सा.का.िन. 1088(अ).—के᭠ ᮤीय सरकार, रेल दावा अिधकरण अिधिनयम, 1987 (1987 का 54) कᳱ धारा 30 के
खंड (ख) के साथ पᳯठत धारा 30 कᳱ उपधारा (2) के खंड (ख) के साथ पᳯठत उप खंड (1) ᳇ारा ᮧद᭜ त शिᲦयᲂ का ᮧयोग करते
ᱟए, रेल दावा अिधकरण (अ᭟ यᭃ, उपा᭟ यᭃ और सद᭭ यᲂ का वेतन और भ᭜ ता तथा सेवा कᳱ शतᱸ) िनयम, 1989 मᱶ और
संशोधन करने के िलए एतवारा िन᭥ निलिखत िनयम बनाती है:-

संिᭃ᭡ त नाम एवं ᮧारंभ:-
(1) इन िनयमᲂ को रेल दावा अिधकरण (अ᭟ यᭃ, उपा᭟ यᭃ और सद᭭ यᲂ का वेतन और भ᭜ ता तथा सेवा कᳱ शतᱸ)
संशोधन िनयम, 2016 कहा जाएगा ।
(2) ये 1 जनवरी, 2016 से ᮧभावी माने जाएंगे ।

िनयम 3 के िलए नए िनयम का ᮧित᭭ थापन 3:- रेल दावा अिधकरण, (अ᭟ यᭃ, उपा᭟ यᭃ एवं सद᭭ यᲂ का वेतन
और भ᭜ ता तथा सेवा कᳱ शतᱸ) िनयम, 1989 के िनयम 3 के िलए िन᭥ निलिखत को ᮧित᭭ थािपत ᳰकया जाए, अथाᭅत्:-
“3. वेतन--- अ᭟ यᭃ दो लाख पचास हजार ᱧपये ᮧितमाह, उपा᭟ यᭃ दो लाख प᭒ चीस हजार ᱧपये ᮧितमाह और सद᭭ य
सा.का.िन. 746 (अ) ᳰदनांक 28 जुलाई, 2016 ᳇ारा ᮧकािशत रेल सेवा (संशोिधत वेतन) िनयम, 2016 कᳱ अनुसूची के
भाग क मᱶ िन᳸द᭬ ट वेतन मैᳯᮝ स के लेवल 16 (205400 ᱨ.-224400 ᱨ.) मᱶ संशोिधत वेतन ᮧा᭡ त करᱶगे । 1 जनवरी,
2016 को वेतन मैᳯᮝ स के लागू लेवल मᱶ सद᭭ य का वेतन मौजूदा मूल वेतन अथाᭅत् मौजूदा वेतन बᱹड तथा ᮕेड पे मᱶ
आहᳯरत वेतन को 2.57 के गुणक से गुणा करके ᮧा᭡ त रािश को िनकटतम ᱨपये मᱶ पूणाᲈᳰकत करके ᮧा᭡ त आंकड़ᲂ को वेतन
मैᳯᮝ स के उस लेवल मᱶ िनधाᭅᳯरत ᳰकया जाएगा तथा यᳰद ऐसा कोई समान आंकड़ा वेतन मैᳯᮝ स के लागू लेवल मᱶ ᳰकसी

सेल के तदनुᱨपी है, तो वह वेतन होगा तथा यᳰद लागू लेवल मᱶ ऐसी कोई सेल उपल᭣ ध नहᱭ है तो वेतन मैᳯᮝ स के उस
लागू लेवल मᱶ ठीक अगले उ᭒ च᭭ तर सेल मᱶ वेतन िनधाᭅᳯरत ᳰकया जाएगा:
पर᭠ तु ᳰकसी ᭪ यिᲦ कᳱ अ᭟ यᭃ, उपा᭟ यᭃ अथवा सद᭭ य के ᱨप मᱶ िनयुिᲦ के मामले मᱶ जो उ᭒ च ᭠ यायालय
के जज के ᱨप मᱶ सेवािनवृ᭜ त ᱟआ हो अथवा के᭠ ᮤ या रा᭔ य सरकार के अधीन सेवा से सेवािनवृ᭜ त ᱟआ हो तथा जो
पᱶशन, उपदान, अंशदायी भिव᭬ य िनिध मᱶ िनयो ता अंशदान अथवा ᳰकसी अ᭠ य ᱨप मᱶ सेवािनवृिᱫ लाभ ᮧा᭡ त कर
रहा हो अथवा ᮧा᭡ त ᳰकया हो अथवा उसके िलए पाᮢ हो गया हो, का वेतन पᱶशन अथवा पᱶशनभोगी कᳱ सकल रािश
अथवा अंशदायी भिव᭬ य िनिध मᱶ िनयो ता के अंशदान के समतु᭨ य पᱶशन अथवा ᳰकसी अ᭠ य ᱨप मᱶ सेवािनवृिᱫ लाभ
यᳰद कोई िलया हो अथवा िलया जाना हो, मᱶ से घटा ᳰदया जाएगा” ।

