेरटन उस मामले म गवाह बनने का इ छुक नहX होता है

तो उससे आगे कोई पूछताछ नहX क= जाएगी ।

पुिलस ारा गुड सेमेरटन क जांच पड़ताल

(1)

यद कोई गुड सेमेरटन गवाह बनना चाहता है तो उसक= जांच पड़ताल अS यिधक संवेदनशीलता एवं सM मान के साथ

और Qलग, धम2, राR Hीयता, जाित या कसी अ य आधार पर िबना कसी भेदभाव के, क= जाएगी ।

यद कोई गुड सेमेरटन गवाह बनना चाहता है और पुिलस थाने जाना नहX चाहता तो जांच अिधकारी 1ारा सादे कपड़-

म उससे पूछताछ यथासंभव उसक= सुिवधानुसार कसी समय और ? थान, , , , जैसे उसके आवास या काय2 के ? थान पर क=

जाएगी ।

जब गुड सेमेरटन से पूछताछ उसक= सुिवधानुसार समय और ? थान पर कया जाना संभव नहX होता है और गुड

सेमेरटन को जांच अिधकारी 1ारा पूछताछ के िलए पुिलस थाने म जाना अपेिTत होता है तो उस अिधकारी 1ारा ऐसा

कए जाने के कारण- को िलिखत म रकाड2 कया जाएगा ।

यद कोई गुड सेमेरटन पुिलस थाने म जाने का चयन करता है तो उससे िबना कसी अनुिचत िवलंब के एक तक2 संगत

और समयब_ `प से एक ही बार म पूछताछ क= जाएगी ।

यद गुड सेमेरटन, , , , जांच अिधकारी क= भाषा या संबंिधत TेBािधकार क= ? थानीय भाषा से िभ न भाषा म बातचीत

करता है तो जांच अिधकारी 1ारा एक इंटरGेटर क= < यव? था क= जाएगी ।

जब कोई गुड सेमेरटन अपने आप को एक GS यTदशU घोिषत करता है तो उसे, आपरािधक GJया संिहता, 1973

(1974 क= 2) क= धारा 284 िजसका संदभ2 शपथ-प पर औपचारक प से सा य से है, के अनुसार अपना साf य

शपथ-पB पर दए जाने क= अनुमित दी जाएगी ।

जांच पड़ताल करते समय ऐसे गुड सेमेरटन का पूरा बयान या शपथ-पB पुिलस अिधकारी 1ारा एक ही बार पूछताछ के

दौरान रकाड2 कया जाएगा ।

मामले क= परि? थितय- के अंतग2त यद गुड सेमेरटन अनुिचत िवलंब, , , , < यय या असुिवधा के िबना उपि? थत नहX हो

सकता अथवा उसक= जांच पड़ताल उसक= सुिवधानुसार समय और ? थान पर कया जाना संभव नहX होता है तो

संबंिधत < यि* त 1ारा आवेदन कए जाने पर कोट2 ऑफ मिज? Hेट, आपरािधक GJया संिहता, 1973 (1974 क= 2) क=

धारा 284 के अनुसरण म, उस गुड सेमेरटन क= जांच पड़ताल के िलए एक आयोग िनयु* त कर सकती है ।

पुिलस अधीTक या पुिलस उपायु* त या कसी िजले के तS ? थानी वरR ठता शीष2 के पुिलस बल के कोई अ य पुिलस

अिधकारी, जैसा भी मामला हो, , , , यह सुिनि7 चत कए जाने के िलए उS तरदायी ह-गे क उ* त उि लिखत सभी GJयाएं उनके

संबंिधत TेBािधकार भर म तS काल `प से लागू क= जाएं ।

(ROAD SAFETY)

NOTIFICATION

New Delhi, the 21st January, 2016

No. RT-25035/101/2014-RS.—Whereas, the Hon'ble Supreme Court in the case of Save Life

Foundation and another Vs Union of India and another in Writ Petition (Civil) No. 235/2012 vide its order

dated 29^th October 2014, inter-alia, directed to issue necessary directions with regard to the protection of Good

Samaritans until appropriate legislation is made by the Union Legislature;

And whereas, the Central Government published the guidelines in the Gazette of India, Extraordinary,

Part I, Section I dated 12^th May 2015 for protection of the Good Samaritans, i.e. a person who is a bystander

or a passer-by, who chooses to assist an injured person or a person in distress on the road;

And whereas, as per para 1 (7) and (8) of the said guidelines dated 12^th May, 2015, Standard

Operating Procedures are to be framed for the examination of Good Samaritans by the Police or during trial;

And whereas, the Central Government considers it necessary to issue Standard Operating Procedure

for the examination of Good Samaritans by the Police or during trial and here by issue the following standard

operating procedure, namely:—

The Good Samaritan shall be treated respectfully and without any discrimination on the grounds of

gender, religion, nationality, caste or any other grounds.

Any person who makes a phone call to the Police control room or Police station to give information

about any accidental injury or death, except an eyewitness may not reveal personal details such as full

name, address, phone number etc.

Any Police official, on arrival at the scene, shall not compel the Good Samaritan to disclose his / her

name, identity, address and other such details in the Record Form or Log Register.

Any Police official or any other person shall not force any Good Samaritan who helps an injured

person to become a witness in the matter. The option of becoming a witness in the matter shall solely

rest with the Good Samaritan.

The concerned Police official(s) shall allow the Good Samaritan to leave after having informed the

Police about an injured person on the road, and no further questions shall be asked if the Good

Samaritan does not desire to be a witness in the matter.

2. Examination of Good Samaritan by the Police

In case a Good Samaritan so chooses to be a witness, he shall be examined with utmost care and

respect and without any discrimination on the grounds of gender, religion, nationality, caste or any

other grounds.

In case a Good Samaritan chooses to be a witness, his examination by the investigating officer shall,

as far as possible, be conducted at a time and place of his convenience such as his place of residence

or business, and the investigation officer shall be dressed in plain clothes, unless the Good Samaritan

chooses to visit the police station.

Where the examination of the Good Samaritan is not possible to be conducted at a time and place of

his convenience and the Good Samaritan is required by the Investigation Officer to visit the police

station, the reasons for the same shall be recorded by such officer in writing.

In case a Good Samaritan so chooses to visit the Police Station, he shall be examined in a single

examination in a reasonable and time-bound manner, without causing any undue delay.

In case the Good Samaritan speaks a language other than the language of the Investigating Officer or

the local language of the respective jurisdiction, the Investigating Officer shall arrange for an

interpreter.

Where a Good Samaritan declares himself to be an eye-witness, he shall be allowed to give his

evidence on affidavit, in accordance with section 296 of the Code of Criminal Procedure, 1973 (2 of

1974) which refers to Evidence in Formal Character on Affidavit.

The complete statement or affidavit of such Good Samaritan shall be recorded by the Police official

while conducting the investigation in a single examination.

In case the attendance of the Good Samaritan cannot be procured without delay, expense or

inconvenience which, under the circumstances of the case, would be unreasonable, or his examination

is unable to take place at a time and place of his convenience, the Court of Magistrate may appoint a

commission for the examination of the Good Samaritan in accordance with section 284 of the Code of

Criminal Procedure, 1973 (2 of 1974) on an application by the concerned.

The Superintendent of Police or Deputy Commissioner of Police or any other Police official of

corresponding seniority heading the Police force of a District, as the case may be, shall be responsible to

ensure that all the above mentioned procedures are implemented throughout their respective jurisdictions with

immediate effect.
