अिधसूचना

नई ᳰद᭨ली, 14 जनवरी, 2016

का.आ. 251(अ).—िन᳜िलिखत ᮧाᱨप अिधसूचना, िजसे के᭠ᮤीय सरकार, पयाᭅवरण (संरᭃण) अिधिनयम, 1986

(1986 का 29) कᳱ धारा 3 कᳱ उपधारा (2) के खंड (v) और खंड (xiv) तथा उपधारा (3) के साथ पᳯठत उपधारा (1) ᳇ारा

ᮧदᱫ शिᲦयᲂ का ᮧयोग करते ᱟए, जारी करने का ᮧ᭭ताव करती है, पयाᭅवरण (संरᭃण) िनयम, 1986 के िनयम 5 के

उपिनयम (3) कᳱ अपेᭃानुसार, जनसाधारण कᳱ जानकारी के िलए ᮧकािशत कᳱ जाती है; िजनके उससे ᮧभािवत होने कᳱ

संभावना है ; और यह सूचना दी जाती है ᳰक उᲦ ᮧाᱨप अिधसूचना पर, उस तारीख से, िजसको इस अिधसूचना वाले भारत

के राजपᮢ कᳱ ᮧितयां जनसाधारण को उपल᭣ध करा दी जाती हᱹ, साठ ᳰदन कᳱ अविध कᳱ समाि᳙ पर या उसके प᳟ात् िवचार

ᳰकया जाएगा ;

ऐसा कोई ᳞िᲦ, जो ᮧाᱨप अिधसूचना मᱶ अंतᳶव᳥ ᮧ᭭तावᲂ के संबंध मᱶ कोई आᭃेप या सुझाव देने का इ᭒छुक है, इस

ᮧकार िविन᳸द᳥ अविध के भीतर, के᭠ᮤीय सरकार ᳇ारा िवचार ᳰकए जाने के िलए, आᭃेप या सुझाव सिचव, पयाᭅवरण, वन

और जलवायु पᳯरवतᭅन मंᮢालय, इंᳰदरा पयाᭅवरण भवन, जोर बाग रोड, अलीगंज, नई ᳰद᭨ली-110003 या ई-मेल पते: esz-

[email protected] पर िलिखत ᱨप मᱶ भेज सकेगा ।

ᮧाᱨप अिधसूचना

बारनावापारा व᭠ यजीव अभयार᭛ य, रायपुर ᮧभाग, िजला बलौदा बाजार, छ᭜ तीसगढ़ मᱶ ि᭭ थत है और यह अपने समृ᳍

पयाᭅवास के िलए जाना जाता है, िजसमᱶ िविभ᭠ न ᮧकार के ᮧाणी और वन᭭ पित हᱹ, िजसके अंतगᭅत तᱶदुआ, जंगली भᱹसा, सलोथ

भालू, सांभर, ᭣ लू बुल, िच᭜ तीदार िहरण, बार᳴कग िहरण, िहना, भेिडया, गीदड़, लोमड़ी, जंगली िब᭨ ली, नेवला, खरगोश,

सामा᭠ य लंगूर, जंगली कु᭜ ता, जंगली सुअर, आᳰद हᱹ । यह महानदी और उसकᳱ सहायक नᳰदयᲂ – बालमदेही और जᲂक नᳰदयᲂ

पर जल आवाह ᭃेᮢ का भी िनमाᭅण करता है । बारनावापारा व᭠ यजीव अभयार᭛ य रायपुर से 100 ᳰकलोमीटर कᳱ दूरी पर

ि᭭ थत है । बारनावापारा व᭠ यजीव अभयार᭛ य 244.66 वगᭅ ᳰकलोमीटर के ᭃेᮢ मᱶ फैला ᱟआ है ;

और, बारनावापारा व᭠ यजीव अभयार᭛ य, महानदी और उसकᳱ सहायक नᳰदयᲂ – बालमदेही और जᲂक नᳰदयᲂ पर जल आवाह

ᭃेᮢ का भी िनमाᭅण करता है ;

और, बारनावापारा व᭠ यजीव अभयार᭛ य के चारᲂ ओर के ᭃेᮢ को, िजसका िव᭭तार और सीमाएं इस अिधसूचना के पैरा

1 मᱶ िविन᳸द᳥ हᱹ, पाᳯरि᭭ थितकᳱ, पयाᭅवरण और जैव िविवधता कᳱ दृि᭬ ट से पाᳯरि᭭थितक संवेदी जोन के ᱨप मᱶ सुरिᭃत और

संरिᭃत करना तथा उᲦ पाᳯरि᭭थितक संवेदी जोन मᱶ उ᳒ोगᲂ या उ᳒ोगᲂ के वगᲄ के ᮧचालन तथा ᮧसं᭭करण करने को

ᮧितिष᳍ करना आव᭫यक है;

अतः, अब, के᭠ᮤीय सरकार, पयाᭅवरण (संरᭃण) िनयम, 1986 के िनयम 5 के उपिनयम (3) और पयाᭅवरण (संरᭃण)

अिधिनयम, 1986 (1986 का 29) कᳱ धारा 3 कᳱ उपधारा (2) के खंड (v) और खंड (xiv) के साथ पᳯठत और उपधारा (1)

᳇ारा ᮧदᱫ शिᲦयᲂ का ᮧयोग करते ᱟए, छ᭜ तीसगढ़ रा᭔य मᱶ बारनावापारा व᭠ यजीव अभयार᭛य कᳱ सीमा से एक ᳰक लोमीटर

तक के ᭃेᮢ को बारनावापारा व᭠ यजीव अभयार᭛य पाᳯरि᭭ थितक संवेदी जोन (िजसे इसमᱶ इसके प᭫ चात् पाᳯरि᭭ थितक संवेदी