कᱶᮤ सरकार ने रेल दावा अिधकरण के अ᭟यᭃ, उपा᭟यᭃ और सद᭭यᲂ के वेतनमान और सेवा के िनयम एवं शतᲄ को 01
जनवरी 2016 से संशोिधत करने को अनुमोदन दे ᳰदया है । यह ᮧमािणत ᳰकया जाता है ᳰक अिधसूचना को पूवᭅ᳞ापी ᮧभाव
देने से रेल दावा अिधकरण के ᳰकसी अ᭟यᭃ, उपा᭟यᭃ और सद᭭य पर ᮧितकूल ᮧभाव पड़ने कᳱ संभावना नहᱭ है ।

NOTIFICATION
New Delhi, the 24th November, 2016
G.S.R. 1088(E).--- In exercise of the powers conferred by sub-section (1) read with clause (b) of sub-section (2)
of section 30, read with section 30A of the Railway Claims Tribunal Act, 1987 (54 of 1987), the Central Government
hereby makes the following rules further to amend the Railway Claims Tribunal (Salaries and Allowances and
Conditions of Services of Chairman, Vice-Chairman and Members) Rules, 1989, namely :-
1.
Short title and commencement:---
(1) These rules may be called the Railway Claims Tribunal (Salaries and Allowances and Conditions of Services of
Chairman, Vice-Chairman and Members) Amendment Rules, 2016.
(2) They shall be deemed to have come into force on the 1st day of January, 2016.

Substitution of new rule for rule 3:--- In the Railway Claims Tribunal (Salaries and Allowances and Conditions of
Services of Chairman, Vice-Chairman and Members) Rules, 1989, for rule 3, the following rule shall be substituted,
namely:-
“3. Pay:--- The Chairman shall receive a pay of rupees two lakh and fifty thousand per mensem, a Vice-Chairman shall
receive a pay of rupees two lakh and twenty five thousand per mensem and a Member shall receive pay in level-16
(Rs.205400-224400) of pay matrix specified in Part A of the Schedule to the Railway Services (Revised Pay) Rules, 2016
published vide G.S.R. 746(E) dated the 28th July, 2016. The pay of the Member as on the 1st January, 2016 in the
applicable level of the pay matrix shall be the pay obtained by multiplying the existing basic pay i.e. pay drawn in the
existing Pay Band and Grade Pay by a factor of 2.57, rounded off to the nearest rupees and the figure so arrived at will
be located in that level in the pay matrix and if such an identical figure corresponds to any Cell in the applicable level of
the pay matrix, the same shall be the pay, and if no such Cell is available in the applicable level, the pay shall be fixed at
the immediate next higher Cell in that applicable level of the pay matrix:
Provided that in the case of appointment as Chairman, Vice-Chairman or Member of a person who has retired
as a Judge of a High Court, or who has retired from service under the Central Government or a State Government and
who is in receipt or has received of, or has become entitled to receive any retirement benefits, by way of pension,
gratuity, employer’s contribution to a Contributory Provident Fund or other forms of retirement benefits, the pay shall
be reduced by the gross amount of pension or pensionary equivalent of employer’s contribution to the Contributory
Provident Fund or any other form of retirement benefits, if any, drawn, or to be drawn by him.”

Explanatory Memorandum
The Central Government has accorded approval to revise the scales of pay and certain terms and conditions of
services of Chairman, Vice-Chairman and Members of the Railway Claims Tribunal with effect from 1st January, 2016. It
is certified that no Chairman, Vice-Chairman and the Members of the Railway Claims Tribunal is likely to be affected
adversely by the notification being given retrospective effect.
Note :- The principal rules were published vide number G.S.R. 844(E), dated the 19th September, 1989 and
subsequently amended vide numbers G.S.R 726 (E), dated the 6th December, 1991, G.S.R. 185 (E), dated the 11th April,
