का.आ. 3585(अ).—यत: त᭜ कालीन पोत पᳯरवहन, सड़क पᳯरवहन एवं राजमागᭅ मंᮢालय (सड़क पᳯरवहन एवं

राजमागᭅ िवभाग), मᱶ भारत सरकार कᳱ अिधसूचना सं᭎ या का.आ.1748(अ) ᳰदनांक 12 मई 2016, ᳇ारा भारत के राजपᮢ मᱶ

ᮧकािशत, असाधारण, भाग-II, ख᭛ ड-3, उपखंड-(ii) एवं रा᭬ ᮝीय राजमागᭅ अिधिनयम, 1956 (1956 का 48) (इसमᱶ इसके

बाद उ᭍ त अिधिनयम के ᱨप मᱶ देखᱶ) कᳱ धारा 3ए कᳱ उपधारा (1) के तहत जारी, के᭠ ᮤ सरकार ने असम रा᭔ य के िडᮩूगढ़

िजले मᱶ भूिम के ᳰकमी. 538.000 से ᳰकमी. 604.000 तक (डेमो से िडᮩूगढ़ से᭍ शन तक) रा᭬ ᮝीय राजमागᭅ सं᭎ या 37 के

िह᭭ से मᱶ िनमाᭅण (चौड़ा करने /चार लेन का बनाने आᳰद) अनुरᭃण, ᮧबंधन एवं ᮧचालन के िलए उ᭍ त अिधसूचना कᳱ अनुब᳍

अनुसूची मᱶ िविन᳸द᭬ ट भूिम के अजᭅन के आशय कᳱ घोषणा कᳱ है।

एवं यत:, उ᭍ त अिधिनयम कᳱ धारा 3ए कᳱ उपधारा (3) के तहत उ᭍ त अिधसूचना का सार ᳰदनांक 01 जून 2016

के ‘’द असम ᳯᮝ᭣ यून’’ एवं ᳰदनांक 01 जून, 2016 के ‘द दैिनक ज᭠ म भूिम’ मᱶ ᮧकािशत ᳰकया गया है।

एवं यत:, आपिᱫयां ᮧा᭡ त ᱟई हᱹ एवं उन पर िवचार कर िलया गया है तथा सᭃम ᮧािधकारी ᳇ारा नामंजूर कर दी

गई हᱹ।

एवं यत:, उ᭍ त अिधिनयम कᳱ धारा 3 डी कᳱ उपधारा (1) के अनुसरण मᱶ, सᭃम ᮧािधकारी ने के᭠ ᮤ सरकार को

अपनी ᳯरपोटᭅ ᮧ᭭ तुत कर दी है।

अब, अत:, सᭃम ᮧािधकारी कᳱ उ᭍ त ᳯरपोटᭅ कᳱ ᮧाि᳙ के बाद एवं उ᭍ त अिधिनयम कᳱ धारा 3 डी कᳱ उपधारा (1)

के ᳇ारा ᮧद᭜ त शिᲦयᲂ का ᮧयोग करते ᱟए, के᭠ ᮤ सरकार एतद᳇ारा यह घोषणा करती है ᳰक उ᭍ त अनूसूची मᱶ िविन᳸द᭬ ट भूिम

पूवᲃ᭍ त उ᳎े᭫ य हेतु अᳶजत कᳱ जानी चािहए।

और इसके आगे, उ᭍ त अिधिनयम कᳱ धारा 3 (डी) कᳱ उपधारा (2) के अनुसरण मᱶ, के᭠ ᮤ सरकार एतद᳇ारा यह घोषणा

करती है ᳰक सरकारी राजपᮢ मᱶ इस अिधसूचना के ᮧकाशन पर उ᭍ त अनुसूची मᱶ िविन᳸द᭬ ट भूिम सभी ᮧकार कᳱ बाधाᲐ से मुᲦ

होकर पूरी तरह से के᭠ ᮤ सरकार मᱶ िनिहत हो जाएगी ।

NOTIFICATION

New Delhi, the 30th November, 2016

S.O. 3585(E).—Whereas by the notification of the Government of India in the Ministry of Road Transport and

Highways, number S.O. 1748 dated New Delhi, the 12^th May, 2016, published in Gazette of India, Extraordinary, Part

II, Section 3, Sub-section (ii) issued under sub-section (1) of section 3A of the National Highways Act, 1956 (48 of

1956) (hereinafter referred to as the said Act), the Central Government declared its intention to acquire the land specified

in the Schedule annexed to the said notification for building (widening / four-laning, etc.), maintenance, management and

operation of National Highway No. 37 on the stretch of land from Km 538.000 to Km 604.000 (Demow Dibrugarh

Section) in Dibrugarh District in the State of Assam.

And whereas the substance of the said notification has been published in “The Assam Tribunal” dated the

1^st June , 2016 and “The Dainik Janambhumi” dated 1^st June 2016; under sub-section (3) of section 3A of the said Act;

And whereas no objection has been received from any person by the competent authority;

And whereas objections have been received and the same have been considered and disallowed by the

competent authority;

And whereas, in pursuance of sub-section (1) of section 3D of the said Act, the competent authority has

submitted its report to the Central Government;

Now, therefore, upon receipt of the said report of the competent authority and in exercise of the powers

conferred by sub-section (1) of section 3D of the said Act, the Central Government hereby declares that the land

specified in the said Schedule should be acquired for the aforesaid purpose;

And further, in pursuance of sub-section (2) of section 3D of the said Act, the Central Government hereby

declares that on publication of this notification in the Official Gazette, the land specified in the said Schedule shall vest

absolutely in the Central Government, free from all encumbrances.

Brief description of the land to be acquired with or without structure falling within the stretch of land from

Km. 538.00 to Km. 604.00 in Demow-Dibrugarh Section of the National Highway No. 37 in the State of Assam.
