आदेश

(नव᭥बर, 2016 के 17वे ᳰदन पाᳯरत)

1. यह मामला कांडला पᱫन ᭠यास मᱶ कंटेनर भाड़ा कᱶᮤ को संचालन कर रहे के᭠ᮤीय भंडारण िनगम (सीड᭣᭨यूसी) के वतᭅमान ᮧशु᭨क कᳱ वैधता के िव᭭तार से संबिधत है।

2. सी ड᭣᭨यू सी के बतᭅमान दरमानᲂ का िपछला अनुमोदन 6 जनवरी, 2012 के आदेश सं᭎या टीएएमपी/35/2010 सीड᭣᭨यूसी के ᳇ारा ᳰकया गया था जो 1 माचᭅ, 2012 के

भारत के राजपᮢ मᱶ अिधसूिचत ᱟआ था। आदेश मᱶ दरमानᲂ कᳱ वैधता 31 माचᭅ, 2014 तक थी। त᭜प᳟ात सीड᭣᭨यूसी ᳇ारा ᳰकए गए अनुरोध के आधार पर इस ᮧािधकरण ने

सीड᭣᭨यूसी के दरमानᲂ कᳱ वैधता मᱶ कई अवसरᲂ पर िव᭭तार ᳰकया गया और िपछली बार 21 जून, 2016 के आदेश के ᳇ारा वैधता का िव᭭तार 30 िसतंबर 2016 तक ᳰकया

गया था।

3. 21 जून, 2016 के आदेश ᳇ारा वतᭅमान दरमानᲂ कᳱ वैधता का िव᭭तार करते समय, इस ᮧािधकरण ने सीड᭣᭨यूसी को 31 जुलाई, 2016 तक अपने दरमानᲂ के सशᲂधन

का ᮧ᭭ताव दायर करने कᳱ मंजूरी दी थी l

4. इस संब᳍ मᱶ सीड᭣᭨यूसी ने अपने 27 जुलाई, 2016 के पᮢ के ᳇ारा सूिचत ᳰकया है कᳱ सीड᭣᭨यूसी ᮧािधकरण को ᮧ᭭तुत ᳰकए जाने वाले ᮧशु᭨क ᮧ᭭ताव का अनुमोदन

ᮧा᳙ करने कᳱ ᮧᳰᮓया मᱶ है और इसिलए अनुरोध ᳰकया ᳰक ᮧशु᭨क ᮧ᭭ताव दायर करने कᳱ तारीख को 31 जुलाई, 2016 से 31 अग᭭त, 2016 कर ᳰदया जाए। तदनुसार

ᮧािधकरण ने अपने 5 अग᭭त, 2016 के पᮢ के ᳇ारा सीड᭣᭨यूसी को अपने दरमानᲂ के संशोधन का ᮧ᭭ताव दायर करने के िलए 31 अग᭭त, 2016 तक िव᭭तार करने कᳱ

मंजूरी संसूिचत कᳱ।

5. अब सीड᭣᭨यूसी ने अपने 7 नव᭥बर, 2016 के पᮢ ᳇ारा ᳰफर से अनुरोध ᳰकया ᳰक उसके वतᭅमान दरमानᲂ कᳱ वैधता 31 ᳰदसंबर, 2016 तक अथवा ᮧािधकरण के

अनुमोदन तक, जो भी पहले हो, िव᭭तार ᳰकया जाए। सीड᭣᭨यूसी ने अपने 10 नव᭥बर, 2016 के ई-मेल ᳇ारा अपने दरमानᲂ मᱶ संशोधन का ᮧ᭭ताव भी दायर ᳰकया है। इस

पर परामशᭅदायी ᮧᳰᮓया आरंभ करने के िलए अलग से संसािधत ᳰकया जा रहा है l

6. उᲦ को देखते ᱟए, और चूंᳰक केपीटी के वतᭅमान दरमानᲂ कᳱ िव᭭ताᳯरत वैधता 30 िसतंबर, 2016 को समा᳙ हो चुकᳱ है और सीड᭣᭨यूसी ᳇ारा ᳰकए गए अनुरोध के

आधार पर यह ᮧािधकरण सीड᭣᭨यूसी के वतᭅमान दरमानᲂ कᳱ समाि᳙ कᳱ वैधता का िव᭭तार 31 ᳰदसंबर, 2016 तक अथवा संशोिधत दरमानᲂ के कायाᭅ᭠वयन कᳱ ᮧभावी

तारीख तक, जो भी पहले हो, करता है।

7. यᳰद 1 अᮧैल, 2014 कᳱ अविध के प᳟ात् अनुमत लागत और अनु᭄ेय ᮧितफल के अितᳯरᲦ कोई अितᳯरᲦ अितरेक पाया जाता है तो उसके िन᭬पादन कᳱ समीᭃा के

दौरान, ऐसे अितᳯरᲦ अितरेक को िनधाᭅᳯरत ᳰकये जाने वाले ᮧशु᭨क के ᮧित पूणᭅत: समायोिजत ᳰकया जाएगा।

NOTIFICATION

Mumbai, the 25th November, 2016

No. TAMP/35/2010-CWC.—In exercise of the powers conferred by Section 48 of the Major Port Trusts Act,

1963 (38 of 1963), the Tariff Authority for Major Ports hereby extends the validity of the existing tariff for the Central

Warehousing Corporation operating the Container Freight Station at the Kandla Port Trust as in the Order appended

hereto.

(Passed on this 17^th day of November, 2016)

This case relates to the extension of the validity of the existing Scale of Rates of the Central Warehousing

Corporation (CWC) operating the Container Freight Station at the Kandla Port Trust (KPT).

The existing Scale of Rates (SOR) of CWC was last approved by this Authority vide Order No.TAMP/35/2010-

CWC dated 06 January, 2012 which was notified in the Gazette of India on 01 March, 2012. The Order prescribed the

validity of the SOR till 31 March, 2014. Subsequently this Authority based on the request made by the CWC had

extended the validity of SOR of CWC on couple of occasions and the last extension being till 30 September, 2016 vide

Order dated 21 June, 2016.

While extending the validity of its existing SOR vide Order dated 21 June, 2016, this Authority had granted

time till 31 July, 2016 to the CWC to file its proposal for revision of its SOR.

In this regard, the CWC vide its letter dated 27 July, 2016 informed that the CWC is in the process of obtaining

approval of tariff proposal which will be submitted to TAMP and hence requested to further extend the date of

submission of tariff proposal from 31 July, 2016 to 31 August, 2016. Accordingly, the Authority has, vide its letter dated

5 August, 2016, intimated about grant of extension of time till 31 August, 2016 to file its proposal for revision of its

SOR.

The CWC has now vide its letter dated 7 November, 2016 again requested to extend the validity of the existing

SOR till 31 December, 2016 or till approval of TAMP whichever is earlier. The CWC vide its email dated 10 November,

2016 has also filed its proposal for revision of its SOR. This is being processed separately for initiating consultation

process.

In view of the above and since the extended validity of the exiting SOR of KPT has expired on 30 September,

2016 and based on the request made by the CWC, this Authority, extends the validity of the existing SOR of the CWC

from the date of its expiry till 31 December, 2016 or the effective date of implementation of the revised SOR, whichever

is earlier.

If any additional surplus over and above the admissible cost and permissible return emerges for the period post

1 April, 2014, during the review of its performance, such additional surplus will be set off fully in the tariff to be

determined.
