सा.का.िन.1098(अ).—रा᳦पित मूल िनयमावली के िनयम 45 के उपबंधᲂ के अनुसरण मᱶ, सरकारी आवास

आबंटन (ᳰद᭨ली मᱶ सामा᭠य पूल) िनयमावली, 1963 मᱶ िन᳜िलिखत और संशोधन करते हᱹ, अथाᭅत् :-

1.(1) इन िनयमᲂ का संिᭃ᳙ नाम सरकारी आवास आबंटन (ᳰद᭨ली मᱶ सामा᭠य पूल) संशोधन िनयमावली,

2016 है ।

(2) ये राजपᮢ मᱶ इनके ᮧकाशन कᳱ तारीख को ᮧवृᱫ हᲂगे ।

2. सरकारी आवास आबंटन (ᳰद᭨ली मᱶ सामा᭠य पूल) िनयमावली, 1963 (िज᭠हᱶ इसमᱶ इसके प᳟ात् मूल िनयम

कहा गया है) के अनुपूरक िनयम 317-ख-5 के ᭭थान पर िन᳜िलिखत िनयम रखा जाएगा, अथाᭅत् :-

“अनुपूरक िनयम 317-ख-5 आवासᲂ का वगᱮकरण – (1) इन िनयमᲂ मᱶ अ᭠यथा उपबंिधत के िसवाए कोई

आवेदक नीचे सारणी के ᭭तंभ (1) मᱶ यथाउपदᳶशत टाइप के आवास के आबंटन हेतु, उᲦ ᭭तंभ के सामने ᭭तंभ

(3) मᱶ िविन᳸द᳥ वेतन मैᳯᮝ᭍स के ᭭तर के अनुसार पाᮢ होगा :-

(3) िविभ᳖ टाइप के आवासᲂ के िलए पूᳶवकता कᳱ तारीख और ᮧतीᭃा सूिचयᲂ को तैयार करने के िलए संगणना

िन᳜ानुसार कᳱ जाएगी :

(क) टाइप I से टाइप IV आवासᲂ के संबंध मᱶ पूᳶवकता तारीख का अवधारण कमᭅचारी ᳇ारा के᭠ᮤीय

सरकार कᳱ सेवा मᱶ ᮧवेश कᳱ तारीख के आधार पर ᳰकया गया जाएगा और आवास के इस टाइप के

िलए पाᮢता का िविन᳟य वेतन मैᳯᮝ᭍स मᱶ आवेदक के ᭭तर के अनुसार ᳰकया जाएगा :

परंतु इस ᮧवगᭅ के अधीन ᳰकसी आवेदक को, उसकᳱ पाᮢता के टाइप से एक टाइप िन᳜ आवास हेतु

बोली लगाने कᳱ अनु᭄ा दी जाएगी ।

(ख) ऊपर खंड (क) मᱶ िन᳸द᳥ ᳰकसी आवेदक को, िजसने ᳰकसी िविश᳥ ᭭टेशन पर लगातार 5 वषᲄ कᳱ

अविध के िलए सेवा कᳱ है, वषᭅ कᳱ 1 जनवरी को ऐसे ᮧ᭜येक 5 वषᲄ के पूरा होने पर, ᮧतीᭃा सूची

मᱶ उसकᳱ पूᳶवकता तारीख कᳱ संगणना के ᮧयोजन के िलए के᭠ᮤीय सरकार कᳱ सेवा मᱶ उसके ᮧवेश

कᳱ तारीख से ऊपर एक वषᭅ कᳱ वरीयता ᮧदान कᳱ जाएगी ।

(ग) टाइप IV(᭭पै.) और ऊपर के आवासᲂ के संबंध मᱶ पूᳶवकता तारीख का अवधारण उस तारीख के

आधार पर ᳰकया जाएगा, िजससे आवेदक, वेतन मैᳯᮝ᭍स मᱶ उसके ᭭तर के अनुसार आवास कᳱ

टाइप के िलए िनरंतर पाᮢ रहा है ।

(घ) टाइप IV(᭭पै.) और ऊपर के आवासᲂ के िलए पर᭭पर ᭔ये᳧ता िन᳜िलिखत कारकᲂ के आधार पर

िवचार मᱶ ली जाएगी, अथाᭅत् :-

(i) जहां दो या अिधक आवेदकᲂ कᳱ पूᳶवकता तारीख एक समान है, वहां ᭭तर मᱶ उᲬतर ᭭तर

वेतन वाला आवेदक ᮧतीᭃा सूची मᱶ ᭔ये᳧ होगा ;