जोन कहा गया है) के ᱨप मᱶ अिधसूिचत करती है, िजसका िववरण िन᳜ानुसार है, अथाᭅत् :--

1. पाᳯरि᭭थितक संवेदी जोन का िव᭭तार और उसकᳱ सीमाएं—(1) पाᳯरि᭭थितक संवेदी जोन बारनावापारा व᭠ यजीव

अभयार᭛य कᳱ सीमा से एक ᳰकलोमीटर के िव᭭तार के साथ 93.997 वगᭅ ᳰकलोमीटर ᭃेᮢ मᱶ फैला ᱟआ है (िजसके अंतगᭅत

81.86 वगᭅ ᳰकलोमीटर आरिᭃत वन और संरिᭃत वन हᱹ) ।

(2) बारनावापारा व᭠ यजीव अभयार᭛ य का पाᳯरि᭭थितक संवेदी जोन 21⁰18' 09'' से 21⁰30' 26'' उ᭜ तरी अᭃांश

और 82⁰21' 08'' से 82⁰34' 13'' पूवᱮ देशांतर के बीच आता है ।

(3) पाᳯरि᭭थितक संवेदी जोन के भीतर आने वाले 21 ᮕामᲂ अथाᭅत् अचानकपूर, भीनमोरी, धवलपुरा, धेबीखार1,

धाटमुरवा, िगधपुरी, जामहर2, जामहर7, जामहर8, जोगीदीपा, खुरमुरी, कᲂिजया, ल᳎ाह, मोहदा, नवागांव, पाकरीद,

फुरफु᭠ दी, रावन, सािहयाभाटा, तालदादार, ते᭠ दुछुआ हᱹ ।

(4) पाᳯरि᭭थितक संवेदी जोन का मानिचᮢ सीमा के ᭣ यौरᲂ और अᭃांश और देशांतर सिहत उपाबंध I के ᱨप मᱶ उपाब᳍

है ।

(5) बारनावापारा व᭠ यजीव अभयार᭛ य और उसके पाᳯरि᭭थितक संवेदी जोन कᳱ सीमाᲐ के ᭣ यौरे जीपीएस िनदᱷशांकᲂ

के िनबंधनᲂ मᱶ उपाबंध-II के ᱨप मᱶ उपाब᭟ द है।

2. पाᳯरि᭭थितक संवेदी जोन के िलए आंचिलक महायोजना – (1) रा᭔य सरकार, पाᳯरि᭭ थितक संवेदी जोन के ᮧयोजनᲂ

के िलए राजपᮢ मᱶ इस अिधसूचना के अंितम ᮧकाशन कᳱ तारीख से दो वषᭅ कᳱ अविध के भीतर, इस अिधसूचना मᱶ ᳰदए गए

उपदशᲄ का अनुपालन करते ᱟए, ᭭थानीय ᳞िᲦयᲂ के परामशᭅ से आंचिलक महायोजना तैयार करेगी ।

(2) उ᭍ त योजना को रा᭔ य सरकार मᱶ सᭃम ᮧािधकारी ᳇ारा अनुमोᳰदत ᳰकया जाएगा ।

(3) पाᳯरि᭭थितक संवेदी जोन के िलए आचंिलक महायोजना रा᭔ य सरकार ᳇ारा इस अिधसूचना मᱶ यथािविन᳸द᭬ ट रीित

मᱶ और सुसंगत कᱶᮤीय और रा᭔ य िव िध यᲂ और कᱶᮤीय सरकार ᳇ारा जारी मागᭅदशᭅक िस ᳍ांतᲂ, यᳰद कोई हᲂ, के सामंज᭭ य से

तैयार कᳱ जाएगी ।

(4) आचंिलक महायोजना उसमᱶ पयाᭅवरणीय और पाᳯरि᭭ थितक मु᳎ᲂ को सि᭥ मिलत करने के िलए सभी संबंिध त रा᭔ य

िव भागᲂ के साथ परामशᭅ से तैयार कᳱ जाएगी, िजसके अंतगᭅत िन᭥ निलिखत हᱹ--

(i)

पयाᭅवरण ;

(ii)

वन ;

(iii)

शहरी िवकास ;

(iv)

पयᭅटन ;

(v)

नगरपािलक ;

(vi)

राज᭭ व ;

(vii)

कृिष ;

(viii)

छ᭜ तीसगढ़ ᮧदूषण िनयंᮢण बोडᭅ ;

(ix) ᳲसचाई ; और

(x) लो क िन माᭅण िव भाग।

(5) आंचिलक महायोजना अनुमोᳰदत िव᳒मान भू-उपयोग, अवसंरचना और ᳰᮓयाकलापᲂ पर कोई िनबᲈधन अिधरोिपत

नहᱭ करेगी जब तक ᳰक इस अिधसूचना मᱶ इस ᮧकार िविन᳸द᭬ ट न ᳰकया जाए और उ᭍ त आंचिल क महायोजना सभी

अवसंरचना और कायᭅकलापᲂ मᱶ दᭃता और पाᳯर ि᭭ थ ितक अनुकूलता का सुधार करेगी ।

(6) आंचिलक महायोजना मᱶ अना᭒छाᳰदत ᭃेᮢᲂ के जीणᲃ᳍ार, िव᳒मान जल िनकायᲂ के संरᭃण, आवाह ᭃेᮢᲂ के

ᮧबंधन, जल-संभरᲂ के ᮧबंधन, भूतल जल के ᮧबंधन, मृदा और नमी संरᭃण, ᭭थानीय समुदायᲂ कᳱ आव᭫यकताᲐ तथा

पाᳯरि᭭थितकᳱ और पयाᭅवरण से संबंिधत ऐसे अ᭠य पहलूᲐ, िजन पर ᭟यान देना आव᭫यक है, के िलए उपबंध हᲂगे ।

(7) आंचिलक महायोजना सभी िव᳒मान पूजा ᭭ थलᲂ, ᮕामᲂ और नगरीय बंदोब᭭तᲂ, वनᲂ के ᮧकार और ᳰक᭭ मᲂ, कृिष