(ii) जहां दो या अिधक आवेदकᲂ कᳱ पूᳶवकता तारीख और ᭭तर मᱶ वेतन एक समान है, वहां

वह आवेदक, िजसने के᭠ᮤीय सरकार कᳱ सेवा मᱶ पहले ᮧवेश ᳰकया है ᮧतीᭃा सूची मᱶ ᭔ये᳧

होगा ; और

(iii) जहां दो या अिधक आवेदकᲂ कᳱ पूᳶवकता तारीख, ᭭तर मᱶ वेतन और के᭠ᮤीय सरकार कᳱ

सेवा मᱶ ᮧवेश करने कᳱ तारीख एक समान है, वहां पहले सेवािनवृᱫ होने वाले आवेदक को

बाद मᱶ सेवािनवृᱫ होने वाले आवेदक पर पूᳶवकता ᮧदान कᳱ जा सकेगी ।

(ङ) भारत सरकार के सिचव और अपर सिचव के रᱹक के आवेदकᲂ कᳱ पर᭭पर ᭔ये᳧ता का अवधारण,

ᳰद᭨ली मᱶ भारत सरकार कᳱ सेवा मᱶ उनके ᮧवेश करने कᳱ तारीख के आधार पर, ᮧ᭜येक सेवा के

िलए ᮧकािशत िसिवल सूची के अनुसार ᳰकया जाएगा ᳴कतु ऐसा इस शतᭅ के अधीन रहते ᱟए ᳰकया

जाएगा ᳰक समान सेवा के किन᳧ बैच का कोई आवेदक या समान बैच का कोई किन᳧ आवेदक

अपने ᭔ये᳧ बैच के आवेदक या समान बैच के ᭔ये᳧ आवेदक पर पूᳶवकता ᮧा᳙ नहᱭ करेगा :

परंतु जहां सेवा मᱶ ᮧवेश करने कᳱ तारीख समान है, वहां पहले सेवािनवृᱫ होने वाले

आवेदक को बाद मᱶ सेवािनवृᱫ होने वाले आवेदक पर पूᳶवकता ᮧदान कᳱ जा सकेगी :

परंतु यह और ᳰक अिखल भारतीय सेवा (एआईएस) से िभ᳖ सभी अ᭠य सेवाᲐ के संबंध मᱶ

आवेदकᲂ कᳱ पर᭭पर ᭔ये᳧ता का अवधारण, उ᭠हᱶ तैनात ᳰकए जाने और सेवा या बैच पर

᭟यान न देते ᱟए भारत सरकार मᱶ उनके ᮧवेश कᳱ तारीख के आधार पर ᳰकया जाएगा ।

(च) टाइप V और ऊपर के आवासᲂ के िलए हकदार आवेदक, इस शतᭅ के अधीन रहते ᱟए ᳰक ऐसा कोई

आवास टाइप IV िवशेष आवास से िन᳜ नहᱭ होगा, अपनी हकदारी से िन᳜ आवास हेतु आवेदन

करने के िलए भी पाᮢ होगा :

परंतु टाइप V-ए[डी II] और टाइप IV(᭭पै.) के िलए पाᮢ आवेदक टाइप IV आवास के िलए

आवेदन करने के िलए भी पाᮢ हᲂगे :

परंतु यह और ᳰक जहां टाइप V और टाइप VI आवास को, यथाि᭭थित, टाइप Vए और टाइप

Vबी या टाइप VIए और टाइप VIबी के ᱨप मᱶ वगᱮकृत नहᱭ ᳰकया गया है, वहां टाइप V और

टाइप VI आवास के िलए सभी आवेदकᲂ को उनके संब᳍ टाइपᲂ मᱶ एकसाथ समूहब᳍ ᳰकया

जाएगा ।

(4) ᭪ यैि᭍ तक वेतन को ᮧितᭃा सूची मᱶ पर᭭ पर-᭔ ये᭬ ठता का अवधारण करने के ᮧयोजनᲂ के िलए िवचार मᱶ