ᭃेᮢᲂ, ऊपजाऊ भूिम, हᳯरत ᭃेᮢ जैसे उ᳒ान और उसी ᮧकार के ᭭ थान, उ᳒ान कृिष ᭃेᮢ, आ᳸कडᲂ, झीलᲂ और अ᭠य जल

िनकायᲂ का अ᭤यकंन करेगी ।

(8) आंचिलक महायोजना ᭭ थानीय समुदायᲂ कᳱ जीवकोपाजᭅन को सुिनि᭫ चत करने का सुिन ᭫ चय करेगी ।

3. रा᭔य सरकार ᳇ारा ᳰकए जाने वाले उपाय-- रा᭔य सरकार इस अिधसूचना के उपबंधᲂ को ᮧभावी करने के िलए

िन᳜िलिखत उपाय करेगी, अथाᭅत् :--

(1) भू-उपयोग – पाᳯरि᭭ थितक संवेदी जोन मᱶ वनᲂ, उ᳒ान-कृिष ᭃेᮢᲂ, कृिष ᭃेᮢᲂ, आमोद-ᮧमोद के ᮧयोजन के िलए

िचि᭠हत ᳰकए गए पाकᲄ और खुले ᭭थानᲂ का वािणि᭔यक और औ᳒ोिगक संब᳍ िवकास ᳰᮓयाकलापᲂ के िलए उपयोग या

संपᳯरवतᭅन नहᱭ होगा :

परंतु पाᳯरि᭭थितक संवेदी जोन के भीतर कृिष भूिम का संपᳯरवतᭅन, मानीटरी सिमित कᳱ िसफाᳯरश पर और रा᭔य

सरकार के पूवᭅ अनुमोदन से, ᭭थानीय िनवािसयᲂ कᳱ आवासीय जᱨरतᲂ को पूरा करने के िलए और पैरा 4 कᳱ सारणी के ᭭तंभ

(2) मᱶ ᮓम सं. 10, 21, 26, 27, और 28 के अधीन ᳰᮓयाकलापᲂ को पूरा करने के िलए अनु᭄ात होगा, अथाᭅत् :-

(i)

पाᳯरि᭭ थितक अनुकूल पयᭅटन ᳰᮓयाकलापᲂ के िलए पयᭅटकᲂ के अ᭭ थायी आवासन के िलए पाᳯरि᭭ थितक अनुकूल

आरामगाह जैसे टᱶट, लकड़ी के मकान आᳰद ;

(ii) िव ᳒मान सड़कᲂ को चौड़ा करना और सुदृढ़ करना;

(iii) कुटीर उ᳒ोग, िजसके अंतगᭅत ᮕामीण उ᳒ोग, सुिवधाजनक भंडार और ᭭ थानीय सुिवधाएं भी हᱹ,

(iv) वषाᭅ जल संचय, और

(v) ᮧदूषण उ᭜प᳖ न करने वाले लघु उ᳒ोग, :

परंतु यह और ᳰक रा᭔य सरकार के पूवᭅ अनुमोदन और संिव धान के अनु᭒ छेद 244 तथा त᭜समय ᮧवृᱫ िविध के उपबंधᲂ के

अनुपालन के िबना, िजसके अंतगᭅत अनुसूिचत जनजाित और अ᭠य परंपरागत वन िनवासी (वन अिधकारᲂ कᳱ मा᭠यता)

अिधिनयम, 2006 (2007 का 2) भी है, वािणि᭔यक या उ᳒ोग िवकास ᳰᮓयाकलापᲂ के िलए जनजातीय भूिम का उपयोग

अनु᭄ात नहᱭ होगा :

परंतु यह और भी ᳰक पाᳯरि᭭ थितक संवेदी जोन के भीतर भू-अिभलेखᲂ मᱶ उपसंजात कोई ᮢुᳯट, इसमᱶ पैरा 3 मᱶ िन᳸द᭬ ट

मानीटरी सिमित के िवचार ᮧा᳙ करने के प᳟ात् रा᭔य सरकार ᳇ारा ᮧ᭜येक मामले मᱶ केवल एक बार संशोिधत होगी और उᲦ

ᮢुᳯट के संशोधन कᳱ कᱶᮤीय सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय को सूचना देनी होगी ।

परंतु यह और भी ᳰक उपयुᭅᲦ ᮢुᳯट का संशोधन मᱶ इस उप पैरा के अधीन यथा उपबंिधत के िसवाय ᳰकसी भी दशा मᱶ भू-

उपयोग का पᳯरवतᭅन सि᭥मिलत नहᱭ होगा ।

परंतु यह और भी ᳰक िजससे हᳯरत ᭃेᮢ मᱶ जैसे वन ᭃेᮢ, कृिष ᭃेᮢ आᳰद मᱶ कोई पाᳯरणािमक कटौती नहᱭ होगी और

अनᮧयु᭍ त या अनु᭜ पादक कृिष ᭃेᮢᲂ मᱶ पुन: वनीकरण करने के ᮧयास ᳰकए जाएंगे ।

(2) ᮧाकृितक जल ᮲ोत - आचंिलक महायोजना मᱶ सभी ᮧाकृितक जल ᮲ोतᲂ कᳱ पहचान कᳱ जाएगी और उनके संरᭃण

और नवीकरण के िलए योजना सि᭥ मिलत होगी और रा᭔ य सरकार ᳇ारा ऐसे ᭃेᮢᲂ पर या उनके िनकट िवकास ᳰᮓयाकलाप

ᮧितिष᳍ करने के िलए ऐसी रीित से मागᭅिनदᱷश तैयार ᳰकए जाएंगे ।

(3) पयᭅटन - (क) पाᳯरि᭭थितक संवेदी जोन के भीतर पयᭅटन संबंधी ᳰᮓयाकलाप, पयᭅटक महायोजना के अनुसार हᲂगे,

जो आंचिलक महायोजना का एक भाग बनᱶगे ।

(ख) पयᭅटन महायोजना पयᭅटन िवभाग ᳇ारा छ᭜ तीसगढ़ सरकार के वन और पयाᭅवरण िवभाग के परामशᭅ से तैयार कᳱ

जाएगी ।

(ग) पयᭅटन संबंधी ᳰᮓयाकलाप िन᭥ निलिखत के अधीन िविनयिमत हᲂगे, अथाᭅत् :-

(i) पाᳯरि᭭थितक संवेदी जोन के भीतर सभी नए पयᭅटन ᳰᮓयाकलापᲂ या िव᳒मान पयᭅटन ᳰᮓयाकलापᲂ का िव᭭तार

कᱶᮤीय सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय के मागᭅदशᭅक िस᳍ांतᲂ के ᳇ारा तथा रा᭬ ᮝीय ᭪ याᮖ

संरᭃण ᮧािधकरण, ᳇ारा जारी पाᳯरि᭭थितक पयᭅटन (समय-समय पर यथा संशोिधत) मागᭅदशᭅक िस᳍ांतᲂ के

अनुसार, पाᳯरि᭭थितक पयᭅटन, पाᳯरि᭭थितक िशᭃा और पाᳯरि᭭थितक िवकास को मह᭜व देते ᱟए पाᳯरि᭭थितक

संवेदी जोन कᳱ वहन ᭃमता के अ᭟ययन पर आधाᳯरत होगा;

(ii) पाᳯरि᭭ थितक अनुकूल पयᭅटन ᳰᮓयाकलापᲂ के संबंिधत पयᭅटकᲂ के अ᭭ थायी िनवास के िलए आवासन के िसवाय

पाᳯरि᭭ थितक संवेदी जोन के भीतर होटल और ᳯरसोटᭅ के नए संिनमाᭅण बारनावापारा व᭠ यजीव अभयार᭛ य कᳱ सीमा

के 1 ᳰकलोमीटर के भीतर अनु᭄ात नहᱭ हᲂगे ।

(iii) आंचिलक महायोजना का अनुमोदन ᳰकए जाने तक, पयᭅटन के िलए िवकास और िव᳒मान पयᭅटन ᳰᮓयाकलापᲂ

के िव᭭तार को वा᭭तिवक ᭭थल िविन᳸द᳥ संवीᭃा तथा मानीटरी सिमित कᳱ िसफाᳯरश पर आधाᳯरत संबंिधत

िविनयामक ᮧािधकाᳯरयᲂ ᳇ारा अनु᭄ात ᳰकया होगा ।

(4) नैसᳶगक िवरासत - पाᳯरि᭭थितक संवेदी जोन मᱶ मह᭜वपूणᭅ नैसᳶगक िवरासत के सभी ᭭थलᲂ जैसे सभी जीन कोश

आरिᭃत ᭃेᮢ, शैल िवरचनाएं, जल ᮧपातᲂ, झरनᲂ, घाटी मागᲄ, उपवनᲂ, गुफाएं, ᭭थलᲂ, ᮪मण, अ᳡रोहण, ᮧपातो आᳰद कᳱ

पहचान कᳱ जाएगी और उ᭠हᱶ संरिᭃत ᳰकया जाएगा तथा उनके पᳯररᭃण और संरᭃा के िलए इस अिधसूचना के ᮧकाशन कᳱ

तारीख से छह मास के भीतर, उपयुᲦ योजना बनाएगी और ऐसी योजना आंच िलक महायोजना का भाग होगा ।

(5) मानव-िनᳶमत िवरासत ᭭ थल - पाᳯरि᭭ थितक संवेदी जोन मᱶ भवनᲂ, संरचनाᲐ, िश᭨प-त᭝य, ऐितहािसक, कला᭜मक

और सां᭭कृितक मह᭜व के ᭃेᮢᲂ कᳱ पहचान करनी होगी और इस अिधसूचना के ᮧकाशन कᳱ तारीख से छह माह के भीतर उनके

संरᭃण कᳱ योजनाएं तैयार करनी होगी तथा आंचिलक महायोजना मᱶ सि᭥मिलत कᳱ जाएगी ।

(6) ᭟ विन ᮧदूषण -- पाᳯरि᭭थितक संवेदी जोन मᱶ ᭟ विन ᮧदूषण के िनयंᮢण के िलए रा᭔ य सरकार का पयाᭅवरण िवभाग,

वायु (ᮧदूषण िनवारण और िनयंᮢण) अिधिनयम, 1981 (1981 का 14) और उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के

अनुसरण मᱶ मागᭅदशᭅक िस᳍ांत और िविनयम तैयार करेगा ।

(7) वायु ᮧदूषण -- पाᳯरि᭭थितक संवेदी जोन मᱶ, वायु ᮧदूषण के िनयंᮢण के िलए रा᭔य सरकार का पयाᭅवरण िवभाग,

अनुसरण मᱶ मागᭅदशᭅक िस᳍ांत और िविनयम तैयार करेगा ।

(8) बिह᮲ाव का िन᭭सारण - पाᳯरि᭭थितक संवेदी जोन मᱶ उपचाᳯरत बिह᮲ाव का िन᭭सारण जल (ᮧदूषण िनवारण

तथा िनयंᮢण) अिधिनयम, 1974 (1974 का 6) और उसके अधीन बनाए गए िनयमᲂ के उपबंधᲂ के अनुसार होगा ।

(9) ठोस अपिश᳥ - ठोस अपिश᳥ᲂ का िनपटान िन᳜िलिखत ᱨप मᱶ होगा -

(i)

पाᳯरि᭭थितक संवेदी जोन मᱶ ठोस अपिश᳥ᲂ का िनपटान भारत सरकार के त᭜कालीन पयाᭅवरण, वन और