िलया जाएगा ।

(5) ᮧैि᭍ टसबंदी भ᭜ ते, सेना सेवा वेतन या वेतन के ऐसे ᳰकसी अ᭠ य संघटक को ᮧितᭃा सूची मᱶ पर᭭ पर-᭔ ये᭬ ठता

का अवधारण करने के ᮧयोजनᲂ के िलए िवचार नहᱭ मᱶ िलया जाएगा ।

NOTIFICATION

New Delhi, the 28th November, 2016

G.S.R 1098(E).—In pursuance of the provisions of rule 45 of the Fundamental Rules, the President hereby

makes the following further amendments to the Allotment of Government Residences (General Pool in Delhi) Rules

1963, namely :-

(1) These rules may be called the Allotment of Government Residences (General Pool in Delhi) Amendment

Rules, 2016.

(2)

They shall come into force on the date of their publication in the Official Gazette.

In the Allotment of Government Residences (General Pool in Delhi) Rules 1963, (hereinafter referred to as the

said rules), for supplementary rule SR 317-B-5, the following rule shall be substituted, namely:—

S.R. 317-B-5 Classification of residences.--(1) Save as otherwise provided in these rules, an applicant shall be

eligible for allotment of residence of the type as shown in column(1) as per the level in the pay matrix specified

in the corresponding column(3), in the table below:-

accommodation as shown in column(1) as per the level in the pay matrix specified in the corresponding

column(3), in the table below:-

The calculation of date of priority and preparation of waiting lists for different types of

accommodations shall be as under:

(a) The date of priority in respect of type I to type IV accommodation shall be determined on the basis

of the date of joining of the employee in the Central Government service and the eligibility for the

type of accommodation shall be decided as per their level of the applicant in the pay matrix:

Provided that an applicant under this category shall be allowed to bid for one type lower

accommodation than the type eligible for such.

(b) An applicant referred to in clause (a) above who has served continuously at a particular station for

a period of five years shall, on each such completion of five years as on 1^st January of the year, be

given one year edge over and above his date of joining in the Central Government service, for the

purpose of calculation of his date of priority in the waiting list.

(d) The inter-se seniority for the type IV(S) and above accommodation shall be considered on the basis

of the following factors, namely:-

(i)

where the priority date of two or more applicants is the same, the applicant having a

higher level pay in the level shall be senior in the waiting list;

(ii)

where the date of priority and the pay in the level of two or more applicants are the

same, the applicant who has joined the Central Government service earlier shall be

senior in the waiting list; and

(iii)

where the date of priority, pay in the level and the date of joining the Central

Government service of two or more applicants are the same, the applicant retiring

earlier may be accorded priority over the applicant retiring later.

(e) The inter se seniority of applicants in the rank of Secretary and Additional Secretary to the

Government of India shall be determined as per the civil list published for each service on the basis of

their date of joining the Government of India at Delhi subject to the condition that no junior batch

applicant of the same service or no junior applicant of the same batch and of same service shall get

priority over his senior batch applicant or senior applicant in the same batch:

Provided that where the date of joining is the same, the applicant retiring earlier may be

accorded priority over the officer retiring later:

Provided further that in respect of all other services other than the All India Services (AIS),

the inter se seniority of applicants shall be determined on the basis of their date of joining the

Government of India, irrespective of their place of posting and service or batch.

(f) The applicants entitled for type V and above accommodation shall also be eligible to apply for

accommodation below their entitlement subject to the condition that such accommodation shall not

be below type IV Special accommodation:

Provided that the applicants eligible for type VA(D II) and Type IV (S) shall also be eligible

to apply for type IV accommodation:

Provided further that where type V and type VI accommodation has not been classified as type

VA and type VB or type VIA and type VIB, as the case may be, all eligible applicants for type

V and type VI shall be grouped together in their respective types.

Personal Pay shall not be considered for the purposes of determining the inter-se seniority in the

waiting list.

(5)

Non Practising Allowance, Military Service Pay or any other such component of pay shall not be

considered for the purposes of determining the inter se seniority in the waiting list.