जलवायु पᳯरवतᭅन मंᮢालय कᳱ समय-समय पर यथा संशोिधत अिधसूचना सं. का.आ. 908(अ), तारीख

25 िसतंबर, 2000 नगरपािलक ठोस अपिश᳥ (ᮧबंध और हथालन) िनयम, 2000 के उपबंधᲂ के अनुसार

ᳰकया जाएगा ;

(ii) ᭭थानीय ᮧािधकरण जैव िन᳜ीकरणीय और अजैव िन᳜ीकरणीय संघटकᲂ मᱶ ठोस अपिश᳥ᲂ के संपृथᲥन के

िलए योजनाएं तैयार करᱶगे ;

(iii) जैव िन᳜ीकरणीय सामᮕी को अिधमानतः खाद बनाकर या कृिम खेती के मा᭟यम से पुनःचᳰᮓत ᳰकया

जाएगा ;

(iv) अकाबᭅिनक सामᮕी का िनपटान पाᳯरि᭭थितक संवेदी जोन के बाहर पहचान ᳰकए गए ᭭ थल पर ᳰकसी

पयाᭅवरणीय ᭭वीकृत रीित मᱶ होगा और पाᳯरि᭭थितक संवेदी जोन मᱶ ठोस अपिश᭬ टᲂ को जलाना या

भ᭬ मीकरण अनु᭄ात नहᱭ होगा ।

(10) जैव िचᳰक᭜सा अपिश᳥ - पाᳯरि᭭थितक संवेदी जोन मᱶ जैव िचᳰक᭜सीय अपिश᳥ᲂ का िनपटान भारत सरकार के

त᭜कालीन ᳇ारा पयाᭅवरण और वन मंᮢालय कᳱ समय-समय पर यथासंशोिधत अिधसूचना सं.का.आ.630 (अ) तारीख 20

जुलाई, 1998 ᳇ारा ᮧकािशत जैव िचᳰक᭜सीय अपिश᳥ (ᮧबंध और हथालन) िनयम, 1998 के उपबंधᲂ के अनुसार ᳰकया

जाएगा ।

(11) यानीय यातायात - पᳯरवहन कᳱ यानीय गितिविधयां आवास के अनुकूल िविनयिमत हᲂगी और इस संबंध मᱶ आंचिलक

महायोजना मᱶ िवशेष उपबंध अिधकिथत ᳰकए जाएंगे और आंचिलक महायोजना के तैयार होने और रा᭔ य सरकार के सᭃम

ᮧािधकारी के ᳇ारा अनुमोᳰदत होने तक, मानीटरी सिमित ᮧवृᱫ िनयमᲂ और िविनयमᲂ के अनुसार यानीय गितिविधयᲂ के

अनुपालन को मानीटर करेगी ।

(12) औ᳒ोिगक इकाईयां –

(क) ᮧ᭭ तािव त पाᳯरि᭭थितक संवेदी जोन मᱶ नए का᭬ ठ आधाᳯर त उ᳒ोगᲂ कᳱ ᭭ थापना को िस वाए िव िध के अनुसार

᭭ थािप त िव ᳒मान का᭬ ठ आधाᳯर त उ᳒ोगᲂ के अनु᭄ात नहᱭ ᳰक या जाएगा ।

(ख) जल, वायु, मृदा, ᭟ विन ᮧदूषण काᳯर त करने वाले ᳰक सी नए उ᳒ोग कᳱ ᮧ᭭ तािव त पाᳯरि᭭थितक संवेदी जोन मᱶ

᭭ थापना को अनु᭄ात नहᱭ ᳰक या जाएगा ।

4. पाᳯरि᭭थितक संवेदी जोन मᱶ ᮧितिष᳍ और िविनयिमत ᳰᮓयाकलापᲂ कᳱ सूची - पाᳯरि᭭थितक संवेदी जोन मᱶ सभी

ᳰᮓयाकलाप पयाᭅवरण (संरᭃण) अिधिनयम, 1986 (1986 का 29) के उपबंधᲂ ᳇ारा शािसत हᲂगे और नीचे दी गई तािलका

अ᭭थायी अिधभोग के िलए आवास के िसवाय संरिᭃत ᭃेᮢ कᳱ सीमा से

1 ᳰकलोमीटर के भीतर ᳰकसी नए वािणि᭔यक होटलᲂ और िव᮰ाम᭭थलᲂ

कᳱ अनु᭄ा नहᱭ दी जाएगी ।

11.

संिनमाᭅणᳰᮓयाकलाप।

(क) संरिᭃत ᭃेᮢ कᳱ सीमा से 500 मीटरके भीतर ᳰकसी भी ᮧकार के

नए वािणि᭔ यक संिनमाᭅण को अनु᭄ात नहᱭ ᳰकया जाएगा:

परंतु ᭭ थानीय लोगᲂ को पैरा 3 के उप पैरा (1) मᱶ सूचीब᳍ ᳰᮓयाकलापᲂ

सिहत उनके आवासीय उपयोग के िलए उनकᳱ भूिम मᱶ संिनमाᭅण करने

कᳱ अनुमित दी जाएगी ।

(ख) ऐसे लघु उ᳒ोगᲂ जो ᮧदूषण उ᭜ प᭠ न नहᱭ करते हᱹ, से संबंिधत

संिनमाᭅण ᳰᮓयाकलाप िविनयिमत ᳰकए जाएंगे और लागू िनयमᲂ और

िविनयमᲂ, यᳰद कोई हᲂ, के अनुसार सᭃम ᮧािधकारी कᳱ पूवᭅ अनुमित

से ही ᭠ यूनतम पर रखे जाएंगे ।

(ग) पाᳯरि᭭थितक संवेदी जोन मᱶ सि᭠ न माᭅण ᳰᮓयाकलाप आंचिलक

महायोजना कᳱ अनुसार होगा ।

6. िनदᱷश िनबंधन :

(1) पाᳯरि᭭थितक संवेदी जोन सिमित इस अिधसूचना के उपबंधᲂ के अनुपालन को मानीटर करेगी ।

(2) पाᳯरि᭭थितक संवेदी जोन मᱶ भारत सरकार के त᭜ कालीन पयाᭅवरण और वन मंᮢालय कᳱ अिधसूचना सं. का.आ.

1533(अ) तारीख 14 िसतंबर, 2006 कᳱ अनुसूची मᱶ के अधीन सि᭥मिलत ᳰᮓयाकलापᲂ और इस अिधसूचना के पैरा 4 के

अधीन ᮧितिष᳍ गितिविधयᲂ के िसवाय आने वाले ऐसे ᳰᮓयाकलापᲂ कᳱ दशा मᱶ वा᭭तिवक िविन᳸द᳥ ᭭थलीय दशाᲐ पर

आधाᳯरत मानीटरी सिमित ᳇ारा संवीᭃा कᳱ जाएगी और उᲦ अिधसूचना के उपबंधᲂ के अधीन पूवᭅ पयाᭅवरण िनकासी के िलए

के᭠ᮤीय सरकार के पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय को िन᳸द᳥ कᳱ जाएगी ।

(3) इस अिधसूचना के पैरा 4 के अधीन यथा िविन᳸द᳥ ᮧितिष᳍ ᳰᮓयाकलापᲂ के िसवाय, भारत सरकार के पयाᭅवरण,

वन और जलवायु पᳯरवतᭅन मंᮢालय कᳱ अिधसूचना सं᭎यांक का.आ. 1533(अ) तारीख 14 िसतंबर, 2006 कᳱ अिधसूचना के

अनुसूची के अधीन ऐसे ᳰᮓयाकलापᲂ, िज᭠हᱶ सि᭥मिलत नहᱭ ᳰकया गया है, परंतु पाᳯरि᭭थितक संवेदी जोन मᱶ आते हᱹ, ऐसे

ᳰᮓयाकलापᲂ कᳱ वा᭭तिवक िविन᳸द᳥ ᭭थलीय दशाᲐ पर आधाᳯरत मानीटरी सिमित ᳇ारा संवीᭃा कᳱ जाएगी और उसे संब᳍

िविनयामक ᮧािधकरणᲂ को िन᳸द᳥ ᳰकया जाएगा ।

(4) मानीटरी सिमित का सद᭭य-सिचव या संब᳍ उपायु᭍ त, ऐसे ᳞िᲦ के िवᱨ᳍, जो इस अिधसूचना के ᳰकसी उपबंध

का उ᭨लंघन करता है, पयाᭅवरण (संरᭃण) अिधिनयम, 1986 कᳱ धारा 19 के अधीन पᳯरवाद फाइल करने के िलए सᭃम

होगा ।

(5) मानीटरी सिमित मु᳎ा दर मु᳎ा के आधार पर अपेᭃाᲐ पर िनभᭅर रहते ᱟए संब᳍ िवभागᲂ के ᮧितिनिधयᲂ या

िवशेष᭄ᲂ, औ᳒ोिगक संगमᲂ या संब᳍ पणधाᳯरयᲂ के ᮧितिनिधयᲂ को अपने िवचार-िवमशᭅ मᱶ सहायता के िलए आमंिᮢत कर

सकेगी ।

(6) मानीटरी सिमित ᮧ᭜येक वषᭅ कᳱ 31 माचᭅ तक रा᭔ य के मु᭎ य व᭠ यजीव वाडᭅन को अपनी वाᳶषक कारᭅवाई ᳯरपोटᭅ

उपाबंध III मᱶ उपबंिधत ᱨप मᱶ उ᭍ त वषᭅ के 30 जून तक ᮧ᭭तुत करेगी ।

(7) के᭠ᮤीय सरकार का पयाᭅवरण, वन और जलवायु पᳯरवतᭅन मंᮢालय मानीटरी सिमित को अपने कृ᭜यᲂ के ᮧभावी

िनवᭅहन के िलए समय-समय पर ऐसे िनदेश दे सकेगा, जो वह ठीक समझे ।

NOTIFICATION

New Delhi, the 14th January, 2016

S.O.251(E).— The following draft of the notification, which the Central Government proposes to

issue in exercise of the powers conferred by sub-section (1), read with clause (v) and clause (xiv) of sub-

section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) is hereby

published, as required under sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, for the

information of the public likely to be affected thereby; and notice is hereby given that the said draft

notification shall be taken into consideration on or after the expiry of a period of sixty days from the date on

which copies of the Gazette of India containing this notification are made available to the public;

Any person interested in making any objections or suggestions on the proposals contained in the draft

notification may forward the same in writing, for consideration of the Central Government within the period

so specified to the Secretary, Ministry of Environment, Forest and Climate Change, Indira Paryavaran

Draft Notification

WHEREAS, the Barnawapara Wildlife Sanctuary is located in Raipur Division, District Balodabazaar,

Chhattisgarh and is an important protected area known for its rich habitat consisting of a variety of flora and

fauna including leopard, Bison, Sloth Bear, Sambhar, Blue Bull, Spotted Deer, Barking Deer, Hyeana, Wolf,

Jackal, Fox, Jungle Cat, Mongoose, Hares, Common Langur, Wild Dog, Wild Boar, etc. It forms a watershed

for the River Mahanadi and its tributaries – the Balamdehi and Jonk rivers. The Barnawapara Wildlife

Sanctuary is located at a distance of about 100 kilometre from Raipur. The Barnawapara Wildlife Sanctuary

is spread over an area of 244.66 square kilometres;

AND WHEREAS, the Barnawapara Wildlife Sanctuary forms a watershed for the River Mahanadi and its

tributaries – the Balamdehi and Jonk rivers;

AND WHEREAS, it is necessary to conserve and protect the area surrounding the protected area the extent

and boundaries of the which is specified in paragraph 1 of this notification around the the protected area of the

Barnawapara Wildlife Sanctuary as Eco-sensitive Zone from ecological, environmental and biodiversity point

of view and to prohibit industries or class of industries and their operations and processes in the said Eco-

sensitive Zone.

NOW THEREFORE, in exercise of the power conferred by sub section(1), clauses (v) and (xiv) of sub-

section (2) and sub-section (3) of section 3 of the Environment (Protection) Act 1986 (29 of 1986) read with

sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies

an area to an extent upto one kilometre from the boundary of Barnawapara Wildlife Sanctuary in district

Balodabazaar, in the State of Chhattisgarh as the Barnawapara Wildlife Sanctuary Eco-sensitive Zone (herein

after referred to as the Eco-sensitive Zone) details of which are as under, namely:-

Extent and boundaries of Eco-sensitive Zone.- (1) The Eco-sensitive Zone spread over an area

of 93.997 square kilometre (this includes 81.86 square kilometres of Reserve Forest and and Protected Forest )

with an extent upto one kilometres from the periphery of the Barnawapara Wildlife Sanctuary.

(2) The Eco-sensitive Zone of Barnawapara Wildlife Sanctuary lies between 21⁰ 18' 09" N to 21⁰ 30' 26" N

latitude and 82⁰ 21' 08" E to 82⁰ 34' 13" E longitude.

(3)

A total of 21 villages, namely Achanakpur, Bhinmori, Dhawalpura, Dhebikhar1, Ghatmurwa,

Gidhpuri, Jamhar2, Jamhar7, Jamhar8, Jogidipa, Khurmuri, Konjia, Ladadih, Mohda, Nawagaon, Pakrid,

Phurphundi, Rawan, Sahiyabhata, Taldadar, Tenduchhua fall within Eco-sensitive Zone.

(4) The map of the Eco-sensitive Zone along with latitudes and longitudes is appended as Annexure-I.

(5) The boundary details of Barnawapara Wildlife Sanctuary and its Eco-sensitive Zone in terms of GPS

coordinates are given in Annexure-II.

Zonal Master Plan for the Eco-sensitive Zone.- (1) The State Government shall, for the purpose of

the Eco-sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of

publication of final notification in the Official Gazette, in consultation with local people and adhering to the

stipulations given in this notification.

(2)

The Zonal Master Plan shall be approved by the Competent Authority in the State Government.

(3)

The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such

a manner as is specified in this notification and also in consonance with the relevant Central and State laws

and the guidelines issued by the Central Government, if any.

(4)

The Zonal Master Plan shall be prepared in consultation with all concerned State Departments,

namely:-

(i)

Environment,

(ii)

Forest,

(iii)

Urban Development,

(iv)

Tourism,

Municipal,

(vi)

Revenue,

(vii) Agriculture,

(viii) Chhattisgarh Environment Conservation Board,

(ix)

Irrigation; and

(x)

Public Works Department.

(5)

The Zonal Master Plan shall not impose any restriction on the approved existing land use,

infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in

improvement of all infrastructure and activities to be more efficient and eco-friendly.

(6)

The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water

bodies, management of catchment areas, watershed management, groundwater management, soil and moisture

conservation, needs of local community and such other aspects of the ecology and environment that needs

attention.

(7)

The Zonal Master Plan shall demarcate all the existing worshipping places, village and urban

settlements, types and kinds of forests, tribal areas, agricultural areas, fertile lands, green area, such as, parks

and like places, horticultural areas, orchards, lakes and other water bodies.

(8)

The Zonal Master Plan shall regulate development in Eco-sensitive Zone so as to ensure eco-friendly

development for livelihood security of local communities.

Measures to be taken by State Government.- The State Government shall take the following

measures for giving effect to the provisions of this notification, namely:-

(1)

Land use:- Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for

recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or

industrial related development activities:

Provided that the conversion of agricultural lands within the Eco-sensitive Zone may be permitted on

the recommendation of the Monitoring Committee, and with the prior approval of the State Government, to

meet the residential needs of local residents, and for the activities listed against serial numbers 10,21,26,27,28

in column (2) of the Table in paragraph 4, namely:-

(i)

Eco-friendly cottages for temporary occupation of tourists, such as tents, wooden houses, etc. for Eco-

friendly tourism activities,

(ii)

Widening and strengthening of existing roads,

(iii) Small scale industries not causing pollution,

(iv)

Rainwater harvesting, and

(v)

Cottage industries including village industries, convenience stores and local Amenities,

Provided further that no use of tribal land shall be permitted for commercial and industrial

development activities without the prior approval of the State Government and without compliance of the

provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled

Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):

Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be

corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and

the correction of said error shall be intimated to the Central Government in the Ministry of Environment,

Forest and Climate Change:

Provided also that the above correction of error shall not include change of land use in any case except

as provided under this sub-paragraph.

Provided also that there shall be no consequential reduction in green area, such as forest area and

agricultural area and efforts shall be made to reforest the unused or unproductive agricultural areas.

(2)

Natural springs:-The catchment areas of all natural springs shall be identified and plans for their

conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be

drawn up by the State Government in such a manner as to prohibit development activities at or near these

areas which are detrimental to such areas.

(3)

Tourism:- (a) The activity relating to tourism within the Eco-sensitive Zone shall be as per Tourism

Master Plan, which shall form part of the Zonal Master Plan.

(b) The Tourism Master Plan shall be prepared by Department of Tourism, in consultation with Department of

Forests and Environment Government of Chhattisgarh.

(i)

All new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone

shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment,

Forest and Climate Change with emphasis on eco-tourism, eco-education and eco-development and based on

carrying capacity study of the Eco-sensitive Zone;

(ii)

new construction of hotels and resorts shall not be permitted within 1 kilometre from the boundary of

the Barnawapara Wildlife Sanctuary except for accommodation for temporary occupation of tourists related

to eco-friendly tourism activities:

(iii)

till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism

activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny

and recommendation of the Monitoring Committee.

(4)

Natural heritage:- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene

pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc.

shall be identified and preserved and proper plan shall be drawn up for their protection and conservation,

within six months from the date of publication of final notification and such plan shall form part of the Zonal

Master Plan.

Man-made heritage sites:- Buildings, structures, artefacts, areas and precincts of historical,

architectural, aesthetic, and cultural significance shall be indentified in the Eco-sensitive Zone and plans for

their conservation shall be prepared within six months from the date of publication of final notification and

incorporated in the Zonal Master Plan.

(6)

Noise pollution.- The Environment Department of the State Government shall draw up guidelines and

regulations for the control of noise pollution in the Eco-sensitive Zone in accordance with the provisions of

the Air (Prevention and Control of Pollution) Act, 1981(14 of 1981) and the rules made thereunder.

(7)

Air pollution:- The Environment Department of the State Government shall draw up guidelines and

regulations for the control of air pollution in the Eco-sensitive Zone in accordance with the provisions of the

Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made thereunder.

(8)

Discharge of effluents:- The discharge of treated effluent in Eco-sensitive Zone shall be in

accordance with the provisions of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974) and

the rules made thereunder.

(9)

Solid wastes:- Disposal of solid wastes shall be as under.- (i) the solid waste disposal in Eco-

sensitive Zone shall be carried out as per the provisions of the Municipal Solid Waste (Management and

Handling) Rules, 2000 published by the Government of India in the erstwhile Ministry of Environment and

Forests vide notification number S.O. 908 (E), dated the 25^th September, 2000 as amended from time to time;

(ii) the local authorities shall draw up plans for the segregation of solid wastes into biodegradable and non-

biodegradable components;

(iii) the biodegradable material shall be recycled preferably through composting or vermiculture;

(iv) the inorganic material shall be disposed of in an environmentally acceptable manner at site identified

outside the Eco-sensitive Zone and no burning or incineration of solid wastes shall be permitted in the Eco-

sensitive Zone.

(10)

Bio-medical waste:- The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out as

per the provisions of the Bio-Medical Waste (Management and Handling) Rules, 1998 published by the

Government of India in the erstwhile Ministry of Environment and Forests vide notification number S.O.

630(E), dated the 20^th July, 1998 as amended from time to time.

(11)

Vehicular traffic:- The vehicular movement of traffic shall be regulated in a habitat friendly

manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time

as the Zonal Master Plan is prepared and approved by the competent authority in the State Government,

Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the

rules and regulations made thereunder.

(12)

Industrial units.- (a) No establishment of new wood based industries within the proposed Eco-

sensitive Zone shall be permitted except the existing wood based industries set up as per the law.

(b) No establishment of any new industry causing water, air, soil, noise pollution within the proposed

Eco-sensitive Zone shall be permitted.

List of activities prohibited or to be regulated within the Eco-sensitive Zone.- All activities in the

Eco-sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of

1986) and the rules made thereunder, and shall be regulated in the manner specified in the table below,

namely:-

permitted within the Eco-sensitive Zone.

Use or production of any hazardous

substances.

B. Regulated activities

10.

Establishment of hotels and resorts.

No new commercial hotels and resorts shall be

permitted within one kilometre of the boundary of the

protected area except for accommodation for

temporary occupation of tourists related to eco-

friendly tourism activities.

11.

Construction activities.

(a) No new commercial construction of any kind shall

be permitted within 500 metre from the boundary of

the protected area:

Provided that, local people shall be permitted to

undertake construction in their land for their

residential use including the activities listed in sub-

paragraph (1) of paragraph 3:

(b) The construction activity related to small scale

industries not causing pollution shall be regulated and

kept at the minimum, with the prior permission from

the competent authority as per applicable rules and

regulations, if any.

Trenching ground.

5. Monitoring Committee.- (1) The Central Government hereby constitutes a Monitoring Committee, for

effective monitoring of the Eco-sensitive Zone falling in the State of Chattisgarh, which shall comprise of the

following namely:-

(i) Divisional Commissioner, Raipur

An expert in the area of ecology and environment

Terms of Reference.-

(1)

The Monitoring Committee shall monitor the compliance of the provisions of this notification.

(2)

The Monitoring Committee shall monitor the compliance of the provisions of this notification.

(3)

The activities that are covered in the Schedule to the notification of the Government of India in the

erstwhile Ministry of Environment and Forest number S.O. 1533(E), dated the 14^th September, 2006,

and are falling in the Eco-sensitive Zone, except the prohibited activities as specified in the Table

under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual

site-specific conditions and referred to the Central Government in the Ministry of Environment,

Forest and Climate Change for prior environmental clearances under the provisions of the said

notification.

(4)

The activities that are not covered in the Schedule to the notification of the Government of India in

the erstwhile Ministry of Environment and Forest number S.O. 1533(E), dated the 14^th September,

2006 and are falling in the Eco-sensitive Zone, except the prohibited activities as specified in the

Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the

actual site-specific conditions and referred to the concerned regulatory authorities.

(5)

The Member-Secretary of the Monitoring Committee or the concerned Collector or the concerned

park in-charge shall be competent to file complaints under section 19 of the Environment

(Protection) Act, 1986 against any person who contravenes the provisions of this notification.

(6)

The Monitoring Committee may invite representatives or experts from concerned Departments,

representatives from industry associations or concerned stakeholders to assist in its deliberations

The Monitoring Committee shall submit the annual action taken report of its activities as on 31^st

March of every year by 30^th June of that year to the Chief Wildlife warden of the State as per

proforma given in Annexure III.

The Central Government in the Ministry of Environment, Forest and Climate Change may give such

directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.

The Central Government and State Government may specify additional measures, if any, for giving

effect to provisions of this notification.

The provisions of this Notification are subject to the orders, if any, passed, or to be passed, by the

Hon’ble Supreme Court of India or the High Court or National Green Tribunal.
